Registration of London High Court judgement stalls

chiluba_courtTHE registration of the London High Court judgement against former President Chiluba and 21 others in the Lusaka High Court has stalled.

Attorney-General Mumba Malila said this in an interview in Lusaka yesterday.

“Unfortunately, that has stalled after the death of Judge Japhet Banda who was presiding over the matter,” Mr Malila said.

He said this was not under Government’s control and that there was nothing much that could be done.
Mr Malila said Government was still waiting for the Judge-in-charge to allocate the matter.

Two years ago, London High Court Judge, Peter Smith reduced damages against Dr Chiluba to US$57.4 million from the US$58.3 million he was earlier ordered to pay the Zambian government in connection with the Zamtrop and BK conspiracies and for the breach of fiduciary duty.

This is according to Judge Smith’s final judgement against each of the 21 defendants in the London civil case brought by the Attorney-General of Zambia.

“Upon handing down of judgement in this matter following the hearing on June 7, 8 and 11, 2007, it is ordered that there be final judgement against each of the defendants in the following sums being inclusive of interest and credits required to be given to the claimant (Government) in respect of recoveries made,” Judge Smith’s order read in part.

The Judge also ruled that a Mr Meer, a partner in a London law firm, Meer Care and Desai, the first defendant, pay US$11.135,665.61
Former Zambia Security Intelligence Services director-general Xavier Chungu was ordered to pay US$57,261,390.72 for conspiracy and another 56,442,027.90 for breach of fiduciary duty, among others.

  1. Was it anormal death? Hmmm I smell rat. Rememebr the late Paul Tembo’s case, the witnesess died in a car crash.From Ndola to Lusaka, now this on the same road as Judge Banda. Hmmm gentlemen and countrymen Politics is a dangerous game but we should forge ahead and convict FTJ.

  2. I have observed that the comments on LT from people have reduced, why? The layout looks too advanced. Why did you change?

    • I have observed that also. Its realy difficulty to follow what people are writing. Its like they are trying by all means to trace the people who are commenting. LT just go back to the previous layouts.

    • According to the last update from LT, this is not yet the final layout. The site is somehow on “probation” if you like, and LT is observing how bloggers move with the changes. Be patient, I’m sure they will simplifying it further.

    • on the contrary, this works for me. it kud be complicated for the simple minded. no offence because they didnt will themselves to be that way

  3. In the meantime the goverment must confisticate all the suites from this man and auction them. Oh no i think the sizes are wrong. Give them to street kids……….., allocate the matter to another judge. Government must also use the services of retired judges

    • You right Chiluba is a free man. You are fighting corruption sellectively. The same corruption Chiluba commited is the same Nyama Soya , Dora etc are committing and you have failed to take action. So leave Chiluba alone to enjoy His wife Regina as you enjoy your wives.

  4. This RB administration is trying to get Chiluba off the hook. There is suspicious lack of vigour in prosecuting the cases.Recall Maila saying the government was satisfied with the pace?

  5. There is no need to start saying the judgement has stalled. Just say some other judge is yet to be allocated the case to make the judgement

  7. The judiciary in Zambia is less effective and is manupilated by politicians. I like the way courts operate in Zim. Pa Zed, judges are corrupt.
    Chiluba is a thief, why not send him to jail up to now?

  8. What I’m trying to say is why should money be wasted on this case when other leaders are committing the same crimes ie. late Mwanawasa and now RB. Trying to pursue individual former Presidents will not work, what needs to be done is to change the powers of the Presidency. Chiluba had no limit to what he had access to, same with KK and other Presidents so to me it is pointless to try and pursue individuals rather, the laws and excessive powers of the Presidency need to be reduced, so let this old man go and let us use the saved money on important developmental needs. The only people benefiting from this are lawyers for not doing anything.

  13. The father of all thieves will never go to prison, first it was his heart and now it is the death of a judge..he is not just a thief, NINDOSHI aswell. A combination of Ubuloshi, bukabwalala and bukatoba bwama yanda, all in a little body. Small body but big aaah.

    • The only person ( Levy ) this little thief feared most is dead so he is rejoicing because he knows that the current president is following Chilubas foot prints, so that makes it hard for any government institution to fight corruption.

  14. chiluba is too clever for today’s govt, they cant manage him. when he 1st appeared in court he mentioned ‘bad’ words on LPM and nobody of our elders reminded him that in zambia we dont speak ill of the dead, not even the court cautioned him, what they are doing just shows lack of seriousness and how for granted they take us.

  16. I agree with people not satisfied with the new LT lay out. Please LT listen to bloggers. There’s something that has been lost, something taken out of this blog as a result of this new upgrade. Not everything new is better. I personally prefer the last layout as it was easier and faster to follow thru comments. It was also similar to the blog lay outs on BBC. This new LT is quite clumsy and it is easy for people to get lost. If possible please give us back the old one and may be just improve it, especially the issue of having to refresh the whole page just to read new comments. I have certainlly commented less as a result of this upgrade.

  17. This case has taken very long and it wont go any where. The Govt is just losing tax payers’ monies to lawyers who are now being investigated for other corrupt practices. Funny, isn’t it?

  18. Sad story for FTJ. The zedians are partly to blame they forced the man into state house. He was not ready. Zedian lets learn to say no if we dont have the capacity, now its stumbeko fimofimo, he is no sure what to say about the kwacha, anyway bola ni 90 nimutes.

  19. In Zambia, it is not adviseble drive if you are involved in the fight against corruption. Remember Prof Alfred Chanda former TIZ president, he was onto something big, something to do with the late LPM and co and suddenly he was involved in a fatal accident in Mazabuka. Judge Banda samething. Another former minister, his car hit into a tree, I remember reading in the post that his breaks could have been tempered with, can’t remember his name, he was also onto something big. LPM’s death…The underworld in Zambia is dangerous, be careful!!! but on the other hand all this could have been natural dealths and not manufactured but will we ever know the truth? Kaya. Zona bola ni 90 minutes

    • Hey dont compare American democracy to Zambian ….? I dont know what call it. In American presidents are servants of the people, people can force a president to step down without any stone throwing or police being involved, while in Zambia RB is the boss of the country, he can do or decide what should be done and every jackass( TETAMASHIMBA ) will follow it. Very soon you will be eating GMO maize with the blessing of your boss ( Nyama Soya ) Please dont compare a dictatorship type of democracy to an American true Democracy, least of all comparing Obama to RB, its like comparing night and day.

  22. Deputy ministers sacked
    President Rupiah Banda has with immediate effect fired Science and Technology Deputy Minister, Jonas Shakafuswa and Energy Deputy Minister, Lameck Chibombamilimo.

    Mr. Banda announced the dismissal of the two when he addressed thousands of MMD cadres who matched to State House on Thursday to show solidarity with his leadership.

    The President also said he would also dismiss MMD MPs who are not loyal to the party and face them in their constituencies during by-elections.

    • All directors and shareholders of Zambian airways will be declared bankrapt, meaning that they will not be allowed to run any business in Zambia. in other words once Membe is declared bankrapt he will not be allowed by Law to run the Post. The Newspaper will therefore be in Limbo!! the court will infact appoint an interim mngt team that will iherit all assets and liabilities including collateral that was used to get those loans, if thats not enough then the Court will lift the vail on the directors and shareholders meaning Membe and freinds will be answerable as individuals. my intelligence tells me Membe might survive but Nchito is definately going to jail.

MINISTER of Finance and National Planning Situmbeko Musokotwane has attributed the cumulative depreciation of the Kwacha by 73 per cent since June last year to short-term and fundamental factors like political uncertainty and re-emergence of pricing of local goods and services in dollars. Who is responsible for checking and stopping political uncertainity? Pricing of local goods and services in dollars who is encouraging this?

  31. It annoys me when I see that this theif is still free and arogant. Many of my colleagues died in their homes due to his irresponsible leadership. The short man is a very bad element in our society. Look at how his irresponsibility has adversely affected his children, his relatives and now he is pleasing Regina, a neighbour’s wife, would you want to respect such a person? In South Africa, they would have stoned the short man to death a long time ago.

Jacob Zuma is facing over 100 counts of corruption and yet the ANC and the general black population have endorsed him as their next president. man even his personal financial advised was convicted of fraud and corruption two years ago. man the man is about to take his wife number 6, we all wonder who is going to be the first lady…..
