Convict Katele, co-accused — Nchito

THE State has asked the court to convict all the accused persons in the corruption case involving former Finance minister Katele Kalumba because they failed to provide reasonable explanations on why they found themselves receiving payments that suggested corruption.

The State tendered its written submission in the high court yesterday.
Kalumba is jointly charged with former Finance permanent secretary Stella Chibanda, former Finance chief economist Bede Mphande, former Finance director of budget Boniface Nonde, former secretary to the treasury Benjamin Mweene, former Access Financial Services Limited (AFSL) directors Faustin Kabwe and Aaron Chungu.

All the accused are indicted on charges of corruption.
State prosecutor Mutembo Nchito, in his submissions before deputy director of court operations Edward Musona said the explanantions given by all the accused persons were fanciful and full of lies.

“The explanations given were fanciful at best but in any event, clear lies, Chibanda received and seemed not to know why and how she got it, her suggestion that it was a loan are fanciful and entirely unsupported, Mpande received US$28,000 in circumstances that he could not explain and when challenged by investigations, he was quick to pay it back.

“Prof Mweene in much the same way as Chibanda accepted the construction of a cottage at his house in circumstances that cannot be anything other than corruption. He too could not explain the benefit. Nonde behaved in a very similar fashion to Mpande by receiving money he could not explain reasonably and when challenged by investigators he was quick to pay back, when it was too late after the damage had been caused,” he said.

Judgment has been set for May 26 this year.

  2. You dont receive money for doing nothing Ms Chibanda.As a financia person,you should have been the dirs one to know but then you were serving in Kafupi’s govt where plunder was the order of the day.

  3. How does the state prosecutor honestry secure conviction of plunderers when the head of state is busy interfering with the arm of justice. Let us face the fact that Chiluba has sought temporary protection all in the name of RB. The appeal case of Regina is still pending all because the Judiciary is hiding its embarassment. Anyway, the circle has one origin and terminal.

    he is National Secretary of the rulling MMD,reports directly to the president,he has as much power in mmd as the president,he was at one time evacuated to India for medicals,meanwhile some minister could only go to nigeria for prayers,where’s Jeff Kande today??? lets face it…you convict katele,thats the end of mmd,the other accused will be convicted,kalumba will walk out a free man..

This is what i call bias journalism at its best.The article only talks about the states final submissions, what about the final submissions from the defence team?The writer of the article doesnt even bother to mention the defence lawyers name! Thats exactly what happened in the Dora Siliya trial, the media only sold us the submissions from the prosecution and i was personnaly convinced that siliya falsely claimed money from govnt and she dubiously awarded a contract to selex.only after reading the defence final submission did i realise that the ministry only showed interest in selex and the contract was never awarded contrary to the allegations.i also learnt from the defence submissions that the boreholes where commissioned at a cost of more than what was infact claimed.

  9. Now here is a typical “MMD controlled Times of Zambia” story. The article talks about what the other co-accused did or received, but is completely mute on Katele Kalumba. If you are going to report a story, why not go the whole way? So what is Kalumba actually accused of?

Let corrupt elements be placed where they need to be “THE State has asked the court to convict all the accused persons in the corruption case…” as opposed to voting them to become Zambian President as a reward of bad behaviour.

  11. Hang em high – from katele to kafupi, Mabenga and all. Wasn’t mabenga supposed to be in jail? That’s what the Supreme court said. Now, with kafupi as RB’s surrogate, let’s see what happens. What a shame to be ruoled by thugs, as if we haven’t got better persons!!! Mashili kaofelamina!

  12. Come on guys, lets face the reality. Kalumba is a clean man , he never stole anything. He was arrested because Levy Gvt hated him very much, closeness to Chiluba made him to be criminal. No evidence was adduced against him. You can evev conclude by the headline (Convict Katele, co-accused )—Nchito
    For doing what? Nchito have mentioned how co-accused received cash. But failed to mention what Katele did. Regardless of whatever polical affillition pliz pliz Katele is a Great Man, Come on guys

  13. @ #15,16 and 17, being a state prosecutor does not make him government or mmd, same as being a civial servant make anyone automatically the ruling party

  14. simple reason..Katele was never imprisoned because mwanawasa was protecting him… mwanawasa keep him(katele) out of jail to show luapula people that he was not targeting them..nchito knows
    When katele was arrest dug out that rat hole.. the news was allover the walls of zambia. but mwanawasa ‘forgave’ him (katele)

    so RB can just let mwanawasa’s will be:d/

  15. Engines, you are quiet right. I have followed this case closely and once again, I will be very surprised if the courts convict. I like Nchito, but I am sorry to say that the submission was very weak. Nchito has spent a large amount of his time as a lawyer either in defence or conveyancing. I cannot understand why the real prosecutors were not allowed to take this case? He is literally asking the defendants to prove their innocence! I thought the onus is on hime to prove guilt. These guys have been shu shu shus most of their adult lives. That is how they get money from government!

  16. It has been estimated that in the UNIP era, 1 in 10 adults were informers. Under Chiluba some continued to do the same. When people receive money for ‘consultancy services’ the money is from espionage and intelligence activities, at home or abroad.
