ECZ interpretation of Grade 12 requirement is academic and not legal-Government

Government says it is waiting for a legal interpretation of the minimum academic qualification of a grade 12 certificate or its equivalent from the ministry of justice.

Deputy Minister in the office of the vice president Bwalya Chungu says the interpretation that has been given by the Examinations Council of Zambia is from the academic world and is not from a legal point of view.

Mr Chungu said relevant authorities are studying the matter as it is a constitutional issue and legal interpretation will be rendered in the third week of March by the attorney general’s office.

The deputy minister was speaking in response to Mpongwe Mp Gabriel Namulambe, Ikelengi MP Elijah Muchima and Chipata central MP Mtolo Phiri.

The deputy minister also disclosed that government will engage the ECZ on the possibility of decentralising the process of certification of school certificates to provincial centres.

  1. Perhaps the ECZ gave their interpretation because the Grade 12 certificate is an academic document!!!! PF just accept that your MPs passed the constitution without realizing what they were doing because some of them didn’t even have basic reading skills

    • Bwana D. Minister, the ministry of Justice or the Attoney General does not give legal interpretations but ‘ their Legal opinion’. The courts are the ones that will give legal interpretation because they are the ones that interprate the law.

      If I remember correctly, about two weeks ago, the Vice President said ” Examination Council of Zambia will tell the nation what a G12 is and its equivelent certificates as they are the examining body. Today they (ECZ) give you their answer and you say they are wrong.

      I only agree with you on decentralising the certification process/ exercise.

  2. I don’t understand why such a basic qualification as grade 12 is causing people such sleepless nights in a country which has been independent over 50 years. Someone please shed some light.

  3. This dull deputy minister has empty brains too. Just hope he has not been misquoted. That is an academic qualification….so what legal interpretation is he talking about? Just accept you do not have one and leave space for others who have that minimum qualification.

One can guess what PF is up to…I think as Zambians we just need to grow some guts and put an end to this nonsense where a bunch of politicians have the audacity to instigate the changing of certain clauses of the constitution inorder to preserve or support their own political fortunes as opposed to doing so in the best interest of the country.

  5. Of course he’s right to seek legal interpretation. But the legal opinion will be based on the academic interpretation by ECZ.
    Instead of waiting for the attorney general someone should be bold enough to petition the chief justice (or is it the concourt) to interpret what this means for Kaingu who has a form2 certificate, some business certificates, an MBA & a PHD but no G12 or equivalent. We need to put a close to this unnecessary debate.

    • Grade 12 is minimum requirement..therefore kaingu exceeds the minimum requirement and by no doubt qualifies.And MBA is higher than G12

  6. Comment:if its only grade twelves who qualify to b coucillors or mps then in all fairness only grade twelves should vote.
    Africa nids wise and selfless leaders not pipo with academic papers.our fore fathers some of them hardly had a chance 2 sit behind a desk for a long tym managed 2 take this nation to greater heights.whilst our generation with over qualified academic personal have grounded this great nation to a halt.

  7. Comment :MUST HAVE ATTAINED A GRADE TWELVE LEVEL OF EDUCATION and must have a grade twelve certificate are not the same Redraft the clause so that you are not cut off . That is your intention. Debating things at night under the influence of beer this is the end result.
