Supreme court dismisses appeal of Soldier imprisoned for defiling a 14year old in hospital

THE Supreme Court has dismissed an appeal involving a 39 year old soldier who was sentenced to 15 years imprisonment after he was found guilty of defiling a 14 year old girl who was admitted in hospital.

Supreme Court Judge, Justice Florence Mumba sitting with other judges in Kabwe said he was lucky that he abandoned the appeal because the court was ready to double his sentence to send a warning to would be offenders.

This is was in a case in which Chibale Sukanzila of Gondar barracks in Chipata’s Eastern province is allegedly to have defiled the girl on June 17, 2008 and was convicted and sentenced to 15 years imprisonment with hard labour on October1 8, 2010.

However, the appellant who is also a medical officer appealed against the sentence.

When the case came up for the commencement of appeal hearing, yesterday, Justice Mumba said it was saddening that the appellant acted in such a manner considering that the girl was hospitalized due to an illness.

”It seems the girl child is no longer safe not only in homes but in hospital as well otherwise count yourself lucky because people like you do not deserve to be in society, ”he said.

She said appellant who was an officer at the Gondar camp hospital took advantage of a defenseless girl who he injected with medicine which made her unconscious while are legs were num describing his actions as shocking.She said the court would have doubled the sentence had he proceeded to send a warning to would be offenders.During trial, the girl told the court that on 16 June, 2008 while at school she felt sick and developed stomach and chest pains and was later taken to hospital where she was admitted.

She told the court that she was hospitalized for malaria and her mother later left her in custody of her friend who was a medical officer at the hospital because she had to pick some things from home.

She said while the friend to her mother was away the appellant when to her bed and said he wanted to inject her but she refused because she was not prescribed with such medicine but he later injected her by force and become unconscious.
She said after waking up she discovered that her legs were still paralyzed while the appellant was sleeping next to her half dressed and later reported the matter to her mother.

    the officer forgot all his troubles not releasing it was on a patients bed.he had a good sleep.

  2. My God, he was that comfortable after commiting such a crime? who does that and where on earth? dont hung him give him life, so he can sleep comfortably for a long time! I could have frist squeezed his ballons before calling for help!

  3. this story is hanging….leaving the reader with questions. what is the arrangement of the beds at this hospital? was that done in a side ward(a seperate cubical)? its very rare to question a medical officer wat he is about to administer…how dd she know there was no injectable medicine prescribed for her? forced injection on her?.. how…?why ddnt she scream for help…?it seems there was only a victim and the attacker in the entire hospital..the anaesthetic effect takes a bit long to ‘expire’ and during the time it was in effect no one …the mother and her friend turned up…? If we go by the story,,how do u enjoy sex wth some-one who is basicaly unconscious….same as doing it on the dead…obviously its not the first time this guy has done this….deserves more than 15yrs

  4. Do we need him to appeal for the sentence to be doubled? Can’t we just review the case? Such a monster can’t get 15 years!

Yes the accused deserves a severe sentence but to say the supreme cpourt was to double it also raise concern, it gives the impression that the bench is led by emotions of sympathy rather than rationality. This is the calibre of judges at the helm of justice in Zambia, it explains why your country is not developing.

  6. 15 years for defilement/rape. How about abuse of drugs, can they find a separate charge there and add a few more years to his sentence?

  7. shame be to this soldier ,instead of injecting quinine he injected his manhood on a minor,wish it was posible to double the sentence even without the apeal,before REV KAPYA starts advocating for his rights

I strongly appreciate what military personel do in our country Zambia,furthermore commisioned officers regardless of which wing they find tthemselves in,however this story breaks my heart and gives me a benefit of doubt if at all people in uniform men we trust interms of discipline and protecting our land tend to be rapists on defenseless people to make the matter worse on a patient really,for interest sake was this officer married what are the reactions of the wife,family and his entire workmates at Gondar?or could it be that he visited a sangoma for a rank?let us be human in carrying out our duties well.Crime does not pay .

    I wonder why a friend of the girl’s mother did not witness the incidence? Did he conspiracy with the accused not to report the matter to the police or her mother Or did he disregard looking after the girl as requested by the girl’s mother to whom he was a friend to? He should be a polygamist to satisfy his sexual desire.
