Parliament should restore Chiluba’s Immunity-Dr Bulaya

PARLIAMENT should consider restoring the immunity of second republican president Frederick Chiluba posthumously because he was acquitted on criminal charges for which he lost his immunity from prosecution, former Ministry of Health Permanent Secretary Kashiwa Bulaya has said.

Dr Bulaya said former president Chiluba did a lot for the country and that the removal of his immunity was orchestrated, engineered and executed by the cartel that illicitly took control of State institutions using the friendship they created with the Government and leadership that they manipulated.

He said future governments should never fall into the temptation of maliciously removing immunities of former leaders because what had happened in Zambia was not the fight against corruption but a scheme to harass and scandalize former presidents.

Dr Chiluba explained that countries that gained their independence after Zambia such as Namibia and Mozambique did not have a history of harassing their former heads of State because they respected their former leaders.

He said Tanzania was a shining example of a country that respected the institution of the presidency and that since the time of Julius Nyerere to the current President, John Magufuli, none of its former presidents has been harassed under the guise of fighting corruption as was the case in Zambia.

“Parliament should consider restoring the immunity of second republican president Frederick Chiluba whose immunity was without doubt maliciously planned, engineered and executed by the cartel at the time. Late president Chiluba did a lot for this country and was acquitted of his criminal cases by the court and it would only be appropriate for Parliament to consider restoring his immunity posthumously,” Dr Bulaya said.

And Dr Bulaya has paid tribute to President Lungu for having delivered to Zambians a people-driven Constitution which had been eluding the country for many years. Dr Bulaya said President Lungu had shown true traits of a democrat and a listening leader who had refused the temptation of resisting the demands of citizens.

“President Lungu has exhibited true traits of a true democrat by giving Zambians their Constitution. While other leaders in the region and elsewhere in Africa are changing their constitutions to allow them run for the infamous third term, President Lungu has been magnanimous enough to respect the wishes of Zambians by assenting to the amended Constitution,’’ Dr Bulaya said.

    • The other countries do not elect misfits and thieves to become their Presidents. If Sata had lived to the end of his term he would have to be prosecuted. The same with Lungu. State House in Zambia is a magnet for thieves.

    • What the hell, Chiluba messed up Zambia, He brought corruption and deserve no consideration. Let this case stay as it is so that in his next life, he should realize his mistakes.

    • Chiluba stole public funds and the London judgement is there. Only that corrupt RB refused to register it in Zambia so that the money and property could be recovered. Balaya must shut up if he has nothing to talk about.

    • Kafupi also pocketed a lot of public funds through people like Dennis Mumba (Zimoil), Valentine Chitalu and HH (privatization), Ronald Penza (MoF and arms deals), Edith Mawakwi (Carlington maize deal), Katele Kalumba (MoF), Moses Katumbi (Emerald deals) etc

I personally dont support the removal of the former presidents immunity its jst the share waste of money through legal fees i mean its not easy to convict a former head of state that is a fact records are there worldwide unless they have committed war crimes against humanity not mere corruption cases middled with political vengeance

  4. @Patrick, he may have has his flaws, but there great things he did and warned us about and had you and other Zambia listened, we would be in a better position

    1) The economic boom and liberation experienced under MMD rule was anchored by the foundation he put in Place

    2) And no one can cast a tribal stone at this great son of the soil, he overlooked his own to go and pick Levy Mwanawasa based on Principle and even rejected people who wanted to put him in power forever using a third term campaign. That is just how principled he was.

    2) He clearly warned Zambians that Sata can’t make a good President and you thought he was wrong and the rest is history.

    • You forgot to mention that he also stole millions and introduced corruption to the Zambians. No matter what good he did, it does not matter because there are worst things he did and he lacked principles in the end. A man should be answerable for his wrongs, as it stands FTJ died a mambala who took advantage of the Zambians.

  5. Also, I think this Bulaya got a light term. He should have stayed in jail for a longer time. What he did could have cost lives.

    Is this a medical Dr or a PhD? Because he kind of demonstrates why President Lungu is right in introducing competent tests on Permanent Secs and others! Chiluba is dead. Fat lot of good it will do to restore his immunity from prosecution. Why even kindergarten kids know you can’t prosecute a Dead Person. Just imagine, Trying a dead person; Our Judges would have to be given crystal balls and veils to communicate with the deceased. Woooooo, are you there? Spell out a letter on the ouiji(sp)board!!! Come on Dr Bulaya. Let the Dead sleep in peace, they neither need nor are they affected by immunity to prosecution.

  8. @Dr. Bulaya Kashiwa, please let sleeping dogs lie. Titus Mpundu alias Fredrick Chiluba was a classmate of BY Mwila,Musonda Fanwell “Blackee” ……at Kawambwa Secondary school in 1960 August. He lived a lie as Fredrick Jacob Titus Chiluba from the time he got a job at Atlas Copco Ltd in Ndola till his death. Give us a break from this liar of a man please. It is actually a shame that his grave has been made as visible as it is in Independence Avenue. Dr. Kashiwa Bulaya, your name appeared in our papers NOT honourably either. What are you really defending? Titus Mpundu alias Fredrick Chiluba or yourself?

    • Because they have the power to declare war in the countries interest and in war people die. because they have to order people’s deaths, those that threaten national security and you don’t want them to be so exposed to prosecution for some of the deep things they do for the country that are certainly beyond the average person’s knowledge.

From what i know as regards the amended constitution on protection of the President from legal proceedings , RB and FTJ (mhsriep ) their immunities were restored by the constitution and parley has no role to play. 98(10) says “Where a court acquits the person who held the the office of the President or who performed executive functions, of an offence for which that person’s immunity from criminal proceedings was removed, the immunity of that person shall, for all purposes, be deemed not to have been removed, without further proceedings.”

  14. Yes FTJ contributed immensely but to say he gave us freedom & justice is not true. Zambians gave themselves the multipartyism & the attendant benefits that come with it. He was not the architect of Garden house nor Pope square. We braved KK’s wrath to bring ourselves here. When he tried to screw the constitution to give himself a third term we rejected it. This praise singing is what’s killing this country. Kadansa is messing up all the way, instead of challenging him to up his game, we prefer to hero worship him for crumbs from our table.

    It’s Rupiah Banda and people like Emmanuel Mwamba and other Chiluba supporters who are trying to fool Zambians again.Banda & Chiluba were crooks.

  17. FTJ was a good man at inception but along the way he was also surrounded by a cartel or power got into him so much that he errored even at persecutions of KK and the Third Term Bid. It was such errors that made a man who on both instances won by over 50% to be hated by citizens so much that people ullulated at the removal of his immunity. He persecuted KK even without removing KK’s immunity he locked him up. This sword got back to him. But your suggestion is salient. As it is now FTJ awaits resurrection to either condemnation or eternal life.

  18. Found GUILTY in a London court, where its not a norm to have “Nichekeleko Verdicts” Acquittals in Zambia should be taken with a pinch of salt, especially in such cases, where corruption raises its Ugly head in 95% of cases.
    This BANDIT, Titus Mpundu – Kiluba, NEVER even returned a Red Cent from his illegally acquired bounty. Add salt to injury, his wife was stopped from buying a shopping mall in Finland worth Millions of U.$.Dollars, whilst Zambian’s have their “Shacks” demolished in the rainy season.

  19. I studied the Zamtrop Account and confirmed what KK warned Zambians about Kafupi. Kafupi Titus was an accomplished thief before he became president. KK informed the nation that Kafupi was entrusted with money meant for widows, K10,000, but instead of dishing it out to widows, he pocketed it all and nothing for the widows. He was a thief.

    Theft of the Zambian people’s trust and goodwill,
    Theft of name and certificates from Fred Chiluba then of Chilanga Cement,
    Theft of the MMD presidency from Arthur Wina,
    Theft of council houses used to bribe voters in the 1996 elections,
    Theft of $1m from Zambians to have kasai suits tailored for him in Belgium,
    Theft of Mwanza’s wife.

    What short memories some Zambians have! No wonder we are a peaceful lot, read docile!
