The opposition UPND has written to the Inspector General of Police to allow party members hold a peaceful walk from the Party Secretariat to the residence of their President Hakainde Hichilema.

Party Secretary General Stephen Katuka says the objective of the walk is to petition the President and his running-mate Geoffrey Mwamba to take the presidential petition case to the International Criminal Court (ICC) and International Court of Justice (ICJ).

Below is the copy of the later copied to the media.

Dear Inspector General:

We seek your office’s immediate intervention concerning our application to hold a peaceful walk from the UPND Secretariat to the residence of our Party’s President, His Excellency, Hakainde Hichilema’s, residence on Saturday the 24th of September 2016 at 14:00 hours. The route we intend to use is Burma Road.

The objective of the walk is to petition UPND President, his Excellency, Hakainde Hichilema and his running mate, Hon. Geoffrey Bwalya Mwamba, to take the presidential petition case to the International Criminal Court (ICC) and International Court of Justice (ICJ).

We are, however, dismayed by the failure of the Police to effectively process this application despite the fact that we adhered to the preconditions and requirements by submitting the application on the 16th of September 2016. This application was addressed to the Police Commissioner, Lusaka Province.

We were later notified that the Police Commissioner only saw the application on Monday the 19th of September 2016 and hence the application couldn’t be considered because it fell out of the stipulated seven days that the police should be notified before the date of the event. We were also advised to address the application to the Police Command, Lusaka Urban and not the Police Commissioner, Lusaka province.

As per guidance, we resubmitted the application and addressed it to the Lusaka Urban Police Command. To our shock and disbelief, the Police Command told us to write to the Lusaka City Council to get permission to use their road. Instead of stamping our application letter, the Police Command just wrote their address on it. See attached.

This has left our party in a dilemma as we are shocked at the response of the Police. We are aware that the law clearly stipulates that all we need to do is inform the Police before we hold such an event and there is nowhere in the laws of the land where it states that we need to get permission from the council.

We strongly feel this is just one of the many attempts by those in authority to violate and silence the opposition and those with dissenting views in this country. We need not remind you that it’s within our rights to hold such a procession as long as we meet all the requirements of the laws of the republic of Zambia. Denying us this occasion will be a clear violation of our rights and freedoms which are evidently enshrined in the Constitution of Zambia.

It’s not a hidden secret that when the PF members want to match or demonstrate, they do it without following the due process of the law. They are free to willfully stage a protest or demonstrate without the consent of the Police. As a matter of fact, they do it so willfully giving the impression that they are above the law.

The UPND is a law abiding and peaceful party. We have had our rights subdued over the course of time and we feel this should come to a stop immediately. Zambia belongs to all of us who live in it. Public roads belong to all Zambians and it’s shocking that we have to ask for permission to use what belongs to us. We need to move away from these retrogressive cat and mouse games.

    • Some people have been made to believe that excellence is synonymous to presidency no wonder some bloggers are laughing at UPND’s SG for calling HH as his excellence. Anyone can be addressed as as such depending on his standing in society, his character and integrity.

      Why not just sit and talk. Why petition your own president, is he refusing?

      And if he is refusing, or not refusing, why inconvenience the public for your internal matters?

      Why should a wife go to police to seek permission to march on the streets to protest or petition the husband to take her for dinner.

    • The police command claiming the roads belong to the city counsel? Wow. The roads are public property constructed using public funds (People’s taxes). The city counsel has just been given the responsibility to maintain them…using our (taxpayer) money. Either the police command didn’t know what they were talking about, or they’re just out to frustrate UPND. Some injustice was done, and if you don’t see that, it’s either you’re just perpetually drunk with PF’s imbote, or you’re just plain biased. Smartmatic is an expert company, if not the leading company, in electronic voting today. ECZ may want to contact them, and see how they can work with them in the future presidential elections. Not only does electronic voting enable fast vote counting, and results given in a matter of a few hours ( say 2 to 3 hours) instead of days, but it reduces the chances of manipulation, eliminates the need for the printing of ballot papers, and the cumbersome job that comes with their transportation and storage. It also cuts down on the number of staff that you need to run an election, which becomes a huge savings financially. No more suspicions of loads of trucks with pre- printed ballot papers traveling at night to help rig the election. Though this system looks like it’s expensive, in the long run there are far more benefits than drawbacks. And the main benefit is that it reduces the suspicions, finger pointing, accusations, manipulations that are usually associated with ballot paper manual voting.

    • @5 Visungu, in fact they want to carry out a pre-emptive act by taking the case to the ICC so they can be considered as victims rather than perpetrators of ethnic violence. This case cannot be entertained at the ICC because a petition lost in the courts of law for failure to comply with procedures does not constitute a crime – for that matter can never be an international crime. However material found on Martha Mushipe fit an international crime as they are aimed at inciting ethnic violence. The ICC may receive the case for the sake of record and then ask that HH and GBM first respond to a case that was report about them earlier on! They would not want to be abused by these terrible loosers, they have more serious business to worry about!

Please get it in your thick heard: there was no rigging in this election and the challenges registered here and there, which by the way were more pronounced in Southern province, could not have affected the ultimate outcome significantly. In case you have forgotten, in October 2014, Kenyan president Uhuru Kenyatta became the first sitting head of state to appear before the International Criminal Court, where he faced charges of crimes against humanity after the disputed presidential elections of 2007. He appointed his deputy president to serve as acting President while he attended the hearing at The Hague as a private citizen!! He survived the charges against him only because Kenyan witnesses grew cold feet and refused to testify (obviously they had been intimidated). The Kenyan government also refused to release evidence.

  57. Honorable Katuka our SG, I think that the path we want to take by having a peaceful walk to His Excellence Hakainde;s home is fine in a country that adheres to its laws and fundamental rights. Not in Zambia. We had nasty experiences during the just ended campaign period with the Police and this time will not be any different. We will be delayed by the Police. I therefore make a suggestion for your consideration that the petitioners ask PRESIDENT Hakainde and VICE PRESIDENT Mwamba to meet them at our National Party offices to present the petition.

Despite losing to ECL/Inonge in just ended elections, he still has another opportunity with a bigger and better prize in 2021. It is public knowledge that HH has contributed a lot to the growth of UPND as we know it today. GBM will have ascended to the helm of the party having “paid ” almost nothing. This is strategy at its best. It would have taken probably 20-30 years (without guarantee of success) to reach the same position if GBM had to start from the scratch . Congratulations GBM for your political and business savvy.
