Chikopa to remain in Zambia till Supreme Court sets date for appeal ruling-Justice Minister

MALAWIAN Judge, Lovemore Chikopa, who is chairperson for the tribunal set up to probe three judges, will for now remain in Zambia despite a stay granted by the courts against the proceedings.

Justice Minister, Sebastian Zulu said in Lusaka in an interview that Mr Justice Chikopa would for now remain in the country and that a decision would only be made when the Supreme Court sets a date for the appeal hearing.

Two of the three suspended judges, Nigel Mutuna and Charles Kajimanga have obtained a stay to prevent the tribunal from sitting to hear their alleged impropriety pending the full determination of the judicial review by the High Court.

The two Judges are asking the High Court to quash President Michael Sata’s decision to constitute a tribunal to conduct investigations of alleged impropriety or incompetence.

High Court Judge, Fulgence Chisanga, last week granted the duo leave to apply for judicial review which would operate as a stay of Mr Sata’s decision.

Mr Zulu noted that since the tribunal was appointed by President Sata, it was only him that could advise otherwise.

“If the Supreme Court takes a longer time to hear the matter, I agree that the judge should first go back to Malawi until the matter is disposed of in court,” Mr Zulu said.

Several sections of society have called for Mr Justice Chikopa’s to return home pending the disposal of the case in which the two judges are disputing the decision by President Sata to set up a tribunal.

Supreme Court Justice, Phillip Musonda, who was suspended together with the two Judges, is however, not party to the legal proceedings.

  2. Chikopa will be bungee jumping tomorrow at vic falls using tax payer’s money. What I dont understand is that if he is such a renowned judge that we have single source him from Malawi, does he not have pending cases to preside over in Malawi? Does that some poor souls in Malawi will have to wait for their cases to be heard until the Zambians sort themselves out?

  3. Chikopa’s stay in Zambia means the government is determined to undermine our courts of law. The same government that wants to fight against corruption in the judiciary wants to use the courts of law to bend to its pressure. Its time Zambians rose to defend the judiciary. Meanwhile, the judiciary should reform but not at government’s pace. Let the reforms be dictated by the judiciary itself unless every man and woman in the judiciary is corrupt!

  4. This is unbelievable, nowonder Zambia will never reach its full potential. We have so much money to waste. Judge Chikopa will have aready been paid, kept and fed for two weeks when Malawi is only an hour’s flight away! Is this a govt that cares for the economic development of the country or is it one that is up to destroying as MCS said yesterday that a little corruption is ok?

  5. guys as you think about chikopa, have in mind those innocent people who could not afford an injuction rotting in jail. if only they were heard but no one gives a damn. if the judges in question are innocent, why getting afraid to be probed? all of us must own up and be responsible. its the judges waisting our time not chikopa. see our friends from the philipines have just sacked one judge and no one is raising a hand. these people are corrupt and must be probed.

  9. apparently govt is not footing Chikopa’s bills..Malawi is footing his bills in appreciation of receiving 5 million litres of our fuel…its an advanced barter system that you simple Zambians cant understand.. dull chaps

  10. I think Sebestian Zulu, has a BIG problem I now realise why Mr. Sata refered to his report as USELESS! CHIKOPA’S stay here translates into hefty allowances at the expense of tax payers. Above all how do you expect him to chair the tribunal? From the look of things the Government have a stake in Chikopa’s warefare that is the reason why Mr. Zulu, is failing to come out clearly.

  17. You chaps think Judge Lovemore will just go back to Nyasaland and start work on Monday morning in court in Blantyre. The man was just sworn-in and has asked for leave from his government for 3 months, who do you think is going to pay him when he goes home. 
    These silly opposition politicians should bring bread and butter issues like the draft constitution that affect the common man not drivel.

Zambians should demand that the government, as a matter of transparency, discloses to the general public as the interested party( being tax payers), how  much the importee,  judge Chikopa is gobbling  from their hard earned contributions through his unproductive and protracted stay in the country

  24. This PF is moving away from the ideals that we believed in when we voted them into power! They have become arrogant, insolent and divisive! In one breathe, the justice Minister says, he will obey the law, in the next one he says the law implementers are a sham! Even their cahorts (The Post) have become a law unto themselves. Not a single day, passes without the defacto advisor to government, insulting the judges at will! The next elections seem far away, but time will catchup with them. Even Mmembe wont come to their defence! Saize will go back to peddling the backstreet as he was doing, this time last year!

  26. This is now fire the judiciary is playing with. The executive can fire the whole bench and reconstitute it like what Kibaki did in Kenya. If the supreme court waivers by delaying the case or reaffirming Chisanga’s ruling, Sata should fire them all, appoint Roger Chongwe and foreign judges to realign our judiciary. Enough is enough with this stupidity.

  27. All you bloggers going on about corrupt judges etc, how does making a ruling based on the facts before him make a judge corrupt? Did some- one pay the Judge money to fix Mmembe and Nchito? why is he being called a liar ? Because he told the nation the truth about what happens to their hard earned cash ,why some people are asked to pay hundreds of kwachas or be bankrupted whilst some rich accountant cum journalist cum lawyer and hhis lawyer cronies (including a Director Of Public Prosecutions no less!!) is allowed to try and wriggle out of settling K14 billion  by using their knowledge of both law and accounting to their advantage.

  28. PF govt has made too many not well thought through decisions i.e.setting up of the tribunal before all channels are undertaken. Now we have a judge being paid for doing absolutely nothing, when in this very country some people are going to bed without a meal after supporting this govt with all they had in Sept 2011. PF need to realize that there is a job to be done and not passing jokes at the bridge in Stone. Stop being controlled by M’membe’s editorials and start governing the nation. We need clear policy formulation to address the many issues affecting our people. We cannot feed our people by keeping Chipoka on a payroll for doing nothing. PF pse listen and do the right thing in the name of human dignity. As for corruption and oil contracts buying, stop this at once.
