
Heritage Party President Brigadier General Godfrey Miyanda has called upon President Michael Sata to transfer current Justice Minister Wynter Kabimba from the Ministry of Justice and replace him with a person who will act beyond partisan lines.
In a statement made available to the media, Gen Miyanda said that he believed that PF’s ‘Stop Dora” Campaign was politically motivated due to the PF’s desperation and fear of future bye-elections.
Below is the full Statement;
STATEMENT: MINISTER OF JUSTICE OR PARTISAN PARTY CADRE?

I call upon the President to transfer the current Minister of Justice, Hon Wynter Kabimba, from the Ministry of Justice and appoint a person who will act beyond partisan lines in this strategic ministry that should be the bastion of the Rule of Law and custodian of our democracy.
The ZNBC evening news of 6th August 2013 showed Hon Wynter Kabimba, Minister of Justice, revealing that he had instructed PF lawyers to “engage” the High Court to act to stop certain opposition MPs from standing in the forthcoming bye-elections. In an act of abdication of his Ministerial portfolio the Minister took off his Justice shield and donned the PF cadre cap by speaking as Secretary General rather than Minister of Justice! We take this to be an attempt to disguise the fact that he is the Minister of Justice at all times who should never act in a partisan way. How can the Justice Ministry remain under a person who has shown clearly that he is a cadre first and Minister of Justice last?

I believe that this PF “Stop Dora” Campaign is politically motivated due to the PF’s desperation and fear of future bye-elections. While it is in order for the PF or any other aggrieved person to go to court to raise issues regarding an election, the latest tactics by the PF Secretary General are baffling. It seems the Minister of Justice has thrown away his legal mind and forgotten that citizens have certain rights that have to be observed whether in civil matters or criminal (or quasi criminal actions such as election petitions).
Under our laws it is NOT automatic that a finding that there was corruption in an election always ends in a disqualification from participation in future elections; it will depend on the evidence. I thus find the tactics being applied by the Minister to be not only irregular but premature and presumptuous.
The Minister, himself a lawyer, announced that he had instructed his lawyers to “engage” the High Court. What is this “engage” language? Rather, an appropriate process is commenced which involves other parties rather than conducting a private “engagement”. How do you challenge something that has not yet happened? Minister Kabimba’s lawyers may end up having no one to sue and instead “engage” the High Court alone! The PF are in such a panic rush to get hold of the Report that they have decided to make desperate short cuts.

There is a process or procedure to be followed after a determination of a petition by the High Court. At the conclusion of the hearing, where the High Court finds that some corrupt or illegal acts were committed, the Court would prepare a Report and invite the concerned candidates to show cause why they should not be named in the Report. Only then should the Report be submitted to the ECZ and the DPP. Hon Siliya and others have a right to be heard BEFORE the Report is submitted. The Courts should not be badgered by the Minister of Justice into doing things that are not procedural.
A point of note here is that although it is the High Court that must prepare the Report, in this case the High Court held that there was no corruption; consequently an appeal ensued which culminated in the Supreme Court overturning the High Court decision. Without having had sight of both judgements, I assume that the Supreme Court’s decision was based on points of law, rather than on facts, unless there were grounds to disagree with the court below. Since it is the Supreme Court that made a contrary finding, I would assume that it is the one to make the Report indicating the nature of the evidence given in respect of the corrupt and/or illegal acts as well as naming the person/s found wanting. The Report would be sent to the ECZ and the DPP; with the DPP to establish whether there was sufficient evidence to warrant a prosecution under the corrupt acts under the electoral law. Here I contend that this is a matter for the DPP and NOT the ACC because the offences are corrupt and/or illegal acts under the electoral law.
Lastly, instead of creating so many bye-elections the Minister must consider rejecting the whole 2011 election including that of the President, as it is the credibility of the whole election that must now be in question! This should be done without going to court to trouble and pressurise the judiciary and the hard-working ECZ.

The Editorial comment in to day’s Post Newspaper is passionately urging our courts and Government to fight electoral bribes by disallowing candidates whose seats have been nullified.
The puzzle I see is that our own DPP Mutembo Nchito:-
a) is a documented forger
b) is on record to have corruptly issued a nolle in favour of Raja Mahtan who in turn discontinued a court case against Mutembo Nchito where he was being sued for recovery of US$4m owed to Finance Bank.
Where is the morality of allowing criminals occupying important judicial positions while pursuing an individual who merely said words during the campaign that have now turned out to be true?

The Free Dictionary defines Justice as the “The upholding of what is just, especially fair treatment and due reward in accordance with honor, standards, or law”.
Hon. Kabimba, SC is highly compromised by holding the portfolio of Justice and the position of PF Secretary General. This is obvious to anyone who cares to pay attention. The current arrangement works well in a one-party state where citizens’ political affiliation is not a factor. All Zambians, regardless of partisan allegiance, look to the Justice Minister for legal justice.
Will HH, for instance, get fair treatment from Hon. Kabimba under the current circumstances? Very unlikely, and yet, HH as a Zambian citizen and tax payer, is entitled to receive justice from the GRZ.

General Miyanda knows the PF are following the right procedure. We elected the PF to uphold the law. The question is WHY is the HIGH COURT not producing the REPORT after a candidate has been found wanting as per the requirements of the law? All Kabimba is doing both as Minister of Justice (this is a justice issue for the people of Zambia) and PF secretary general (an important issue for the PF as a political party) is to move the court to abide by the law.
The only thing I find disappointing about Kabimba is his failure to reform the Judiciary. He is taking too long to institute serious changes in the judiciary. The law on electoral mal-practices is very clear. It is the Judiciary that is failing the people, it shoud therefore be reformed.

Read and understand. The high court did not find any corruption issue with Dora, the reason PF appealed to defunct Supreme court that found Dora wanting. How do you expect High court to issue a report. it is the supreme to write. However, the law say it should be the High court and not the supreme court.

We original PF members think Kabimba is doing a good job. The only people that are always criticizing are those that have always been critical of PF from its inception. If critics think Winter is making PF unpopular, they should be celebrating so that PF is kicked out of power in 2016. The moral calibre of any government , including the PF system, can only be mirrored through the Ministry of Justice. But this time around the world sees the PF Govt as being run by a fleet of persons with warped mind-sets. If the PF party considers itself to have assumed the role of legalising and executing deception, gangsterism, andtorture, then let the Govt openly create the Ministry of Gangsterism, Deception and Torture, and then appoint Kabimba as Minister, Mmembe as its Deputy Minister and Mutembo Nchito as its Permanent Secretary. Wynter acts in the interest of PF, not of justice. As long as PF is under threat, Wynter will stand to fight tooth and nail until PF wins. He is strategically put there as Justice Minister to win cases for PF. The Injustice Minister will pay one day.
As Miyanda has said, the 2011 election should be declared null and void as ‘no’ party was free from corruption. According to Myles Sampa, PF lied to the electorates in the run up to the 2011 elections; the 90 day promises. Lying is part of corruption making all the sixty parliamentary seats and the presidency corruptly won. Consequently, two years down the road, the PF have scored ZERO vis-a-vis their own promises.

It appears all opposition presidential candidates seem to have hidden and personal agends , (perhas on how best they can loot the country of its resources) if all could agree and come up as a united front they can unseat the current Government.

Well done General but let us face the facts here. The issue of the “CADRES” taking up key if not all government positions is not something that we should even waste time on because every political party wants to ascend to power and promote its own ideals. By doing this it has to employ its members who fought hard. – ofcourse not all cadres are good but I do not believe that the opposition political leaders are the ones who should offer “correct” advise to the party in government when all they need is to pray that the party in government makes more and more mistakes so that they capitalise on that. Miyanda has failed to run his own party, (its now a one man party) let alone spell out tangible programmes that HP has for Zambia except the laughable (plagiarised Ujaama) Village Concept. Talking is an industry in Zambia. So much energy and time spent yapping! Such impractical men with no sound/workable economic theoretical blueprint to follow should not pretend that they can make better presidents.
The General is a very proud leader of the Heritage Party but the danger with him is that he does not want to give in. He wants to stick to what he knows and understands to himself – to me that is the danger. Principled people are never good leaders but to be good leader you need to be flexible and at times give in. PF may have not yet implemented some of its promises because they had to accommodate to some extent even the views of people like those of the General – they are governing the entire Zambia and not PF alone. To an outsider, everything looks simple but to an insider he finds that he may not have control on some things. A promise will always remain so and can only be fulfilled if certain conditions allow.

Mr Winter (correct spelling) Kabimba has form for blurting out his ludicrous and dictatorial opinions on Zambia’s democracy. One wonders whether this Winter Kabimba has any brains at all and it seems this man is on a mission to offend as many people as possible. Make no mistake PF will pay a heavy price for this ridiculous behaviour. As General Miyanda has rightly pointed out, if 2011 were fraudulent as Kabimba alleges, why not dissolve parliament and call fresh elections? PF a government birthed in lies.

Mr Miyanda is right. We need to separate part functions from the state functions. We need the new constitution before 2016 so can sort out all the contentious issues. The learned men in the judicial system have failed us because they operate in a corrupt environment and make decisions based loyalty to the appointing authorities.
