
Chief Government spokesperson Kennedy Sakeni has said stakeholders challenging the Public Order Act should find time and look at the latest United Kingdom Public Order Act.
Mr Sakeni who is Information and Broadcasting Minister said in a statement in Lusaka yesterday that stakeholders raising concern over the Act should not look down on things simply because they were called Zambian.
“Our law has been fashioned in keeping with international best practices. Public Order Acts in particular are designed to help authorities to keep law and order,” he said.
“However, despite the numerous arguments made so far over this subject matter, as a responsible and law abiding Government we are restrained from saying much on this matter because it is in the court and we shall wait to be advised by the Attorney General’s Chambers,” Mr Sakeni said.
During the week, the Law Association of Zambia (LAZ) filed a petition in the High Court challenging the constitutionality of the Public Order Act.
LAZ president James Banda revealed in a statement released to the media that the LAZ Litigation team had filed the petition challenging certain provisions of the Public Order Act.
Mr Banda said that the action had been taken in the public interest and was in line with LAZ’s objectives which include promoting the rule of law and the rights and liberties of individuals and also promoting the reform of the law both by the amendment of and removal of imperfections in the existing law.
Ba SAKENI does it mean if something is allowed somewhere else it should also be allowed in Zambia? If you dont know Zambia is a sovereign state and we have our own laws that govern our country. If a man/woman is given all the rights with no limits he/she will immediately infringe the rights of other peoples be they relatives, business partners, fellow country men & women, name them. Human beings can be so selfish that they would live and let others die! We need public order and thus the public order act. All societies and nations has such measures, go anywhere, developeed or developing. Public order is necessary otherwise chaos is eminent. Remember thosr killed because of simply taking a walk late evenings, those who are robbed night and day, those disturbed in various forms by drunks, list is endless! Public order act is helpful in mass control, in catching wrong doers and in reinforcing law and order. We should respect human rights.

I always say that our problem in Zambia is that we want to copy things from other countries instead of developing “things” that will work effectively for us. I know that our Courts recognise UK Law where we do not have existing Statutes and that’s fine, but issues like dual nationality should be researched and not just copied because the US, UK, South Africa etc allow it. These matters have implications and advanced economies do research the impact of such matters before embarking on such direction.Â

Obviously there is a difference between petty and serious crimes (disturbance by drunks, robbers, and those who murder people who take walks in the late evening to use your examples) and having freedom to engage in political discourse (right to hold meetings, stage rallies, etc).Â
Giving people the right to freedom of expression is therefore far from an invitation to “chaos” as would like us to believe! Rather freedom of expression is key to building a stronger democracy to the benefit of all Zambians…. even you!

What buffles me is an ever recourse to insulting and belittling other people! From what I know of human beings we all fall short glory each and every day. Even those who claim to be seemingly clever they too can be so *****ic, myopic or utter foolish in the eyes of other observers.
