MMD victory should be a reminder PF to concentrate on promise delivery and not by-elections creations-Nevers

MMD president Nevers Mumba has said that his party’s landslide victory in the Mkaika parliamentary by-election is a clear signal to the Patriotic Front that the people of Zambia are upset and want action and not mere talk.

Dr Mumba told QFM in an interview that if the PF had doubts following its losses in the Solwezi East,Chipata central and Kafulafuta by-elections, the loss in Mkaika should remove every doubt that Zambians are upset with them.

He said that the people of Mkaika have handed the MMD a landslide victory because they have realized that the PF cannot perform.

He added that the MMD victory should be a reminder to the PF to concentrate on delivering on the promises they made to the people and not creating by-elections.

Dr. Mumba says the Patriotic Front should go back to the drawing board and put their house in order before things get even worse for them.

He said that despite the MMD victory he believes by elections are unnecessary at this time.

The MMD president said that he hoped the losses suffered by the PF will make them realize that the induced by-elections to prove their popularity are not helping the Zambian people.

And United Party for National Development (UPND) deputy Spokesperson Cornelius Mweetwa has said that his party is happy with the victory of the MMD.

He said that the victory should send a strong message to the PF.

Mr Mweetwa has since congratulated the MMD on their victory in Mkaika, adding that the victory is a clear indication that the people of Zambia are fed up with the PF’s poor governance style and stagnant economy.

Meanwhile, MMD has said its victory in the just ended Mkaika constituency parliamentary by-elections was a lesson to other political parties in the country.

MMD Deputy National Secretary Chembe Nyangu said Mkaika constituency and Eastern province as a whole was its stronghold.

Mr. Nyangu said what has happened in Mkaika was evidence enough that the former ruling party stood a high chance of bouncing back into power in 2016 which he said was just around the corner.

“This is just a warning signal. MMD will no doubt bounce back to power come 2016. Zambian people have seen that it is only the former ruling party which is able to bring development for their benefit,” he said.

He said MMD was a peaceful party which does not subscribe to violence adding that even during its heated campaigns, the party conducted issue based strategic campaigns.

And deputy Minister of Home Affairs Stephen Kapyongo, who was one of PF campaign team members in the area conceded defeat in the just ended Mkaika parliamentary by-elections in Eastern province.
Mr. Kapyongo said his party accepts the verdict of the people in Mkaika constituency.

Meanwhile, Foundation for Democratic Process (FODEP) Executive Director Macdonald Chipenzi said the outcome shows the will of the people in Mkaika.

Mr. Chipenzi said the result was good for a democratic country such as Zambia where people were free to exercise their right to vote for their preferred candidates.

“The people of Mkaika have spoken. This is good in democracy in a young nation like Zambia,” Mr. Chipenzi said.

He said his organization will be looking forward for peaceful campaigns in the future Petauke Central, Mulobezi and Malambo parliamentary by-elections slated for September 26, 2013.

And Ant-Voter Apathy Programme Director Richwell Mulwani said it was good that the people of Mkaika have again ushered into National Assembly a Member of Parliament of their choice.

Mr. Mulwani said his organization was impressed with the voter turnout during the Mkaika parliamentary by-election.

He urged electorates in the three in future by-elections in Malambo, Petauke Central and Mulobezi constituencies to emulate the people of Mkaika and vote in large numbers for their preferred candidates.

The opposition Movement for Multiparty Democracy (MMD) won the Mkaika constituency parliamentary seat in a by-election that was held yesterday with its candidate, Peter Phiri getting 9,054 votes against his closest rival, David Phiri of the ruling Patriotic Front (PF) who trailed with 1,712, representing a difference of 7342 votes.

National Restoration Party (NAREP) candidate, Nigel Mpakateni came third with 161 votes while Nelson Mwale of the United National Independence Party (UNIP) brought the rear with 136 votes.

Mkaika constituency has 34,174 registered voters but only 11,305 voted yesterday with 242 votes being rejected.

The Mkaika parliamentary seat fell vacant after the then area MP, David Phiri resigned from the MMD to join the ruling PF on which he re-contested the seat.

ECZ to carry out nomination exercise despite Attorney General’s appeal

The Electoral Commission of Zambia (ECZ) will go ahead with conducting the filing in of nomination papers in Petauke Central, Malambo and Mulobezi constituencies next week despite government appealing against High Court decision to allow Dora Siliya, Maxwell Mwale and Hastings Sililo to re-contest the three seats.

The ECZ set Tuesday September 10 for filing in of nomination papers by interested candidates and September 26, 2013 for the by-elections in the three constituencies.

ECZ Public relations Manager Cris Akufuna told ZANIS in Lusaka today that the commission remains committed to the programme which was announced some few days ago ahead of the three by-elections in Petauke Central, Mulobezi and Malambo constituencies respectively.

Mr. Akufuna said the ECZ was ready to conduct the exercise noting that all logistics were in place in readiness for the filing in of the nomination papers on Tuesday, September 10, 2013.

Yesterday, Attorney General Mumba Malila appealed against the High Court’s decision to allow former Petauke Central Member of Parliament (MP) Dora Siliya and two others to re-contest by-elections in three constituencies.

Mr. Malila, who is appealing against part of the judgment delivered by Judge Mungeni Mulenga on September 3, 2013 said the judge overstepped her boundaries when she issued a global order requiring ECZ to accept the nominations papers from Ms. Siliya, former Malambo MP Maxwell Mwale and former Mulobezi MP Hastings Sililo.

He has in his memorandum of appeal to the Supreme Court filed four grounds on which he is basing his arguments.

Mr. Malila said Ms. Justice Mulenga erred in law and fact when she held that Supreme Court judgments were binding on all parties including ECZ when she refused to give effect to the Supreme Court judgments which upheld the nullification or nullified the elections of Ms. Siliya, Mr. Mwale and Mr. Sililo to the National Assembly on the basis that the trio had been involved in corrupt or illegal practices.

He further said the lower court was wrong in law and fact when it held that ECZ was only mandated to act on the report issued under section 104 (6) of the Electoral Act number 12 of 2006 to take the action outlined in section 22 of the Act barring persons from contesting for any position for a period of five years.

Mr. Malila also argued that this was notwithstanding the fact that the law does not require the Supreme Court of Zambia to render a report to the ECZ upon its nullification of a seat on the basis of corrupt or illegal practices.

Additionally, Mr. Malila said the Judge was wrong in law and fact as she overstepped the boundaries of the case by issuing a global order requiring the ECZ to accept the trio’s nominations.

This he said was notwithstanding the fact that there were other criteria and qualifications other than participation in illegal and corrupt practices required for the acceptance of such nominations.

Ms. Justice Mulenga on Tuesday quashed the decision of the ECZ that purported to bar the trio from re-contesting their seats and ordered the electoral body to accept nomination papers from them on the date it would set.

MINES, Energy and Water Development Minister, Christopher Yaluma is facing a lawsuit for failing to pay more than K480,000 for accommodation at Lusaka’s luxurious Fallsway Apartments.

It is alleged that Mr Yaluma spent 203 nights without paying for accommodation services. Vali’s Properties Limited a company engaged in accommodation and hospitality services has since asked the Lusaka High Court to order the Minister to pay the total sum of K488, 980.61 owed to it.

The money was for accommodation services offered to Mr Yaluma on various dates between June 2012 and March 2013. The company was also demanding for payments of damages for breach of agreement for payment of bills, interest , costs and any other relief the court may deem fit.

It stated in a statement of claim filed before the principal registry that on about June 4, 2012, Vali’s Properties Limited and Mr Yaluma orally agreed that the minister would occupy one of its three bed-roomed villas known as Fallsway Villas. Meanwhile five retired Zambia Army soldiers have sued Government for unlawful termination of employment.

Andrew Phiri, Mathew Bwalya, William Phiri, Lameck Haambole and Geoffrey Bwalya have sued Attorney General Mumba Malila for wrongful termination of employment in the alternative, damages for breach of contract.

The soldiers stated in their statement of claim filed in the Lusaka High Court that they were at all material times retired soldiers of the Zambia Army based at Arakan barracks in Lusaka.

They said on various dates between January 2010 and July 2010 they were reengaged in the Zambia Army on contracts for one year period in accordance with the Attorney General instructions which regulated the terms and conditions of service for officers and warrant officers re-engaged on contract.

The five said they diligently performed their obligations under the contracts until sometime in May 2010 when the defendant through the newly appointed Army Commander unilaterally and without any notice or inquiry terminated their contracts.

The termination was based on allegations that the contracts were not supported by any piece of legislation including the Defence Act chapter 106 of the Laws of Zambia.

The opposition Movement for Multiparty Democracy (MMD) has retained the Mkaika Parliamentary seat.

MMD’s Peter Phiri has polled in 9 054 votes to beat his closest rival David Phiri of the Patriotic Front (PF,) who is in the second place with 1 712 votes.

In third place is Nigel Mpakateni of the National Restoration Party (NAREP) with 161 votes followed by Nelson Mwale of the United National Independence Party (UNIP) in the fourth position with 136 votes.

The Mkaika constituency had 33 polling stations in which 11, 295 votes were cast.

A total of 232 votes were rejected.

The Mkaika by-election came about after PF’s David Phiri, who was then an MMD member of parliament and deputy Minister in the PF government, defected to the ruling PF.

THE African Parliamentarians Network Against Corruption (APNAC) has described as magnanimous Minister of Home Affairs Edgar Lungu’s decision to cancel the US$210 million contract awarded to ZTE Corporation for the supply of the public security safety network.

And Transparency International Zambia (TIZ) has demanded that officials who negotiated for the contract be suspended immediately.

APNAC says the tender process was allegedly characterised by corruption.

On Wednesday, Mr Lungu terminated the contract awarded to ZTE Corporation to pave way for investigations following allegations of failure to comply with procurement regulations, requirements and processes.

APNAC chairperson Cornelius Mweetwa said in Lusaka yesterday that the minister should have taken action long before Wednesday.

“I want to commend the minister of Home Affairs for his magnanimity to cancel the contract, which was surrounded by corruption,” he said.

Mr Mweetwa, who is UPND deputy spokesperson, said the Anti-Corruption Commission (ACC) should have been proactive in detecting the corrupt activities that surrounded the awarding of the contract and provide the minister with necessary information.

He said the ACC should not wait for the minister to commence investigations because it is their responsibility and mandate to investigate such matters.

“If the ACC will always wait to be reminded to do its work, then we will start questioning their relevance,” he said.
TIZ executive director Goodwell Lungu said in his letter to Mr Lungu dated September 5 that suspending the officials will pave way for smooth investigations by the ACC.

“The TIZ demands that all the officials who took part in the signing and negotiating of this deal, regardless of their status and position, be suspended with immediate effect,” he said.

“By copy of the letter, we wish to inform you that the TIZ has handed over a 57-page dossier of evidence to the ACC on this matter for action,” he said.

Mr Lungu said the government officials should desist from engaging in wasteful secret procurement deals.

Mr Malila said the Judge was wrong in law and fact as she overstepped the boundaries of the case by issuing a global order requiring the ECZ to accept the trio’s nominations.

This he said was notwithstanding the fact that there were other criteria and qualifications, other than participation in illegal and corrupt practices required for the acceptance of such nominations.

Preview: Renard-We will Cope

Herve Renard says Zambia will cope in Kumasi despite a turbulent last 48 hours en route for Friday’s big World Cup qualifier showdown against The Black Stars.

Zambia on Friday face their biggest test on the road to Brazil when they attempt to pick up their first away win in the Group D qualifiers that will hand them a place in the final super 10 playoff round that kick off in October.

Herve Renard’s side has drawn away to Lesotho last March and lost to Sudan in June, 2012 before that result in Khartoum was erased after the latter used an ineligible player in that qualifier.

How Zambia will adopt after a grueling 48 hour delay following two chaotic departure delays in Johannesburg and Lusaka will be interesting to witness.

Zambia has barely trained and upon arrival in Kumasi on Thursday could not train from the match venue due to ‘security concerns’ by the host country.

“It has been a difficult trip during the last few days. It’s our fault we came late, but we will cope,” Renard said in Accra upon arrival.

“We have no option than to win. We have to win, and the venue doesn’t matter.

“There is a difference in the quality of players, and where they are playing. When big names play for each other and are united, you always are the favourites.”

Meanwhile, Zambia come into the game limping with no shows for key strikers Jacob Mulenga and Collins Mbesuma due to injury and who have scored three and two goals respectively in the Group D qualifiers.

However, very little has been said about midfielder Rainford Kalaba who has suffered from poor form in Zambia’s last two games.

Kalaba has enjoyed a resurgent of form at Mazembe and last Sunday secured a 1-0 win for DR Congo giants in a 2013 CAF Confederation Cup Group B win over CA Bizertin of Tunisia with a late breathtaking solo goal that saw him beat four players.

Finance Minister Alexander Chikwanda is tomorrow expected in Mongu district, Western Province to officially open Investrust Bank Plc.

Mr Chikwanda is expected to arrive at Mongu airport at 08:30 hrs on Friday.

The minister will first pay a courtesy call on his royal highness the Litunga Lubosi Imwiko II at Lealui Royal Palace upon arrival.

He is also expected to tour some developmental projects in the Province such as the Mabumbu Cashew Plantation and inspect winter crops grown in the Barotse plains.

ZANIS Business reports that this is contained in a statement given to ZANIS by Western Province Permanent Secretary Emmanuel Mwamba.

Mr Chikwanda will be in the Province for a one day visit.

Meanwhile Invest Trust plc Managing Director Friday Ndlovu has described the province as potential in terms of business.

Mr Ndlovu said the bank will be extended to other provinces in the country and called for support in reaching out to the other areas.

He was speaking this afternoon when he paid a courtesy call on Western Province permanent Secretary Emmanuel Mwamba.

And Mr Mwamba commended Invest Trust PLC for bringing development in the province, citing that Western Province is under banked.

The PS added that Western Province has been ranked as the poorest province in the country, adding that the modernised bank will change the picture of the province.

Mr Mwamba said the opening of the bank is a clear indication that Invest Trust supports what government is doing in developing the province.

The PS further added that western Province is also entitled to equal measures and shares just like other provinces in the country.

Government has accorded a State Funeral to Minister of Information and Broadcasting Services and Chief Government Spokesperson.

ZANIS reports that Secretary to the Cabinet Roland Msiska revealed the development in a statement this evening.

Dr. Msiska said d this is in accordance with the Guidelines on State Functions.

Mr. Sakeni died in Lusaka this afternoon at the age of 56, at the University Teaching Hospital (UTH).

The Late minister was also Mansa Central Member of Parliament and the Party’s Chairman for Luapula Province.

The late Mr. Sakeni was transferred to the Ministry of Information and Broadcasting Services as Minister on 6th July, 2012, from the Ministry of Home Affairs where he served in the same capacity.

Funeral for the late minister is being held at his residence in Lusaka at House Number 5369 Brentwood Drive in Woodlands

According to Dr. Msiska, Burial arrangements will be announced later.

Government has announced that the tender for the installation of Closed Circuit Television (CCTV) cameras on the streets of Lusaka awarded to to Zhongxing Telecom Services (ZTE) of China has been terminated to pave way for the investigations.

Announcing the termination in a statement today, Home Affairs Minister, Edgar Lungu said that he has communicated to the Anti-Corruption Commission (ACC), the Auditor General and the Ministry of Justice to scrutinise the contract following allegations of single-sourcing the contractor.

The contract involving ZTE and the Ministry of Home Affairs was for the Public Security Safety Network Phase III project also called the Safe City Project.

Mr Lungu said the contract termination follows mounting allegations of non-compliance to standard regulations in the manner it was awarded.

Mr Lungu said that following the allegations of failure to comply with the procurement regulations, requirements and processes, Government had decided to terminate the contract.

“The Ministry of Home Affairs wishes to inform the public that in view of the various allegations made in the manner in which the Ministry entered into a contract on the Safe City Project, the manner in which the contract for the Phase III Project was awarded to ZTE by the Ministry of Home Affairs be referred to the ACC and the Auditor General for thorough investigations,” he said.

Zambeef gives ZNBC K70,000 to broadcast live Zambia-Ghana match

Zambeef Products PLC has given the Zambia National Broadcasting Corporation (ZNBC) K70,000 to enable the corporation to broadcast live the crucial World cup qualifier match between Zambia and Ghana tomorrow evening.

Zambeef handed over the funds to ZNBC yesterday, Wednesday September 4, 2013 in an exclusive deal that will also ensure that millions of radio listeners throughout the country listen to live commentaries of the match on the radio on Friday September 6, 2013.

Zambeef Group Head of Marketing Perry Siame said the radio platform reaches the most remote parts of Zambia and will give ordinary Zambians who do not have television sets an opportunity to catch live commentary on critical national team matches.

Siame said as per tradition, Zambeef will continue to take the lead on these soccer radio commentary sponsorships.
He said this year alone, the meat company has sponsored a number of live matches including all the Zambian matches that were played during the COSAFA cup.

Siame said in a statement released to ZANIS in Lusaka today that Zambeef sees its support for match broadcasts over the years as a means of giving back to the country and the customers who have helped build the company over the last 18 years.

And ZNBC Sales Director Peter Shula thanked Zambeef for once again coming on board to assist the corporation acquire broadcast rights to televise the game live from Ghana.

Shula noted that Zambeef has a track record of supporting the company’s soccer broadcasts, and that as a corporation, ZNBC was delighted to welcome Zambeef onside again for the important match.

He said the company exemplifies the spirit of teamwork that is necessary to beam international games to households countrywide.

Chipolopolo play Ghana’s Black Stars in the 2014 FIFA World Cup Group D qualifying decider in Kumasi, Ghana, which kicks off at 18 hours Zambian time on Friday.

In what promises to be a thrilling match, Zambia must win to qualify for the final play-off stage of the Africa zone 2014 FIFA World Cup qualifiers.

The Black Stars currently lead Group D with 12 points, one more than Zambia.

Opposition NAREP concerned on the levels of malpractices in Mkaika

Opposition National Restoration Party (NAREP) says it is concerned with the levels of electoral malpractices being witnessed in the ongoing Mkaika by-election.

NAREP National Secretary, Jevan Kamanga says his party is aware of the vote buying that is taking place in Mkaika.

He alleged that the ruling PF was paying money to the voters and promised to give them more if the party wins the Mkaika seat.

ZANIS reports that this according to a statement made available in Lusaka today by Mr. Kamanga.

Efforts to get Acting Government Spokesperson Fackson Shamenda was not immeadiatly available for comment on the matter as his mobile phone was switched off by broadcast time.

However , the opposition party’s National Secretary said his party finds this very unfortunate in a democratic state and hopes that the Electoral Commission of Zambia and the Police will investigate this matter and bring the culprits to book.

Rev. Kamanga said the party has been informed that some PF party members were last night giving K500 to groups of 20 people of Mkaika in exchange of their voters cards.

He said the party is also aware of the areas they are targeting in a bid to lessen the votes of the other candidates.

Rev. Kamanga wondered what the ruling PF thinks they will benefit from these actions saying it’s now very well known to everyone that the PF will do anything it takes to win the election.

He further reminded the PF that they cannot fool the Zambian people forever.

Rev. Kamanga said the people of Zambia are more important than a by election and the PF must start treating the citizens of this country with the respect they deserve.

He said the PF will not become popular by buying votes from the people as people will instead realize how corrupt they are.

Rev Kamanga has also advised the Zambian people especially the youths not to be used by selfish politicians.

“As a party that truly cares about the people of this country, NAREP will remain committed to doing the good things and will not resort to vote rigging or any such behaviour that will compromise with our party principles”.

MMD members assaulted by suspected PF cadres in Katete

Three opposition Movement for Multi Party Democracy (MMD) carders were last evening assaulted by suspected Patriotic Front (PF) cadres in Katete District at Tikondane Lodge near St Francis Hospital.

ZANIS reports from Katete District that Eastern Province Police Commissioner Grace Chipalila has confirmed the development in an interview, today.

Ms. Chipalila named the three as Abraham Zulu an MMD counselor, Jeremiah Njovu and Micheal Phiri elder brother to Patriotic Front Candidate David Phiri.

The trio were allegedly beaten up by cadres suspected to be from the ruling Patriotic Front after they were followed to Tikondane lodge at around 23 hours last night.

The police commissioner said police has however not made any arrests to this effect as the victims have failed to identify the suspects.

Ms. Chipalila has however assured Katete resident of enough security in the district during and after the polls.

And Patriotic Front Candidate David Phiri who is the young brother to Micheal Phiri said has dispelled assertions linking him to the assault incident.

Mr. Phiri told the media in Katete t his father’s residence that he has not been in contact with his brother for some time and only met him yesterday when he went to pick his vehicle at their fathers’ house.

He said he is aware that his elder brother belongs to the opposition MMD and that he has no problem with his brothers’ decision.

He noted that every person has the right to join a party of their choice.

Meanwhile Defence Minister Geoffrey Mwamba has condemned the action by the alleged PF cadres.

Mr. Mwamba said it is wrong for anyone to take the law in their own hands adding that the three should have been taken to the police for further action after they were found in the act.

He said the PF has always insisted on maintaining peace during its campaigns.

He added that it is however unfortunate that the MMD cadres went on to campaign after the close at 18 dishing out money and other materials.

Phiri, Njovu and Zulu who have been hospitalized at St. Francis Hospital were yesterday beaten up by suspected PF cadres after they were alleged to have been found giving out money and other campaign materials.

Nchelenge Man arrested for ‘boiling’ daughters hands over “Chisense”

Police in Nchelenge district of Luapula province have arrested a 38 year old man for assaulting his eight year old daughter by boiling her hands with hot water.

Luapula province Police Commissioner Malcom Mulenga confirmed the arrest of Evans Mulenga Kaseke of Dyson Village in Chief Kambwali’s area in a telephone interview with ZANIS in Nchelenge today.

Mr. Mulenga said the culprit has been charged with two counts of child assault contrary to section 248(A) as amended by the Act number 15 of 2005 CAP 87 of the Laws of Zambia.

He said Kaseke, on 28th August 2013, burnt both hands of his eight year old daughter Charity Mulenga and that of her sibling Benandicto Chileshe aged five using hot water.

He further said that the culprit was apprehended on 29th August, 2013 by the Community Crime Prevention Unit who handed him over to the Police at Nchelenge Station where he was formerly arrested and charged.

According to the police, the accused on the material date went to grind maize and on his return home found the children had eaten the relish popularly known as “Chisense” which was meant for lunch.

This angered Kaseke who prepared hot water and later dipped the hands of his children in the pot instantly ripping off their skin.

Mr. Mulenga said the assailant has been remanded at the Nchelenge Police Station and that he will appear in court soon.
Meanwhile, a 33 years old woman of Chienge district in Luapula Province has sought the indulgence of the police after she was allegedly expelled from her village by the village head person.

Monica Chabale of Lupili Village in Senior Chief Mununga’s area in an interview with ZANIS today said she has spent one month in the bush for fear of her life from village head person Lupili.

Ms Chibale said trouble started when her husband died and she remarried the deceased’s relative as per tradition.
However, she said village head person Lupili has accused her new husband of being a witch and expelled her from her house and warned her never to set her feet back or face lynching.

The woman who was found at the Nchelenge Police Station said she has suffered for the last one month and now wants the police to protect her interest and help her have access to her house.
