
A Director at the Zambia Public Procurement Authority this morning testified before the Roydah Kaoma tribunal that President Micheal Sata has no authority to direct the cancellation of a public tender.
ZPPA Director of Inspections and Standards Gloria Ngoma also testified that the ZPPA Act does not allow Tourism Minister Sylvia Masebo to cancel an ongoing tender process.
Mrs. Ngoma told the tribunal that the ZPPA Act is explicit adding that only the approvals authority, procurement committee and the controlling officer can terminate or suspend a running tender.
She further explained that new members cannot be included to a tender evaluation process once it has commenced for fear of manipulation of the process.
But during cross examination by Mrs. Masebo’s lawyer, Micheal Mundashi, Mrs. Ngoma said there was an inconsistency detected during the evaluation process for 19 hunting blocks because the committee departed from the criteria.
Mrs. Ngoma said it would have been appropriate to cancel the tender due to the inconsistencies.
Meanwhile, the tribunal that was established to probe Mrs. Masebo for alleged professional misconduct this morning concluded its sittings.
Tribunal Chairperson Justice Roydah Kaoma said the findings of the tribunal will be ready by 30th March 2014 and will later be presented to President Sata and the Speaker of the National Assembly.
Wasting of money and resources. Ms Masebo should just own up, the rules are clear and therefore, she had no power to act in the manner she did. So is Mr Sata, on procurement process as far as the rules apply.

Masebo has apparently vindicated herself. Come the day to account for all these irregularities in ZAWA post PF, she will simply point fingers to Sata and set herself free. Even the director has also protected herself for the future. I hope others will emulate these fearless women.
I encourage all those involved in unlawful practices instigated by Sata to keep records of instructions from Sata either in written or voice recorded forms. There are phone conversation recording apps out there. Make sure you grab one and start using it now and save all important info for the rainy day.

It is interesting how people can read the same information and interpret it in so many different ways let me help; Ms Masebo testified that she was directed by the president to fire ZAWA management and to dissolve the board. She did NOT testify that the president ordered her to cancel the tenders. Secondly, Ms Ngoma testified that Ms Masebo did NOT have the power to cancel the tender; that power is vested in the approvals authority, procurement committee and the controlling officer. In short, Ms Masebo abused her authority and acted illegally. I hope this helps!
Even if Michael Sata ordered her to fire the Board and management,she was supposed to do so with due regard to procedure.She became over zealous and took the law into her own hands.She must face the consequences.

The Masebo Tribunal must rise to the occasion and deliver justice. We are all watching. We know that Wynter Kabimba was fraudulently cleared by a fraudulent tribunal formed by imbeciles who thrive on cheating in order to eat. Masebo refused to resign and already you can see the arrogance in the PF. All these things being swept under the carpet will resurface when a real government is formed. We as Zambians do not generally eat Game meat the way we eat beef, and wild animals in the family of impalas, wildebeests and so on, reproduce at a very fast rate like goats. I suspect that other people eat these animals on our behalf. The question is , are our security wings up to the task?

Surely from the media the way this tribunal has been gone, Masebo should not escape. Her only defense was that Sata direxted her to commit the offence; plus a series of unsubstantiated allegations which she failed to report to the police.

When Ministers are appointed, they need to go for an orientation seminar or workshops on the workings of government. Ministers think they have powers which they do not have. Sata too thinks he has powers which he doesn’t have. When anomalies are identified in a tender, people are free to complain to ZPPA who in turn can ask for a re-evaluation. This is supposed to be done within a specified number of days. A Minister cannot just wake up one day and cancel a tender because of perceived anomalies. Procedure Madam Masebo was not followed. Unfortunately these are issues not taught at UNZA where Mrs Masebo went to school. The lady messed up big time! When Sata gives you wrong instructions, you are supposed to advise him where he is wrong. Don’t just accept everything coming out of his mouth.
Masebo has laid a trap for President Sata. From her submission to the Tribunal, both Sata and Masebo broke the law and Impeachment is now the way to go. Masebo has given the grounds for Pres Sata to be impeached.
One wonders whether Mmembe, Scott Kabimba and Masebo planned to embarrass Pres Sata since they are not comfortable with him. The sooner Cobra is impeached, the easier it is for the Cartel to impose one of their own as President well before 2016.
Wont be surprised to see Scott, Malila, Whyter and Masebo being realigned in Cabinet as part of the President plans to clip the powers of the Cartel that is holding him hostage.
These 19 hunting blocks have ganged up together with their petitioner William harrington because they were killing animals indiscrimately for their selfish gains and doing the same business with some of our neighbouring countries with a view to depleting our game reserves. After measures were put in to put a stop to this they rise up and cry foul. Zambia my country where are we going.
