YALI surprised by Lungu’s stance on enactment of constitution

The Young African Leaders Initiative (YALI) says it has been taken by surprise by Acting President Edgar Lungu’s statement that Parliament will decide whether to hold the Referendum on the enactment of a new Constitution or not.

Acting President Edgar Lungu is quoted in some sections of the media saying Parliament will determine the roadmap of the constitution-making process because it is the only arm of Government that is mandated to make and change laws.

But YALI Governance Advisor Isaac Mwanza told QFM News in an interview that what is most surprising is that Mr. Lungu is very much aware of the provisions of the Referendum Act that places the responsibility to call for a referendum on the President and the Executive.Mr. Mwanza said Mr. Lungu has received enough proposals on the way forward in the Constitution reform process from YALI and the Grand Coalition and that it is the responsibility of government to help guide the process.

He noted that if Mr. Lungu is serious about letting Parliament to have a say whether the Constitution will be adopted via the Referendum or not, the Justice Minister should introduce a Constitution Bill in Parliament.

Mr Mwanza has since called on Members of Parliament, especially from the opposition to avoid the temptation of introducing the motion on the roadmap in Parliament as past precedent has shown that very few of such motions would be passed considering that Parliament is dominated by the PF.

  1. Like a game of draughts Lungu is playing and winning but he knows that when the king comes from the temporary recess his game is all but over.

    I dont like him mostly because I would prefer a Bemba to be the helm, that doesn’t mean i am tribalist.

    It is just that I feel that seat is better off being occupied by a Bemba.

      Remove the criminal Nostradamus (Chanda Chashi a.k.a. Reuben Mwansa). He is wanted in Chicago for threatening a Zambian with death. He does not deserve to be even at the very bottom. He is foul mouthed and a danger to fellow Zambians. He should be caged in jail for a long time. By the way his comments are helping investigators to track his whereabouts.

  3. This YALItumpa guy has not even quoted the Constitutional provisions that he is referring to. The referendum must be passed as an act for that particular exercise because under the current constitution this is an amendment that can be dealt with by parliament. However, if the Bill of Rights is going to be changed, there is no question about its being brought to the people as a referendum. I hope the parliamentarians will do the right thing and at least consider tabling the matter of the referendum in the meantime.

  9. Most people commenting on the draft constitution do not even understand the contents in that document. That constitution we are vehemently pushing for has aspects that are very “half- baked” to say the least. It is better Parliament votes for individual aspects of the document one at a time.

  11. I like consistency of these guys in engaging and pushing government. I think that is how NGOS are supposed to work as opposed to the past where it’s all been confrontation and this surprise is not just for YALI but we have all been surprised and more surprises are coming. Keep it up guys and let the haters keep saying what they do, u have a voice no doubt and no one helped to build your voice among strong CSOs. So don’t worry appoint some disgruntled fellows here who will see nothing good in u. They didn’t help u and u don’t need them.

    • Read the current constitution then you will understand why Parliament has a say in the process. Ask the YALI to quote the chapter they are using.

  15. It seems in Zambia we just want to talk for the sake of it. A constitution is not an ordinary document. Without going into many details, I wish to educate these juveniles that the current constitution has clauses which demand that to make certain changes we have to “unlock” certain parts for this to be done. It is incumbent on our MPs to be loyal to mother Zambia to do the right thing when the time comes.
    What surprises me is that the MMD, UPD, Civil Society, Trade Unions spent 5 years on the National Constitution Assembly but failed to come up with a constitution. They spent the entire period discussing Michael Sata’s age and whether he had a university degree or not in order to stop him from contesting the Presidential elections.   17. Michael Sata’s age and whether he had a university degree or not in order to stop him from contesting the Presidential elections. All this changed when RB who happened to be order than Sata succeeded Dr. iMwanawasa and that Sata actually had a degree(s). Much as we all want a new constitution, morality must prevail. You can’t force someone to do what you failed to do. We should be honest with ourselves if we are to be true leaders.
    Due to exam leakages we have ended up with chaps who just bark for no reason.
