Am waiting for cabinet authority before I can release Draft Constitution to the public-Kabimba

Minister of Justice Wynter Kabimba has said that his ministry will only release the draft Constitution to the public after seeking Cabinet authority.

Speaking at the Southern African Centre for Constructive Resolution of Dispute (SACCORD) constitution summit in Lusaka today, Mr Kabimba said that he will have to wait on Cabinet to authorise him on when to release the document.

He says more debate will be allowed on the draft constitution upon its release to the public.

Mr. Kabimba also said that there is need to continuously build consensus on the Constitution making process.

Mr Kabimba further said that Government will not back-peddle its stance on the constitution making process. He insisted that government will release the draft constitution at an appropriate time.

Mr Kabimba said that if the desire of the nation was to have a constitution that will stand a test of time devoid of any political ambitions, there was need to give the process more time.

He assured Zambians that government shall remain open to dialogue on the constitution in order to contribute to consensus building so that people can give themselves a legitimate constitution which has eluded them since independence.

The Minister of Justice said government will stick to the yardsticks required on the ongoing process of dialogue and consensus building until reaching the stage of enacting the constitution by parliament.

Mr. Kabimba said the ownership of the constitution making process should present itself as people owned and people driven adding that it must be an inclusive and non-partisan in its complex and not a political tool by one group of people.

He clarified that the genesis of the current ongoing constitutional making process was the Patriotic Front (PF) initiative and will never be abandoned.

The law maker said the president has expressed government’s commitment to the constitutional making process adding that the draft constitution has been handed over to the Ministry of Justice.

Meanwhile, Mr. Kabimba has commended SACCORD for facilitating the constitution Indaba saying the culture of promoting the hegemony of views or ideals by one group against another cannot yield positive results.

However, some groups of stakeholders have expressed anxiety that subsequent comments by the government seem to suggest the negation and lack of consistent policy pronouncements.

And Mr. Kabimba, who also PF Secretary General, urged stakeholders against taking preconceived and rigid positions on the matter because it is a national issue and not for a selected section of society.

Meanwhile, SACCORD board chairperson Nkolola Wakumelo says dialogue over the constitution must be promoted at all cost.

Dr Wakumelo says the forum was one of the platforms organised to kick off dialogue of the Constitution-making process.

Several interest groups and individuals are attending the forum which is being held at Lusaka”s Protea Hotel.

  1. Continue buying your time. 2016 is coming at supersonic speed! For me, be assured that you will never see my vote, no matter what! You have dissapointed me with the way you are running the country! Tell me what promise you have fulfilled so far, tell me!

    • If no deadlines given then that’s just rhetoric Mr Kabimba. You will continue playing around with statements and pronouncements until the 2016 General Elections thinking an election under the current constitution will favour you because you can’t amass a 50% + 1 Vote. What a shame to you politicians. If something can’t fill your pocket, it is not good for the nation. What a shame to your own souls!

    • I think Mr Kabimba has shown a lot of maturity.

      These instructions and information he has given us are priceless and fruitful.
      Looks like the constitution is coming anytime soon fellow women.

      There is time to be sulky and spout nonsense but this is not the time.
      Let us wait and hope that mr Kabimba does as he explains and quite frankly he
      has a lot of reputation which we are all aware of.

      This is a time to rejoice and again, probably just explains why this party LISTENS to people.

      They have listened the constitution is almost as good as released.

      Let us move forward and more importantly commend them.

      and when did the 90days constitution become red lips kabimba`s issue???

    • Finally the document has been found with Kabimba. What a game you are playing Kabimba with the Zambian people. Need not worry not time will catch-up with your lies

    • The President has alrealdy stated the position of Givernment – Zambia does not need a new constitution. Cabinet cannot overturn the President’s decision. Is Hon. Kabimba developing cold feet over the position of the PF Government – not to enact a new constitution as it is not necessary.

    • Which is which Mr. Kabimba? Last time you said that it is only the appointing authority ( Michael Sata ) who can authorize the release of the final draft constitution but right now you want cabinet to make a decision.Well since cabinet meets at least once a week or a month,we should be able to hear your report soon.By the way since the draft report was reported missing,can you shed some light as to where this report was recovered?

    • The last time I checked Kabimba was never voted for by anyone in 2011. He thus doesn’t have any Legitimacy.

  3. I HAVE BEEN WONDERING WHERE THE CONITITUTION WAS NOT UNTIL TODAY WHEN WINTER CONFESSED IT WAS IN HIS CUSTODY. THEN I WAS MADE TO BELIEVE THAT IT WAS MISSING BECAUSE NO ONO WAS BRAVE TO CONFIRM WHERE IT WAS , MINISTRY OF JUSTICE PS SAID HE DID NOT KNOW SO WAS THE TECHNICAL COMMITTEE. ALL I CAN SAY IS LOST BUT FOUND.

  4. I am trying to understand if there is an issue of bipolar disorder with our PF government Ministers. In one breath they claim the draft has not been handed over and at the same time they await cabinet permission. Is there a schizophrenic press reporting fasehoods, or are you really being led by normal people?? This is really confusing and disappointing at the same time. Oh! I think I have contracted schizophrenic bipolar syndrome as well!

  5. The crook have the constitution yet all long has been denying .Confirmation enough to say something is being hidden and that makes all process questionable .

  6. Whenever our brother WYNTER opens his mouth it’s all rhetoric, falsehood, lies, empty promises and just academic juggon. So for some people this is good governance, not at all. Time, resources, energy mention it have already been lost. Yet he comes together with other people opposed to reality; and says dialogue should continue. Please, all we want is release the draft constitution and outline the road map clearly instead of sounding eloquent for utterly nothing. I personally, not interested on ho well you articulate the issue the business of consensus. It is no longer important. Consensus was already built when people made submissions, then there was the wasteful ncc, followed by another wasteful technical committee. God save us from this behaviour by our leaders. Where are you Lord?

      God is very much aware of what is happening. Both the PF government and the Zambian citizenry will see the power of God for our questionable behaviour. Read Exodus – the story of the struggle Moses had with Pharoh and the sturbonnes of Pharaoh and the unbelief of the Jews. If God was to base his decisions on the basis of the behaviour of Pharaoh and the Jews themselves, the perfection of His righteousness/perfection would have been distorted. Even for Zambia God has to stand above our selfishness, inconsistencies and greed to protect His Name, His Holiness. Only his timing is the right timing. Praise God.

  7. Why does the Constitution need to be authorised by the Cabinet before it is released to the public??? The Cabinet is appointed by the President and therefore is loyal to him. The Constitution draft is supposed to pass through PARLIAMENT and NOT the CABINET!!! This document is NOT the PF’s document, it is our people’s document, that is by law, it has to pass through PARLIAMENT!!!! Why is dishon. Wynter Kabimba trying to confuse the people of Zambia?? More delaying tactics, we see!!! You have already lost my vote, come 2016! VIVA OUR MOTHERLAND, ZAMBIA, ALUTA CONTINUA ! NOT YET UHURU !!

    • You are 100% correct. The TORS did not indicate that Cabinet makes the final decisions. The TORs did not say the draft constitution should be tailored to the PF Manifesto. What kind of dullness is this. If Winter and the entire PF cant understand the simple TORS of the Technical Committee, CAN THEY UNDERSTAND COMPLEX POLICY ANALYSIS AND BUDGETING ETC???

  12. He can say whatever he wants but we already know that their desire is not to give us the masses a people driven constitution against a few beneficiaries from PF misrule. But us the masses we say come 2016 elections, NO CONSTITUTION, NO PF! Period. The ball is in their court and we will see who will win.

  13. Panga Family finally found the draft constitution document, which they denied having received until today??? What type of government is this??? It like they are governing through “trial and error” !! They have no clue whether they are coming or going…What a waste of the people’s vote!!! From what I have seen, the calibre of cabinet is below par and the fact that they are hand-picked by “You know who” tells you a lot about where their loyalty will lie when it come to this “people-driven constitution”. They would rather support an “Animal-driven constitution”!!
    Now listen here Ka Kabimba, STOP THE DELAYING TACTICS and get on with the promises you and your “Panga Family” made in your manifesto, and deliver the PEOPLE”S CONSTITUTION, ASAP!!!

  14. I find it very difficult to understand mr. Kabima’s statements quoted below. Did the terms of reference include approval by cabinet office before release of draft constitution?   17. Does Kabimba’s statement surprise anyone? Kabimba studied animal farm to the core. Remember Squealer, the propagandist? He had answers to every question. That’s Kabimba for you. Who is in charge of cabinet? And who can call for the meeting of Cabinet? In short Kabimba is saying, the buck stops at Sata’s table. Why then did Sata sent Kabimba to this meeting? To tell people that cabinet has yet to decide on the constitution? Puliz, give me a break! Any wonder that this SACCORD meeting has been declared useless by other opposition parties of repute? Viva Grand coalition!

  18. This is mere empty talk, unfortunately. The reality is that PF is trying to find a way to wig itself out of this constitution saga. How to do it, is the dilemma for which they need an Archimedes; who will one day jump out of his bath tab and run naked along Independence Avenue, shouting “Eureka, Eureka…” all the way to State House. Such a find, however, may elude PF.

  21. We need to find a screw driver to tighten the screws in Kabimba’s head. This man’s foolishness beats that of Broken-Hill Man! Does he even think before making a public statement? Even his grandfather must be ashamed to have fathered the father to this man.
    Kabimba, please sober up. You might need to consult Masebo to know how cold it is out there!
