Former Tourism Minister Sylvia Masebo has been re-arrested by police immediately after the court entered a nolle prosequi in a case where she was accused of escaping from lawful custody and conducting an unlawful procession..
Ms. Masebo together with four others, were immediately taken to Woodlands Police station, where they are currently being interrogated.
Earlier, Lusaka Magistrate Lameck Mwale dismissed Ms. Masebo’s application for the court NOT to entertain the nolle prosequi from the Director of Public Prosecution- DPP-
Magistrate Mwale said the court has NO power to ask for reasons why the DPP is entering a nolle.
He questioned why Ms. Masebo’s lawyers asked him to refer the matter to the High Court, if they knew that the charge she was facing does NOT exist.
Magistrate Mwale says he cannot allow the defence to ask for the matter to be taken to the HIGH court, when the charge does NOT exist.
The Magistrate later entered a nolle prosequi and asked the accused to leave the accused dock.
