Wynter Kabimba’s Letter to President Hakainde Hichilema on His Campaign Promises

Greetings and compliments of the season.

I have decided to write you after a great deal of thought and dismay regarding some campaign promises you personally made and what has followed now that you are occupying the office of presidency after the 12th August, 2021, general elections.

(I) Freedom of Expression.

On many occasions while you were in the opposition and fell victim to the injustices frequently perpetrated against you by the PF government, you promised the Zambian people that when elected as president you shall guarantee all citizens freedom of expression as provided by the constitution which you later swore to uphold and respect.

One of the most obnoxious provisions in this area is the provision in the Penal Code which provides for the criminal defamation of the president. This archaic provision which has its roots in our colonial past to protect the British monarchy and not the British prime minister is not consonant with the tenets of the rule of law which you have continued to proclaim and the fundamental right of citizens to express themselves against the wrongs you are likely to commit or omit to do as head of state. This provision as you may know does not exist in the statute books of the United States of America.

I, therefore, wish to say this to you, that if you are truly a democrat as you claim to be, you should promptly have this provision removed as you are neither a monarch nor a saint but a mere mortal of flesh and blood who should be subject to criticism by our citizens without hiding under the protection of the realm of criminal defamation.

(ii) Rights of Suspects.

Our criminal justice system is anchored on the principle that a person is presumed innocent until proven guilty by an impartial tribunal established by law. Such a tribunal is represented by our courts of law.

Again as a reminder to you, you cried foul about the number of times when you and other UPND members were arrested while you were in the opposition without the police and other investigating agencies observing the due process of law. Again as president, you publicly proclaimed to this nation that the police shall not detain or keep in custody any person or suspect unless and until they have fully investigated the alleged offence committed by such a person.

However, what the nation has seen in the recent past is the complete opposite. We have witnessed the rights of politicians picked up as suspects being violated with gross impunity under your watch. We have seen suspects of bondable offenses remain in police custody for days for no good or justifiable reasons. If the police is defying your good intentions and instructions, why have you not taken actions or come out to publicly condemn these transgressions by the police? Your loud silence as president and commander –in-chief is beginning to translate into tacit acquiescence of such open injustices.

(iii) Political Cadre violence

It was overly mischievous and embarrassing for your party spokesperson during the Sunday interview edition on 19th December, 2021, to make a statement that the acts of violence perpetrated by UPND cadres at the radio station in Mpika recently and chelstone police station last week were isolated incidents. Where was the man when on more than one occasion you stated publicly that political cadre violence would have no place in Zambia under your government? I hope you realise that even the acts of violence we saw under PF started with what Zambians thought were an exception and not the norm as it later turned out to be.

Since these incidents are to be treated as exceptions, please tell the nation when the citizens of this country should start counting and consider acts of political party violence by your cadres as systemic and a part of the UPND political culture which would necessitate your intervention as President as you promised the people.

Your Excellency, in the words of Thomas Hardy, “Character is fate,’’……..that our lives are determined in large part by our own attitudes and actions.’’

  2. Wynter where have been all the years Lungu ruled the country with absolute disregard for anything. Today you want to appear like a person who is concerned. You should have talked during Lungu’s time. If you have nothing to say please save the media some space and us the readers time. Maybe that is why PF never selected you. There was something wrong they knew and decided to go with Lungu.

    Most of his promises he hasn’t fulfilled nor started fulfilling, l know UPND cadres will call you names, but the truth is you have hammered on the top of the nail.

Since the law of defamation of the President of the Republic of Zambia still exists, HH has no power to stop the police arresting anyone because that would constitute interference in police operations. The only power HH has is to pardon those convicted. That said, is abusing anyone part of freedom of speech? Displeasure, anger and disappointment can be expressed without being abusive.

  8. It is ironic that Mr Wynter Kabimba has suddenly discovered these new facts about the Penal Code. He was Minister of Justice at one time, what did he do with that authority? It is hypocritical to think that he can suddenly now appear to be the advocating for the needs of the masses when his record shows how brutal he was to opponents and how he stifled dissent in the PF. He was partly responsible for the rise of PF caderism.

  9. It’s good that Wynter has put it in writing, the record has been set. However, I wish to remind him that he’s expecting so much from a man that presided over the most violent political Party in recent years. The UPND became the most provoked and intolerant Party since HH took over. Yesterday he rewarded Ackson Sejani the chief tribalist and architect of the infamous Mapatizya formula. William Tekere Banda is still his senior advisor at the UPND. HH can’t reprimand political violence when he presides over the most violent political Party. Where are Kungo’s killers? He’s not interested in seeing justice, it’s only those crossed his path that will have their day in court. Let him prove us wrong. Zambezi Portland Cement!!

PLEASE WINTER NOTE THAT THE PF HAD THAT PIECE OF LEGISLATION FOR TEN YEARS INCLUDING THE TIME WHEN YOU ACTED AS PRESIDENT. WHY DIDN’T YOU THINK OF REPEALING IT.   13. I do not understand why people say, “Don’t say anything because you didn’t speak out during the PF regime “. Bally should listen and make corrections. This is the same attitude that got PF in trouble. The UPND has a communication problem, they made promises they can’t keep. They should acknowledge the mistake and course correct. They still have alot of goodwill from the people, so they will be fine. This goodwill will not last forever. Once it runs out, it will be very hard to earn the trust of the people

WHAT YOU OUGHT TO UNDERSTAND, IS THAT, THIS IS A MAJOR CHANGE FOR POLICE AND CHANGE DOESNT HAPPEN WITHIN A DAY, ESPECIALLY THAT THE POLICE WAS INFILTRATED WITH PF CADRES, IT HARD TO MAKE A CHANGE. Kabimba is the definition of what is wrong with our politics, he couldn’t write this stupid letter to the most corrupt and violent leader Zambia has ever seen Lungu because he was rented by him. Lungu violated and brutalised us. Summer Kabimba never ever wrote these stupid and annoying letters. By the way when is he going to start organising his ‘ brief case nashala neka party, he is always attacking and criticising HH, that will never win him an election. Go and grow your useless party.

    2] Besides that Mr. Kabimba, you should understand that law of defamation of the President is still valid and NOT been repealed yet. ALL that HH can do he has already done. But the Police are following current valid law. ASK BA PF IN PARLEY TO RAISE A MOTION FOR DEBATE to repeal, BUT DONT EXPECT HH TO REPEAL UNDER PRESIDENTIAL POWER, DOING SO HE WILL BE BREAKING THE LAW.

  20. Mr. Kabimba Sir, don’t be too clever for nothing. You were minister of justice. You bwana did not want to remove the piece of law which you have proposed (deformation of the President).,even when edger was President and people were arrested for that and the law is clear about the detention. You being the lawyer Sir, you didn’t defend the suspects but instead you supported Ecl because he was your classmate.Why now?
    This issue of accusing HH all the time is not helping matters. What you need to do is to follow up those matters and inform the public if any actions were taken . President HH can not be everywhere. He has ministers and permanent Secretaries and you as council to guide the public and not to come out like some of us, that is politicking Sir.

Let be people criticise the president cos it is a democratic right. If HH goes at this pace it will be one term . Citizens react hastely and you will cry loudly. There is no president who is not criticised on earth. Who is HH?

  23. Former Justice Minister who never saw the need to correct short comings in the penal code at the time he was enjoying being in power. I think most politicians in Zambia don’t mean what they say. President HH is so far doing extremely well with governance issues. We cannot forget where we are coming from and Winter was quiet at the height of PF brutality
