Judiciary delinked from the Executive

The Ministry of Justice has concluded the process of de-linking the Judiciary from the Executive arm of government.

This means that the Judiciary will now operate autonomously and determine its own conditions of service.

Justice Minister, George Kunda said an autonomous judiciary will provide an efficient and effective administration of justice.

He was speaking in parliament, when he presented a statement on the estimates of revenue and expenditure for the judiciary this year.

Mr. Kunda however said the judiciary will still be linked to government through the Ministry of Justice.

He said government will continue funding the judiciary through the Ministry of Finance.

  1. If what Kunda told Parliament is anything to bank, I am also asking for the process to start for ensuring parliament was delinked from the Executive arm of Govt. This process I am referring to comes handy with the process of rewriting the constitution. The new constitution must clearly have provisions that will entail separation and independence of the Judiciary, Parliament and Executive. For the case of parliament, we must clauses of appointment of cabinet outside parliament, so that legislators remain legislators, etc.

  3. That the way to go if we are serious about the rule of law and protection of Democracy…At last the sun is starting to shine in Zambia’s democracy…separate organs of governance is the pillar of any democracy.

  5. And I thought we had “democracy” in Zed. So all this long the Judiciary was dancing to the tune of the executive!!!!!!!!!!!! What a sad news to Zed. Its not time for us to celebrate really. What else out there is not what it seems to be??????

  6. Since it has just been delinked, the witch hunting for FTJ should be declared null and void. Reason? It was orchestrated by the executive, rubber stamped by parliament (removal of immunity) and carried out by the judiciary (Smith and Zambian courts)! (Even though Smith was not part of our judiciary. A good reason for the state to lose the case! Interesting!

    ‘Atonomous’? Just as we all thought the Judiciary operates indipendently from the executive, we may also believe that it will ‘start’ to act indipendently whilst in actual fact, it aint!

    We don’t know the extent of this delink. Who will appoint the Chief Justice and other key judges?

    Its Crucial that we know all aspects of this delick otherwise its just going to be one of those cheesey ministirial statements!

  8. It has not been delinked since it will recieve funding from the government through Ministry of Justice. So there is no way they will bite the hand that will continue feeding them

  10. All these changes are being made because they know Sata will capitalise on such points.Sata is actually a good thing to happen to Zambia. I cant wait for Sata to come and expose more of the rot that has been going on

  11. Why should it take a President to de-link the Judiciary from the Executive? Should that action not be the prerpgative of the Parliament? And should such action not be enshrined in the constitution? The problem with the President having the power to de-link the Judiciary from the Executive is that another President can “exercise” executive power — whether legit or not — and link it back to his office! I say that this whole thing is all smoke screen!

  12. These are just political rhetorics, lets see action. Indeed who is going to appoint Judges including the CJ, and who will determine their conditions of service and salary? The Judiciary will continue receiving funding from govt, therefore BOMA will still directly or indirectly call the shots! Money speaks. Anyway good step, but Kunda please define that extent of autonomy, otherwise its just donor appeasement.

By the way is it true that Kunda is using the words “de-link from the executive” If so then am at a loss coz we have learnt, and is still there, in our education system that zambia has ‘separtion of powers’ with the 3 arms of govt: executive, parley and judiciary. Whats is this de-linking now? Should we re-writing our civics syllabus and books, and the govt should sorry for misleading us all this time about separation of powers. I am convinced kunda was misquoted as is always with politicians. He just met to talk about the issue of conditions of service.

  14. its a good thing , but it will working looking at that funding shall still come from ministry of finance, as we all know that you can not bite the finger that funds you.
    Lets see how it works.
    Also change the civics books so that the misleaading does not continue.

  16. Don’t be fooled that they have de-linked judiciary from executive. This is supposed to be enshrined in the constitution and not mere talk. Otherwise for me nothing has changed.
    Too much political rhetoric in Zambia. Is it because we have politically inept members of parliament who dont even know how to debate apart from saying yaa yaa eey and busy dosing waiting for their gratuity.

  17. Crooks seems to be everywhere. Business and govt especially. We are conned day in day out. I dont know whom to trust anymore. Mwanawasa and govt are the biggest crooks Zed has ever had. They lie and lie and lie more. Im in pain. We really need an overhaul in govt. Otherwise we are not going any where except backwards…..

  18. You pipo this ‘delinking’ nonsense is only in terms of making their fellow lawyers and related employees peg their remuneration so high as to come close to the private practitioners. Then govt would justfy the expense by saying the judiciary is autonomous, so they decided how much they should pay themselves. Pipo not everybody can become lawyers or judiciary employee. There are all these other civil servants who are also critical and need good conditions of service. Lets see were it takes us. This ‘delinking’ is in my view a joke.

  19. I have always stated that we have one huge crime scene called Zed.

    We will need someone to investigate the real reasons for not ” delinking” earlier. We will also need to find out why Levy has not moved on all the culprits responsible for the growing financial thefts as exposed by our Auditor General.

    I would not be surprised if results showed a link to the luska stock exchange growth and activities.

Now that judiciary is “de-linked”, when are you going to implement the “Suprem Court” court decision to pay civil servants who were encouraged to voluntarily separate from the civil service so as to help govt. restructure the sector but were cheated by Kafupi! And your govt knows Kafupi was a trick star! If a govt of lawyers cannot carry out court orders, who can? We are scared to death to know that such claims can be treasonable under a govt of men, but alas, the new deal is also completely useless when it comes to following the pamputi! Anyway Ba Kunda, ala your actions are not in conformity with your profession and expections! You r a politician like any before! Make precidence now!
