Herbalist gets 18 years for defilement

THE Kitwe High Court yesterday sentenced a traditional healer to 18 years imprisonment with hard labour for defiling an 11-year-old girl.

Judge Evans Hamaundu jailed Fredrick Chinyimba, 32 of New Kawama township after he was convicted of the offence by a magistrate’s court.

Chinyimba was referred to the High Court for sentencing after he was found guilty of the offence.

Facts of the case were that on June 14 last year, the girl was sleeping in the house, which her family was sharing with Chinyimba.

While in bed, the girl noticed that a man had sneaked in the room and forced himself on her.

She realised that it was Chinyimba who immediately threatened her and ordered not to raise alarm as he defiled her.

The following day in the morning the girl told her sister about what had happened after her brother-in-law and Chinyimba had gone out.

When her brother-in-law came back, the girl’s sister explained what had happened. The family then resolved to wait for Chinyimba to get back home so that they could question him.

And when Chinyimba returned later in the day, he admitted to have had sex with the girl and the relatives of the girl apprehended him and took him to the police.

The girl told the court that she was shouted at by her sister after she told her that she had taken a bath after the ordeal.

She was, however, taken to the hospital where it was discovered that her hymen was broken.

In defence, Chinyimba told the court that he knew nothing about the defilement and that the girl was tutored to lie in court.

And in mitigation he pleaded for leniency saying he was a first offender who required leniency

  1. 18 yrs sentence too little compare to what traumatic the girl will throughout her life time. Plzii NCC dont just enjoy the money, introduce in the constitution ‘FINTENDE’ clause for defilers bcoz its getting out hand.

  4. i’m sure upon further investigation it would have revealed that the act was part of a ritual.i wonder whether the herbalist had an examination to determine his sanity….alot of these chaps are psychologically disturbed…but in Zambia we only believe this to be true when you are found eating the Times of Zambia outside Shoprite!!!We have quite a few lunatics running around and until they are caught doing sumthin’ we just think they are eccentric !!

  5. Away with traditional healers and herbalists, they are lying to people that they can cure their illnesses while they abuse them and shut them with hidious threats.

    The law should be changed in Zambia. These men should be castrated like animals they are, and lock them up in a mental asylum for good.

    Government should prepare chimbokaila for these filty beasts.

    Mr Mwanawasa, you are lawyer and president, do something, our daughters lives are being destroyed for good.

If there was an awareness educational program of sorts, i believe we would be getting many sexual predators locked up.One of the sisters was aware enough for the need to preserve evidence while the victim, possibly trying to hide her shame, went to clean herself up and again at the possible urging-threat of the perpetrator. Our girls need to be protected and educated on matters of social interactions as well as necessary sex education.I agree with Zedian#6 that the President put into play his qualifications and power to initiate appropriate laws addressing sex offenders.This token sentence though is a start. Sibongile what do you say?

  8. Does the ***** know how traumatic it is to the young girl. I wish i was near the baggar when it happenened, I would squeezed his “balls”. 18 years is too little. I ll do a citizen’s appeal so that the ***** is caged forever.

  9. i am sure a study could reveal why this sexual abuse is so rampant. and necessary and appropriate measures could be put in place to deter instead of the fire fighting situation that is prevailing. i think there will always this kind of abuse if no preventive measures are put in place and fast.

  10. This issue has come up many times in our courts of late! I am happy the judges are meting out stiff sentences, that one small component of addressing the issue. Let us also address this early in life through primary school education! Boys should be taught that it is wrong to sexually harass girls! i remember those days in the 80’s, some chaps would be proudly telling tales that “twalikalya kasato!” This was being said with a sence of self satisfaction without thing of the implications on the victim! Look at the chaps in the “compounds”, they can just touch a girl without her conset in public in full view of people without any reaction from members of the public! Education is a long term soln

Many of these girls being victimized are young, uninformed, and lack the capacity or means to speak out unlike you who has the choice to abuse online media. Can you for a moment imagine this was your sister raped,abused and left helpless? Indeed, does it have to be your sister for you to be sensitized? This is an occurance that is becoming way too common and requires immediate deterant measures however stiff.Thats the issue here, not spousal infidelities which seems to be your cup of tea. These kids NEED HELP. Period.

  13. number 18 you got me wrong,i probably have a better understanding than you do,I know what it feels,it wrong its inhuman,am not in support of it.Peep the whole scene,have a broad perspective you must be one of the cops I mentioned, cause your script tells me so.That man if anything deserves death cause he might have even inffected my young sister.

  15. Ba Pundit #5, excellent point! Alot of these character’s have deep psychological & psychiatric problems. It would be great if our local researcher’s undertook a detailed study to help us identify the root causes? I bet you, alot of this crap is going on unreported and it really messes up the lives of these innocent young souls!

  16. #19&20 First off, i’m not a cop and even if i were, being concerned with such an issue is not a crime.In #14 what is your apology for if i misunderstood you? The facts of the crime speak for themselves and,as such, your lack of substance and mockery of the situation does not offer anyone motivation to comment on the case, certainly not me.I always appreciate other peoples thoughts and ideas as long as they are positive and i would yours if that were the case.   17. why go 4 a 11yrs old child when there are alot of women in the strts, sometimes i fail to understand,its not human something must be wrong somewere,i dont know wat the gvnment can do to stop this.
