We in the Forum for Democratic Alternatives party (FDA) agree with the interpretation of the law by the Supreme Court and recently the High Court Judge Judith Mulongoti in particular, in the case where she cleared United Party for National Development (UNDP) Zambezi west constituency contender Charles Kakoma and has allowed him to re-contest his seat after it was nullified on account of corruption and illegal electoral malpractices.
However we in the FDA note with serious concern that government should address and correct the defects in the law, which should have allowed and compelled the High Court to prepare, and for the High Court Registrar to deliver a report to the Electoral Commission of Zambia (ECZ) and the Director of Public Prosecutions (DPP) on the findings that Mr. Kakoma committed electoral malpractices in respect of the 2011 elections which led to the election results being nullified.
Government in particular should learn from the case and judgments that there is urgent need to repair the defects in the laws in respect to those found guilty with electoral illegalities and corrupt malpractices so that we do not have a situation where perpetrators of these vices go unpunished or scotfree.
This judgment should also serve as an eye opener to the Director of Public Prosecutions and the Electoral Commission of Zambia, whose agencies should recommenced to the government the need to have the lacuna in the laws rectified, so that corruption does not appear to be encouraged in Zambia.

If the court has ruled that Kakoma should stand, respect the decision. But let the people of Zambezi teach Kakoma a lesson by rejecting him in the ballot. Corruption doesn’t pay. Kakoma like his corrupt friends, have been disgraced and it is just normal for a normal person to voluntarily go silent after the disgrace. To rear the ugly head up and want to recontest the seat is a show of criminal mentality.

Corruption is evil and Sondashi should not contradict himself in his analysis.The law is adequate to take care of corruption and also expose those on Cow dung manure perpetuating this vice.
Like in most democratic countries, corruption is illegal in Zambia. This great legacy that needs to be preserved. On that basis, any apparent manipulation of Zambian laws that results in glorifying corruption and lawlessness is unconstitution. Period. Even at judgment, the law needs to be approached proactively. In Italy, the law that is not codified can not be said to exist. Under English Law, even the uncodified legal behavior can be instantly codified through proactive judgments. There is no need to wait for a brand new piece of legistlation to deal with repugnant situation, such as corruption.
Criminality is not with PF but those corrupting the judiciary.
I don’t think that sondashi is interpreting things properly. what seem to be the problem in this judgement is the failure toactually pinpoint the corruption committed to kakoma himself and not any other third party,linked to kakoma. Judge mulongoti did not clearly state in the judgement that kakoma was guilty of corruption,henc the refusal to mention kakoma’s name in the report to ECZ
The high court is not the one that found kakoma guilty and as such cannot to made to make a report and sight him as corrupt. As much as corruption should not be encouraged, false accusations cannot be allowed. corruption is criminal and hence punishable. if truly the supreme court has evidence of corruption against Kakoma why is the ACC sleeping? they should prosecute him. Sondashi is giving advice to wrong people. Despite Kabimba being a LOWyer, he has chosen to pursue the elimination of Kakoma’s candidature through silly court cases instead of changing the law to compel the courts to assign accountability where corruption is proved.
