PF Deputy Spokesperson Frank Bwalya says the move by the UPND to take its presidential election petition case to the International Criminal Court will yield nothing.
In an interview with QTV News, Mr. Bwalya has wondered how President Lungu’s re-election can be overturned by a Court that has no competence.
Mr. Bwalya says the PF is in fact not aware of any Court outside Zambia that can hear an election petition which the opposition UPND is seeking.
He states that the move is only an attempt by UPND leader Hakainde Hichilema to calms his party members.

While we would love to see justice done in the case of what happened with regard to Zambia’s presidential election, it’s however highly unlikely that ICC or ICJ would agree to take up UPND’s case. ICC’s focus is prosecution of war crimes, such as genocide and crimes against humanity. ICJ’s focus is “settling legal disputes between states.” They make it clear that they do not take up cases presented by individuals WITHIN a sovereign nation. They settle disputes between two or more nations. Maybe what UPND can do now is to hire a professional video documentary producer, to make a video documentary, in which they can present their evidence to show how they believe the election got rigged. I am waiting for the day when I will look to Zim for nshima. Issue is, this is a total waste of time. By the time the ICC gets to hear the petition, it will be 2021. And even if they determine according to wish list, then what? They have no jurisdiction to remove a sitting president, chosen by the people. Suppose they agree with HH that ECL is a criminal etc. then what? ECL will still be YOUR president in Zambia. So just do the right thing, go and sleep until 2020 when you can start campaigning again.
It is not about over turning the forged election results, it is about discrediting the party that failed to prove its legitimacy before the courts. UPND borrowed heavily and promised big things. What better method can you use to the creditor than to tell them that you cannot pay on time because your katundu (votes) was stolen??? Just pay up.
