Newly appointed Labour, Sports, Youth and Gender Minister Fackson Shamenda

The ministry of Labour says the revision of the Minimum wage does not include unionised workers.

Labour Minister Fackson Shamenda says unionised workers can only use the minimum wage as a bench mark for their bargaining process.

Mr. Shamenda says the minimum wage caters for workers such as those who work in shops and all those who do not belong to any union.

Meanwhile Mr. Shamenda has told ZNBC News in an interview that the process of reviewing the minimum wage involves a lot of discussions and negotiations with various stakeholders.

He is however positive that his Ministry will come up with the revised minimum wage within the next two months.

President Michael Sata has directed the Minister of Labour to come up with a revised minimum wage.

The minimum wage has for a long time been at K419 000.

  1. is the PF already swallowing their puke? have they started noticing that they made too many promises. We know 90 day promise is impossible and minimum wage is difficult. Please just think and strike a balance

  2. He’s spot on,that’s how the minimum wage works,it’s just a benchmark,the wage employees get can be above the national minumum wage but not under. Most workers in management get more than the minimum wage anyway that’s why the Minister is not talking about them.

  4. It is important to look into the issue of minimum wage along with proposed PAYE and VAT rates in the 2012 budget. Assuming that the PAYE and VAT rates are revised downwards in the 2012 budget, automatically the take home pay and people’s purchasing power increase.

  5. Its a pity to see Pf distancing its self from the people who voted in its favour. I warned ba muntu about this but never listened. I want to urge ba muntu that they have been dribbled and must think twice.

MINIMUM WAGES MUST BE INCLUDED FOR DOMESTIC WORKERS ALSO AS MOST OF THEM RECEIVE LESS THAN 250,000.THESE DOMESTIC WORKERS WORK LONG HOURS 7 DAYS A WEEK AND MANY OF THEM STAY IN THE SAME YARD AS THEIR EMPLOYERS AND THEIR ACCOMODATION ARE VERY APPAULING SO CAN HON SHAMENDA LOOK INTO THIS SERIOUS PROBLEM BECAUSE NO ZAMBIAN SHOULD BE A WORKING AS A SLAVE FOR THEIR RICH MASTERS.HOUSE SERVENTS ARE TREATED LIKE ANIMALS ESPECIALLY BY THE ILLEGAL CHINESE AND THE RECENT ILEGAL INDIANS WHO HAS INVADED ZAMBIA UNDER FALSE WORK PERMITS AND CITIZENSHIPS.THE ORIGIONAL INDIANS ARE NOT A PROBLEM BECAUSE THEY NORMALLY PAY MORE THAN THE GOVT GAZETTED WAGE.

    • He is there becoz he is educated just like Kanganja is still there and Sata said Zambia is for all despite party affliation and not for PF. Come to think of it, most Zambians are aligned to a party of there choice.

  10. Yes, reality is dawning. Is it any wonder that the President chose to be mute on the issue of tax ? The PF is realising that what they were talking about are actually impossible to attain. Can’t people see the naivety in PF. There were celebrations here in Kitwe a few days after PF was put into power. Speculations were that mines in Chambishi had automatically increased workers salaries and the minimum was k2 000 000. This turned out to be false; the truth is that the overzelous Mbulu had promised workers that they would get not less than two million Kwacha…And management at the mines was unaware of this.

  11. Do you know that even I, as a etacher ,have a servant? I can only afford to pay my worker k250 000. If this minimum will be applicable even to domestic servants I will have ti fire mine. But when I talked to her she told me she was ok with the money she was getting.

  12. Dear friends its dissappointing to note that even those of us who atleast feel we are enlightened and yet going by what we write i pity this country.

    The minimum wage has always been for non Unionised workers the minister is simply trying to educate the masses seeing alot of us do not understand. so when revised it will only apply to that category and those unionised and those in management and government workers can then negotiate accordingly.
    please seek some education.

    1. Coverage of Minimum Wages and Conditions of Employment (General) Order 2010/2011 – The order governs wages and conditions of employment for the general worker (note that shopkeepers are governed under a separate Statutory Instrument, No. 1 of 2010).

    2. The Minimum Wages and Conditions of Employment Act applies to all employees (including casual workers) in Zambia, but do not apply to the following categories of employees:

    • Employees of the Government of the Republic of Zambia
    • Employees of local authority
    • Employees who undergo collective bargaining (unionized workers)
    • Employees in management positions (as defined under the Industrial Relations Act)
    • Employees in a sector for which the Minister, by statutory instrument, has prescribed the minimum wage.

I can’t help but note that we will now see a deluge of Comments from PF sympathisers who I imagine, “the penny dropped” that the light may not be so bright at the end of the tunnel. I do believe that in fact no light exists and if the PF Government can help bring back the fight against corruption as a priority and install a sense of pride among Zambians, in light of the huge foreign interests in our mother Zambian, then they would have played a huge part in our journey to developing our nation. May I add that the fight against corruption should be within the legal framework and not kaponya style.

  17. HE CLEARLY SAYS, UNIONISED WORKERS CAN USE IT AS A BENCHMARK, OR IN OTHER WORDS, A STARTING POINT OF NEGOTIATING. MEANING IT HAS TO MINUMUM WAGE PLUS A PERCENTAGE. NOT LESS THAN THE MINIMUM.

  19. @Malikopo, Instead of finger-pointing certain foreigners, I can tell you that the BIGGEST culprits are Zambians. I know of a former General in the Zambia Army (loaded) paying his maid K150,000 (through the daughters’ own admission who laughed about it). I also know a SA’n white man paying his maid K720,000 and an Indian family who are taking one of their long serving employees to India for a heart operation!

    Problem is that the perceptions from the pre-1964 era still linger on; foreigners treat and pay their workers rubbish while Zambians look after fellow Zambians well. If you think about it, and see it for yourself, the converse is true. And it’s in the interest of Zambians that this mindset doesn’t change so foreigners always remain the scapegoat…

  20. it is very sad that even with the information age where all of you cannot get basic information. Some people are even jumping saying the PF have failed. The minimum wage applies only to the protected workers and these are outlined in the Act (Please go to the Ministry of Labour website and download the Act. Mind you, if you employ more than 25 employees, they should be encouraged to join a union which is in line with your business. This union will be responsible for negotiating salaries for your employees and other conditions of service through the collective bargaining process. Jobs which have skill like Artisans,Mechanics etc are not covered under the minimum wages act and where such employees dont belong to a union, a contract should be witten taken to the labour officer for attestation

  21. The Minimum Wage is only the suffering zambian casual & many non-unionised workers. This forms a majority of the people who wanted change. The subject is a hot one & must be approached with care lest we kill the poor employers.

    In my view we should correct the economy & this problem will be solved in the process.

  25. @29, DONCHI KUBAMBA, I QUIET AGREE WITH YOU AT CERTAIN POINT AS I HAD SAID THAT THE REAL INDIANS OF ZAMBIAN ORIGION ARE PAYING THEIR WORKERS WELL BUT I WAS REFERING TO THE ILLEGAL INDIANS WHO HAS SETTLED IN ZAMBIA IN THE LAST 10 YEARS ARE THE ONES THAT PAYS THEIR WORKERS POORLY AND TREAT THEM AS SLAVES.THIS ILLEGAL CHAPS HAS INDIAN MENTALITY AND THE LABOUR MINISTRY MUST TAKE ACTION ON THESE CULPRITS.SOME OF THESE CROOKS EVEN HAVE THE GUTS TO SAY TO THEIR POOR WORKERS THAT ZAMBIA IS YOURS MARI ENA KATINA MEANING MONEY IS OURS.THIS ILELGAL GUYS MUST BE SENT BACK TO THEIR HOMELAND IN THE GANGES.

  26. Minimum wage is coming within 2 months. We need it. There are some Zambians who are servants in UK and they boast that there enjoying there. Why can’t our servants and lowly paid workers also enjoy here? Please time for change.

  27. I doubt if PF will come up with a smart minimum wage framework. A minimum wage that applies to all categories of sectors is inappropriate for the Zambian situation. For instance, how do you subject casual workers in the mining and manufacturing sectors, to the minimum wage with domestic workers. A sectoral minimum wage framework could be workable for Zambia.

  29. Ever since the new govt came into power Zambians have been choked with political rhetoric with no corresponding outcomes. What seem to be the case is backtracking statements from this govt. Has Sata apologised to the fugitive Swiss. Pragmatism is clearly proving subtle and tricky for Sata as the 90 days is drawing near to the end. We shall be told some rhetoric story again. Kaponyas are expecting more money in their pockets.

  32. IT WILL MAKE SENSE IF ALL EMPLOYEES WHO NOT BELONG TO MANAGEMENT LEVEL BE UNIONISED. WE HAVE ALOT OF UNIONS THAT COVER EVEN DOMESTIC WORKERS SO EVEN SHOP AND FARM WORKERS BE UNIONISED AS A WAY TO PROTECT THEM FOM GREEDY EMPLOYERS.THE MINISTER IS OFF THE MARK.

  33. I think when the president talked about the minimum wage he meant that all low earning workers needed an improvement. He even waved a hand asking if all in the room at the tme would be happy with 450 pin. I don’t understand what Shamenda is now waffling about. Ala!

  34. The minister has misguided himself.
    What does he mean that it does not apply to unionised workers?
    Does he mean it has no bearing?
    Does he mean they can choose to use it as benchmark or not?
    Or is he saying they must use it as benchmark?
    Because if they have to use it as benchmark, then it applies to the unionised workers just as it does to the non-represented such as shop attendants.
    If he says it does not apply to the unionised, then he is saying employers cannot be held accountable to the minimum wage close even if their unionised workers get below the minimum wage as long as the have negotiated and agreed.
    By the term ‘minimum wage’, it means that even to the non-represented workers, it is a benchmark and not a ‘stated (fixed) salary’.

  36. lets be carefull with minimum wage,it might kill our industry,i own a small bakery, my monthly profit is K20m i pay tax,napsa,zesco and workmen compersetion i remain with K12m, i pay rentals and remain with K7m i have 12 workers who have survived on this barkery for 8years imagine the the minimum wage goes to K800 000 my business will close and workers will go on the streets, just reduce taxes and we have too many statutary bodies to pay to

  39. Why should it take two months if you know what you are doing? are you trying to buy time so people can forget about this topic or reduce they expectations? I bet you are in for a hard five years, we need you to deliver and nothing less. 60 days is too much you are not negotiating with anyone, but simply putting the economists and other stakeholders to work on this case.

Now i am confused, as far as i know minimum wage means the minimum amount an organisation is allowed to pay an individual who has minimum experience and qualifications for the job, but does not mean this becomes the salary that should now be paid even if the person concerned should be paid more. The minimum wage simply says you start paying from this level upwards and nothing else. So what is the minister saying?

  41. The minister implies (whether knowingly or unknowingly) that for unionised workers, it is up to their union to negotiate. Even if they negotiated for K200,000 it will not have anything to do with the ‘minimum wage’ close.
    It is onlu the non-unionised workers who will be given benchmark called ‘minimum wage’.

  43. Does the man really understand how the minimum wage works? Simply, it is a smallest wage an employee can get as mandated by law regardless of industry sector so as to cushion the effects of inflation and other factors. The figure is adjusted accordingly when there are any significant changes in the economy.
    It seems it has now dawned on them (gov’t) that this will upwardly affect the cost of production in Zambia if wholesomely implemented.

Why should companyz like zamefa which makes huge profits from our copper to cable paying penuts operators with basic pay of k950,000 and only 24 employees are on permanent 286 on contract and have no union.mr sata our president help us at this company twacula these guyz are saying this money we get is ok since we can manage to buy our selfs a bag of mealiemeal and capenta what about rentals,school feels for our children when them get over 50million we are not seeing the benefit of our copper better ba tata ba sata u look for other investors twacula pacompany apa ukuchushiwa na kubantu banensu .this is very anoying.
