ECZ officially postpones by -elections nominations until further notice

The Electoral Commission of Zambia (ECZ) has postponed until further notice scheduled nominations for parliamentary by-elections in Petauke central, Mulobezi and Malambo.

ECZ Public Relations Manger Crispin Akufuna has announced this in a statement issued to ZNBC News in Lusaka today.

Mr. Akufuna says the decision to postpone the nominations follows Friday’s Supreme Court order staying the September 3rd High Court judgment that ordered ECZ to allow DORA SILIYA, Maxwell Mwale and Hastings Sililo to file their nomination papers for the by elections.

The Lusaka High Court ordered the ECZ to accept the nomination papers from the three who were barred from filing their nominations for Petauke, Malambo and Mulobezi parliamentary by elections.

But on Friday nominations for Petauke, Malambio and Mulobezi parliamentary by-elections were put on hold following a new turn of judicial events.

The Supreme Court granted the state a stay of excursion in a matter in which it appealed the High Court’s decision to reject an application to stay the execution of the September 3rd, judgment.

The Supreme court has set September 11, as the date for inter parte hearing.

Double standards, Selective application of the law will lead Zambia into a dangerous unjust society ..We still remember and its on record, Given Lubinda and Fred Mmembe’s lies/ deception on the “Universal Print Group (UPG) and the Stanbic Bank Zambia Limited account number 0140034477502 to be one of the accounts used to pay bribes to ECZ officers.”
    If these are not lies then lock up Fred Mmembe and Lubinda for subversion/ treachery and treason, but if true then Sata and PF are enjoying proceeds of crime, contrary to Section 71 of proceeds of crime Act No. 19 of 2010 of the Laws of Zambia. In fact Sata and PF ascendency to power was based on the 90 days lies, deception and the grave allegation against (UPG ), contrary Section 22 and Section 104 subsection 7 and 8 of the Electoral Act

  2. these ‘rights has enshrined in the constitution’ thing is always overdone by these liars masquerading as lawyers.
    why cant they just come up with straight forward laws that do not raise unnecessary conflicts among themselves in those chambers is beyond me.
    the idi.ocy of the all set up is that the same liars can defend you today on a case of say, theft, and tomorrow undefend you on the same if they are offered more money by your accusers.
    strange species these ‘chameleons’ are.

    • High court is to shoulder the blame, Supreme court’s decision is final and binding, but how come the Hon. jugde failed to take that into account ,but pin point on the weakest link that is dangerous.The ECZ should have acted on the basis of Supreme Court’s judgement .We don’t want corrupt leaders to bounce back.Trust me Dora will not stand her time is up unless you are corrupt you will support that

  3. Waste of resources, waste of productive time. A lot of people are held unnecessarily long in our remands because our courts cannot dispose off their cases on time and yet they are always handling useless political cases. These jackals in heyna gowns are irritatingly inept and useless.

  4. You are not serious, Can see that you are now compromising with Politicians. Anyhow we will give ECZ a benefit of doubt. Because we know you can do better and not get compromised. Let the By elections take palace as scheduled. PF created them so no Excuses from their side. Is a Solicitor General a PF party cadre or Civil servant, if he is a civil Servant,: what’s his interest? TO impress Plot 1???

  5. The tried to take its course but the Govt intervened. Anyone who has the slightest understanding of Law will know that the “High Court report” came to late to stop the trio filing their nominations. And the pronouncement by the public relations officer suggesting that the trio should not stand, was a calculated move by the state to Barr the trio using unconstitutional means. Again this new appeal IS only done to serve PF interests and not those of national interest. PF seem to fail to realise that it is these very “unpalatable moves” that are impacting on their dwindling fortunes. If I was Sata I would put the construction of the retirement home on hold because judging from the voices, he may loose it even before he manages a step through the front door….

    • It’s about morality we don’t want to subscribe to corrupt elements let others stand.In the Western World they don’t intertain corrupt leaders or elements who does not know how corrupt MMD was !Some buried billions of Kwachas yet we support those corrupt elements

    • Why do you resist change ? We are compelled to take up pension whether you like it or not in this part of the World, it’s for a good reason.The fact is PF is in Govt.They are busy building infrastructure and that is what will make them popular.To be successful is to leave a mark.What has made great nations ,is infrastructure development but not appeasing people.We need to encourage people to be productive.

You cannot expect the courts to operate independently when the Chief Executive Officer (CEO) of the ruling party (PF in this case) is also the presiding officer for the Ministry responsible for Justice. It is not just possible, no matter how much you may want to massage the system. No sir, Hon. Kabimba, no madam, Mrs Chief Justice Chibesakunda. KK gave us an opportunity to go to school and are therefore able to have this knowledge. Of course you have the State machinery to enforce this contradiction and we onlt have truth on our side. But remember, truth has a longer lifespan.

I think it’s about time Dora and her crew sued these guys, they have no proof that she is corrupt if they had she would be in jail already, besides, there is no law which stipulates that anyone accused person is not eligible in contesting any seat, this is just playing dirty games on the part of GRZ, it strikes me hard to realise that there was no talk when that Boy Masuku masumba contested and won while under the inverstigations of fraud in whict it was indicated that he bought his cerificates or diplomas, why then do we want to block people who might help in developing the nation? Let them stand as you persue them for corruption charges.

  8. Government wings need to collaborate more efficiently. ECZ and Judiciary must learn to consult in a transparent and integral manner.This can also be informal or formal, the case may be. Good communication is essential for Good Governance.

  9. The problem is us Zambians we support corrupt elements the court nullified the elections based in corrupt elements and only human beings were involved.Let Dira sue the State you will see all her skeletons exposed

  10. It is the fear of the government loosing those elections thats causing them to try by all means to make sure Dora and compny dont contest. Why not let the people decice who they want to vote for????????? The high court has spoken and Kabimba is just using the supreme court because he vowed to see to it that those people dont contest
