DPP Nchito upset over the absence of Former President Rupiah Banda’s son

Director of Public Prosecutions (DPP) Mutembo Nchito has lodged a complaint to chief resident magistrate Joshua Banda against former Republican President Rupiah Banda’s son Andrew’s alleged laxity to appear before the courts of the law.

Mr Nchito told magistrate Banda that the accused person, facing one count of soliciting of a two per cent cut on all payments by the Road Development Agency (RDA), was aware that he was supposed to appear in court yesterday but was not present.

Mr Nchito said this was not the first time that Banda was not present in court.

When the matter came up yesterday for continued defence, Banda’s lawyers from Milner Katolo and associates informed the court that the accused person’s car brokedown on his way to Lusaka and could not manage to be in court on time.

At this point, Mr Nchito rose and asked the court to accord him an opportunity to express himself in chambers.

“Your honour, this is not clear, the accused person is not in court today but he was aware that he is supposed to be in court this morning.

“This is not the first time he is not present in court and yet he is active in making comments in the media,” he said.

This is in a case in which Banda, the former Deputy High Commissioner to India, is facing an offence of soliciting a two per cent cut on all payments made by the Road Development Agency (RDA).

Particulars allege that Banda, being a public officer as First Secretary at the Zambian Embassy in Italy and later Deputy High Commissioner to India, solicited and agreed to receive gratification amounting to two per cent of all monies paid to Frattelli Locci SRI by RDA.

The magistrate gave Banda a benefit of doubt and adjourned the matter to today afternoon.

  1. Like Father like Son. This cartel of Banda’s ran a corrupt regime. Time to account has come. Henry Banda should now be extradited. It seems only James Banda is a clean businessman

  2. Leave Banda alone. He has every right to be treated like a Zambian because he is a Zambian. Mutembo Nchito carries heavy buggage too – K18 billion DBZ debt – so he should not appear as if he is a saint here. All accused persons are subject to court procedures and if an accused cannot appear in court due to some unforseen situation, then he or she must be heard and excused. Just because it is Rupia Banda’s son does not mean he should not be excused when he has a genuine reason. Lets not be selective in our criticism. Mutembo Nchito is not even supposed to be proscuting others because he himself is a criminal. Zambians, lets be serious for once. We have a thug for DPP and we are quiet as if all is well. These criminals have hijacked the system and we are now at their mercy. Wake up people!

Or is it that you are suffering from GOOD governance dementia to know that the man you seek in your local courts, has been detained at some police station in one of that ”rural” town of Lusaka for some offence he committed at some place in the eastern province?
