Traders and Fishermen refuse to pay govt increased fees in Mpulungu

There was a near riot at Ngwenya market in Mpulungu yesterday after marketeers and traders defied fisheries officers from the fisheries department who attempted to begin implementing the new fisheries act, which has seen revised fisheries license fees and charges. The government have increased the licence fees for all commercial fishermen to K5 000 000 per fishing boat per year from the K300 000 they paid last year.

Meanwhile fishermen and traders in Mpulungu have maintained that they will not be part and parcel of the new fish charges and fees which they are being asked to pay by the fisheries department because they are too high and abnormal.

Fisheries officers who raided Ngwenya market in an effort to start implementing the revised fisheries act were met with force until they called for police officers who also failed to change the fishermen’s stance.

Fisheries officers were forced to retreat to their offices after they failed to negotiate with the uncompromising fishermen.

The fishermen and traders later ganged up and descended on the office of district commissioner Willie Simfukwe and demanded to seek audience with him to sort out the issue.

Addressing the irate fishermen, district commissioner Willie Simfukwe said the fisheries act is a statutory instrument which has been passed into law by parliament and can only be revised if it is sent back to the national assembly.

Simfukwe said the act was earlier suspended by former agriculture and cooperatives minister Sara sayifwanda after complaints from fishermen in Mpulungu who stated that the new fees in the act were unmanageable.

He said even president Rupiah Banda confirmed the suspension at a public rally in Mpulungu during the election campaigns to pave way for consultations before its implementation.

Simfukwe however said the fisheries department has ignored theses pronouncements and have gone ahead to implement the act in Mpulungu. He appealed to government through the permanent secretary in the ministry of agriculture and cooperatives to urgently address the issue saying it is painting a bad picture on government.

Simfukwe said the implementing of the act is a sensitive issue which can easily ignite chaos from the people in the area because most of them depend on fishing for their livelihood.

He however appealed to fishermen to be calm as the issue is being sorted out and warned the fishermen and traders against taking the law into their own hands.

But the irate traders and fishermen said they will not compromise with the fisheries department and pay the new fees because the fees are too high.

In an interview later, Ngwenya market committee chairman Webby Sichilima said it will be difficult to guarantee the safety of fisheries officers who will be sent to implement the act at the market because traders and fishermen at Ngwenya market are agitated.

Sichilima warned that the mood at Ngwenya market is currently tense and appealed to the relevant authorities to urgently find a lasting solution to the matter.

And some fisheries officers involved in revenue collection have voiced their concerns on the matter saying their work has become extremely difficult to carry out.

The officers who sort anonymity for fear of reprimand said they are no longer free to collect revenue from fish and kapenta on behalf of the government of the republic of Zambia because of the oppositions and threats they are encountering from the traders.

They complained that some traders are asking them to build their own markets and collect revenue from there because Ngwenya market belongs to the walamo committee under the senior chief Tafuna of the Lungu people of Mpulungu.

Last month, during a meeting held at the fisheries training centre in Mpulungu, fishermen and traders booed and jeered at fisheries officers who had traveled from Kasama to address them.

The meeting which was attended by over 60 fishermen, local councilors, marketers and traders and government officials from the fisheries department had to be cut short without reaching an agreement after some fishermen walked out and demanded to have an audience with the new agriculture and cooperatives minister and the director of fisheries claiming the officers from Kasama were too junior to address their plight.

Outlining the new fees then, principal fisheries technician john Mtonga told the fishermen that government had approved a new statutory instrument where fishing license fees and other charges have been revised.

Mtonga told the gathering that starting 16th may, 2008, all commercial fishermen in Mpulungu will be required to pay K5 000 000 per fishing boat per year from the K300 000 they paid last year.

In nsumbu, commercial fishermen will be charged K2, 499 000m per boat per year, an increment from the K300 000 per boat last year.

According to the revised fees, license fee for ring net boats have been apt from K100 000 to K1, 980 000 per boat per year.

Mtonga who told the fishermen that he was only carrying out his duty said people in the ornamental fishing business will be required to part away with K5 000 000m to obtain a license an increment from the K300 000 they spent to get one last year.

He said each ornamental fish caught from Lake Tanganyika for export to other countries will now cost K900 from K20.

For small fishing boats owned by peasant fishermen, the K11 000 they used to pay per boat every year has now been hiked to K99 800.

Mtonga said people using angling (Indobo), will now be charged K19 800 per month from K2000 last year.

He pointed out that the above fees among other charges took effect on 16th May, 2008, saying his job in Mpulungu was only to collect views and complaints which he was going to forward to the ministry in Lusaka for possible action.

But the angry fishermen, some talking on top of their voices, complained that the revised fees were too high and unjustified.

Who can honestly start paying such an amount?? One would wonder how they were coming up with such figures. Can someone explain to me why working Zambians who pay taxes do not get personal tax refunds annually taking into consideration the expenses they incur such as tuition,giving to charity,mortgages,Day care/nanny expenses,Child credits,medical expenses for those who do not have health insurance etc. We get our tax refunds here annually and it’s the same taxes we pay infact in Zambia it’s even higher. Can somebody help me understand why the Zambian workers do not get this priveledge. God bless Zambia.

  27. That is the reason why local authorities, departmental staff, ministry personnel need to have better education that Grade 4.
    How can you make such an increase? that is like spoiling your economy deliberately. What percentage is the increase from 300,000 to 5,000,000? That comes to about 1,670% and surely is that rational? Not at all – 1,670 percent? unacceptable.
    This is the calibre of authorities that Chiluba and his team left in 2001. Sad!

  28. # 37, i guess you do not understand the concept of tax refunds and i don’t blame you, i didn’t too until i came to the USA i was really suprised that the employed can get this benefit. For example if you get a salary of $60,000 annualy and you paid between $15,000 to $18,000 in taxes in 2008. You have to file your tax returns in January latest by April 15th, meaning you file a tax return form which indicates how much you paid in federal and State taxes. How much you contributed to Medicaid and Social Security . Then you can itemise your expenses based upon what the law qualifies. Let’s say you paid $10,000 in tuition, $7,000 in day care,$15,000 in mortgage etc Your total qualified expenses

  31. contd are $37,000 for 2008, so you subtract 37,000 from 60,000 which leaves you with an income of $23,000. According to the USA govt you were only supposed to be taxed on the $23,000 and not on the whole $60,000. So once you file your tax returns the US govt pays you back the difference of between $10,000 to $12,000 or more depending on the qualified expenses and your income in about 2 weeks to a month. It’s a benefit and i was just wondering why our Government doesn’t do that because the Zambian workers spend a lot on qualified expenses so they need part of their taxes refunded. Anybody with an answer out there?

  35. I do not mean to be disrespectful to Rupiah Banda but I am convinced that he was never ready to be President of this country. I believe Rupiah was not psychologically prepared because, as I recall, the man had resigned to his farm before Levy Mwanawasa appointed him vice-president.
    Rupiah has no direction and this is why he has not told the nation how he intends to tackle the pressing issues which we are facing in this country like high mealie-meal prices and the effects of the global financial crisis.

    Besides, we have had crippling load shedding and unfortunately, our government has never informed the nation on how it is going to address this problem.

    These licenses were increased long before elections.
    So much as RB has got power to intervene, he is not the cause.
    There are many structures that Chiluba passed on to Mwanawasa, who also could not change all of them and have been left to RB to deal with and dealing with he must.
    But squaring the blame on the current regime is quite a misguided view.

There are two types of tax refunds in the USA Personal and Business Tax Refunds.The Internal Revenue Society (IRS) equivalent to ZRA has determined tax laws by which all citizens and legal permanent and temporary residents have to abide by and also are rewarded for complying to those tax laws. We all know that tax revenue is the base for a country’s development as it is used for infrastructure,security,education,health systems,social services etc. The IRS has a mandate to collect those taxes and encourage the people to pay those taxes by reawrding them with different

    The fees, however low they govt might think they have been, need to be increased on basis of reasonable graduation not this type of pick-pick-na-pick-tolo way of doing things.

You will then subtract the expenses from the annual income for that year. The difference is what you can legally be taxed on, so the IRS has a mandate to refund the excess you paid them, At times your qualifed expenses are more than the taxes you paid ,they will actually refund you more than what you actually paid in taxes.     Did you mention RB by accident or you used some logical connection?
    Anyway you may not understand what the topic is all about.
    These fees were raised way before RB came in, and blaming it on RB is like you and I having nurssary school going children and we forget to comb their hair. When we realise that they had gone to school without combing their hair we say to ourselves, “But RB and his govt, look at our children’s hair! He has failed, he is doing nothing; how can our children’s hair be so shaggy?”.

    I wonder if Zambia really practices a sensible tax system that benefits locals. Many accountants in Zambia did ACCA or CIMA where they learn British taxation. Do local institutions teach Zambian taxation. Apart from PAYE, I wonder what else Zambians participate in.

  69. 101 it is possible to get tax refunds even in zambia if you have been giving to charites eg churches -but they must issue you with a reciept everytime you give -which you can later submit at the end of the year to the tax office.Why dont people do it? Simple -they dont know

  70. Judge Japhet Banda dies in traffic accident

    Ndola based High Court Judge Japhet Banda is dead. Judge Banda died in a road accident on his way to Ndola from Lusaka Friday mid morning.

    Judge Banda was rushed to Kabwe general hospital after the accident that occurred near Kapiri Mponshi after his vehicle collided with a truck. He died in the hospital.

    Judge Banda was handling the case involving former president Fredrick Chiluba and three others accused of looting the national treasury.

    Judge Banda earlier this year refused to set aside the London High Court judgment which former president Frederick Chiluba and others challenged as illegal.

  71. 102…Yes most accountants did Business Tax(uk) which is different from Local tax.Moreover someone with CIMA hasnt got sufficient tax knowledge compared to ACCA or ACA being a CIMA accountant myself.
    The only way our tax system will improve is if a new professional body specialising in zambian tax like we have here in the uk CAT(Chartered Institue Of Taxation)or ATT(Assiocation of Taxation Technicians)
    This will enable zambian accountants who study CIMA or ACCA to top up their qualification with a local taxation course..Just a thought though 😕

  78. The economy world wide is very bad and things are deteriorating. We have self inflected hunger or let me say hunger induced by the poor planning govt. Is this the right time to increase the charges like that. What it means is that the cost of fish will be very high as if they are being imported. Watch out for this MMD, I have no kind words for them because they have been chaeting since 1991. This is a very long time and they have not improved anything. We are going backwards all the time. They are liars and who ever supports them must start thinking twice. If the cost of catching fish is that much, how much will it cost to buy it in our markets, in shoprite, ordering it in a hotel etc?

  84. An increase from 300,000 per boat to 5,000,000 per boat is unacceptable. For large commercial fishing fleets, this may make sense.

    The biggest problem here is that no one has defined what amounts to a “boat” !! Is is a canoe, two canoes, a speed boat, a fishing trawler, …this needs to be thought through properly.

  89. This is very sad. In this modern day and age, our govt hasn’t moved any closer to civilization. These increments they impose on poor Zambians are meant for a cause. Good or bad. But its sad to see that they haven’t modernized their approach. Why do they have to do it “with immediate effect” always. Why can’t they plan ahead and announce it to everybody months ahead of time. Better still start making small increments every so many months for people to adjust to the new prices. Its very sad ku Zed. You can take a villager out of a village but you can’t take the village out of him. All those degrees and diplomas.

  90. These increments are on average more than 500%. Where in the world do governments do this? Are they trying to make fishing a preserve of foreigners as well? May be they have made a pact with foreigners who can come in after the locals have been driven out of fishing. Given that we do not have an effective opposition, I salute the people of Mpulungu for standing up for themselves. Laws do not exist in a vacuum. They have to be enforceable. This one is not.
