A man who is alleged to have filed a complaint in the Lusaka Magistrate Court over the facts disclosed by Edgar Lungu and Jean Kapata in their affidavits to the High Court amounted to a criminal offence has denied ever filing in the complaint.
Austin Katunta told a news briefing in Lusaka Tuesday morning that he never filed a complaint against the duo that the Magistrate was being requested to institute criminal proceedings against the duo.
This is a matter where Mr Newton Nguni is contesting the alleged irregular manner in which the hand over of the Presidency was done on 29th October 2014 following the death of President Michael Sata.
Mr Katunta said facts before court purport that he had sworn and filed the complaint against the duo before the Lusaka Magistrate Court.
“Last week, PF Matero Constituency Chairman Morgan N’gona called me to get my personal details and stated that they needed my details for something that would be discussed or disclosed later. That was the last I heard from him. Then on Saturday, I discovered through the Post Newspaper of Saturday 6th December 2014 and Sunday 7th December 2014 that a complaint had been laid to the Lusaka Magistrate Court about this matter. The report showed that I had raised the complaint to the court,” he recounted.
Mr Katunta added, “I wish to clearly and categorically state that I didn’t complain avout this matter, I didn’t lay complaint to the Lusaka Magistrate Court. I didn’t sign any affidavit, I didn’t give any consent for anyone to use my name.”
He said he is surprised that a complaint was raised in his name adding that this is a serious case of forgery saying anyone who has done this has committed serious offences.
“It is for this reason that I wish to proceed to make a formal complaint to the Police. I find the use of my name without any express authority by way of signing to be a very serious criminal offences and I take strong exception. From my little legal knowledge it is clear that offences such as uttering false documents, forgery and falsely uttering my signatures is perjury in court.”

This guy is blaming one of his own and naming him. He said he found out about it in a newspaper but it appears the matter is in front of the courts.
Am I confused or is he complaining that whatever is in court is a forgery and he knows who is behind it? Reading the comments I am not sure whether we are all on the same page here…
People may feel strongly about my claim that something untoward is going on between UPND and the M’membe lead cartel.
Today we see the ZWD defending Guy Scott and this is adding to the favourable coverage Sampa has been getting of late from the ZWD. The two are known cartel puppets and up until now, sworn enemies of the ZWD. What has changed now?
On the other hand we are not seeing the usual Post Newspaper attacks on HH and his campaigns. In fact we have seen some favourable quotes in “support” of Sampa and attributed to UPND MP, Gary Nkombo.
There is also a concerted attack on Edgar Lungu by both camps.
Could it be that Mahtani is the “common link” and a deal has been struck?

@ It’s a worry – I love conspiracy theories as much as the next guy but here’s an alternative reality…
Maybe the Prez is not such a bad guy (when allowed to breathe) and the newspapers are following the views of their readership (makes financial sense). Concerted attack on ED could just be reality biting (sorry for the PF massive) but he’s campaigning for the top job as a relatively unknown person (high profile entry to the podium via jubilee/funeral doesn’t count) and if he was in the Western world he would be getting a tougher grilling than Zed will ever give him. If he’s kosher he will survive. If he’s not he won’t. Ultimately it is up to how he resonates with voters who might not want to be force fed this time round… just thinking out loud…
