The inter-party hearing in the petition in which the declaration of President Edgar Lungu as winner of the presidential election has been challenged has been adjourned to Monday.

Today the Court dismissed an application by Constitutional Court Registrar Kelvin Limbani that there is no space to keep election materials following the request made to the court by the UPND to have all presidential election materials used in the just ended elections in the custody of the court.

Constitutional Court Judge Annie Sitali ruled that the affidavit should be filed by another person other than the Registrar of the Constitutional Court.

And Judge Sitali has said that she will consider hearing the application by the petitioners to amend the petition on Monday.

Meanwhile, UPND Lawyer Gilbert Phiri has told journalists that his team is confident that the petition will be disposed off within the constitutional fourteen days.

Mr. Phiri stated that the court is on course in hearing the petition and that there are no unnecessary delays in handling the matter.

The matter has been adjourned to Monday for continued hearing of preliminary issues

      —————————————————–
The day ECL decide to jump on the challenge to go on a working holiday in Mfuwe, that was the HH and GBM lost the petition in the concourt. UPND has no EVIDENCE to present to the court. If you are a President Edgar Chagwa Lungu and PF supporter like. Get your WHITE and GREEN regalia ready because it dununa again at heroes.

    • Clueless, useless UPND Lawyer Gilbert Phiri has told journalists that his team is confident that the petition will be disposed off within the constitutional fourteen days. Really?? S101 ((5) states: The Constitutional Court shall hear an election petition filed in accordance with clause (4) within fourteen days of the filing of the petition. Hearing is not the same as disposing off.
The UPND chaps do not understand the Constitution. Judgement will come much later you under 5 lawyer!!!

    • We have become so myopic and lost sight of the bigger picture. It is sad for citizens to treat politicians, especially the ones in government, like royalty. Our leaders think they are doing a good job with the praises and support we shower them with. African countries will start developing the moment we make politicians understand that they are elected to serve us and not for us to worship them. The opposition is there to provide checks and balances on behalf of the citizens and yet we call them all sorts of names and forget how important this mandate is. This is not a game. People we put in office will determine the direction this country headed.

    • Very well said, Farmer.

Much like everyone has the right to express opinions up here (minus insults). We do not have to agree with each other and should learn to agree to differ like any good parent should teach their child.

Increasingly some behave as though they should be listened to over others. This election had supporters on both sides, apathetic and those who just want what they feel is best for Zed which may be neither but it remains the constitutional right of the opposition to exist and excercise all rights at their disposal.

    • Part of the reasons why things have been bad in the country has not been a result of leadership but a result of bad opposition leadership.

Ever since Lungu took office in 2015, HH has been negative at everything, spread every negative word, spoken ill of every aspect of the economy of the country, including what he knows is right, just to see failure so that the leadership can be discredited.

One recent example is the just ended referendum, with impunity and arrogance he deliberately decided to durect his effort in the opposite direction ducouraging people, just to see the process fail, so he can laughter at the leadership – just that, he is happy.

    • The problem is that most Zambians lack basic understanding and analysis. In america it does not matter whether you are opposition or not; you cause problems, you are spotted out and you get punished in the polls.

HH and UPND must heavily pay in 2021 elections.

  1. These courts! “Constitutional Court Judge Annie Sitali ruled that the affidavit should be filed by another person other than the Registrar of the Constitutional Court”! So which person then other than the one who keeps court records? And then “Meanwhile, UPND Lawyer Gilbert Phiri has told journalists that his team is confident that the petition will be disposed off within the constitutional fourteen days.”That sound good,so which means in the remaining one week everybody will have argued their case?? Really?

If u r a rejected, its good u try other games like NSOLO,CHIDUNU,SOJO,AKA RED NAKA BLACK.
Or its a way of paying back to the Zambian people the wealth gained through Privatization-many people gain alot during these campaigns as blessors become loose with cash.

  4. I wish Zambia was like America where the losing candidate showers praise on the winner despite the campaign rhetoric! Remember how Senetor John McCain praised Obama’s election in 2008, and off course the losing Republican candidate in 2012? Mu Africa takwaba! Why are we like this???

    • @6,american electoral system is a clean sheet, the candidate win based on electoral votes u get, some states split but most states is take them all,the goal line is 270-.electoral votes.due to this the loser has no much complaints as each state manages its own electoral system, its decentriasation.

    • In Zambia it’s not campaign rhetoric but violence , intimidation and rigging. That is what what we have to get rid of before we reach the level of showering the winner with praise. Simple.

  7. Its good we have known HH otherwise this country would have regretted if he was elected. Where does HH hatred for LUNGU has come from? From today let’s vote for politically tested pipo. All HH wants is to block LUNGU nomatter what it costs this great country. Does HH know the economical impact of what he is doing? Tomorrow you will blame LUNGU if the economic growth goes down

    • Dull Smith, it is not about hatred. It is about what is best for Zambia and it’s people.

Learn a bit about what Democracy and freedom mean.

Or go and live in Zimbabwe. That might open your eyes.

  8. I appeal to my fellow Zambians that are in support of the PF administration. I understand that your loyalty blinds you from the haphazard manner that national affairs are being executed. Let us not lie to ourselves. Things are not well in Zambia. Never before has Zambia experienced such a tragic failure in leadership.
The levels of violence we’re witnessing are unprecedented. The silencing of dissenting voices with such impunity is unprecedented.
If you allow this pattern to go on without speaking against it, these abuses will strike closer to your home next time. Perhaps then you will get your head out of the sand and realize that you’ve contributed to the creation of a monster.

  13. I’m so concerned that educated Zambians are using this forum to address trivial issues rather than big problems highlighted by these elections. If HCL, is the right leader, this is the moment to show leadership. What is showing is total disregard of law, and he and his running party are there to enrich themselves. Once that is gone in a nation were 65% of the young adults are uneducated, what kind of society are your grand children going to inherit?
It is beyond the the regalia given, but this so call cadres culture will destroy the the country that once held a proud peaceful people.
So for you that can write and read, discuss issues that will help other to understand what is at stake. I’m not a member of any of the parties and did not vote. I’m just concerned that…

  16. Kelvin, we’ve heard cries of rigging before. In most cases it is mere speculation and lack of confidence in the electorates. In Zambia, even the ruling party has been on record that elections had been rigged. None of them have been proved correct, unless my memory is bad. Do you have any of such proven stories? Besides, elections should not make you sick; because you are merely floating yourself to the electorates. Its like serving food on the table. If it is not eaten, its either one has no appetite, or is satisfied. Why compel anyone at all to eat it?

  18. I can assure you after this is over and the duly elected Presido Lungu is sworn in, Zambians should be ready for some good but drastic changes to the way the country will be managed forthwith. We are wasting time here with the stu.p.i.d petition just because of some selfish, egocentric, id.io.ts in the name of HH and GBM.
These two fools and a lot of others like Scott, Miles Sampa, Mulenga Sata, Mushipe chilufu, Masebo Sylvia chinyo, disgraced pastor Mumba are all very bitter individuals and do not mean well for Zambia. The fools even campaigned the Bill of Rights, what a waste of space in Zambian politics?
We should amend the constitution straight away to prevent this circus in the future for the sake of mother Zambia. HH, GBM and chinyo Mushipe have held the whole country to ransom…

  21. Masonry was originally a means by which people in the occult could practice their “craft” and still remain respectable citizens.Since Masons are involved in so many worthy causes, many are unaware that Masonic leaders readily admit that Freemasonry is actually a religion, not merely a “fraternal, social, civic service organization.” In the final analysis, Masons do not adjust their beliefs to fit the Bible, the Bible is adjusted to fit their beliefs. A Mason’s loyalty is never to God but to the Lodge.”Masonry … requires merely that you believe in some deity, give him what name you will … any god will do, so he is your god” At the heart of Masonry is a secret Luciferian doctrine which a Mason only comes to understand as he reaches the higher levels..THINK

He has stolen money K23 Million in 1 year and his PF cardes like Kaizer Zulu are amongest the top 10 richest men in Zambia. All this doesnt bother you Zambians coz stealing and dealing is part of your lives.
Lungu sold Land Cruisers less then 2 years old at K30,000 when the same 6 year old car from Japan cost K500,000 is this not missue of goernment resourse, he flew JK and his band in ZAF choppers. Wake Up Zambians. Dont just follow blindly. Ati Dunnua Reverse. Foolish

  31. How Does HH Claim to Have Won?

Looking at past elections, including 2011, Zambians have a pattern of votting that makes HH claim invalid.

In cross examinations, the defence can sure ask even the bench to ask themselves if there were in a polling Booth, would they Vote HH as president and Vote for a PF MP? No, and a big NO.

Today, as we stand, more PF MPs have been declared than UNDP.

If HH was a serious politician, he should have petitioned for wards, MPs and Mayor’s results, not presidency.

After winning lower votes, then he can claim presidency. As long as other seats remain valid, HH has no case to waste at Constcourt & drag the whole country into uncertain future; business is at stand still, Why? Because of HH’s arrongancy & desperation to make big money!

    Each one…
