The ruling Patriotic Front (PF) has moved swiftly to assure its members that Minister of Justice and Defence Minister Edgar Lungu remains the PF president and Presidential Candidate for the Patriotic Front.

In a statement released to the media, PF Secretary General Davies Chama advised the party members to continue campaigning for Edgar Lungu and to continue canvassing for support from zambians to ensure that the PF candidate emerges successful on 20th January 2014.

Today, the Supreme Court has sent back to the Lusaka High Court the case in which Matero Member of Parliament Miles Sampa challenged the consent Judgement that declared Defence Minister Edgar Lungu as PF President.

15TH DECEMBER 2014

SUBJECT; HON. EDGAR LUNGU REMAINS PF PRESIDENT

Following the Judgment from the Supreme Court made today regarding an appeal made by Mr. Miles Bwalya Sampa, we wish to state the following;

  1. That the Consent Judgment from the Lusaka High that declared Hon. Edgar Chagwa Lungu as PF President and PF Presidential Candidate remains valid.
  2. That Hon. Edgar Chagwa Lungu remains the PF President and Presidential Candidate for the Patriotic Front.
  3. That the Supreme Court has sent back the matter to the High Court to determine whether Mr. Sampa and others can be allowed to join the case.

We therefore wish to advise our members to continue campaigning for the PF President, Hon. Edgar Lungu and to continue canvassing for support from our citizens to ensure that our candidate emerges successful on 20th January 2014.

    • Neither Miles Sampa nor Edgar Lungu should be allowed to file in their nomination papers on the PF ticket until this case has been disposed of from the courts of law. Let justice prevail regardless of the time remaining before nomination, and irrespective of whether or not the PF or Sampa or Lungu will be affected.

    • Why should we even think of allowing these two to stand for presidency? This involvement of the High court is a clear sign that the PF cannot keep their house in order. And we have them as the ruling party! We desperately need sanity restored to our country.

    • People amaze me. Particularly in relation to how they are easily fed with half baked truths but then seem to get hooked and then vilify people on that basis.
      Look at RB and the corruption claims, failure to give constitution and all that. Yet no “real” evidence before the courts for this corruption. Evidence on constitution is that PF and UPND refused to vote for one at Second reading.
      Today we have Sampa being praised like an angel and “ready made leader”. How did that happen?
      He is a known womaniser, with potential killing on his hands. Apart from the matero taxi firm and BIGOGA beatings he has nothing to show for his political career and yet People are villifying Lungu for his drinking. How? Simply becoz the Post Newspaper and ZWD are saying so

Lungu is extremely popular and is without doubt he is the people’s choice to lead Zambia on. Rather than be led on by the likes of Guy Scott and the Cartel Mr Sampa open your eyes sir and see that the people’s President is Edgar C. Lungu.

    • @ BIG L, HH supporters are not pro-Sampa in its simplest sense. Rather, the wrangle will help UPND in that the PF votes will be split should Miles decide to form his own party. Another scenario that would work in favour of UPND is IF Sampa decides to defect to UPND. The latter is highly unlikely though. But as things stand at the moment and say EL won the upcoming general elections (hypothetically speaking of course and only in dreamland), Sampa would get the axe!

    • Which law are you using? If an MP is petitioned, he continues working as MP until judgement is passed. This is the same case here. The retrial may still go Inonge’s way as we do not see how the second convention that failed to meet the minimum number of delegates, the electoral college and was done whilst on injunction can be recognised. Do not forget, there is a contempt case involving the second team in court.

  16. Davies Chama, just stay cool. Zambian laws are different from the laws that govern PF. PF laws only apply when necessary. U are now trying to even misinterpret our national laws to suit PF interpretation. IT CAN’T NEVER! Miles Sampa is hot on your heels.

I hate to burst your bubble truth hates that’s not the case, Miles has high profile lawyers who are ready to challenge any decisions against their client, EL should just continue begging Sampa to withdraw the case, EL needs to sit down with Sampa and settle this out of the courtroom, otherwise Sampa can get an injuntion at the last minute barring EL.

They did not touch on the aspect of EL having been elected presidential candidate from the PF. So if the supreme court says they will not touch on the aspect of EL having been elected as PF party president because they believe he was elected as such what does that mean to you?   19. Davies Chama is hoodwinking no one because deep down he knows that this ruling has serious ramifications for Edgar Lungu and his candidature. Chama knows that Miles Sampa can now present his grievance before the courts and it is probable he could end up having another ruling in his favour due to the haphazard manner in which Lungu was selected to stand as the PF’s presidential candidate. What then for Lungu?Remember that even those now in the forefront of campaigning for him publicly voiced their misgivings and called Lungu’s selection illegal.Kambwili said it, Lubinda said it and Simuusa said it.I say to you, brace yourselves because the bell has yet to toll.And for whom it toll, only time will tell.

    • Lets not forget that the convention was called for by the GS, MS, GBM and the cartel. Despite strong opposition from the EL and the majority of PF central committee members that the convention would divide the party they still went ahead. Guy Scott even set the dates for the convention. In order for the convention to take place there was a requirement of a minimum of 3000 delegates. EL was voted for by show of hands (as he was the sole candidate) but we were not told how many delegates attended. MS received 900 votes and GBM 200 votes. When added all the votes received by all the amounted to less than 1500. Did the second convention have the required 3000 delegates to form a quorum? MS was elected party president by an illegal convention which did not even have a quorum.

Sent back to high court where court contempt is waiting for Miles Sampa.High court will deal with contempt of court case first then hear sampa.Sampa has no time and is not going anywhere.Lungu is a lawyer guys. Supreme court has just denied justice miles sampa. Hence the same high court which dismissed his case will do the same.In short they want sampa to be disciplined in high court for court contept

      The Judiciary must pay these Contemptuous Politicians the Highest Judiciary Complement by ensuring they reap only punishment from their bad seed. I don’t see how Sampa et al can suddenly be seen as Competent when they were not previously.

  42. Miles Sampa is disputing the fact that he consented to the Consent Judgement. The Consent Judgement therefore has been technically set aside.
    The High Court will therefore have to decide which of the two parallel PF conferences held in Kabwe elected a legitimate president for PF.
    The first conference elected Mr Lungu PF president unopposed as Mr Sampa and others decided to stay away.
    The High Court issued an injunction against holding a second conference. Notwithstanding this, Sampa et al ignored it and proceeded with the second conference. The second conference was therefore illegal. A barred convention cannot produce a legitimate leader or result. Another illegality is that the second conference did not form a quorum. Miles Sampa’s claim to the PF Presidency cannot therefore…

    • I find it inconceivable that Sampa and others would deliberately disregard a court order knowing fully well the repercussions.According to the participants of the second conference the court order was not duly served on the organisers prior to their conference going ahead thereby rendering it ineffectual. It can be argued that this coupled with the haphazard manner by which Edgar Lungu secured his nomination at the first conference legitimises Miles Sampa’s resulting nomination.In equity you have to come with clean hands and Lungu did not.He and his cohorts used intimidation to create an atmosphere where fair play was impossible.The judges will surely not overlook this fact as that would be setting a dangerous precedent.So brace yourselves, this could turn really messy.

  46. This confusion has been caused by Dr. Scot for allowing the second election to take place at the convention at Mulungushi last month. All this confusion is a result of that. Earlier Cabinet had anonymously indorsed Edgar Lungu as president of PF, but the acting president never listened to the thinking and wish of the majority in their cabinet! What a regret for the whole thing! I had confidence in the PF, but now…………..!

  47. What the supreme court has simply said is that the high court ruling is VERY VALID otherwise it would have ruled in favor of Sampa.
