I will make the final decision after studying the report, RB

rbandaPresident Rupiah Banda says he will make his final decision on the report of the Dora Siliya Tribunal after studying it.

President Banda said Zambians are free to comment on the report because Zambia was a democratic country.

“Everyone is free to say what he or she wants to say over the report since Zambia is a democratic state. I will however make a final decision,” he stated.

The President was responding to a question from journalists concerning calls from some section of society for him to take action on the report.

Some civil society organisations yesterday demanded for the dismissal of Transport Minister Dora Siliya.

The 10 organisations urged President Banda to immediately relieve Ms. Siliya of her duties for allegedly breaching various laws and more seriously the constitution.

  1. Just defend the Zambian Constitution President RB Banda like you did swear at your inaugration ceremony which was done in a rush.

    Otherwise, the elections of 2011 will determine the fate of the MMD in future Zambian politics.

  6. In view of everything surrounding the DORA SAGA, the only logical reason why President might keep Minister DORA is that he actions had full blessings of him. While such may make sense, it is good to tell a friend to say mwana tinaitaya so just relax in your dropped state but I will give you some chances to remain useful and make money – the way it appears late former President LP Mwanawasa seemed to have dealt with the VJ’s statement issues about GRZ owing Mr Moses Katumbi instead of vice versa.
    While the media people like M’membe would make a name if Minister Dora is fired, it is still the only thing that is in the interest of voters who know what is expected of their President.
    The easiest way to solve this impasse is to ask Minister DORA SILIYA TO RESIGN as it will be noble.

She took decisions with full knowledge of what was happening and apologizing will not solve this problem. Firing her is a solution because there are other MPs, equal to the task, who can perform her functions. Only difference is that they are likely to be more careful in taking liberties with their position.

And at this juncture, I would like to ask those who are close to the Undereducate to ask him to disband his PF and join the might UPND in 2011 while the UPND must be convinced to allow him, bashikulu Sata MC, to stand as UPND political party Chairman unchallenged in its 2011 General Assembly also called CONVENTION.

    I believe we need a united opposition to STOP the MMD from ruling Zambian any further than the year 2011 atleast for next decade after 2011.

If the tribunal was set up to conduct specific functions for a specified amount of time, surely we can expect that decisions pertaining to recommendations made should also be time bound.

    If you read the story in the paper, the tribunal handed over the case to RB and made him responsible for making the final decision. I would like to see the part in the tribunal’s proceedings where recommendations where made.

  22. #29, My mistake, no recommendations are made by the tribunal. The point is, RB has the facts before him and an entire staff at State House to summarize those facts for him if the report is too long for him to read. He needs to be clear and give a time line as to when he will make his decision.

  25. Your excellence, if you are finding it hard to study the report, I can surely be of assistance at no cost to yourself in particular and to the nation at large (national service). Your excellence, I believe that you are well versed on legal matters (not to mention your immediate subordinate) and therefore, I want to believe that justice delayed is justice denied to Hon Siliya if she is right, and to the country if she has transgressed the annals of Zambia.
    I understand that it is really a test of time for you sir, but i want to also think that Zambia has many jobless (my self for example) and capable individuals who can take up Hon Siliya’s job while you study the report and toil to figure out what course of action to take. Hopefully the tribunal report is not boring and sleeping you.

  26. Of course the final decision should come from President RB. But he should never forget where the power of the privileged decision making position has come from.
    He should not keep the people waiting for too long. It is an insult to the people who trusted him and gave him that power to decide on their behalf. Dora nor George on their own did not give RB that power.

  29. In the absence of a criminal case adjudication, practically these calls are wasteful petitions with a very narrow window of influencing RB’s prerogative decision of appointing or disappointing his team members.

    The ideal missed opportunity was their failure to build a criminal case if they had any evidence and win it clean. Such as material transfer evidence of any transaction should have been established and substantiated before the tribunal. But alas, emotions took precedence over reasoning resulting in this failed crusade resulting in the tribunal legal opinion.These emotions and indeed face saving gigs after some rapacious moves in the tribunal, this will be a mere talk show. Breach of the constitutional if justified to avert corruption does not mount to criminal conduct.

  30. Interesting is the fact that the common law world over has many precedence especially in the USA. I’m keen to see what case same NGOs and sponsors will build up that will dictate whom RB can appoint and disappoint. Matter of Precedence, I know not of any President who gets his appointing orders from NGOs or blogs unless I’m educated on this one.

    Be advised to come up with substantive criminal charges and not under five emotions if they have to build hope and legal credibility. Breach of the constitution without criminal charge does not suffice judicial reasoning. Any petition is likely to be thrown out with costs, the money which could better be used somewhere else.

  49. What I don’t understand is why Dora can’t resign on her own on moral grounds… really why is it that resigning isn’t such a common thing in our politics. Resigning seems to be the only intelligent decision by her, even to save face!

  50. Read through ‘Constitution’ on Wikipedia; especially look at paragraghs: General features; Entrenchment; Distribution of sovereignty; Separation of powers; Constitutional courts. I would like to draw your attention to the statement in the ‘General Features’ paragraph that says: “…When an official act is unconstitutional, i.e. it is not a power granted to the government by the Constitution, that act is null and void, and the nullification is ab initio, that is, from inception, not from the date of the finding…” Qn: Does this mean that RP Capital’s work is null and void and they won’t be paid money? Remember they have already started doing work? We really should be digesting this tribunal ruling even more: what it means; the precedence it is setting, etc!

    (i) benefits of nominal value including customary hospitality and token gifts
    (ii) gifts from family members
    (iii) transfers pursuant to a contract for which full value is given
    Up to this point, there is not so much of a problem

Eyebrows begin to rise when the tribunal in giving its ratio decidendi (the reason for the decision) appears to be offering solutions as to how the case should or should have proceeded to get certain desired results or giving suggestions that seem to point to an alternative remedy that appears not legal but political.

    The tribunal stated the following: “Breach of the constitution is a serious matter. If a sitting President breaches the constitution he is liable to impeachment under Article 37 of the Constitution. In this case by ignoring the advice of the attorney general, honourable Siliya breached article 54(3).

    The advice of the attorney general is also clearly spelt in Chapter 8 Paragraph 8.13 of the Cabinet handbook. We are not idle to think that Ms Siliya is not acquainted…

  64. It is this portion of the findings that begs a number of questions?
    Is it in the court’s place to point disappointed litigants in the way that they should proceed or should have proceeded?

    Judicial proceedings are very straightforward and clear. That is if one is not satisfied, he can have recourse to a higher court until the matter is declared res judicata. (Literary meaning let the matter rest).

    Furthermore, it brings to question the motive of the tribunal to drop a line about the possible impeachment of a President who breaches the Constitution.

    And is this why the President’s detractors have followed the cue and are now pushing the argument that Ms Siliya should be dismissed, and failing which Mr Banda should be impeached for breaching the Constitution?

  65. Is it a coincidence, that there is mounting pressure to shift the issue from Ms Siliya to Mr Banda?
    Is that what the tribunal really intended? Obviously not.

    Modern day jurisprudence has been at loggerheads over the function of the judiciary whether it is to merely interpret the law and run the risk of law development remaining stagnant or be innovative by discovering and creating new law.

    This is the case in America where judges there seem to be over stretching their function, in total defiance to the Madbury ruling that it is a prerogative of the court to interpret law.

  66. Zambia has had its share of this argument as can be seen from the case of Akashambatwa and others v Attorney General where the Supreme Court inserted the word “vice versa” to give clarity to a provision in the Parliamentary Powers and Privileges Act on floor crossing.
    In the case of the tribunal ruling, there is the growing complication of the political campaign growing out of it.

Well, Shaka and his friend did nothing wrong but Nyama Soya did not even study their case, he “Sam-Mateted” accross State House bushes and impalas to declare before a frenzy and unintelligent party cadre mob and quote: “Today, I have fired Shaka and Chibombamilimo”. We can only conclude he is not firing Dora because of two things, tribalism or them being bed fellows.

Mr President do the correct and logic thing – fire Dora and Kunda. This way you will remove the cynicism you have created in some of us on your character. Please! And why can’t Kunda energetically jump to Dora’s support like he did before?   83. Hey guys I understand the tribunal made recommendations. So, why does RB have to study the whole thing? In my no-so-humble opinion, I think the recommendations were made to help him draw the conclusion fast, otherwise what are they for. I mean the experts on the law themselves have made the recommendations. RB you have no grace with the law the ones who have, have spoken.

You do not need to read through the entire report, especially after seeing how you like sleep, it will take you the rest of the year to reach the end. By then, you would have even forgotten what the report you were reading was all about…then you will say that you will need to revise but again by the time you finish, you would have forgotten…back to contents and page one again……so just make the decisions man.

    Since, Ms Dora Siliya resigned, the President has been proved wrong in his quick words that he is the only one to make a final decision. Quite alright he might have helped speak or communicate to Ms D. Siliya about resiging, but Ms Dora Siliya MADE THE FINAL DECISION which is great.
    Thank you Dora. Lovely stuff and you have made history in Zambian politics being the only second one to resign from a GRZ appointed job after late former President Levy P Mwanawasa who resigned from the Zambian Vice Presidency when characters like the Undereducate continued participate in the Chiluba GRZ that reduced the Zambian economy to almost nothing. Thus, all the very best in your future endeavours.

    Ohhh, how I hope the Minister of Justice Vice President George Kunda would be the 3rd Zambian government politician to resign from office after saying things which misled the Nation.

    I wish both Minister Veep G. Kunda and President RB Banda all the best as they learn from this experience to do things betterand/or handle National issues well without panic in future.
