UPND seeks court injunction on the use of the slogan ” Aleisa aleisa”

THE United Party for National Development (UPND) has sought an injunction to restrain MMD presidential candidates Rupiah Banda, Nevers Mumba and Matero Member of Parliament Miles Sampa from using its slogan ‘Aleisa aleisa.’

UPND member Mr Bweembelo Choongo of Lusaka’s Kamwala South stated that the trio should be barred from using the UPND slogan ‘aleisa aleisa’ in the forth coming Presidential election campaigns because it was started by the UPND.

In his affidavit filed in the Lusaka High Court, the plaintiff said the defendants had been using the trade mark which had become so prominent and synonymous among UPND members, sympathisers and voters.

“Seeking an order that the slogan known as ‘Aleisa’ initiated and adopted by UPND as a campaign trade mark should not be used by any of the mentioned above, or any other party in whatever manner,”he said.

Mr Choongo said his party was not happy that the trio had been using the UPND slogan in their campaigns recently without any justification.

He said aleisa slogan was for UPND alone and that it took so much energy and thinking for members to come up with it, which meant that their party president Hakainde Hichilema was coming into power.

“This slogan was initiated in 2011 and is currently being used by UPND, the trio is also using it with a view to sway the UPND supporters and general public which will in turn prejudice the party during the forth coming elections,” Mr Choongo said.

He asked the court to order the defendants to come up with their own slogans which would not be similar to that of the UPND to avoid confusing the members.

While using the slogan, the trio was also waving their right hand on top of their heads exactly the way UPND supporters were doing.

    • UPND need to seek guidance from PACRA re copyright of their slogan. There are some common names where an organisation or individuals cannot have the monopoly over th Intellectual Property Rights (IPR). If UPND have not registered the slogan with the patent office (PACRA), this may not stand in the courts of law(especially the IP law). Going to court may not be the best solution.

    • This move is in response to the injuction which PF filed to restrain UPND from using the song “BUFI” during campaigns.

      If the court does not grant this injunction then, they should set aside the earlier injunction regarding the “BUFI” song.

      That song was a satire and did not make direct reference to PF alone. It was cleverly composed to let people interpret it in ways it applied to them. Unfortunately, most people felt it referred to PF.

      If there is any clear sign of how judiciary had been compromised by PF and the Mmembe cartel, its the banning of the song “BUFI “during campaigns.

      UPND is simply testing the impartiality of our judiciary. Thats it and nothing else.

    • Its all they know best. At the moment, PF hasn’t got a legitimate presidential candidate to stand on 20~1~15 because their convention was a fraudulent. Both Edgar Lungu & Miles Sampa were not elected, whilst the former was imposed upon them just like selecting a class monster oh sorry, monitor. Atleast on the latter however, PF have failed to democratically elect their candidate & this should be taken seriously as a contempt to the tenets of democracy.
      PF is desperate, even embezzling a slogan, shocking!

  17. Boza, this slogan was invented by either ZAMTELL , AIR TEL or MTN. There is this advert in which people shout aleisa aleisa. UPND has pirated this slogan , so I am asking the owner of this slogan to sue UPND. UPND is lying they are not the owner of the trade mark ” ALEISA ALEISA”.

  20. Bring Rupiah Bwezani Banda back. When RB took over,the world over was facing a devastating global credit crunch which needed great economic engineering and mastery for countries to pull through. Many countries fell short but Zambia under RB never saw a single company closing shop.as witnessed in most neighbouring states.

UPND have nothing serious to do!this slogan “aleisa aleisa” is for Nkana FC and not your HH!plus it has no impact on mass voters!the major problem UPND has now is how to attract votes in more than 100 contituencies held by PF and MMD MPs who’re on the ground campaigning for their presidents!councilors and MPs works make a president win since they’re given a task to deliver victory in their areas!so since 90% MPs for UPND are from southern,then winning in other areas where HH has no MPs is almost impossible!   24. …….was this so called ‘trade mark’ slogan registered with any legal organisation..say ECZ..like it is done with party symbols ??….this shall be the simplest case the judge has to throw out without even looking at it….
    in my opinion, UPND are supposed to be excited about it…..imagine in 2011 elections, people shouting ‘don’t kubeba’ while raising a fist at UPND rally….PF would have been excited instead of getting agitated……

  26. I am very disappointed by some of the comments which some people are making based on tribal lines. Why cant we one day start thing like USA residents who don’t know even the meaning of tribes. As long as Presidency will be based on tribal lines, then we should forget about developing the nation. USA is developed because tribal power does not exist. If we Zambians will not be careful, this animal called tribal superiority may generate anarchy if not civil war. May God Help Mother Zambia.

  27. All I see among the above blogers is a general desperation among the PF supporters. Indeed the last kicks of a dying horse. In my own opinion I think HH and Nervers can do better especially if they work together. EL has nothing to offer. He worked closely with Sata and together they made all these decisions that has not brought Zambia out of this poverty. Go HH don’t forget about the health care. Our zambian hospitals are on their knees begging for help.

  28. The term ‘injunction’ in now abused. Even political slogans must go through court injunctions. Zambian courts have now gone to the dogs. I though an aspirant sought for support by selling the manifesto to the electorates, so slogans also can woo support. Any way its a political game.
