A 13 year old pregnant girl stunned the Kitwe Magistrate’s Court when she accused her grandfather of impregnating her, and not the 19-year-old grade nine pupil charged with defiling her.
This is in a case in which Dickson Nyirenda, a grade nine pupil at Kalulushi Basic School, is charged with defilement which is contrary to section 138 of the Penal Code Chapter 87 of the Laws of Zambia.
The girl testified before Magistrate Maxwell Mainza that she lied that Nyirenda was responsible for her pregnancy because she had her menstrual period after having sex with him.
“Then my grandfather started having sex with me. My grandfather impregnated me. My grandmother told me that I should tell the court that Dickson is the one responsible for the pregnancy.
“My grandmother did not tell me why I should point at Dickson and not my grandfather. I had sex with two people, Dickson and my grandfather. My grandfather impregnated me, I have nothing to add to this. I had sex with my grandfather in November last year, my pregnancy is seven months old.”
Particulars of the offence are that Nyirenda, on a date unknown but between October 1, 2011 and October 30, 2011 in Kalulushi, had unlawful carnal knowledge of a girl under the age of 16.
She, however, admitted that she had a relationship with Dickson and that she had sex with him once at his friend’s place.
The girl narrated that her grandmother chased her from Kalulushi after discovering that she was pregnant and that she is currently staying at the Young Women Christian Association shelter in Kitwe.
And during cross-examination, the girl insisted that her grandfather is responsible for her pregnancy and that she slept with Dickson before falling pregnant.
Mr Mainza adjourned the case to July 13, 2012 for continued trial.
