Government allows UPND rally in Kabwata, but Police will not be there to keep peace

Government has given the opposition United Party for National Development (UPND) the green light to hold its planned rally in Kabwata constituency scheduled for tomorrow.

Home Affairs Minister Edgar Lungu says decision to allow the UPND to go ahead with their planned rally was arrived at following a successful consultative meeting he had with Inspector General of Police Stella Libongani and Lusaka Police Commissioner Joyce Kasosa, respectively.

Mr. Lungu has however stated that police officers will not be present at the rally because of the UPND’s confrontation approach they have taken over the matter.

He said it is the responsibility of the UPND leadership through their Marshalls that they ensure maximum peace before, during and after the rally.

Mr. Lungu said the leadership of the opposition party will be answerable for any violent act that may occur before, during or after their rally, adding that the challenge now lies with the UPND in ensuring that the rally is violent free.

He said the UPND must nonetheless bear in mind that the earlier decision by the police in Lusaka to deny them permission to hold their planned rally on grounds that the opposition party could not be trusted to hold a violent free rally was done in good faith.

Mr. Lungu said the police’s stance was not in any way meant to deny the UPND their freedom of assembly or association as enshrined in the constitution.

The Home Affairs Minister said every Zambian saw for themselves the violent acts that were perpetrated by UPND cadres when they assaulted an innocent police officer who was merely carrying out his duty to safeguard the lives of the general public and those of UPND cadres.

He told journalists at a press briefing in Lusaka today that it was against this background that the police denied the UPND notice to their rally.

“However, though they refused to heed to calls by the Lusaka police commissioner to have dialogue over the issue, as provided for under the Public Order Act.

“ We will allow them to proceed with their planned rally because we want to discourage the spirit of confrontation and violence and at the same time foster the spirit of peace and dialogue because that is what our Government believes in,” Mr. Lungu said.

He appealed to the leadership of the opposition party to ensure they adhere to the provisions of the Public Order Act by ensuring they have enough Marshalls to oversee the event according to the assurance they gave the police in their notice to hold the rally.

Mr. Lungu implored the UPND to cooperate with the police by ensuring that they have an audience with the Provincial Commissioner today so that they can discuss on how best the rally can be policed to avoid acts of violence by UPND cadres as witnessed in the recent past.

“Further the UPND leadership is urged to ensure that their cadres respect members of the public who may be either near the venue of their rally or along the roads leading to the venue for the rally by avoiding the use of unpalatable language or any form of annoying behaviour,” he said.

Yesterday, the opposition party announced that its planned public rally in Kabwata will go ahead after various consultations with Zambia Police.

In a statement made available to the media by Kuchunga Edwin Simusamba, the Deputy general Secretary for Politics, UPND said that Police has agreed to allow the rally to proceed.

” On behalf of the United Party for National Development (UPND), I would like to inform members of the general public that the planned rally in Kabwata will go ahead this Sunday 27th January 2013, starting at 12:00hrs at Kabwata Basic School grounds, ” read the statement

“This follows various consultations between the UPND and the government. The Police has finally agreed to follow the law by allowing the rally to proceed. See you there! Zambia forward,” concluded the statement.

Meanwhile, the Home Affairs Minister said he has powers to bring into extinction a society that threatens the country’s peace, law and order.

He said his ministry has been closely following events in the MMD and has since warned senior MMD officials that the current happenings in the party had the potential to disrupt peace and harmony in the country.

He said he will not hesitate to invoke the powers vested in him as a custodian of law and order in the country to act on the former ruling party if they fail to resolve their internal differences.

Mr. Lungu urged the MMD to straighten out their differences before filling in of nomination for the Mpongwe and Livingstone by election begin saying the party risk not taking part in the two by elections.

He said the Police will not allow a situation where two different factions from the same party bring different names of candidates for nomination on the two by elections.

BOZ withdraws K2.2 trillion old currency from circulation

THE Bank of Zambia (BoZ) has issued about KR2.4 Billion (K2.4 trillion) in circulation and has since withdrawn about K2.2 trillion (KR 2.2 billion) of the old currency.

BoZ currency rebasing project manager Morris Mulomba said the BoZ had managed to issue about KR2.4 Billion and had withdrawn 56 percent of the old currency.

Speaking in Lusaka yesterday during a press briefing, Mr Mulomba said BoZ now had all the rebased currency denominations in circulation.

He said people should not have the perception that there were some denominations missing in circulation.

“We have issued to the market about KR2.4 Billion in circulation and we have withdrawn K2.2 Trillion which is 56 percent of the old currency and we are hoping that by June we will be able to withdraw 90 per cent of the old currency,” Mr Mulomba said.

He said the Central Bank was experiencing a stable inflow of cash during the cash exchange period adding that the extended period for currency exchange had also contributed to this.

He said the bank had withdrawn K2.2 Trillion of the old currency which was 56 percent and was hoping to withdraw 90 percent by June this year.

He said the BoZ had visited all the provinces and had come up with a report that showed how the general public had received the currency rebasing.

Mr Mulomba said the report noted that the general public had accepted the new currency notes and had started using them saying most of the people appreciated the new notes.

He said most people had complained over the coins saying they were too small and could easily be lost.

“We visited all the provinces last week to see how people have received the new currency. We have come up with a report that shows that the new notes have been accepted by everyone, and we also think that more sensitisation is needed as some people still do not understand how to use the new notes,” he said.

He, however, said BoZ should come up with more sensitisation programmes so that those that still had problems with the new notes could understand.

Mr Mulomba said BoZ had not received any fraud case following the rebasing of the kwacha following a threat of having some counterfeit K100 note in circulation.

“We have not received any case of fraud following the rebasing of the kwacha, but there is a threat of having counterfeit K100 notes. We have seen some but we as BoZ are doing something about that,” he said

We want our case to be heard in Western Province, Mongu detainees tell judge

EIGHT Mongu accused persons in a matter in which they are facing an offence of Seditious practices yesterday told the Lusaka High Court that they want their case to be heard in Western Province and not any other place as proposed by the State.

This is in a case in which Christopher Muyendekwa, Malamo Mubiana, Mulima Mubiana, Nalumino Lufwendo, Mubita Silumesi, Kaiko Kaiko and Mubiana Muyunda are charged with one count of seditious practices.

Through their lawyer, Sakwiba Sikota, the accused submitted before High Court Judge Evans Hamaundu that they were comfortable to have their matter heard in Mongu due to security reasons.

Mr Sikota wondered why the State wanted the matter to be transferred from Mongu to Mumbwa knowing well that it would be too expensive on both parties especially the accused in an event that they were found with a case to answer.

“Your honour the State is putting you in an embarrassing situation because the accused are not on any warrants,” he said.

He said if the application was all about fairness and security then it was better the matter was heard in Mongu because the matter carried the interests of the community who were eager to follow the proceedings.

In this matter the Director of Public Prosecution (DPP) Mutembo Nchito had made an application to have the matter be transferred to Mumbwa because the environment situation raised security concerns after their arrests.

The State in reply to Mr Sikota’s submissions said the accused persons were fully aware of the particulars of the offence and emphasised that they are in no way going to make the trial difficult.

And judge Hamaundu clarified that he was not going to issue any extension of warrants to the prisons authorities because the accused persons were not in the hands of the Court yet but that of the State.

And Judge Hamaundu said he was aware that there was a complaint of illness from some of the accused persons and that he would visit them in the afternoon after court.

The court has since reserved ruling on whether the case should be tried in Lusaka or any other place to January 29 this year.

PF will not allow anyone to disturb peace in Kabwata

Patriotic Front Kabwata Constituency Chairperson David Silubanje has vowed not to allow any person to disturb the peace and order that exist in Kabwata.

Mr. Silubanje said people of Kabwata were not interested in political rallies but in ensuring that development programmes in the area progressed.

He said the PF in Kabwata constituency will therefore not engage in violence but will cooperate with the police in maintaining law and order as well as promoting an atmosphere that is conducive for development.

He said the Patriotic Front in Kabwata constituency was aware of the insistence by opposition United Party for National Development (UPND) to hold their rally in the area.

Mr. Silubanje noted that the opposition political party was insisting to hold a rally in the area because of a well known PF traitor whom UPND has been working with so that it will easy for it in case a by-election arises.

He however stated that the PF in Kabwata will still wait for a decision from the central committed pertaining to the case of area Member of Parliament Given Lubinda.

In the recent past, some Patriotic Front members from Kabwata constituency have been accusing Mr. Lubinda of working with the opposition United Party for National Development.

THE Richard Kachingwe led MMD will announce the final list of candidates to contest the Livingstone and Mpongwe parliamentary by-elections on Tuesday next week.

Ousted MMD National Secretary Richard Kachingwe and expelled party chairperson for women affairs Catherine Namugala on Monday formed a parallel structure with a new party headquarters and declared that a new leadership would soon be ushered in.

MMD splinter spokesperson Bernard Mpundu said in an interview yesterday that the party leadership had been receiving overwhelming response from several candidates intending to stand on the MMD ticket.

Mr Mpundu said, so far, the party had received three names for Livingstone and Mpongwe respective, although, several other people were still forwarding their applications.

But MMD vice president for politics Michael Kaingu on Wednesday said at a press briefing that the party had filed in Miniva Mtesa as its Mpongwe candidate and that the party’s candidate for the Livingstone by-election would be announced soon

The Electoral Commission of Zambia (ECZ) has set February 28, 2013 as date for the two by-elections in Livingstone and Mpongwe Constituencies.

Chembo Ready for Zesco United Challenge

Zesco United interim head coach Tenant Chembo has declared himself ready to lead the Ndola side.

Chembo was last week tasked to coach Zesco for the next six months following the resignation of Wedson Nyirenda who has joined HCB Songo of Mozambique.

In an interview, Chembo acknowledged that coaching Zesco was a huge challenge.

The ex-Ndola Lime Hotspurs and Indeni trainer said he was indebted to the club executive for giving him the mandate to coach Zesco.

” It’s a big challenge. Life is all about challenges and I am ready for this challenge,” Chembo said. “I have worked with the team for some time now and I have a good relationship with the players,” he added.

“I know we have a task to win the league,” Chembo said.

Chembo, who was Nyirenda’s deputy, is being assisted by Alfred Lupiya and goalkeeping coach Stephen Mwansa.

Zesco finished third in the 2012 FAZ Super Division campaign.

Renard Insists Zambia Will Qualify

Herve Renard believes Zambia are still on track to reach the 2013 Africa Cup quarterfinals.

Zambia escaped with a late and soft penalty to finish 1-1 against Nigeria to keep their precarious hopes of retaining the title alive.

“I am happy with the result never forget we have Nigeria the Super Eagles in front of us and they did not lose any game in 2012,” Renard said who had vowed to mete-out revenge on the Super Eagles in the build up to this game.

“And they continue the same way that means we are still alive and we are still in a good way to get qualification for the both teams.”

Zambia, on two points, must beat Group C leaders Burkina Faso who have four points regardless of the result in Nigeria’s final game against Ethiopia up in Rustenburg on January 29.

Nigeria too have two points after today’s draw against Renard’s side.

We Have Hope Says Mweene

Kennedy Mweene says there is still hope of Zambia reaching the quarterfinals after stuttering to a second successive draw in Group C at the 2013 Africa Cup.

Mweene kept Zambia’s Africa Cup hopes alive when he converted an 83rd minute penalty to make sure they shared the points with Nigeria.

“I think we still have hope we are working extra hard we cannot just give up the Cup like that,” Mweene said at Mbombela Stadium after the game.

“We have to fight that is why we are champions we have to fight back like we did today.”

Zambia must beat Burkina Faso on January 29 at Mbombela to keep their dreams alive of making into the last eight for a third successive outing.

Burkina Faso enjoy a two point lead at the summit of Group C on four points after thumping Ethiopia 4-0 in the second game of the groups doubleheader at Mbombela on Friday.

“So I think it will not be easy for us to go out we have to fight until the last game we will qualify to the quarter finals,” Mweene said.

Earlier today, Home Affairs Minister, Edgar Lungu, has reiterated government’s duty to ensure law and order is maintained in the country.

Mr Lungu noted that he does not see anything wrong with the Zambia Police Service restraining the United Party for National Development (UPND) if they have reasons to do so.

He was reacting to allegations by the UPND leader, Hakainde Hichilema, who complained that it is the eleventh time that his party is being denied a police permit to hold rallies.

Mr Lungu was speaking in an interview with ZANIS at the Kenneth Kaunda International Airport this morning shortly before President Michael Sata left for Ethiopia.

He explained that Mr Hichilema should understand that each case has to be different, adding that the current one had too many disadvantages.

Mr Lungu also noted that the UPND leader was invited by the Police Service, saying he should have launched a complaint from there.

He observed that opposition political parties should be working with the government of the day instead of perpetrating anarchy in the country all the time.

Yesterday, Mr Hichilema was reported on Zambia National Broadcasting Corporation (ZNBC) as having said this was the eleventh time that his party was being denied a police permit since the PF government came into power.

The Lusaka High Court has dismissed an application by former directors of the defunct Access Financial Services Limited (AFSL), directors Aaron Chungu and Faustin Kabwe to have their five year jail term appeal re-opened.

The four were slapped with a five-year jail term by a Lusaka magistrate’s court on corruption charges.

In this case Chungu and Kabwe who are jointly charged with former Finance Minister Katele Kalumba, his Permanent Secretary, Stella Chibanda had applied to have their appeal case re-opened before delivering judgment.

High Court Judges Nigel Mutuna and Jane Kabuka in delivering their ruling today on whether the applicant’s appeal should be re-opened before passing judgment on grounds that they had established fresh evidence said the court was not convinced with the arguments advanced.

Judge Kabuka who read the ruling said the evidence which the applicants adduced that they had established fresh evidence indicating that some witnesses were paid to testify against them could not constitute credible evidence of a bribe.

“At the most, we find it can only amount to an allegation on the said paid named witnesses, and for the reasons given, the application for leave to re-open the appeal must fail as well as the second limb of the application. To file a further ground of appeal, having been anchored on the success of the application for leave to re-open the appeal, accordingly falls away,” she said.

The judges said it was further clear that the information sought to be adduced as additional evidence was available to the applicants as shareholders or directors in AFSL if they had bothered to look for it.

“Against this backdrop we are constrained from finding that the facts disclosed can, even with the most liberal approach, qualify to be classified as ‘exceptional circumstances’ to justify reception of this evidence as fresh evidence,” said judge Kabuka.

Chungu and Kabwe’s lawyers, Robert Simeza and John Sangwa from Simeza, Sangwa and Associates had asked the court to grant them permission to have the appeal case re-opened claiming two of the key witnesses were paid substantial amounts of money by the prosecution.

The lawyers told the judges that it would be in the interest of justice for the appeal to be re-opened and allow them to file fresh evidence.

They said granting them this application would demonstrate how two former employees of Access Financial Services, Enock Mwale and Isaac Chitundu were allegedly paid K800 million and K658 million, respectively, to testify against them.

They charged that the two witnesses were paid to “colour” their testimonies against their clients and were also paid K2.1 million and K11 million respectively, in excess of their terminal benefits.

Judgment has since been set for March 29 this year.

President Michael Sata has today left for Ethiopia where he is expected to attend the 20th African Union (AU) Summit.

Mr Sata left this morning at 10:30 hours at Kenneth Kaunda International Airport.

The President is accompanied by his Special Assistant for Press and Public Relations, George Chellah and First Lady, Christine Kaseba.

At hand to see off the President were Vice President, Guy Scott, Finance Minister, Alexander Chikwanda, Defence Minister, Geoffrey Mwamba and Information and Broadcasting Minister Kennedy Sakeni.

Others were Home Affairs Minister, Edgar Lungu, Lusaka Province Minister, Freedom Sikazwe, Senior government officials and service chiefs.

President Sata will be among other African Heads of State expected to attend the summit.

The summit, which will among other issues talk about conflicts in the region, would be held under the theme “Pan- Africanism and African Renaissance”.

This year’s AU summit is expected to attract over 50 heads of state and Government representatives.

The Head of State is expected to return home after the summit.

It’s wrong for PF to adopt Namulambe who is facing criminal charges-TIZ

Transparency International Zambia Chapter (TIZ) has said that the nomination of Gabriel Namulambe by the Patriotic Front to represent the ruling party in the Mpongwe by-elections sends a wrong signal to government’s quest to fight corruption.

TIZ Executive Director Goodwell Lungu said that the action clearly demonstrates that the PF can easily accept former MMD government officials whom it has loudly said were allegedly corrupt to now become part of the PF for political convenience and not on principle.

Mr. Lungu said that it is a known fact that Mr. Namulambe is currently facing criminal prosecutions in the courts and having such an individual represent a party in government that is allegedly allergic to corruption is inimical to the party’s energy of fighting corruption.

He has since strongly advised the Patriotic Front government to lead by example by requesting Mr. Namulambe to concentrate on clearing his name for the alleged offenses he is being prosecuted for.

Mr. Lungu told QFM news in a statement that in as much as Mr. Namulambe’s democratic right to resign and join a party of his choice, TIZ believes that it is wrong for such candidates to be given a second chance of re-contesting because of their self inflicted by-election which subjects huge sums of tax payers’ money to wastage.

He categorically stated that TIZ has got nothing against Mr. Namulambe as his organizations’ main interest is to constantly keep reminding government to avoid diluting the corruption fight and sending signals that the PF is becoming a haven for those who are seeking protection.

Mr. Lungu stated that TIZ will closely monitor Mr. Namulambe’s corruption charges to avoid any foreseeable miscarriage of justice.
