President Lungu said the two tribunals were appointed in 2013 pursuant to Article 98 (3) of the constitution of Zambia in relation to 24 (1) (b) of the judicial code of conduct Act No. 13 (1999) of the laws of Zambia to probe Justice Timothy Katenekwa and Justice E.P Sunkutu.
ZANIS reports that this is according to press statement issued in Lusaka today by Special Assistant to the President (Press & Public Relations) Amos Chanda.
President Lungu in his recommendation said Hon. Justice Katenekwa should not be removed from his as position as judge of the industry Relations Court as he was not holding the that position but was on transfer to Kabwe as High Judge.
Mr. Lungu said the charges against erring judicial officers must be brought as promptly as possible whilst they hold the office from which the charges emanate.
He said the Judges workload in the Zambian courts must be given special attention.
President observed that the Judges on transfer must be given adequate notice in order for them to concluded case from the stations they are transferred from.
Meanwhile president Lungu in a letter addressed to Secretary to the Cabinet has ordered that the interim, District Administrative Officers be appointed to act in the vacant positions before new commissioners are appointed.
The president has further warned sabotaging in implementation of various developmental projects that stern action will be taken against.
And Mr. Lungu has directed Special Assistant to the President for Project Implementation and Monitoring Lucky Mulusa and all Ministers to ensure that they take personal interest in monitoring projects that were needlessly being held back.
Why didn’t Edgar do such judicial duties when he was minister of injustice?

ANS: Because TRIBUNALS are only PRESERVE of the REPUBLICAN PRESIDENT to handle. He is the only person under our constitution with powers to constitute/appoint a tribunal and afterwards decide what to do with the findings. Depending on the findings and recommendations of the tribunal, s/he can decide whether to dismiss the erring officers or refer the cases for prosecution. Or s/he can simply ignore the findings and do nothing.
Thats how absolute and defining certain Presidential Powers are under our CONSTITUTION—not even the “minister of injustice” (as you want to sarcastically put it) comes close.
READ THE CONSTITUTION, IT IS ALL THERE YOU CAN’T MISS IT!

Understood! But we still have a country to be run. Until then, these are the Constitutional provisions we have to operate under.

You must separate the judiciary and the executive branch of government. You must also understand that the Zambian constitution is not working, you cannot have one person belonging to all the 3 arms of govt.
As such, the Tribunal must under law, give the accused an opportunity to be heard! A decision maker in a Tribunal or Merits Review, MUST “stand in the shoes” of the original decision maker.
Therefore, if the decision lacks merit, it is then deemed NULL & VOID.
In this vain, it vital that the constitution is changed b’coz all successive presidents ‘ve abused it. The legality of the constitution is compromised by selfish & corrupt elements who gain personally, forgetting the interests of people.

Can the presidential medical tribunal be instituted so that, a president who is under law public property, the health can be reviewed.
To date, the Roger Chongwe Commission of Inquiry into Barotseland and The Barotseland Agreement, 1964 is gathering dust. When will it be released to the public domain as it is the citizens obligations to be informed about the terms, conditions and recommendations?
Those on the commissions of inquiries have been paid colossal monies, & as such, the foundings should be amplified by PF in order to inform the masses about the outcome as well as impending doom.
A president is an individual like any other & should not hide behind power, especially with the incompetent constitution.

Edgar’s incompetence is not subjected to any tribunal yet. He will only see the recommendations in September 2016.

It certainly looks like your arguments are directed at a wrong person. If you don’t agree with me, the Zambian Constitution is widely available for you to download and argue with it. It makes no difference what you think or believe, Constitutions matter!

Yeah, so? And how does that go contrary to what I have said earlier concerning the tribunal powers the President holds under our Constitution? If presidents have in fact ignored the Roger Chongwe Commission of Inquiry findings, they have not committed any offense because our Constitution gives them that latitude.

A tribunal appointed in 2013? Why take so long? It can spend more than the ‘justice’ it is finding. Only a new constitution and FULL implentation can clear the mess in Zambia. Such a thing should be dealt with at the judicial level efficiently and at a lower cost. Pressurise for urgent solution to matters that require immediate attention.
Are you blaming ECL for not releasing the finding of a Tribunal instituted in 2013? ECL has been president for less than 3 months and he has already started releasing findings which were gathering dust.

Mr. President, please clear the air on the mines. This is one of the major issues bringing the kwacha down. Be categorical and not those statement that Yaluma is releasing that are neither here nor there. Be courageous and state in clear terms if the 20% tax has been reversed. Make a categorical policy statement about the mines to calm the investor anxiety. Why should this issue drag on perpetually? This will be more important than what Kalyalya will do.
Can Chagwa Agwa do the right thing and also release the findings of the Roger Chongwe Commission on Barotseland that his rotting mentor Satani stifled?

I am afraid to state that LUNGU is a president of this Republic at a very wrong time all together. Zambia needed a person with a very independent mind, not LUNGU whose decisions are dependent on RB and KK. Worse still LUNGU as things stand right now is a LAME DUCK, for he realises that something is eating him internally and is suffering from stigma, since every one knows that the man is SICK. In other words , He is not in his best FRAME of mind. It is just very normal and you can never expect such a person to perform no matter what you do. We all know what any disease can do on any individual, it be DIABATES HIV/AIDS call them, these are Achalasia, these are life long illnesses and will debilitate you with time .
