Fred M’membe gets a 7 days ultimatum from the Liquidator of the Post Newspaper Limited

POST Newspapers Limited provisional liquidator Lewis Mosho has given the newspaper’s former managing editor Fred M’membe seven days in which to furnish him with the company’s catalogue of assets as he takes control of the business.

Mr. Mosho has written to the Post Newspapers Limited owner, Fred M’membe requesting for a catalogue of assets of in liquidation within seven days from yesterday pursuant to section 281 section 1 of the Companies Act chapter 388 of the Laws of Zambia.

This is contained in separate letters addressed to Mr M’membe, Messrs Nchito and Nchito, and Messrs Palan and George Advocates and made available to media yesterday

And The provisional liquidator of the Post Newspapers Limited, Lewis Mosho of Lewis Natahan Advocates has terminated the legal services of the Nchito Brothers, Messrs Nchito and Nchito to the Newspaper.

The Liquidator has since appointed Messrs Palan and George Advocates as lawyers for the Post Newspapers Limited in liquidation.

Mr. Mosho has requested Messrs Nchito and Nchito to submit their outstanding fee notes if any as regards legal services that they have rendered this far to the Newspaper in liquidation.

He has however warned to report Messrs Nchito and Nchito to the Law Association of Zambia (LAZ) should they continue representing the Post Newspapers without his written permission.

Earlier, Messers Nchito and Nchito filed an application for a Court Order to set aside the Provisional Liquidation of the Newspaper Company.

They sought a stay of the Provisional Liquidation of the Newspaper effected by Lusaka High Court Judge Sunday Nkonde through a court order.

On Tuesday Judge Nkonde placed the Post Newspaper under provisional liquidation and appointed Lawyer Lewis Mosho of Messers Lewis Nathan and Advocates to act as provisional Liquidator in respect of all the assets and properties of the Post Newspaper.

This followed a winding up petition filed in the High Court by five former Post Newspaper employees.

    • You have now been given a lifeline Mmembe. Do the honours and pay up instead of playing victim. All this couldn’t have been happening if you were paying your taxes. Give to Caesar what belongs to Caesar baba!

    • Both PF and the Post are becoming irrelevant. When they differ they should do it quietly because their relationship was based on crookedness.

    • Lawyers have been restricting entry of more players into the practice through ZIALE. Now we have the same hyenas as judges, advocates and executioners.

    • Do those employees realise how they have been tricked by PF? In a liquidation ZRA gets priority over everybody else apart from liquidation costs. If the PFost was technically bankrupt because it could not pay ZRA’s demands, then the employees will get zero as ZRA will keep all the money realised after the liquidator has paid himself.

    • Lewis Mosho has landed a jackpot!!! Who will pay him the instant FREE exabitant legal fees, no one else but ZRA. That “liquidators” will cost ZRA more than The Post Newspaper owe them. And who is ZRA boss, it’s Ministry of Finance. I smell why Mutati dissolved the board.

    • The post can go but the poverty you guys are going through will still be there and it will even get worse. Feel sorry for PF guys celebrating this on an empty stomach and without fuel in there cars and no medicines in hospitals. NOTE. this is an LTD business so membe’s personal wealth will not be touched and he is free to start another business. If the sale of the assets will only raise 10% of what is owed, thats it ZRA looses out, That is why in civilised countries they do not shut down a running business but come up with a plan of recovering what is owed slowly but sure no matter how long it take because in this way you can manage to recover all the taxes and still give work to workers and their families who depend on the company.

    • @LAZ, it is true the name “The Post” newspaper is now history. But nothing at law stops Mmembe or any other shareholders from reconstituting under a different name. They can also employ the same reporters and continue plying their trade.

    • Its not over yet. Fred has many lives and wings. the best ZRA or whoever involved should have done was to cripple his wings first then finally close the post.

      When you look at all this, it’s irrelevant and childish.
      Few years ago they were in marriage and today they are in courts.

    • Wantanshi, that was a wind of change and you cannot pick on Mmembe to say he liberated Zambia. We just moved from one political setup to another. The issue here is tax evasion, which is a very big mulandu anywhere in the world. Mmembe cannot be treated differently.

    • He didn’t work alone. He wasn’t even there when the fight for plural politics started. Don’t give him too much credit. He didn’t influence anything but got involved in a fight that had already started. But the important thing is not what he has done, some of which has been very progressive and some of it very destrctive too. It is what he is not willing to do for the same people he protends to be interested in. If he is a protector of the people of Zambia and a champion against corruption, please advise him that paying tax is mandatory and an important factor in national development.

    • Your reasoning puzzles me. If there one million thieves and one is caught would it make sense for him to complain that “why haven’t you caught the 999999 other thieves. If you have evidence that the times haven’t been paying taxes, you as a concerned citizen go to the complaints tribunal and file your complaint. If nothing happens then your assertion will be proved right. For your information there are publications such as the Catholic Icengelo which are more critical of government performance than the Post but have not been threatened. Reason? They give what belongs to Caesar to Caesar.

    • You’re not 100% right. If a Catholic Parish orders a vehicle they pay the same duty as other people. We pay NAPSA, Workman Compensation and other statutory requirements. We don’t pay tax as a business entity and that is where our “tax free ” ends. We also property rates.

  14. This PF regime is like a devil.It came to steal, Kill and destroy. Zambians made the biggest mistake of their land by voting for this government. What wrongs has Mmembe committed apart from exposing the evil schemes and deeds of the successive governments from 1991?Fellow citizens can you really imagine a situation where no evils are exposed in society and by the time you realize it the society will have got rotten to the core??

Since the Post was closed, there has been a lot of stealing of government funds. The results are there to see. Do we have donors who can say NO to PF’s rule?

  17. Fred has been doing good checks and balances to our govt and country at large but i berg to differ with him on non remittance of taxes.In other countries like usa,china,japan,just to mention seriuos ones on earth Fred could have been jailed a long time ago.

    • i couldn’t agree with you more.he could have simply requested for more time or atleast paid 75% of whatever was being owed then negotiated a payment plan.but our Mmembe become too big headed and thought he was untouchable.Let him go and ope a business in developed nations and avoid paying tax,we see if it will take more than 5 years for him to face the wrath of the law!!

  18. When liquidation calls it is a relentless march. Very hard to stop or check it once it is in motion. Remember the Zambia Airways liquidation. It was ruthless, brutal and rolled over anyone who stood in its way. Even Sonny Mulenga’s promises to save the victims turned funny when he suddenly started fleeing when he couldn’t live up to them. So to my mind this is the beginning of the end of the Post as we know it.

  19. Once the Court grants liquidation and a Liquidator is appointed, it’s very difficult to change the Court’s process. He should have fought the stay before and not after. I feel sorry for him but ignorance of the law is no excuse, specially that Fred thinks he is a lawyer. If I were him, I would rather leave the Liquidator to complete his job. The only thing Fred must know is that he will never be a Director of any media company for some time and again no Bank or any other serious partner local or international will deal with him etc. His name is in serious shambles as we see the events unfold.

    Fred, should have consulted wisely when ZRA garnished his business. They say everything has got its time and this is a lesson to all of us that we should put GOD in front all the time for…

If you owe the Govt. or anybody else and the Courts of law decide on how much you should be paying and you continue paying in order to reduce your debt, should anybody disregard the courts to begin harassing you all the way until you are liquidated? No, it is not right. Any political system must respect the law. M’membe and the Post were paying tax. We know that the figure was colossal but it was being reduced.   28. @ Kanwa Kahosha and others in case you do not know, ZNBC, Zambia Daily Mail, Time of Zambia all these are owned by the Government even the employees get paid from the tax we pay, so my dear do not expect them to pay tax like a private company. When they fall short of money to buy paper your government funds them. The issue here is that Post is not a Government entity hence it should pay tax in full.

When RB announced that he was not interested in closing the post but that the post would be closed by its debtors people did not believe him but M’membe new exactly the extent of his graft. M’membe was given a false relief when RB lost to Sata (MHSRIP). We can fool some people some of the time but we cannot fool all the people all the time. Even the so called cleverest will at one point entangle themselves and fall. The Cartel has a life span as well. What these guys(cartel) should do is concentrate on self initiatives towards the development of our country.
