Sata Defends Expulsion, but MP Describes it as a Joke

Patriotic Front (PF) leader, Michael Sata says there is nothing contemptous about the expulsion of five PF Members of Parliament from his party.

Mr. Sata said the PF Central Committee has fully respected the injuction filed by the 26 MPs attending the National Constitutional Conference (NCC).

He told ZNBC news, that the expulsions have nothing to do with their attenance in the NCC and reasons advanced in their High Court injunction.

Mr. Sata said the expelled MPs failed to abide by the rules of the party by withdrawing their membership subscription fees.

Five Members of Parliament were expelled from the PF (PF.

The PF Central Committee which met at Lusaka’s Blue Nile lodge expelled, Matero MP, Faustina Sinyangwe for gross misconduct while four others were expelled on account of their withdrawal of monthly subscription to the party.

They include Kasama Central MP, Saviour Chishimba, Marjorie Masiye for Mufulira, Wusakile MP, Barnabas Chellah and his Kankoyo counterpart, Percy Chanda.

But expelled Opposition Patriotic Front (PF) Kasama Central Member of Parliament (MP) Saviour Chishimba has described his expulsion from PF as a joke.

Dr. Chishimba has since instructed his lawyer Mwangala Zalomous of the DOVE Chambers together with Lisimba and Company to immediately commence contempt of court proceedings against the Party for allegedly going against a Lusaka High court order restraining the PF from punishing them from attending the National Constitutional Conference (NCC).

Speaking at a press briefing in Lusaka today, Dr. Chishimba said the party has not officially written to him over the move to expel him saying he just heard and read the news in the press.

And commenting on the alleged withdrawal of party contributions from the party, Dr. Chishimba challenged the PF leader Michael Sata to explain the term blood money.

The opposition PF’s full Central Committee members expelled Dr. Chishimba and four others from the opposition party last saturday.

Those expelled include: Matero MP Faustina Sinyangwe, Kankoyo MP Percy Chanda, Mufulira MP Majorie Masiye and Barnabas Chella of Wasakile and reprimanded Chawama MP Violet Samp-Bredt for refusal to obey official instructions from PF senior leaders.

PF leader Michala Sata said the discipline measures taken against the MPs had nothing to do with their participation in the NCC and urged the affected MPs not to hide in the NCC.

He charged that the court injunction did not give the MPs immunity from disciplinary measures set out by the party.

And Dr Chishimba who held a one-man press briefing stressed that he stands ready to fund the party convention should a date be announced.

And commenting on the invitation by MMD to adopt him and those expelled from the party, Dr. Chishimba could not comment but said he is ready to serve any political party.

Meanwhile, Chief Government Spokesperson, Mike Mulongoti says the expulsion of Five Patriot Front (PF) Members of Parliament is a sad development in Zambia’s democratic dispensation.

Mr. Mulongoti who is also Information Minister said PF’s Central Committe’s decision as an act of desprate political intolerance.

He told ZNBC news that Zambians need to be weary of intolerant political organisations ahead of the 2011 tripartite elections.

Mr. Mulongoti who is also the ruling Movement for Multi-Party Democracy (MMD) Elections Chairperson said the expulsion of the Five is a sign of instability in Zambia’s main opposition party.

He said the PF needed to demonstrate maximum political tolerance typical of alternative governments in waiting.

They have become so pompous for nothing. Every organisation has got rules and members need to abide by them. Whoever disagrees is free to leave. Look at advanced parties in Europe e.g. UK, an MP who opposed the Iraq war resigned since they differed in Policy. Same to you PF Members if you disagree leave peacefully. Those prayers were fake.     a)a leader
    b)a consitition
    and a consititution makes laws and regulations.i think mr sata has made a right decision to expel the 5mps because there are not indispensable.they should be order in any party and not to allow any person to do anything anyhow.chishimba, sinyangwe and others must respect the party leadership (pf),and the rules set.why did they join pf if there think sata is bad?

  15. 1). You can’t file an injunction and win after a decision has already been made such as an expulsion.
    2). In the event that the Court rules wrongly and finds Sata to been in contmpt of the courts earlier ruling, the court will put Sata on his defence but the expelled MP’s will never be re-instated to being PF members.

    thus at this stage, their going to court will just make the learned councils richer as they also earn their living by being in court.

  16. I do not support Sata because this is a serious violation of freedom of speech which our four fathers fought for. I think leaders should be free to choose weather they want to participate in the constitution change or not. If a leader thinks its in the best interest of the country i think they should take part instead of listening to an old lost politician who didn’t want to take part because he holds a grudge against the MMD. However, in Sata’s defense, i surely understand why he made that decision and had i been in the same position i probably would have done the same thing. Every organization has got rules and every organization has a leader to make and carry out those rules…

If people where allowed to do what they wanted without obeying the rules that give them the freedom to do so, this society would even be worst than it is today.   18. The worrying thing is that with POLITICS OF POVERTY IN ZAMBIA, the only way to deal with dissenting views is to dismiss (thus threatening the livelihoods of dissenting MPs). Surely, that doesn’t encourage or nurture democracy. Good leadership carries with it the majority by persuasion, not coercion. In a true democracy, we should have room for dissenting views, radicals who don’t tow the party line and these should be in the minority. But when more than half of the MPs go against the party line, democracy demands that you listen, not expel!!!!

  20. Yes discipline is important in any organisation. But for the MPs participating in the NCC, the only disciplinary action they will be sure to receive is expulsion which I believe is the strongest. You will never hear of suspensions.

    Party cadres are even allowed to beat the MPs who are in the NCC. Does that sound like an orderly party? Where is discipline in such situations?

  22. #20 (Analyst) An MP is a law maker. Therefore participating in the constitution making process is his/her responsibility. By being there, they are doing what they were elected for. That’s why they succeeded in filing the injuction. It is also the reason why Sata has to use different charges in order to expel them without being in contempt.

    Why should an MP (a law maker) boycott the constitution making process then come and use the resultant constitution to make laws? At the same time, Sata thinks the new costitution will bar him from contesting in 2011. How does he expect to be defended if he excludes his MPs from the participating?

In KK’s time there was discipline but people got tired of having no alternative leader. A conventon (which I was basically talking about) is not a sign of indiscipline. When you have a president with too much power, you expect problems. It won’t be long before even the decisons of the Central Commitee are made by one man. Can you imagine members of the Central Commitee holding a view different from his?

  28. #25 (Twalibuka), The NCC is not just a mere conference, It is law passed by parliament. Sata should have made fought the hardest when it was still a bill. But the MPs voted for it. So the NCC is law passed by parliament itself. MPs whose duty it is to make laws should not exempt themselves in the constitution making process which includes the NCC. So an MP is there just for the money or not, he/she still has to be there. Can Imagine someone some his MPs to attend a parliament session? MPs are just as duty bound to attend the NCC.

    Sata is pulling his people out. Well let him do as he wishes but he should not, later on, complain about certain clauses when the constitution is finally made.

    On discipline, as #25 said, their is no substitute for dicipline, let Sata discipline his people. But he must ensure he does not do so selectively. He must also find a way of dealing with his cadres who beat his MPs when they appear to hold a different view from his. Unless he sends them himself. And if he does send them, then he is truely a thug. His cadres are breaking the law on his behalf and he seems pleased. If a party president is democratic, he should be concerned about such a trend in his party and must be seen to be doing something about it.

It is therefore not surprising (at least to me) that more than half of his MPs acted like lumpens, hooligans, when he tried to deny them their cut from the NCC. True, you reap what you sow! The hope is that the meek ones may just go back with their tails between the legs; and if the courts rule favorably, then it is payback time.     An MP’s job is to pass laws. PF should have objected to the passing of the NCC Act. They didn’t. Thus the MPs are just doing what the law requires them to even though money was an inducement for most of them: that is, pass laws. PF should have objected to the passing of the NCC Act in the first place. The PF leaders (read Sata) only opposed the NCC when they saw that they (PF leaders) would not not the preferential prominent roles they hoped for.

  51. Kaunda boycotted 1996 elections and killed UNIP, PF’s boycot of NCC may render the party irrelevant as the new constitution will definately be passed. If the economy continues to improve, which I think it will, and a very good constitution is passed, the people of Zambia will start to think less of PF. That is a sound advice Chaps! We need strong opposition for democracy to work, and PF has done a good job so far. Furhter reduction in numbers way decrease PF’s influence if they loose the By-elections.   52. Pipo the 5 MPs have been expelled for other reasons and not NCC. I think that its correct to discipline a member for wrong doing. MMD does it routinely. Recently what happened Findley for saying MMD is not for LPM’s relatives? Of course he got a ‘sack’ out of his membership. So whats so special abt these 5. Calling your president a ‘thug’ is not part of the injuction. Discipline must be upheld. There are others who are in the NCC but have not been expelled as they have behaved themselves in addition to their injuction. Sorry for the 5!

    Calling a party president a thug, is not a reason to dismiss an MP, especially for a president who surrounds himself with thugs, hooligans. Sata knows that if he was sincere, he could have sued for defamation of character in the case of Sinyangwe. What he did was just be vindictive towards his niece. Anyway, good riddance/lesson for some of these opportunist MPs who ignored Sata’s dictatorial tendencies when it suited them. The chickens have come home to roost.

  61. These MPs should not cling to PF coz they made there own decision not to move alongside PF’s collective decision and its right that they’ve been expelled. They should concentrate on how they will win the by elections and mind you its everyone for him or herself.   65. The Sata-nic movement is in trouble. Only a danderhead can fail to see this. Like UNIP, PF has already pushed the self-destruct button. Let me give credit to the Sata-nic inner circle for their clever punch at the 5 MPs. The idea is certainly to intimidate the remaining MPs, and also to see how the PF performs in the bye-elections in the 5 constituencies. The expulsions were were selected – the constituencies involved are the types PF would win back; therefore, they will survive this period, but for the 5 it is all over, whichever way you look at it. They have just drunk from the poisoned chalice filled with the Cobra’s venom, and they are dead and buried. But the Sata-nic days are numbered.

  66. If McCain and Clinton lose to Obama, there will be some lessons for Zambian politics. Sata, like the two, always prides himself in ‘experience’. But it seems the American people might not buy that kind of argument. So why should Zambians? The only real experience Sata has is that of exhibiting his cobra self – spitting out verbal venom at his opponents, with no regard for ettiquette (he probably doesn’t even know this word exists), and hammering his Sata-nic followers with a heavy hand, as we have seen with the 5 MPs.   70. Glad Mwila points out PF depends on Sata and his ‘Sata-nic Verses’. But man, that dependency is a double-edged sword: it might be the party’s strength but it is also its biggest weakness. Sata is PF’s Achille’s heel. The whole party is polarised on a Sata-and-Others basis. Either Sata or no Sata. And the man is arrogance itself on two legs. PF IS TOO SATA-CENTRIC, AND IT IS THIS SATA-CENTRICISM THAT WILL BRING IT DOWN. IT IS LIKE A BRIDGE STANDING ON ONE PILLAR. Bring down the pillar and you bring down the bridge.   71. How many times have we heard Sata say, ‘When I come to power’ rather than ‘When PF comes to power’? Just a reminder: ‘These defiant MPs are taking on an experienced general. I will defeat them.’ And of course that self-prophecy has happened: the ‘experienced general’ has struck, and with a venom too (of course, using PF structures). The point is the MPs are REALLY fighting Sata-nic anger and vindictiveness; not the PF. Sata simply steamrollers over the Scotts and Mumbis of this world.   72. Politics 101. The MPs were stupid not to have seen the writing on the wall. Sata warned them but they’re testing him. Even were freedom of speech is paramount, there are limitations. You cannot shout fire in a movie theater when there’s no fire, you go to jail. The political indiscipline that is perpetuated by these novice MPs will cost them their bread and butter. Ask Joe Lieberman in the US, what happened to him? Today he sits as an independent. Same with these guys, if they feel they are wanted by people, let them recontest. Indisciline breeds Anarchy.
