THE Railway Systems of Zambia (RSZ) says it will not take the government to court.

This follows President Sata’s directive to new Minister of Justice Wynter Kabimba to review the Zambia Railways concession agreement.

RSZ Chief Executive Officer (CEO) Benjamin Even said to their understanding the matter should not reach the courts.

“The matter could be dealt efficiently through the provisions of the agreement or simple dialogue.

“We will respect and cooperate with any process determined by the Zambian authorities regarding the future of this concession,” he said.
Mr Even was speaking at a press briefing in Lusaka yesterday.

He said RSZ fully appreciates the fact that the railways they are operating are a Zambian asset, which belongs to the Zambian nation.

He said their obligation as concessioners is to operate and improve infrastructure and to hand it back to the government at the end of the concession period in better condition.

Mr Even said the concession process was done in the most transparent manner led by the World Bank, which appointed reputable consultants according to its standards.

He said, “The state of the 100 year-old infrastructure and other challenges and matters raised were not all foreseen in the concessioning process by the parties.”

This does not mean that the process was not good, but could be addressed through open dialogue, Mr Even said.

And RSZ has nothing to do with the disposal of assets such as real estate and scrap as this was the property of Zambia and under Zambia Railways Limited (ZRL), Mr Even added.

Mr Even said all assets transactions, real estate and scrap are and were done solely by ZRL. ZRL are also responsible for the operating of Mulobezi rail line as well as Chipata- Muchinji railway line.

He said RSZ has invested more than US$50 million well above the contractual obligation.

Mr Even said the company has 1,000 employees who are paid on time although its facing severe vandalism.

And Railway Workers Union of Zambia acting president Nathan Zulu appealed to his fellow workers to remain calm as government and RSZ resolve the matter at hand.

Mr Zulu also urged his fellow workers not to vandalize RSZ property and maintain discipline as they await the outcome of the review.

  1. Sata is illiterate. He thinks Railway Systems of Zambia owns the properties that belonged to Zambian Railways. Someone should tell this buffoon that Railway Systems of Zambia is just in simple terms, “renting” the 100 year old railtrack built by the colonialists he hates so much. This is why the RSZ won’t even bother suing Sata as he would like them to. They will simply get their rolling stock back to Transnet South Africa. Sata please understand that the damn rail track is yours courtesy of Cecil Rhodes. RSZ can pull out today and the only thing that will change is that a Northerner will be in charge of ZR. TAZARA needs $750m for recapitalization so why the heck do you want to burden tax payers with the ZR mess?

  3. The problem here is that the MMD government, which Sata was part of, nationalized the country’s assets in bad faith. A lot people in government made a lot of money out of selling the nation’s assets. They signed anything as long as there was something in it for them personally. In this article, RSZ seem to be conceding that the agreement was flawed and that it can be improved.

  6. No 3, Don’t just see Zambia in the opposition view only. One day the opposition will be in government some in future if ever. But look at Zambia in development terms. We are really behind, the third world style. You must understand that there are well developed railway systems other places. In other countries the use trains for fast transportation of goods and people, not the funny and daft Zambian way – 14 hourd on train from Kitwe to Lusaka! Something is surely abnormal. The Management at ZR Have not done what they aught do. Their interest is profit, and let it run or burst. They don’t mind for Medium and long term. We need better railways.

  7. I think it was wrong for zambia to get indepence early we should have given a little bit of time for our colonial masters to govern us. Talk of economies which are doing well in africa like southafrica, namibia, angola, zimbabwe( until of late) etc, they got their indepence late. kaunda when he took office, zambia was a pontentially middle incorme nation but he transformed it into a poor nation.

  8. Please advise your Satan to quickly find $1.2 billion to replace the 100 year Cecil Rhodes rail track with a new one. That should be the priority. There is nothing to renationalise here. RSZ never bought the properties of ZR. They still belong to govt. Currently, government owned Tazara has a shortage of rolling stock i.e. engines and wagons to the illiterate PF cadres! The rolling stock RSZ uses is from South Africa. Now tell me where you are going to get the rsources for new rolling stock when you’ve failed to provide the same to the Tazara you’re already running? This Emotional Economics of yours is what tanked the economy under KK. Use your heads to think. Not your hearts, mouths, buttocks or whatever! It’s not enough to have a Chileshe as CEO when its taxpayers losing money!

  9. Regardless of what anyone thinks of this government or the one before, this was a bad transaction and has to be revised period. This railway is and has always been a strategic linking infrastructure for trade and passengers in our land locked country. The transaction advisors in this case were nothing short of unpatriotic cowboys who should be brought to account for entering the country and indeed the concessionaires into this chaotic marriage. They were trusted to structure the best deal for either parties and chose to be short-sighted and greedy. Im no fan of governments position on trying to nationalise anything else outside this deal from hell though simply because we need to position ourselves as the trade and linking hub in the region and North South corridor. ZR is too important!

    I like your analyses and arguments by analogy, you know what, I am neither an exponent of the opposition nor the PF regime. However, I always maintain an optimistic tradition to all UNPD rank and file membership. And or, I maintain a constant pessimistic interpretation about all programmes of PF. The PF govt. has no schedules about how it can graduate Zambia from a cycle of being a recipient of embarrassing donar aid and the PF people enjoy accumulating this huge foreign debit. The money is spent on programmes which do not serve the interests of poor Zambians. Who is going to repay the huge foreign debit? PF govt.is clearly subjecting present & future generations to this debit trap, shame. Viva,HH & UNPD, constructive arguments please not PF sweeping statements

  12. SATA spent time in London working on the railway sweeping the platforms. Later he was promoted to position of bag porter at Victoria railway station. That makes him think he’s a railway specialist. Guys, school is important.

    You are right, I strongly feel that our brothers & sisters need to be re-educated or the taught should be taught or the ill learned should be shown where to attain relevant knowledge. The majority do not understand nationalisation or privatisation, to them it is one and the same thing, shame. Their judgements are clouded with supposedly suppremecy and dissinterestedness. The PF regime should be in the forefront of cutting the debit crisis in lieu of encouraging it. Zambians need a zero debit economy in order to grow their economy and encourage much needed quality investments which can create qualitative employment not quantitative employment meant for illiterate employees and lasts for weeks/few months. Viva HH & UNPD. Peace, education & development to all Zambians.

  14. The problems may be numerous but the underlying track is the same. The railway lines, for the most part, were built for the sole purpose of providing a method of transferring what was required to extract one resource and export it. Post colonial built lines were alternative for import and export as other routes used political hot spots. Railway lines are long term and require extremely stringent and dedicated maintenance. As part of current development there are future projects to lay down more lines, however, like in the UK, the company given one task to do has fallen short of the mark and been called on it. Sounds like a diplomatic acceptance as well as directive to source of other problems. Derailed…might have been a tongue in cheek headline :)

In his warped northern intellectualism he thinks he is expanding the economy and creating jobs for “Zambians”! Very soon a Mr Chileshe, Mwila, Mwamba, Chendabwamba, Musonda etc will be appointed as CEO of the repossessed Zambia Railways! We have watched this horror movie before with Kaunda as the lead actor a.k.a umwine wa film! Now we have a sequel with Sata as the main actor! What can a man do except get another bucket of popcorns (saltless just as my Doctor has advised).

The so called repossession of Zambia Railways should be based on rational grounds not on ‘belief’ as he said in his remarks at the swearing in ceremony of Kabimba!     Mismanagement happens everywhere in the world, but it is quick correction and follow-up action that makes the difference and characterizes how companies in developed countries are run. This is the type of professionalism we should be striving to emulate.

    It is always better to manage our own assets for the collective benefit of our nation than to leave them up to people who are only interested in personal gain. Whether the mines, the airlines, infrastructure or telecommunication, Zambians can do it if only they try.

    Change what you are able to change; sensibly accept that which you cannot change.

Livingstone#20 The problem at hand is that even though you argue that brother Sata is seen as a hero for his fellow northerners, the question is, how is he going to sustain his job creation programm seeing that the project is riddled with so many shortcomings? There are so many flaws which can end up consuming my time and seemingly Zambians miss all these shortcomings. Looking at it from another perspective, the people running the Zambian economy are the IMF& the world bank of this world. They tell the PF govt. when & how high they should jump. They will continue to restructure the Zambian social spending until all the debit is repayed in full. Strictly arguing, nothing belongs to Zambians inluding the nation itself. It is unacceptable and this leadership enjoys IMF&W.Bank orders.why?

A lot of countries would brag about being blessed with all those resources especially fresh water, even our country S. Africa wonders how Zambia can share her emense water resource with us.   20. #3 What rolling stocks are you talking about? RSZ has been using the old equipment left by Zambia railways, they have never bought any engines in the 8 years. They promised so much and delivered nothing and instead they vandalised and stripped the workshops in Kabwe. $50 million is nothing compared to cost of the infrastructure been neglected by RSZ. RSZ has been a failure and they know it themselves, they have no capital to maintain and sustain the huge infrastructure. This concession was a sham from the beginning.

  21. PF and I mean all of you from State House to Intercity please understand simple logic. The problem is not because RSZ holds the concession to operate the line. The problem is the track on which the trains run is a 100 year old gift from that famous rascal Cecil Rhodes. Trains can only run at 5 km per hour instead of 100ks. I repeat relay or replace the track. This will cost you upwards of $1.5 billion dollars. Approach the Chinese for a loan. Once its built advertise for rail or freight companies to operate on the line. Pick three so as to ensure competition. These companies will be charged a fee for using the line. The fees will be used to repay the loan and for line maintenance. Repossession without a plan is just plain stupid. Use your heads!

  22. Zambia has a lot of resources e.g. water, 40% of water in the SADCC region is found in Zambia. Of which even S.Africans wonder how they can access Zambia’s fresh water because S.A. is an arid nation. Furthermore, has huge Uranium ores worth hundreds of billions of dollars(US) in the Gwembe[a] valley, Southern province. The above country has the potential of being the gateway into Africa from any given angle and presently it is the number one producer of the red metal (copper) on the continent & has the potential to be world’s no.2. However, current politicians dwell on programmes unrelated to true development but promotion of debit crisis by accumulating more embarrassing foreign debit. Why, ask yourselves ?

If someone is ‘renting’  your property and he neglects, what do you do? congratulate him or evict him. 100 years old rails is a myth, during ZRL they used replace rail tracks every few years and companies like Perway in Kitwe benefited  because they used to manufacture rails for ZRL. Zambians wake up, we used to ran this rail line efficiently. The concession and privatisation by MMD was a failure. For those supporting UPND, they should ask their president why the privatisation was such a failure under him?

  24. @Livingstone#25 I agree with you on a number of core issues, however, credit is not good for anyone, be they households or a country as whole because it cripples everything, yet on one hand, simplistically one can surmise that it enables one to generate and accumulate profits. It is a myth designed to trap the untaught party in accepting something which he/she claims to know yet she/he does not know it at all. For Zambia to develop, it needs trade in form of investments. This is not a mythology, it needs strong marketing, in fact no one is marketing Zambia for what is worth except, politicians running around in search of hand outs. This is degrading for any progressive Zambians. Debit free Zambia should be a Zambian slogan.

  25. There is no need to attack each as bloggers. You must understand one thing: Zambian negotiators did not understand what they were dealing with hence getting extremely poor agreements in the concession. Allowing the concessionaire to investment only $17m was a mistake on the Zambian government. It was the duty of Zambian negotiaters to refuse the offer from RSZ. Dont blame RSZ, blame the Zambian government for acceting a raw deal. The condtions of acceting the concession should have included an overhaul of the entire track, improved communication system, new coaches/engines, improvement to all rail station infrastructure, penalties for defaulting, etc but we got it all wong. Review the concession using knowlegable experts. I could have offered to assist but I am away on foreign projects

  30. @31. Theoritician. Please understand the distinction. Zambia Railways Limited (ZRL) is a Zambian gov’t owned parastatal that in turn owns all the former assets of the then Zambia Railways. The Zambian Directors and Managers are the ones been accused of selling off ZRL properties.

    Railway Systems of Zambia is a private South African company that is contracted to run mostly cargo trains on the currently dilapidated rail track . My advice to you is to zip your mouth until such a time when you know the facts about the problems of rail transport in Zambia. My simple advice to you is first define the problem before suggesting a solution.

A word of advice, to all truly concerned Zambians, a lot of companies mining copper in Zambia are evading their onus of paying correct taxes to the Zambian Tax Revenue services( hopefully I am correct the about the name of the taxman ). This act is achieved through a well organised act i.e. Grinnakger(a copper guru in Mufurila) has so many companies under different names which operate under the pretex of being legitimate buyers of copper in Switzerland, yet this is a scheme to defraud the Zambian govt. in that Switzerland is a tax free nation.This is why Zambia benefits only 2% of the total value of its copper and the PF simply says Grinnakger go ahead, yet on one hand, IMF is taking away what Zambia gains. Where is the logic in this transaction? It is the blind leading the blind.

You Zambians, you worry too much about comrade HH and his hardworking ethnic group,Tongas , yet you fail to consider the amount of damage which people like Grinnakhger cause to the environment and your economy. They accumulate approximately between 60-70 billion dollars(US) per year from your country and, on the other hand, Zambia’s economy is laging behind many economies. The very same companies cannot even plough back in education so as to grow Zambians or invest in the same communities as responsible companies. This can done through forming co-operatives designed to initiate small-scale business projects for self-reliance in Zambia. Comrade HH take these issues up delligently. Viva UNPD.   35. These RSZ chaps are a bunch jokers in 2003 they said they will invest $40m and now they say they have invested $50. Where did he invest these monies when they took over a rolling stock with newly refurbished wagons, wagons were refurbished at half a million dollars each by ZRL.

  39. @43. Maxwell, can you tell us the names of the Zambian companies that have been refused transportation by RSZ? Is it the PF mining companies? Or is Hakainde’s companies? Looking at the Zambian economy, I won’t be wrong in pointing out that most companies and products are foreign and mostly from South Africa.

I went on a search for the holder of surface rights on that piece of land. All roads led to RSZ directors NOT ZRL and they were asking for an arm and a leg for the same, hence I shelved the plan.. So this hogwash about Zambian directors of ZRL selling assets is your own imagination based on a deep hatred of the seating PF govt to the extent that you willing to turn yor venom to frame innocent Zambians (in ZRL) to defend the thieving RSZ scoundrels.Shame.

The majority of Zambians, including influential politicians all make blazing statements designed to please the audience but the truth is opposite, in that the audience is vast and diverse. The majority of the international community on the whole, draw a lot of logical argument from HH unlike the PF whose blazing statements about HH are centered around his age, his ethnic origin (Tongas), his previous transactions and his almost a billion rand empire.The PF does not inspire the real holders of capital with sincere motives at all.     My dear friend a train is an expensive piece of kit and those second-hand 1960s prices you quoting.  A locomotive now costs about US$ 5 million and a coach up to US$ 1 m depending on the type. A multiple unit (i.e. a self-powered train without a locomotive) can cost an average of US$ 1.5 million for each vehicle, depending on type and size of order. This is a lot of capital to invest and it is essential to make sure it earns its keep. Trains sitting in stations and sidings may look nice but they don’t earn money.
    You ask where these crooks RSZ were the invested that this pocket change $50m…

Their aim is to control Zambia as it is surrounded by eight countries and do among other things gun running. Let’s get back RSZ and avoid smuggling arms into DRC, they’re control borders and rail lines from Zimbabwean to DRC, also related to them is LR Group which operates in Tanzania and Angola. Please wake up.

Smell the coffee chaps what is a measly $50m investment or $70m back when RSZ is using track to transport billion dollars worth of minerals from DRC and Copperbelt to their other companies in South Africa everyday. Remember that this is not just a freight concession but also a passenger concession. Are we getting a good deal as passengers?   55. no.3 It’s you who is illiterate as you only you at things wrongly. RSZ management are not investors but scrape metal dealers who have stripped Zambia Railways of it’s assets. The move taken by Government is timely because allowing to manage another 12 months will have nothing to talk about at Zambia Railways. I totally agree with FDD president that they should be arrested and charged with theft as they have stolen from the Zambian people. Zambia Railways was once a vibrant company when the late Mazoka was in-charge and it employed a lot Zambians as engineers( they used to make bolts and nuts which they used to supply to the mines), Locomotive Drivers etc.

    In a nutshell, what you are saying is that regardless of ending the concession or not, a lot of money is needed to put ZR track and infrastructure right.  Anybody who has crossed a railway in Zambia will notice how meandering these tracks are.  Let us not even mention how rickety they are.  To have high volumes, you need to sort the tracks before you bring in more rolling stock.  This has been a fact for a long time.  Thanks for sharing this despite the numbskulls insulting you.
