Malawi’s ConCourt has put Zambia’s to shame – Sishuwa

Political Analyst Sishuwa Sishuwa has charged that the decision by the Malawi Constitutional Court to nullify the presidential election results has put Zambia’s Constitutional Court to shame.

Malawi’s constitutional court last week annulled last year’s controversial election, which saw President Peter Mutharika narrowly re-elected.

The judge found there had been widespread irregularities in the 21 May vote.

This is the first election to be legally challenged since Malawi’s independence in 1964.

A new vote will take place within 151 days.

Dr Sishuwa said Zambia’s Constitutional Court has a lot to learn from their colleagues in Malawi.

“It annulled Presidential election results, called for a new vote and said the Electoral Commission will bear the petitioners’ costs. There’s even an order to inquire into the Commission’s capacity to run the new poll. Ndiye ma judgement aya,” Dr. Sishuwa wrote on Twitter.

“We have a long way to go to get to a better future, but we must go there,” he said.

And political researcher Dr Neo Simutanyi said there are important lessons to learn from the judgement.

“Mainly, that incumbents can not violate electoral rules, falsify election results and continue in office,” Dr Sishuwa said.

He said the Malawi Concourt has shown that it is possible for an African judiciary to be independent and to fairly and impartially adjudicate electoral disputes.

“Africa is a political laboratory and the Malawian case clearly shows that our political Institutions can function and fearlessly defend the rule of law and democracy,” he said.

“The Malawian Chief Justice said in conclusion: I hope this judgement will work to build the country. I hope Malawian and African citizens understand the import of that statement. As things stand in Zambia the Malawian judgement has put our judiciary to shame,” Dr Sishuwa said.

“Our Constitutional Court is not only incompetent, but an extension of the Executive. Under Lungu political institutions and accountability bodies have been rendered dysfunctional, while rules of the games are rigged in favour of those in power,” Dr Simutanyi said.

“Taking an election dispute to court is a waste of time and money, as the outcome is a foregone conclusion. To imagine that it took Concourt judges almost three years to rule on whether or not Lungu should have handed over power to the Speaker of the National Assembly, a matter which crucially was at the heart of the Concourt inertia following the lodging of the election petition by HH and GBM, shows just the incompetence of our so-called highest court,” Dr Simutanyi said.

Brazil legend Pele is depressed and is too embarrassed to leave his house due to poor health, according to his son Edinho.

The former striker will turn 80 in October, and requires a frame to help him walk after suffering from years of hip trouble.

Many of his recent public appearances have been in a wheelchair, with his son saying that his father is reluctant to leave the house due to his shame about being unwell.

“He’s pretty fragile,” Edinho told Globoesporte . “He had a hip replacement and didn’t have an adequate or ideal rehabilitation.

“So he has this problem with mobility and that has set off a kind of depression. Imagine, he’s the king, he was always such an imposing figure, and today he can no longer walk properly. Only with help. He is very shy, very embarrassed about it.

“It improved a little compared to that recent time when he was in a wheelchair, but he still has a lot of difficulty walking.

“He’s embarrassed, he doesn’t want to go out, be seen, or do practically anything that involves leaving the house. He is reclusive.”

The 79-year-old’s ill-health has previously been reported by Brazilian media.

It was claimed that he had his right kidney removed in 1977, before also stating more recently that he had underwent surgery to remove kidney stones.

Pele appeared in a wheelchair at the 2018 World Cup draw in Moscow, with it also reported that he had collapsed from exhaustion a month later.

The former Santos and New York Cosmos striker played an influential role in Brazil’s domination at international level from 1958-1970, where the country lifted the World Cup on three occasions.

This summer will mark the 50th anniversary of Pele’s third and final World Cup title, where he was a key part of what many believe to be the greatest team of all time when Brazil became world champions in Mexico in 1970.

Pele spent 18 years at Santos, making 1,281 appearances and scoring 1,091 goals – though not all of those came in official matches.

He remains Brazil’s leading goalscorer with 77 and is considered one of the greatest footballers of all time.

Zambia’s continued active participation in major tourism events praised

The United Nations World Tourism Organisation has praised Zambia for continued active participation in major tourism events including the just-ended eleventh edition of the Tourism Investment and Business Forum for Africa.

In a letter to Zambia’s Minister of Tourism and Arts Ronald Chitotela, UNWTO Secretary General Zurab Pololikashvili thanked the Minister for honouring the organization by attending the 2020 Edition of INVESTOUR in the framework of the 40th Edition of the International Tourism Trade Fair of Madrid (FITUR).

Ambassador Pololikashvili said the event was successful, welcoming 200 participants from more than 40 countries of Africa and the World, including 20 African Ministers of Tourism and Heads of Delegations including Reyes Marob, Minister of Industry, Trade and Tourism of Spain.

He said the edition emphasized the UNWTO’s theme of Tourism and Rural Development through round table discussions which also offered the opportunity showcase the diversity of Africa’s creative industry and cultural heritage.

And Mr Chitotela said he appreciates the cordial relation between Zambia and the UNWTO and that he was most grateful to the African continent for giving Zambia a chance to steer the tourism sector to another level during the tenure of chairing the Commission for Africa on Tourism.

He thanked President Edgar Lungu for entrusting him the mammoth task of overseeing the Ministry of tourism.

The Minister said the Zambia Mission in France is doing great job of ensuring the country’s presence at important events including those of the UNWTO that oversees world tourism affairs.

Zambia was among countries that participated at the FITUR and INVESTOUR held on 23rd January 2020.

CTPD concerned with the involvement of Children and Women in Gold Mining in Eastern Province

The Centre for Trade Policy and Development has observed with concern the involvement of Children and Women in unconducive environments were Gold mining is taking place in Eastern Province.

CTPD Extractives Programmes Officer Isaiah Mbewe made the observation during Data collection for a study themed” Appraising the Gold Mining Sector” that the Centre is undertaking in Lusangazi District of Eastern Province.

Mr. Mbewe noted that although Gold mining is a source of the much needed income for communities in such areas, the Centre is concerned that women are involved in the processing and waste disposal of this Mineral resource thereby exposing them to harmful chemicals which have severe consequences on their health.

He stressed that in trying to make a living out of Mining, Women often suffer domestic violence and are forced into prostitution as is the case in one of the Mining sites that the Centre visited in Lusangazi District of Eastern Province.

Mr. Mbewe also expressed concern that Children are working in the unconditional worst forms of Child Labour which include digging and engaging in illicit activities such as prostitution and abuse of drugs.

He has since reiterated CTPD’s call on government to formalize the sector because it plays a critical role in the creation of jobs.

In a statement issued by Information and Communication Specialist Mwaka Nyimbiri, Mr Mbewe also commended the intention by government through ZCCM-IH to formalize the Artisanal Gold Mining with the objective of curbing illegal Mining.

Micho Kicks Off 2-Day Copperbelt Camp

Chipolopolo coach Multin “Micho” Sredojevic has wrapped up day one of his first local players camp since his appointment last week.

The Serbian is holding a two-day camp in Ndola at Levy Mwanawasa Stadium for 63 Copperbelt and Kabwe based players drawn from the Super and National First Division before shifting to Lusaka.

Micho took the Super Division call-ups in the morning session and the second tier players held theirs Monday afternoon.

However, the Zesco call-ups missed Monday’s practice due to their Sunday afternoon league engagement away to Mufulira Wanderers.

Also absent were Kansanshi Dynamos call-ups who are away in Lusaka ahead of Wednesday’s rescheduled Week 15 fixture against Zanaco.

Zambian Government is committed to ending AIDS by 2030-Esther Lungu

First Lady Esther Lungu says the Zambian Government is committed to ending AIDS by 2030.

Mrs Lungu also said Zambia is committed to achieving HIV/AIDS epidemic control by 2021.

She says this has been demonstrated through strong political leadership and commitment for the national response as demonstrated by the engagement and participation of different political and community leaders including President Edgar Lungu.

She cited the establishment of the national HIV Prevention Coalition which is being co-chaired by the Ministers of Health and the Minister of Finance as an effort meant to eliminate the disease.

Mrs. Lungu also said the Government of the Republic of Zambia through the Ministry of Health with its cooperating partners have made remarkable progress in addressing Mother-to-child transmission of HIV.

The First lady further sated the government was committed and had embarked on the process of Elimination of Mother to Child Transmission –EMTCT- of HIV and syphilis in its continued effort to improve health outcomes for mothers and children.

She said the EMTCT of HIV & syphilis National Operational Plan provided guidance for rapid scale up of strategic interventions towards dual EMTCT of HIV and syphilis in the country.

Mrs. Lungu reaffirmed the Zambian Government’s commitment to the core values and principles of the United Nations and the Sustainable Development Goals.

The First lady said this in a speech read on her behalf by Ministry of Health Assistant Director Cancer Prevention, Dr. Sharon Kapambwe during Organization of African First Ladies for Development (OAFLAD) summit in Addis Ababa, Ethiopia.

Malanji to represent President Edgar Lungu at Funeral of former Kenyan President, Daniel Arap Moi

Foreign Affairs Minister Joseph Malanji will represent President Edgar Lungu at the State Funeral Service of former Kenyan President, Daniel Arap Moi.

Mr Malanji has since left Addis Ababa Ethiopia for Nairobi, Kenya.

The Funeral Service will be held at Nyayo Stadium on Tuesday 11th February 2020.

He was seen off by at Bole International Airport by Zambia’s Ambassador to Ethiopia and Permanent Representative to the African Union Emmanuel Mwamba.

This is contained in a statement issued by Inutu Mwanza, the First Secretary for Press and Tourism at the Zambia Embassy in Addis Ababa Ethiopia.

Mr Malanji was in Ethiopia to represent Zambia’s President Edgar Lungu, at the 33rd Ordinary Session of the Assembly of Heads of State and Government of the African Union (AU).

He was accompanied by Minister of Commerce, Trade and Industry Christopher Yaluma, Minister of Justice Given Lubinda and other senior Government officials.

Zesco United Coach George Lwandamina insists they have not turned the corner despite a two point gap between the defending league champions and the leaders.

The defending FAZ Super Division champions on Sunday beat last placed Mufulira Wanderers 2-0 away to collect their second league victory in 2020 after winning just one and drawing one of their last six matches since the start of the new year.

That run of results saw Zesco tumble from first to fifth before making a modest gain to go to number four after the victory at Wanderers on February 9 at Shinde Stadium in Mufulira.

“No, we will be dealing with our own games and we don’t have to be looking at what is happening elsewhere,” Lwandamina said.

Zesco ‘s first win of 2020 was on January 22 when they beat neighbours Buildcon 2-1 away in a Ndola derby before losing by the same margin on the road to Kabwe Warriors and drawing 0-0 at home last weekend against struggling Nakambala Leopards.

“Sometimes playing at home comes with its own advantages and disadvantages,” Lwandamina said.

” Sometimes players play under pressure going by the way we have been playing.

“So today, playing away from our faithful supporters, we got the desired result.”

Two late goals from Winston Kalengo and John Makwatta in the 84th and 88th minutes respectively saw Zesco move to 38 points from 19 games.

Fourth placed Zesco are now two points behind leaders Green Eagles who have played 20 games with thirteen fixtures left after round 21.

Inspector General of Police Kanganja dismisses reports of “gassing” in Lusaka

Inspector General of Police Kakoma Kanganja has dismissed information circulating on social media in which it is being insinuated that most parts of Lusaka have been affected by the gassing.

Mr Kanganja said in as much as the Zambia Police in Lusaka have received reports of gassing from members of the public, the claims are yet to be verified.

He said when complaints of alleged gassing were received by police in Lusaka, officers went on the ground to verify the reports and are still inquiring on the same reports.

“In view of similar occurrences being recorded in some parts of the country, my advise to members of the public across the country is for them to be security conscious and work in collaboration with the police in safeguarding their respective communities”, he said.

Mr Kanganja said Police are working round the clock to see to it that all perpetrators of this crime are brought to book.

He said from the time this crime emanated, some suspects have been apprehended of which some are currently appearing in the courts of law while investigations have continued with a view of apprehending all those involved in this heinous crime.

Mr Kanganja has urged all members of the community who could have security concerns in their communities to seek audience with Officers in Charge of Police Stations so that the concerns are quickly addressed.

“I also wish to inform the general public that results of chemicals being used in gassing households are out, however, my Command has decided not to announce the chemical for security reasons. Announcing the chemical may mean giving information to other criminals”, the Police chief has said.

Mr Kanganja said he fully understand the fear in members of the public concerning the current occurrences and appealed to them to remain calm as the police are doing everything possible to avert the situation.

He further appealed to members of the public to avoid taking the law into their own hands but report or surrender any suspected persons to law enforcement officers.

Mr Kanganja reiterated that the Zambia Police Service is doing everything possible to establish the motive behind this crime and ensure that all perpetrators who include those orchestrating the crime are brought to book.

He said the Zambia Police will be giving updates to the public just like we have always been doing on the occurrences as well as security tips.

Human Rights Commission calls on PF to provide leadership against tribalism

Human Rights Commission Chairperson Mudford Mwandenga has called for any end to continued hate speech based on one’s ethnic or tribal orientation because it is a violation of human rights.

Mr Mwandenga said the smear politically motivated campaigns targeted at individuals on account of their tribe or place of origin is discriminatory and unconstutional.

He said the right to equality and protection against any form of discrimination, including based on one’s tribe, is quaranteed under Article 23 of the Constitution of Zambia, Chapter 1 of the Laws of Zambia and must be respected by everyone.

He particularly called on the PF Leadership to provide effective leadership against tribalism by publicly censuring or reprimanding their leaders and members engaging in hate and tribal remarks.

Mr Mwandenga said tribal remarks constitute hate speech and is also prohibited under the Public Order Act because in addition to being a violation of human rights, it is a recipe for breach of national peace, unity and stability.

He called on everyone not to sacrifice respect for human rights, national peace, unity and stability for selfish and unsustainable political gain.

Mr Mwandenga has further advised that if no practical measures are taken to curtail tribal hatred which is becoming systemic, it may reach the threshold of a crime against humanity.

He said perpetrators of tribal hate speech must be reminded that tribe, like race, is a birth right and therefore, so fundamental a human right that its violation may ignite deep rooted negative consequences for the country.

“In some countries tribal hatred caused widespread discrimination, conflict, civil war and genocide. It is for this reason that tribal hatred and discrimination should not be tolerated or seen as a matter of mere politicking”, he added.

Mr Mwandenga called for the upholding of the “One Zambia, One Nation”, in words and practice for continued national unity, peace, respect and protection of everyone’s rights and freedoms.

Hailstorms destroy over 60 houses and maize fields in Samfya

Over 60 houses have collapsed in Samfya district of Luapula Province following a hailstorm and heavy rains that have left several families without food and shelter in Chief Kasoma Bangweulu’s chiefdom.

The hailstorm has also left over seven people injured with two in critical condition at Mansa General Hospital.
Samfya District Commissioner Mr. Nason Bwalya in the company of the District’s Disaster Management and Mitigation Committee was on hand to assure the affected residents of governments support.

Mr. Bwalya assured the affected residents that the President has been informed and is aware of the disaster.

“We have not come here empty handed as we know of the hardship that has befallen the people of Kafita Village and the president has been informed that is why we are here to do a comprehensive report to assess the situation and send it to higher offices in Lusaka,” he said.

The district commissioner then proceeded to spearhead the distribution of 400 bags of 12.5kg mealie meal from the Disaster Management and Mitigation Unit (DMMU) to the affected residents of Mpata and Chimembe areas of the district.

One of the affected residents Chama Yowa has appealed to the government and disaster management and mitigation unit to help the affected families with shelter and food as they not only lost their houses but their crops as well to the hailstorm.

Government’s quick response with relief food has also been thanked by the affected residents with the Katanshya Ward councilor Medard Chama also thanking Bangweulu Member of Parliament Anthony Kasandwe for quickly providing the logistics needed for delivering the relief mealie meal to the ward.

It is clear that the destruction left in the wake of this hailstorm needs more attention from the Disaster Management and Mitigation Unit as most of the residents have lost their shelter and in some cases their sources of livelihood.

IBA warning to broadcast stations: a case of blaming the messenger

Recently the IBA issued a warning to broadcasting stations against using social and online media as sources of news and agendas. This was ostensibly in reference to the Seer 1 story which has gripped the country. In its statement dated 1 February, 2020, the IBA Director General Josephine Mapoma is quoted as having warned that some social media stories could “compromise the unity and security of the nation.”
Ms. Mapoma further said that the Authority had observed “with concern the growing tendency and excitement by some broadcast stations to rely on unverified social media stories” and that the IBA expected broadcasting stations to be professional and avoid deliberate moves aimed at ignoring conditions for which their licenses were issued. Broadcasting stations “have a duty to abide by the IBA Act and other broadcasting regulations”, the statement further read.

The mandate of the IBA to scrutinize and censure erring media houses is not in contention. What is highly questionable in this instance is the Authority’s interpretation of the series of events and subsequent media frenzy around the matter. The IBA is blaming the media houses for picking the issue from social media and, in its interpretation, escalating it by either continuously making reference to it or providing platforms for debating it in some cases in what it describes as laisse faire attitude.

Notwithstanding the professional obligation for the media houses to analyse and sieve the raw material they receive and subsequently publish or broadcast, in this case blaming them for picking the Seer 1 story from social media and escalating it as a diary idea is not wholly justified. For starters, one of the long-held media theory is that they reflect or are a mirror of society. In this particular case the media were simply seamlessly reflecting the discourse and frenzy that had gripped the nation over the Seer 1 story, the evidence of which was the reactions of the top government officials on the subject.

Instead of killing the story Sumaili somewhat escalated it with her revelation that government was taking the matter seriously and doing something about it.

The second principle we can use to discern the media reactions is what is called agenda setting, with its various forms. One form, media agenda-setting, presumes that the media have an agenda that they ‘sell’ or impose on the audiences or society at large, “That is, if a news item is covered frequently and prominently, the audience will regard the issue as more important”. It further argues that, “media concentration on a few issues and subjects leads the public to perceive those issues as more important than other issues.”

Conversely, public agenda setting, the second form, implies that the media reverberate and are influenced by the public’s agenda. I would argue that this was the case on the Seer 1 issue. The public set and escalated the Seer 1 agenda. The media cannot be said to be culpable for running with the public agenda especially when that ‘public’ includes high ranking public officials, including an official government spokesperson. If the same media did not cover the statements by the government officials, they would be accused of dereliction of duty, or worse still repudiated in the case of government-controlled media. As the saying, what goes around comes around.

For instance, in an article titled, “Sumaili washes hands on Seer 1: I can’t confirm if anyone got his power”, News Diggers dated 31 January 2020, quoted National Guidance and Religious Affairs minister Reverend Godfridah Sumaili as having told a press briefing in Lusaka, on 28 January 2020, that it was difficult for her to confirm or deny claims by Nigerian prophet Andrew Ejimandu, popularly known as Seer 1, that he gave some members of the Patriotic Front party and government some “powers” to win the 2016 elections. “First, I can’t confirm that he didn’t give something to somebody; these are personal transactions; they are usually done in privacy. So I can’t confirm but I just want to say something that he has acknowledged that the powers that he uses are powers from the darkness,” she is quoted.

Instead of killing the story she somewhat escalated it with her revelation that government was taking the matter seriously and doing something about it. “Obviously, we have to work as government; we have to work as Ministry of National Guidance and Religious Affairs; we have to work with the Ministry of Home Affairs; we have to work with the Ministry of Foreign Affairs to ensure that something is done because he cannot not just stand there and start demeaning our governance and even accusing people of having taken his things.” Other statements came from the likes of Given Lubinda (Justice Minister), Nkandu Luo and Stephen Kampyongo (Home Affairs Minister) and others.

Therefore from an agenda-setting trajectory, to a large extent the media were simply responding to and reflecting the agenda set by those in the high levels of our society who dealt with the matter. They were mere messengers of the message and national agenda and discourse.
The IBA also repudiated the mainstream broadcast media for sourcing news stories from social media. News Diggers (30 January 2020), also reports that, “the authority has also noted the high levels of laissez-faire attitude among some broadcasters, leading to more Phone-in programmes that are heavily dependent on issues from social media.”

To put it into perspective, the Authority was referring to what is known as intermedia agenda setting. It is defined as “a dynamic and routinized process of news diffusion, where coverage of one media outlet is influenced by the agenda of other outlets” (Vliegenthart & Walgrave, 2008). In simple terms, it a process whereby a media organization or system picks news (diary) ideas from another (opinion-leader’) news medium or systems (e.g. social media).

While intermedia is as old as the journalism profession itself, it has become more pronounced over the last decade of social media and growth of online-only newspapers. It is one of the fastest growing fields of scholarly research. Empirical data so far unanimously shows that social media are a growing source of news ideas and narratives for mainstream media.

The Authority is right to suggest that mainstream journalists ought to exercise news judgement in dealing with social media news. However, the already high use and omnipresence of social media platforms makes it harder for media houses to resist the reality of intermedia agenda setting.

Empirical data asserts that one of the conditions when mainstream media find it hard to resist the influence of social media agenda setting is when an issue in the spotlight is “inherently more obtrusive than others” (Soroka, 2002; Zucker, 1978) and observable or followed by more people and thus making independent reporting hard. More so if high ranking opinion leaders in society are among the followers and debaters of a story, as was the case with the Seer 1 story.

The media’s closing argument would be that the Seer 1 story hit the Zambian news market through a video on social media. It was then picked from there and escalated by the public officials through official statements that made news for the mainstream media. According to the age-old criterion for news value judgment, the mainstream media are exculpable for covering the story as it evolved and grew. In the bigger scheme of things, the whole saga also speaks to the need to allow the media, regardless of their ownership, to develop their own interpretative capacities, which is a requisite virtue of journalism, Case closed.

UPND accuse Bowman Lusambo of publicly characterizing of HH as a Satanist

The UPND on the Copperbelt has reacted angrily to what they have termed as insults and hate speech against its Leader Hakainde Hichilema by Kabushi PF Member of Parliament Bowman Lusambo.

UPND aspiring candidate for Kabushi Anthony Bwalya says Mr. Lusambo has no right to come to Kabushi Constituency and insult the collective intelligence by importing cadres into Lubuto Ward only to come and discuss the persona of Mr Hichilema at the expense of real issues affecting the people.

Mr Bwalya has also rejected as mentally challenged and uneducated Mr. Lusambo’s public characterization of Mr. Hichilema as a satanist because Mr. Lusambo has no basis to prove his wildly fabricated fantacisies.

He has reminded Mr. Lusambo that the people of Kabushi no longer have time to listen to morally bankrupt politicians whose mild perception of reality drives them towards the public desecration of political opponents as a way of canvassing public support.

Mr Bwalya said Mr Lusambo no longer represents the standard and quality of leadership befitting of the people of Kabushi because under his leadership, the people of Kabushi have lost an opportunity to improve public infrastructure such as roads, clinics, schools and other social amenities; with Constituency Development Fund resources squandered for his own political ambitions.

He has therefore challenging Mr. Lusambo, to cause the publication of report, accounting for ALL CDF resources Kabushi has received since he assumed office, as well as detailing all the projects associated with CDF expenses in the period 2016 – 2019.

Mr Bwalya said the people of Kabushi are passionate about accountability and will not allow Constituency resources to be squandered for political purposes.

He added that the people of Kabushi do not want funeral vehicles but investments in local healthcare, local education and local business development.

Zambia must aggressively fight and stop the coronavirus from entering the country – Nevers Mumba

A few hours ago, I flew into Kenneth Kaunda International Airport. I am alarmed at how casually we are handling passengers coming from China. The measures put in place to fight the Coronavirus are totally inadequate and pose a great danger to the nation’s safety.

Zambia must win this war at the prevention stage and not at the treatment stage. The size of our economy cannot sustain a full fledged fight of the virus once it starts to spread in the country. Our only hope is to be uncompromising in the manner we handle those coming into Zambia from China and any destination where the virus has started to spread.

We advise that anyone who has visited China in preceding 14 days must be quarantined at a special location so chosen for such a purpose for a period of time.

Zambia must invest in top of the range testing equipment and treatment kits. This is where we should be prepared to spend as a nation. Until more information on the spread of the virus is available, we must not leave any stone un turned. We must NOT allow the Coronavirus entry in Zambia. We can’t afford it. We should be bold enough to shut down some businesses in public interest.
