ZCTU canes Government over Public Order Act as Sakeni maintains the Act is needed

The Zambia Congress of Trade Unions has strongly condemned government for u-turning on the application of the controversial Pubic Order Act.

But Chief Government Spokesman Kennedy Sakeni has maintained that the Public Order Act is relevant as it helps to maintain public sanity.

ZCTU General Secretary Roy Mwaba said it is disappointing that the PF government is now in support of an archaic law which they condemned whilst in opposition.

Mr. Mwaba said the Public Order Act is a colonial piece of legislated that should be done away with.

“We are worried as the Labour movement that one of the bad laws you condemned when you were in government was the Public Order Act, we are concerned that you are now embracing this law. I think this is one issue that you need to relook at.”

“The Public Order Act is archaic, undemocratic and today it is the opposition being prevented from meeting and tomorrow it will be the labour movement,” Mr. Mwaba said.

The ZCTU General Secretary was speaking in Lusaka today during the opening of a three day workshop organised by the Labour Media Project which was officiated by Information and Broadcasting Minister Kennedy Sakeni.

But Mr Sakeni defended the application of the Public Order Act adding that the law is critical to maintain public peace and order.

“People want absolute freedom, there is no absolute freedom anywhere, you can’t just allow people to be assembling anyone as they wish, that will bring anarchy,” Mr. Sakeni said.

“Freedoms must have limitations, if you give absolute freedoms, people will start walking around naked and there would be no pornography, sodomy and all that.”

And Mr Sakeni has said that the Freedom of Information (FOI) bill will be dealt with within the next two sittings of parliament.

The minister called on the media in the country to effectively highlight labour issues in order to raise awareness among the workers and other stakeholder

Mbesuma is Back!

Striker Collins Mbesuma has been named by coach Herve Renard in the 24-member Chipolopolo squad that will face South Africa on November 14 in the Nelson Mandela Challenge  at Soccer City  in Johannesburg.

FAZ Spokesperson Erick Mwanza released the names in Lusaka on Wednesday.

Mbesuma who last featured for Zambia at the 2012Africa Cup has been impressive since joining South African giants Orlando Pirates in June and has so far scored four goals at his new club.

Renard has also recalled teenage midfielders Mukuka Mulenga and Shadreck Malambo.

Influential midfielder Rainford Kalaba has also returned to the squad after missing the 2013 African Cup qualifier against Uganda in
October.

African champion coach Herve Renard has named a 24 man strong squad to face 2013 Nations Cup hosts South Africa in the November 14 Nelson Mandela Challenge match at Soccer City in Johannesburg.

FAZ spokesperson Erick Mwanza unveiled the squad list today and said the match was important in setting the tone for the African champions before the provisional squad for Zambia’s title defence is announced.

“As we have demonstrated over the last five years, FIFA International Calendar dates are an integral part of providing the Chipolopolo an opportunity to get together and work together. In playing these matches, we continue our wonderful development path which is aimed at sustaining and enhancing our high levels of competitiveness,” Mwanza said.

“Herve Renard is taking this match with the seriousness it deserves and while we are going into to win it, the main thrust is for the players to enjoy the time together and keep the African winning championship spirit going. We are looking forward to the match which is the venue of the opening and closing ceremonies and without taking anything for granted, it’s a venue we would like to return to on 10th February next year,” he said.

In a squad which has seen the return of Orlando Pirates robust striker Collins Mbesuma, there were no major surprise inclusions or exclusions as the coach retrained the greater majority of the squad which won the Nations Cup last February.

Since calling the duo for the final Nations Cup qualifier against Uganda early this month, Renard has maintained midfield teenagers Mukuka Mulenga and Shadreck Malambo.

Top striker Jacob Mulenga, a leading goal scorer in the Dutch Eredivise, is included and fans who have not seen him in  a Chipolopolo shirt for a year now will hope the highly rated sharp-shooter will make his long awaited return to action when Chipolopolo take on a Bafana Bafana side which has not been to the last two Nations Cup finals and makes a return only in 2013 as hosts.

PF government ready to embrace all tribes

Vice president Guy Scott says the PF government is open for all the people to join including the tribes considered to be smaller ethnic groups in North Western province.Dr Scott said this today that people should stop complaining that they are not represented in the PF government administration because they are considered to belong to the minority ethnic groups.

He said the PF government embraces all tribes in Zambia adding that all persons even from smaller ethnic groups can become vice president or minister under PF as long as those from these groups join and work hard to contribute to the growth and unity of the nation.Dr Scott said he comes from a very small ethnic group of only about 1,000 white Zambians but he was voted for by people from different tribes as MP and he was now vice president under the Patriotic Front government.

He said there was no difference in the way the PF treats its old and new members because it had no membership cards and card numbers for people to side line others based on when they joined the party.Dr Scott was speaking today at a campaign meeting in chief Chizera’s area when he introduced PF candidate Stephen Masumba in the Mufumbwe parliamentary by-election set for November 8.

And Dr Scott said government is this week expected to start working on two roads in Mufumbwe under the 8,000-link-Zambia road development project that was recently launched by President Michael Sata.

The Vice President described as nonsense the story that are circulating in Mufumbwe accusing PF government of withdrawing ZESCO poles that were meant for connecting Mufumbwe to National Hydropower Grid and taking them to Muchinga province.He said that the poles were withdrawn by ZESCO from Mufumbwe because the company wanted to use steel pylons which were durable to connect the district to the national grid.

He was responding to earlier concerns raised by chief Chizera’s representative that Mufumbwe had received the least funding for road projects in the whole country.The Chief Representative also complained over the continued use of thermal generators by ZESCO to supply electricity to Mufumbwe, Zambezi, Mwinilunga, Kabompo and Chavuma in the province.The Representative said the supply of thermal power was expensive and said ZESCO would do better to cut these costs by connecting the three districts to the national grid.

Meanwhile Dr Scott has since completed his three-day campaign trail for Mufumbwe parliamentary by-election and has flown back to Lusaka.

MISA Zambia concerned with increasing attacks on journalists by Political Cadres

The Media Institute of Southern Africa (MISA) Zambia is deeply disappointed with yet another recorded incident of harassment and threats of death on media practitioners by political party supporters commonly known as cadres.

We are highly saddened by the incident of abuse against Journalists, Brian Mwale and his cameraperson Gerald Siingwa, from Zambia National Broadcasting Corporation (ZNBC) who went to cover a story at Police Headquarters in Lusaka on 29 October, 2012 but were intercepted by United Party for National Development (UPND) Political party cadres.

With increasing attacks on journalists by political cadres, MISA Zambia is appealing to the Zambia Police to ensure that perpetrators are brought to book. Recently the Zambian media has been mired by harassments from political supporters in the presence police officers but no arrests are being made. However, we also wish to encourage the journalists to report the cases to Zambia Police Service.

MISA Zambia condemns the harassment of the two journalists from ZNBC and express deep concern because they have occurred within a short space of time. Among some of the recorded incidents include attacks on Muvi TV Reporter, The Post Newspapers photojournalist, a reporter from Joy FM Radio and recently The Post Newspaper staff based in Kasama who all suffered at the hands of political party supporters.

The afore mentioned incidents therefore raise concern on the part of MISA Zambia for the safety of journalists who play a key role of informing the nation and act as a third estate because it is from political parties that we derive leadership of the country.

Due to this rise in violations against the media by political party supporters, MISA Zambia will embark on media literacy programmes to sensitise the concerned on operations of the media.

Ministry of Health close Bars and Food outlets in Kapiri Mposhi

The Council and Ministry of Health yesterday swung into action to close bars and food outlets that were operating without sanitary conditions in Lukanga Swamps in Kapiri Mposhi district.

The operation to close bars and restaurants was in the bid to contain the spread of Cholera and other diarrheal diseases which are currently widespread in the area.

Recently, 15 people died from Cholera in the area and many more were admitted and treated at Waya Clinic, the only Health Center in Lukanga Swamps.

Kapiri Mposhi District Council, Environmental Health Officer, Peter Sati who led the crew told ZANIS that the closure of the outlets followed an order by Kapiri Mposhi District Magistrates Court.

Mr Sati said the District Health Team sought for an order to close the outlets because their owners had failed to observe the minimum health and sanitary standards required for one to run bars and food outlets which is in contravention with the Food and Drugs Act Cap 303 Section 7 and Chapter 295 of the Public Health Act.

He said the owners of the outlets in the area had been reminded and warned several times to observe the Food and Drugs and Public Health Acts and other subsidiary laws to ensure they operate in sanitary conditions.

Mr Sati said the outlet’s owners however ignored the reminders and opted to operate without toilets and running water.

He said the conditions in which the outlets were operating necessitated the further spread of Cholera which claimed people’s lives recently.

15 people died while over 40 others were admitted to Waya Clinic after experiencing severe Diarrhoea and vomiting.

The Cholera broke out at Kaswende, Waya, Kabosha and Ngwenya fishing camps on Lukanga Swamps.

Veep cautions Zambians against voting non performers

Vice President Guy Scott has cautioned Zambians against voting for leaders who have no capacity o develop their areas.

And Dr. Scott has urged the people of Mufumbwe to rally behind the Patriotic Front candidate in the November 8 parliamentary by-election Stephen Masumba.

Dr. Scott said the people of Zambia need proper representation at decision making levels especially in parliament.

He said it is worrying that some leaders have duped the electorate at the expense of fulfilling their selfish ambitions.

ZANIS reports that Dr. Scott made the remarks at a rally held at Wishimanga Basic School in Mufumbwe yesterday.

He described Mr. Masumba as a dedicated man who has propelled the PF to massive popularity not only in Mufumbwe district but North Western province as a whole.

And Dr. Scott has said Mr. Masumba is the best candidate who can bring meaningful development to the people of Mufumbwe.

The Vice President is in Mufumbwe to address a series of public rallies to drum up support for PF candidate Stephen Masumba.

Meanwhile, the Movement for Multiparty Democracy (MMD) has rated its chances of winning the November 8 parliamentary by-election in Mufumbwe as very high, through its candidate Stanford Mulusa.

MMD Campaign Manager in the by-election Newton Samakayi said the MMD is a lot more visible in Mufumbwe among women and youths than Patriotic Front (PF).

Mr Samakayi said the by-election is also a revolution by the people against PF candidate Stephen Masumba, who is former MMD MP for the same area.

He told journalists last night that there was a revolution in Mufumbwe because Masumba, the person they had voted for under MMD last year, decided to abandon them to join PF.

Mr Samakayi said the people in Mufumbwe would vote for the MMD candidate Mulusa to punish Masumba and show him that he does not own the people in the area.

He said MMD was also favoured to win the election because of its developmental record in the area while in power.

He said when the MMD was in government it opened up North Western province to major mining investments and improved the road network from Solwezi to Chavuma.

On the other hand, Mr Samakayi attacked the PF 90-days development promise as a ‘deception’ because it is yet to deliver even after one year had elapsed.

He said the people of Mufumbwe feel they would not benefit from the PF government, whose relationship with the people of North Western province is still not good.

He explained that during the MMD government, poles were brought and erected to supply hydroelectricity to Mufumbwe.

However, he lamented that when the PF took over government it uprooted the poles and took them to Muchinga province.

First Lady calls on companies to empower women doing reproductive roles

First Lady Christine Kaseba has called on companies to put in place policies that will empower women when they are attending to other reproductive roles.

Dr. Kaseba lamented that women are sometimes discriminated against when they undertake maternity leave and some opt not to have children not because they do not want to but because they fear losing employment.

ZANIS reports that the First Lady said this when she gave a motivational talk to Airtel female employees in Lusaka today.

She also called on companies to invest in women because this has a trickledown effect not only on the family but also on the nation.

Meanwhile Dr. Kaseba has expressed concern at the high number people getting infected with communicable diseases in the country.

She said that Zambia has the second highest number of people that are suffering from communicable diseases and that it has been predicted that the numbers could double by the year 2013.

The First Lady has since appealed to women to go for cancer screening because it can help to save their lives if it is detected early enough.

And Airtel management has donated K50 million to the office of the First Lady to help in the fight against cancer and also cell phones that she could donate to any rural health centre of her choice in Zambia.

Government implores mining companies to revamp trade schools

Government has implored Mining companies in the country to consider revamping the trades training institution in their areas of operations in order to create a reservoir of skilled labour for the industry.

Mines Deputy Minister Richard Musukwa said this today during his tour of Kwambula training centre at Solwezi technical trades institute.

Mr Musukwa said it was the desire of government to see that the expanding mining industry had a reservoir of skilled human resource which will be able to continue running the mines long after expatriates leave.

He said once trades schools were operational the dependence on expatriate labour will reduce and this will result in more Zambians taking up skilled jobs in the mining companies.

Mr Musukwa also urged Zambians working in the mines to maximize on expatriate skills in various fields so that they remain equipped with skills that will eventually help them to sustain mine operations after investors leave the industry.

And SOTTI principle Charles Shindamba said the Kwambula training centre had added value to the institution as it would produce the necessary human resource for the mining industry.

The Kwambula training project is an initiative by First Quantum Minerals in conjunction with government to train local people in various skills necessary to support the mining industry.

Power Dynamos coach Beston Chambeshi says a congested fixture schedule will not distract his side’s quest to defend their Faz Super Division league title.

Ahead of Wednesday’s rescheduled week 22 match against Green Buffaloes in Lusaka, Power have played three games in the last eight days including one coming up this Saturday.

Chambeshi said Power has no option but to play their remaining scheduled league matches.

“We have played a lot of games in the past, so this can’t disturb us, we just have to play all our remaining games. We are encouraging our players that this happens in football they just have to remain focused,” Chambeshi said.

“This is not easy, as coaches our plan is being affected but we can’t relax.”

Patritic Front (PF) Secretary General, Wynter Kabimba has advised people in Mufumbwe district to stop practicing politics on tribal lines saying President Michael Sata did not encourage tribalism as it deterred development.

And Vice President Guy Scott said the PF government has expressed happiness to see that the people of Mufumbwe had freed themselves from the MMD lies which had not developed the area for the paste 20 years of being in power.

Dr Scott said it would concentrate on distributing the Fertiliser Input Support Programme (FISP) to the poor people and not the rich as it was in the previous regime because the PF’s manifesto was to ensure that the program benefited the poor.

Speaking at a rally at Wishimanga and Kamabuta basic schools, Mr Kabimba said Mr Sata was serious man who wanted to develop the entire Zambia regardless of tribe or political inclinations because he knew that tribal politics could cause divisions.

“ Mr Sata is a serious man he has no issues with of tribalism but want to ensure that North western province is also developed because it has lacked behind in the last 20 years the opposition MMD was in power, these lies that PF is tribal should not be bought because all tribes are encompassed in the party,” he said.

And Dr Scott has urged those entrusted with the distribution of fertilizer and other farming inputs not to delay the exercise because doing so would mean delaying the PF progress of changing things in the new government.

Dr Scott said his government would build a university in the district because it had never had one and that because of that many pupils who had done well had failed to advance their education and end up getting married or becoming farmers.

“ The PF will not give any farming in puts to the rich people like the MMD was doing, why should the rich continue to get richer, the PF will make sure that the farming inputs reached the intended benefits, the distribution of FISP should also not be delayed all has been put in place so my government expects no delay,” said Dr Scott.

The Vice President has also emphasized that the PF should not waste time with in fighting in the party but asked them to be serious and campaign vigorously so that a right person could be put as Mufumbwe MP.

Dr Scott said all the problems complained about which included lack of clinics, schools and secondary schools could better be developed if they voted for an MP from the ruling party.

Earlier the Veep visited the Central market where he interacted with the marketeers and bought relish from them before proceeding to other two rallies in the afternoon.

And PF chairperson for elections Sylvis Masebo said government would only believe that PF existed in North western province if they voted for Steven Masumba.

She asked the electorates to stop remaining behind by voting for the opposition because that would be wasting their chance for another 10 years of no development in the area.

She said Mr Sata was not surrounded by Bemba people but people from all the 10 provinces hence the need for them not to believe what the opposition political parties were preaching that PF party was based on political lines.

“ So don’t follow tribe but a human being tribes men can make you fail be like Mr Sata who is working for everybody, he has promised give youths jobs he did not say Bemba youths so help him to bring Masumba to Parliament,” she said.

Kitwe Mayor Chileshe Bweupe says there is nothing irregular with the motion to provide him with housing and 24 hours security.
Mr. Bweupe insisted that Mayors deserve to be accommodated in institutional houses and be provided with security in order for the Office of the Mayor to be respected.

He charged that the motion seeking to provide housing and 24 hours security to the Mayor of Kitwe has been politicized.
“This is not about Bweupe, the motion was meant to benefit even future Mayors. We need Mayors to be accommodated in good houses where they can host functions,” he said.

“We have seen functions been hosted at the residencies of the Nigerian Embassy, Botswana High Commission, why should the Mayor, the number one Citizen of the City host functions at Lodges and Hotels?”

The Kitwe Mayor, a close relative of President Sata said some political opponents want to gain mileage from the issue of the motion and bring his office into disrepute.

“I have never used the name of President Michael Sata in vain, people claiming that I use State House to abuse my powers are just been malicious,” he said.

He said he is fully aware that some people want to use the issue to distract him from performing his duties as the Father of the City.

Mr. Bweupe said he is focused on leaving a legacy of hard work and commitment to the City of Kitwe and warned that he will not be distracted in his course of duty.

Recently, Ministry of Local government and Housing Permanent Secretary issued a circular to Kitwe City Council not to enforce the motion to provide housing and 24 hours security to the Mayor of Kitwe failure to which appropriate statutory sanctions will be applied.

Mr. Namachila advised the council not to enforce the decision as it is against public policy and it is costly and attracts audit query.

He explained that moving a motion to provide accommodation and security for the mayor is in contravention of the current legislation and has therefore no legal; backing rendering it an ultra vires decision of no legal effect.

Court deny HH right to appeal , set January 14, 2013 as a date for commencement of trial

THE Lusaka magistrate court yesterday refused to grant an application by opposition United Party for National Development (UPND) Leader Hakainda Hichilema to appeal to the high court against its earlier decision to refuse to refer Hichilema’s criminal charge to the high court for determination on constitutional issues.

And Chief resident magistrate Joshua Banda told Hichilema’s lawyers that they could have avoided the confusion they have caused in regard to the same application had they avoided rushing to the high court to file a notice of appeal when they knew he was yet to decide on the way forward.

Hichilema through his lawyers despite having not heard the ruling from magistrate Banda rushed to file a notice of appeal to the Lusaka High court challenging the subordinate court’s decision.

The high court has since set November 15, 2012 as a date for hearing of the appeal.

This is in a case in which Hichilema, 50 is charged with one count of publication of false news with intent to cause fear and alarm to the public contrary to the Laws of Zambia.

It is alleged that Hichilema on June 11, 2012 in Lusaka, orally published statements in which he said, inter alia, that “PF had signed an arrangement for the militia in Sudan to train PF youths”.

“Prepare for trouble”; “Do you know what is going on in Darfur, Do you know what is going on in Abyei? Do you know what is going on there? Killings!”, statements which are likely to cause fear and alarm to the public.

But Hachilema through through his lawyers led by Sakwiba Sikota asked magistrate Banda to refer the case to the High Court for determination on contraventions of Article 18 and Article 20 of the Constitution of Zambia.

However Magistrate Banda refused to grant the application prompting the defence lawyers to make another application seeking for leave for their client to appeal to the high court over his decision.

Magistrate Banda reserved ruling to yesterday but before Hichilema could hear the verdict, his lawyers filed a notice of appeal to the high court.

In his ruling yesterday, Magistrate Banda noted that he could not grant the application because there was no provision in the criminal procedure code and Subordinate Cpourt Act that backed interlocutory appeals in criminal matters.

“That is the law. No appeal can lie to the high court if I had referred this case to the high court and the high court’s decision was found to be unfavorable then an appeal could lie to the supreme court as was in the recent case involving Frantelli Locci and Andrew Bwezani Banda Vs the people) said magistrate Banda.

Magistrate Banda said in criminal matters an accused person could not appeal against a decision relating to an interlocutory or preliminary issue.

He said “from the foregoing it must be stated that the interlocutory appeal from here to the high court in this matter cannot stand and trial shall proceed”

Immediately after the ruling Hichilema’s lawyers lead by Martha Mushipe sought guidance from the court premised on the fact her client had already filed a notice of appeal and the high court has already set a date of hearing.

But Magistrate Banda who maintained that Hichilema would undergo trial before his court said if only the defence had not rushed to file for notice of appeal, the confusion they have caused should have been avoided.

“I advised to rule on your application today and I do not understand why you rushed to file a notice of appeal in the high court when there was an application pending here. I will stand by the ruling and will proceed to trial and I will not consider what happens outside here” said Magistrate Banda.

He set January 14 2013 as a date for commencement of trial.

Political analyst Neo Simutanyi has advised leaders of the Patriotic Front to stop labeling everyone criticizing their policies as being bitter.

Dr. Simutanyi said those opposing the manner in which the PF has managed national affairs since assuming office are merely doing so in the interest of democracy.

“Please we are not bitter, stop calling us bitter each time we speak, we are not bitter, we are democrats,” Dr. Simutanyi pleaded.

Dr. Simutanyi said the majority of Zambia wants the PF to deliver on its promises made during campaigns.

“We don’t want this government to fail. When it succeeds, everyone including those who didn’t vote for them will be happy. Nobody wishes it to fail,” he said.

Dr. Simutanyi was speaking in Lusaka last evening during a public discussion organised by the Friedrich Ebert Stiftung on the PF’s one year in office.

He said it has become fashionable for PF top officials to react sharply to any kind criticism and call those criticizing them as bitter.

Dr. Simutanyi said the PF should be more tolerant to divergent views adding that Zambia is now a mature democracy and that people will always enjoy their right to expression.

South Africa Under-17 coach Shakes Mashaba said Zambia didn’t take the game seriously on Sunday at Arthur Davies Stadium in Kitwe.

Zambia lost 1-0 at home to South Africa under-17 to bow out 2-1 on aggregate from the 2013 African Junior Cup second round qualifiers.

“What killed Zambia is they were too relaxed. They were confident with the 1-1 that they got in the first game and we needed one goal and that would be amen and fortunately we got it,” Mashaba said.

Meanwhile, Zambia Under-17 coach Oswald Mutapa described elimination from the Morocco 2013 qualifiers as a bitter pill to swallow.

“It is a bitter pill losing at home 1-0. They scored a scrappy goal in which they were well organized from a corner kick,” Mutapa said.

“When you look at their (South African) age you are able to tell that these are young boys.”
