UPND Itezhi tezhi MP asks court to protect him from expulsion from the party

United Party for National Development (UPND) Itezhi tezhi Member of Parliament (MP) Greyford Monde, who is Agriculture deputy minister, has maintained that the court should protect him from being ejected out of the party because he was not given an opportunity to be heard before being expelled.

This is in a matter in which Mr Monde has sought an injunction asking the court to restrain UPND from expelling him for accepting a ministerial position from President Michael Sata’s government.

But UPND has urged the Lusaka High Court not to grant Itezhi tezhi Member of Parliament (MP) Greyford Monde an injunction restraining the party from expelling him because he is not a member of the party.

UPND Secretary General Winstone Chibwe in his affidavit in opposition of Mr Monde’s summons for order of interim injunction stated that Mr Monde was not expelled from the party because of his appointment but because of his recurrent treacherous behaviour.

Mr Chibwe of Sub division E of 682 Lusaka West who was sued by Mr Monde in his capacity as UPND Secretary General, vehemently denied Mr Monde’s assertions that he was an MP for UPND Ithezi thezi constituency as he was expelled.

He said that contrary to assertions by Mr Monde that President Sata had Constitutional powers to appoint MPs within the National Assembly, the UPND has challenged the purported constitutional powers of the President in a matter of Kuchunga Edwin Simusamba vs Attorney General 2012/HP/1561.

Mr Chibwe emphasised that Mr Monde’s charges and his subsequent suspension were not necessitated by his appointment to a ministerial position but were due to his recurrent treacherous acts.

He said contrary to Mr Monde’s assertions that he was not given an opportunity to be heard, UPND gave him three days from February 15, 2013 to exculpate himself but he failed to do so and that his purported request for further and better particulars over his charge came late after the expiration of the period given to him to exculpate himself.

Mr Chibwe said there is no irreparable damage that Mr Monde and the Constituency would suffer for his expulsion from the party and has not demonstrated any such anticipated alleged damage and regrettably, by-elections were provided for in the republican Constitution once an MP has been expelled.

“I therefore crave the indulgence of this honourable court not to grant the plaintiff an interim injunction as he is no longer a member of UPND having been expelled on February 22, 2013. That UPND has an inherent right to sanction any of its belligerent members and that as long as due processes and rules of natural justice are adhered to, it’s not subject to control by any external institutions as the party is a private members club,” Mr Chibwe said.

But Mr Monde insisted that the UPND constitution does not set pout or indeed stipulate the number of days an alleged erring member maybe given to exculpate herself or himself.

Judge Evans Hamaundu who is presiding over the matter adjourned the case to March 15, 2013.

Meanwhile, UPND MP Richwell Siamumene says he is not aware of fresh charges against him by his party that the disciplinary committee would soon prevail upon.

Mr Siamunene who was appointed Commerce, Trade and Industry deputy minister by President Michael Sata last week, was yesterday shocked that his party intended to resume old disciplinary charges which were leveled against him for accompanying Government ministers on a tour of roads and bridges in his constituency about six months ago.

He said he was not aware of any other charges leveled against him besides the old ones and wondered if the party intended to resurrect the same.

“I have not received any charges and I am not aware of any disciplinary charges from my party. The only disciplinary charges I know of are those that were leveled against me some six months or so ago, unless they say the want to resurrect the charges,” he said.

UPND secretary general Winston Chibwe said yesterday that the disciplinary committee would soon be sitting to determine the fate of Mr Siamunene who he said was facing disciplinary cases.

Mr Chibwe said Mr Siamunene had been facing disciplinary charges since December 2012 and the committee would soon decide his fate.

Mr Siamunene is the second UPND MP whom the party slapped disciplinary charges emerging after their appointments to serve in Cabinet.

Itezhi tezhi UPND MP Greyford Monde was the first that the party slapped with disciplinary charges and later expelled him from the party after he accepted the position of deputy minister.

Mr Chibwe said Mr Siamumunene would not be suspended or expelled because of the appointment but because of the disciplinary charges that he was facing.

Those two legislaters from upnd ve done done nothing wrong to accept to work in govt.there is other mps in upnd to appointed to serve in govt,if those expullsions are not halted then zambia stands to lose a lot money on by elections.monde is very brave and couragious,he has set the pace for other upnd mps.

    • But it was right for the PF to chase label MPs who sat on the consititution review commision which was going to shape the directions of the zambian people. It is only wrong when it is done by UPND because in your mind you think UPND has not right in its own that it can decide what is right for them. I wish to let everyone that it is time UPND to things in it own way and not in the way that PF thinks it good. We tried to work with PF but what clearly came out was that UPND was to only listen to what PF was saying. However people have started to understand who stands for what in this country and only the people of zambia will decide the fure of this country. I dont normaly want to respond but sometimes your are forced to do so. People of Zambia let us open our eyes and see real issues .

  4. Who has paid for Miles Sampa’s $20,000 class at Harvard University. Is it out of pocket or is the government footing this bill? How is his one month stay at Harvard going to help the people of Zambia. Sata is the one who should have gone, he could use some education.

    Miles Sampa is very narcissistic, he has at least 2 websites of himself where he posts pictures of himself playing in the snow at Harvard on tax payer money. And Zambians are quiet about it facing mealie meal shortages. Lwenu!

So UPND has no issues with MP being appointed to cabinet it just so happens the ones that do get appointed are the indisciplined ones…so unlike PF who suspend (e.g. Given Lubinda) the UPND is a very strict no nonsense party who expel and cost the nation millions in by-election. But at the same time this strict no nonsense party embraces the likes of William “bloodshed” Tekere Banda and make him presidential adviser? hypocrites! Just like Rev Sekwila when he resigned UPND revealed the Former Livingstone MP was indisciplined and an adulterer (ZWD).

  6. This ‘intravenous false feeding’ principle by Sata by forcibly appointing MPs to his 200 member plus cabinet, from unwilling Party organizations, doesn’t add up. Monde is a ‘political patient’ much similar to a terminally ill patient who has no choice to be forcibly fed. The MP is ‘terminally broke’

    • Sampa be quiet and have a heart. Zambia has suffered enough. You know that $20,000 certificate is not worth anything. Your constituency Matero could have used that money. Even your staffer whom you wrote about on facebook as wanting to take his own life because of Nkongole could have benefited.

  10. IT MAKES NO DIFFERENCE. THE UPND HAS LOST THIS SEAT IN ITT. IF HE IS NOT EXPELLED, HE WILL STILL REMAIN ROYAL TO PF. IF HE GETS EXPELLED HE WILL RE-CONTEST THE BYE ELECTION ON PF TICKET AND STILL RETAIN THE SEAT. SO PROBABLY THE UPND SHOULD HANDLE THIS MATTER IN A WAY THAT WILL NOT DISADVANTAGE THEM FURTHER.   11. Chase all the rebel MPS like what PF did to all those who attended the NCC. Any member who goes against party directives is a rebel and danger to party. For an MP to be appointed by ruling party, it is common sense that there has been a lot of dark corner meetings. You cannot be employed to two masters at once. Expel them both. If another one joins, that is another danger and ought to be expelled too. All the angel who pleased Lucifer were expelled with him because they were dangers to the heavenly peace. Please expel them. They will win if they enjoy popularity in their constituencies. Expel them!

UNFORTUNATELY FOR THE OPPOSITION, ONCE THEY EXPEL AN MP, THATS IT. THE PF GRABS THAT SEAT WITH BOTH HANDS. SO UPND MUST TO BE TACTIFUL IN THESE THINGS. ESPECIALLY IF THEY CLAIM TO HAVE MORE BRAINS THAN SATA.

  16. I thought I was going to get a comprehensive answer from the coordinator pertaining to the issue of our money and contracts but nothing has materialized. The curiosity and anxiety to get a comment from the secretariat has reached to an alarming level. This has prompted me to think of writing this memo with the sole purpose of making you conscious of the gravity and severity of the situation TIDOs are passing through. This is no longer supposed to be regarded as a challenge but a disaster. In this regards, I have seen it imperative to inform you for this will have a negative consequences to the evaluation scheduled for next week. Is the guy who is coming to do the evaluation bringing us something? I don’t think I will withstand this pressure anymore. I have tried my level best…

Currently the opposition are praising both mwanawasa and rupiah,both of them appointed mps from the opposition to serve in govt.besa chimbaka and chiti mulobeka served in the mmd govt.the current laws in zambia allows him to appoint anyone in parliament,equally if hakainde won the last elections he would ve had done the same.

He should not the abuse the judicially to award him honours for his sarcastic statements he made against UPND, a party that earned him a Parliamentary seat in Itezhi tezhi . Besides, who is funding Monde’s insanity? We earnestly pray to God that the Courts will not be turned into useful fiwelewele/fipuba/fifubafuba/vizende. Courts should be regarded as the custodians of true democracy in Zambia.

I ve this question i would like to ask anyone can answer does it mean anyone who has been appointed by mc sata from UPND had some pending disciplinary issues with upnd part come into effect when is appointed ?
