FODEP opposses dual citizenship clause in draft constitution

The Foundation for Democratic Process (FODEP) has said there is need to explicitly scrutinize the recommendation on dual citizenship in the first draft constitution of Zambia.

The 253 page document released to the general public two weeks ago,recommends under part IV that a citizen shall not lose citizenship by acquiring the citizenship of another country.

FODEP executive director Mac Donald Chipenzi said that there was need for the recommendation in the first draft on dual citizenship to be scrutinized because the recommendation was porous.

For instance, Chipenzi said a person who had dual citizenship committed a crime in Zambia could easily relocate to the other country to which he/she is also a citizen.If a person who had committed a crime in Zambia relocates to the other country he/she would then be protected by laws of his/her other country because he is a citizen of that particular country.

“The recommendation under dual citizen may have advantages but it is important that it is also looked at it from the other side. If for example somebody has dual citizenship and commits a crime in Zambia it will be very easy for that person to relocate to the other country.“And once he is in the other country the laws of that country will protect him since he is a citizen of that country making it difficult for him to be brought to book. So it is important that the recommendation is analyzed, “he said.

The first draft under part IV also states that a citizen who before the commencement of the constitution, acquired the citizenship of another country and as a result ceased to be a citizen shall be entitled to apply to the citizenship board of Zambia to regain that citizenship.

Mr Chipenzi also recommended for the inclusion of the Call Vote which he said was one of the recommendations in the Mung’omba Draft Constitution.

He said under the Call Vote the electorates have the powers to petition a member of Parliament (MP) who was under performing in parliament.

“The Mung’omba draft constitution had recommended for a call vote where the electorates can petition a member of parliament who is not representing them adequately. Because in many cases we have MP’s who do nothing in parliament till the end of their term, “he said.

Meanwhile, the Technical Committee on drafting the Zambian Constitution has appealed to Zambian’s to take keen interest and make comments on the first draft constitution.

Technical committee spokesperson Simon Kabanda said there were very few comments from the general public so far.

Mr Kabanda said there was need for the general public to make known what they thought should be included in the constitution.

“Very few comments are coming through on face book and comments box.

So we are appealing to Zambian’s to make their comments and make known what they think should be included in the constitution as this draft is not the final document but a working document, “he said.

Mr Kabanda also revealed that the technical committee would on May 17 2012 have a meeting with stakeholders were they would evaluate the performance of the technical committee drafting the constitution.

It is at this meeting where it would be decided on whether the 40 day period for the public to analyse the draft constitution would be extended.

Someone tell this clown that with dual nationality, the Laws of the Parent country takes precedence so if a Zambian who is a dual national with Britain commits a crime in Zambia and runs to the UK, the Laws of the parent country take precedence therefore the Zambian authorities could request for such a person to be extradited to Zambia. Our politicians are just scared that this would expose them to human rights abuses period.

    The concern about crime is not valid or true re: dual citizenship/nationality, because dc/dn will not be the first time his concern will be introduced.
    Does he not know that that even today people commit crime in their home country, flee to another and seek asylum or obtain permanent residence, seek the protection of a just, responsible host nation, till there is proof that the alleged crime had been committed before a person is subjected to the justice system of the home country? Case in point is Mr Henry Banda who is said to be in South Africa, not as a citizen, but as a resident there, being protected by the Government there, while awaiting evidence that he has committed crimes in Zambia his home nation, before he can be handed over to Zambia.

  17. The phobia that if a dual nationality subject committed a crime in one country could relocate to his/her other country in order to escape prosecution is unfounded. I doubt if there`s a country out there that would protect a criminal just because of dual citizenship. Remember that there`s an overriding international law on crime. Why is it that the long arm of Interpol can fish you out and be extradited even from your own country despite being of a single nationality?  The real problem is not that you can run away but which country’s law would be applied to prosecute a dual citizen.

Though there are cons of dual citizenship like uncertainty on which country’s law to prosecute a villain, dilemma on whether to grant equal rights regarding political and social issues, questions on patriotism etc, the pros are: the easy of capital mobility for investment, facilitates travel(enhances business) as bureaucratic visa and passport processes are eschewed, exposure which offers advantages on both local and global business field, culture and knowledge sharing ensuing from interaction results in enlightenment and innovation hence creating more opportunities . To crown it all, dual citizenship has been a success story in many countries, especially the liberalized economies.

This is not a good reason to deny people the dual citizenship. It is very important for these people to really understand the importance of the dual citizenship and not just come up with irrelevant reasoning just to be heard.     Many countries will not let you have two nationalities (dual nationality). If you become a British citizen and are a national of a country which does not allow dual nationality, the authorities of that country may either regard you as having lost that nationality or may refuse to recognise your new nationality.

     Under international law, we cannot give you diplomatic help if you are in a country of which you are a national. For example, if you hold both British and Chinese nationality we would be unable to give you diplomatic help when you are visiting China.

  30. Like it or not, if you are internationally employable the Zambian passport is amongst the most unwanted document you would have. It takes months to get a visa approved even for a simple visit to a stupid country. So Chipenzi, keep your ideas; we already have citizenship elsewhere because no one will ever take away by birth right; with or without a passport, am Zambian, will always come home, no visa, no nothing. If you so wish kill us at the airport.

  35. I have USA-Citizenship, but I don’t think I am American. I have a house in my hometown in Luapula Province, and I acquired that land from my Chief & local district council, no one asked me for my CITIZENSHIP. Sue me if you want, mwempumba mikowa baswaini!!

If you are a criminal hiding in Zambia Mr Chipenzi and are required by Zimbabwean authorities, The Zambian Government will hand you over to Zimbabwe even if you are a citizen of Zambia. Don’t expect protection. You are on your own in criminality. No country protects criminals. In fact we should even modify this clause by indication that Zambians who have acquired citizenship of another country even before this law do not need to apply, because most Zambian nationals who left to take up employment in other countries have their roots in Zambia and they have contributed greatly to Zambia through investment and taking care of their families. Most that I know who have taken up citizenship of other countries have a string of relatives in Zambia and are taking care of their relatives. Mr Chipenzi should be forgiven for exhibiting this level of understanding of this issue.

They have a position to deal with this, for example in the British passport it states that the holder is not protected by Britain in any way from any of the laws of any other countries that they are a citizen of. We have the brains to work abroad – bwana, where they do real engineering projects.   49. He has a right to an opinion :) Don’t take it or make it personal. What is of interest is how much those who have already acquired illegal citizenships will have to pay to regularize their positions and if this will be an amnesty of sorts. For example many South Africans found out the hard way that biometrics mean both governments are aware who is in this position and were asked to produce proof (both passports) at Heathrow. Remember the small print of that newer citizenship is clear that it must not have been obtained fraudulently and the assumption is that your country already accepts dual. I would like to know there will be no penalties for any of you caught out like this so it not clear what the citizenship board position will be. Anyone out there know?

  50. The reasons given are urbsurd but the call to remove dual nationality from the draft constitution is valid. I have read comments above in support of keeping the clauses but none hold water to justify it. @Linda claims it will allow Zambians in the diaspora to invest in Zambia. My wonder is how and who stops you investing when you are a Zambia national? Others suggest it’s progressive! Can someone please expand on how this would result in any progress? Others suggest it would make it easier to travel to other countries but are these good enough reasons to advance it? Personally, I am indifferent about the whole thing but will strongly oppose it and at most, if allowed, no public office holder should have/had dual nationality. You can’t have divided loyalties when in public office.

    • I have seen it is in the draft that you can not qualify to run for President if you have dual citizenship.

      I came to the UK when I was 18. I have a PhD from Oxford. I am scientist with dozens of patents being used by big organisations. However, I had to get a British passport because I pretty much could not travel anywhere easily without the UK passport. That is the only reason I got the UK passport. However my heart is in Zambia and I feel there is so much for me to offer back in my country. I am only one example. There 1000s of Zambian abroad in a similar situation. Your argument means people like myself would not contribute to Zambia’s developmen

    Well articulated. Can those in favour of dual nationality please advance some reasons for why it would be in Zambia’s interest to include this. The point about utilising knowledge etc is equally baseless. Remuneration and not dual nationality is what has lead to the knowledge and skills drain. One can only be employed in one country at a time and if one wishes to help develop their motherland, then it is easy to pack and head back and utilise your acquired knowledge and skills.

    Divided loyalty is no loyalty at all. There is no Government that restricts individuals from travelling to explore economic opportunities. If there is one please enlighten me. Zambia is currently full of economic migrants who do not hold dual nationalities. I am sure they will have travelled there beforehand to explore with little or no difficulties. and what should stop a Zambian travelling to Zambia to explore similar opportunities? in addition, if you say knowledge and skills can be utilised remotely despite location then what is the point of dual nationality? Those in support are supporting this for selfish reasons and nothing to do with investments, knowledge or progressing our motherland.

      My answer: There are no full economic benefits to the Zambian Enterprise only peripheral as these economic migrates in Zambia currently externalize nearly all their profits out of Zambia. With dual citizenship, it is plausible that they would be inclined to leave more of the returns in Zambia. For instance, how much of the $10.2 billion in revenues from copper remain in Zambia? Please let me know how much of the Chinese profits remain in Zambia as well and we will continue. I have other reasons but I would like us to start there. You are the best, thanks.

    The points you have advanced can be achieved with one nationality. I am a Zambia living in the UK with business interests in both countries and I travel freely back and forth. No one and neither Govt interferes with my travels nor where I put my money. I also have business interests in SA and the far east. Should I also go and acquire nationalities there for the same reasons you submit? One can only be loyal to one country and that includes children born in the diaspora but of Zambian parentage. If they chose to be Zambian they can be just that and provisions are their to facilitate and if the choose the country of birth, again it’s their choice to be respected. Brain drain is simply a non-starter. If and when the pastures become greener in Zambia, they will come – dual or not!

Most people who seek dual citizenship are not criminals – they are in fact sucessful people who can explore investment opportunities in Zambia, their home. These successful people got the other citizenship to facilitate their development – it is the worst thing to have a Zambian passport if you are internationally employable. Every country needs you to get a visa, and yours takes the longest time. I mean every country.

  76. Dual citizenship has got nothing to do with crime. The law enforcement agencies are responsible for clumping down on crime. Interpol is responsible for pursuing those who commit crime and disappear or run to other countries. We cannot through away a good law for fear that it may be abused. It also allows people that have intermarried across boarders to fully participate in civic duties. When you steal in Zambia, you will be considered a thief in Sweden, and where your residence is, that’s the country that takes first criminal jurisdiction over you. It’s very easy to hand you over. There is no need to fear and certainly no need to scrutinize anything about the proposed clause. It’s one of the best pieces in that draft. Read some international law to get a better position.

But for others they don’t need citizenship or permanent residence to run away. In fact crooks run to a country where they are least expected to run away to.

If that is a stand for FODEP, then we don’t need it, it is retrogressive and dangerous to Zambia, Does Mr. Chipenzi know that our colonial master who installed one chitizenship has moved to dual or multiple chitizenships? Does he even know the reasons? Does Mr. Chipenzi know that if you are a Zambian Citizen and acquire a second citizenship, if you committe any bad or terrible thing you will be deported to your orginal country? One Zambian white doctor who acquired a second citizenship in one of the countries in North America was deported for having done some bad thing between 2002-2004. So what I am saying is that the second citizenship does not even hold water. If I want I can give up my second citizenship and I will be forced or deported to my orginal home. I won’t be stateless. Or I can do a bad thing and be deported to Zambia. The dual citizenship should not even go to refendum, it will be the waste of money. The truth is this the Zambian Government cannot stop any orginal Zambian from coming back. You cannot deny the right of a person if he decides to come back to Zambia. There are so many Zambians who acquired another citizenship, are back.

Zambians who live in the diaspora do not want to leave countries of their second nationality to commit crimes in Zambia. What sort of crime? I really dont care what they do, im finding more and more my zambian passport is actually holding me back and making travel difficult around the world, i dont mind it expiring and putting it aside. I have zambian reg and thats forever so i can always get passport even if its in 50 years time.   107. From the comments I believe most people are saying dual citizenship will bring development and investment to the country and also bring lost educated people back into the country. Looking at the torn of the comments and insults from Zambians living abroad makes me think there is more to this than we know. Do the Zambians abroad just interested to eat with both hands in the name of whatever reasons they have given? Personally I have decided to vote against this because our foreign Zambians are not being honest. I have worked in SA and the US but money makes more sense in Zed. The whites just pay u enough to pay rent and buy expiring food.
