A Lusaka Magistrates Court has today found Henry Kapoko and 9 others with a case to answer in a matter in which he and his co-accused are charges with 21 counts of theft of over K4 billion from the Ministry of Health through the Royal College of Lusaka.

Henry Kapoko and other officials from the Ministry of Health were arrested by the Anti-Corruption Commission in 2009 for various offences of corrupt practices and theft by public servant involving over K10million.

ZANIS reports that the Anti Corruption Commission Public Relations Manager Timothy Moono said this in a statement , this evening.

In passing ruling, Honorable Newa who is hearing the matter stated that she found all the ten accused persons with a case to answer on all the 21 counts and has therefore placed them on their defence.

The matter has been adjourned to tomorrow 9th July 2013 when Mr. Kapoko is expected to commence his defence.

Meanwhile two other accused in the same matter Mrs. Valenta Nkhata and her daughter Abigail Nkhata Kapinda will not give any defence as they have elected to remain silent and will not call any witnesses.

In Count One Nobert Peleti and Evaristo Musaba are charged with the offence of Theft by Public Servant contrary to Section 272 and 277 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Nobert Peleti and Evaristo Musaba, between 1st October, 2007 and 31st December, 2008 in Lusaka, jointly and whilst acting together with other persons unknown, being persons employed in the Public Service namely Ministry of Health as Assistant Director-Administration and Chief Accountant respectively, did steal K259,225,000.00 cash, the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment.

In Count Two Dr. Chrispine Sichone and Zukas Musonda Kaoma are charged with Theft by Public Servant contrary to Section 272 and 277 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Dr. Chrispine Sicjone and Zukas Musonda Kaoma between 1st October, 2007 and 31st October, 2007, in Lusaka, jointly and whilst acting together with other persons unknown, being persons employed in the Public Service namely Ministry of Health as Director of Health Policy, Assistant Director-Administration and Principal Accountant respectively, did steal K414,760,000.00 cash, the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment.

In Count Three, Nobert Peleti, Henry Mulenga Ngosa Kapoko and Zukas Musonda Kaoma are charged with Theft by Public Servant contrary to Section 272 and 277 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Nobert Peleti, Henry Mulenga Ngosa Kapoko and Zukas Musonda Kaoma between 1st October, 2007 and 31st November 2007, in Lusaka, jointly and whilst acting together with other persons unknown, being persons employed in the Public Service namely Ministry of Health as Director of Health Policy, Assistant Director-Administration and Principal Accountant respectively, did steal K414,760,000.00 cash, the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment.

In Count Four, Nobert Peleti, Zukas Musonda Kaoma and Henry Mulenga Ngosa Kapoko, are charged with Theft by Public Servant contrary to Section 272 and 277 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Nobert Peleti, Zukas Musonda Kaoma and Henry Mulenga Ngosa Kapoko, between 1st February 2008 and 20th March 2008, in Lusaka, jointly and whilst acting together with other persons unknown, being persons employed in the Public Service namely Ministry of Health as Assistant Director-Administration and Principal Accountant respectively, did steal K542,250,000.00 cash, the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment.

In Count Five, Zukas Musonda Kaoma, Nobert Peleti, Enala Matutu Phiri, Vincent Luhana and Henry Mulenga Ngosa Kapoko, are charged with Theft by Public Servant contrary to Section 272 and 277 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Zukas Musonda Kaoma, Nobert Peleti, Enala Matutu Phiri, Vincent Luhana and Henry Mulenga Ngosa Kapoko, between 1st February 2008 and 1st April 2008, in Lusaka, jointly and whilst acting together with other persons unknown, being persons employed in the Public Service namely Ministry of Health as Principal Accountant, Assistant Director-Administration, Assistant Accountant and Senior Accounatnt respectively, did steal K350,750,000.00 cash, the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment.

In Count Six, Dr. Chrispine Sicjone and Zukas Musonda Kaoma are charged withTheft by Public Servant contrary to Section 272 and 277 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Dr. Chrispine Sicjone and Zukas Musonda Kaoma between 1st March, 2007 and 30th December, 2008, in Lusaka, jointly and whilst acting together with other persons unknown, being persons employed in the Public Service namely Ministry of Health as Director of Health Policy and Principal Accountant respectively, did steal K856,691,500.00 cash, the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment.

In Count Seven, Zukas Musonda Kaoma and Nobert Peleti are charged with Theft by Public Servant contrary to Section 272 and 277 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Zukas Musonda Kaoma and Nobert Peleti, between 1st September, 2008 and 30th December, 2008, in Lusaka, being persons employed in the Public Service namely Ministry of Health as Principal Accountant and Assistant Director-Administration respectively, jointly and whilst acting together with Henry Mulenga Ngosa Kapoko and other persons unknown, did steal K899,952,100.00 cash, the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment

In Count Eight, Christopher Bwalya, Evaristo Musaba, Vincent Luhana, Enala Matutu Phiri, Nobert Peleti and Zukas Musonda Kaoma, are charged with Theft by Public Servant contrary to Section 272 and 277 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Christopher Bwalya, Evaristo Musaba, Vincent Luhana, Enala Matutu Phiri, Nobert Peleti and Zukas Musonda Kaoma, between 1st November, 2008 and 30th December, 2008, in Lusaka, being persons employed in the Public Service namely Ministry of Health as Assistant Internal Auditor, Chief Accountant, Acting Senior Accountant, Assistant Accountant, Assistant Director-Administration and Principal Accountant respectively, jointly and whilst acting together with Henry Mulenga Ngosa Kapoko and other persons unknown, did steal K756,655,900.00 cash, the property of the Government of the Republic of Zambia which came into their possession by virtue of their employment.

In Count Nine, Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, are charged with Theft contrary to Section 272 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, between 1st October, 2007 and 31st December, 2008 in Lusaka, jointly and whilst acting together with Nobert Peleti and Evaristo Musaba and other persons unknown, did steal K259, 225,000.00 cash, the property of the Government of the Republic of Zambia.

In Count Ten, Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, are charged with Theft contrary to Section 272 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, between 1st October, 2007 and 31st December, 2008 in Lusaka, jointly and whilst acting together with Dr. Chrispine Sichone and Zukas Musonda Kaoma and other persons unknown, did steal K414, 760,000.00 cash, the property of the Government of the Republic of Zambia.

In Count 11, Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, are charged with Theft contrary to Section 272 of the Penal Code Cap 87 of the Laws of Zambia.

In Count 13, Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, are charged with Theft contrary to Section 272 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, between 1st October, 2007 and 31st December, 2008 in Lusaka, jointly and whilst acting together with Zukas Musonda Kaoma, Nobert Peleti, Henry Mulenga Ngosa Kapoko, Enala Matutu Phiri, Vincent Luhana and other persons unknown, did steal K350, 750,000.00 cash, the property of the Government of the Republic of Zambia.

In Count 14, Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, are charged with Theft contrary to Section 272 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata and Abigail Nzala Nkhata Kapinda, between 1st October, 2007 and 31st December, 2008 in Lusaka, jointly and whilst acting together with Zukas Musonda Kaoma, Dr. Chrispine Sichone and other persons unknown, did steal K856, 691,500.00 cash, the property of the Government of the Republic of Zambia.

In Count 15, Valenta Miyoba Chizyuka Nkhata, Abigail Nzala Nkhata Kapinda are charged with Theft contrary to Section 272 of the Penal Code Cap 87 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata, Abigail Nzala Nkhata Kapinda and Henry Mulenga Ngosa Kapoko, between 1st October, 2007 and 31st December, 2008 at Lusaka, jointly and whilst acting together with Zukas Musonda Kaoma and Nobert Peleti and other persons unknown, did steal K899, 952,100.00 cash, the property of the Government of the Republic of Zambia

In Count 17, Nobert Peleti, is charged with Money Laundering Contrary to Section 7 of the Prohibition and Prevention of Money Laundering Act No. 14 of 2001 of the Laws of Zambia.

It is alleged that Nobert Peleti, on dates unknown but between the 1st January 2008 and 31st December 2008 at Lusaka, jointly and whilst acting together with other persons unknown, did engage directly or indirectly in business transactions that involved K3,223,593,000.00 money acquired from an illegal activity whereby the said money was concealed or disguised by purchasing a motor vehicle, namely Toyota Hilux Surf Reg. No. ABP 9591 bearing Chassis No. KZN-185-0050794, property acquired from an illegal activity or proceeds of crime.

In Count 18, Valenta Miyoba Chizyuka Nkhata, is charged with Money Laundering Contrary to Section 7 of the Prohibition and Prevention of Money Laundering Act No. 14 of 2001 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata, on dates unknown but between 1st January 2007 and 31st December 2008 at Lusaka, jointly and whilst acting together with other persons unknown, did engage directly or indirectly in business transactions that involve K4,495,044,500.00, money acquired from an illegal activity whereby part of the said money was concealed or disguised by purchasing a motor vehicle, namely MERCEDEZ BENZ C220 Reg. No. ABP 737, bearing Chassis No. WDB202022-2F416657, property acquired from an illegal activity or proceeds of crime.

In Count 19, Valenta Miyoba Chizyuka Nkhata is charged with Money Laundering Contrary to Section 7 of the Prohibition and Prevention of Money Laundering Act No. 14 of 2001 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata, on dates unknown but between 1st January 2007 and 31st December 2008 at Lusaka in the Lusaka District of the Lusaka Province of the Republic of Zambia, jointly and whilst acting together with other persons unknown, did engage directly or indirectly in business transactions that involve K4,495,044,500.00, money acquired from an illegal activity whereby part of the said money was concealed or disguised by purchasing a motor vehicle, namely TOYOTA KLUGER Reg. No. ABL 9777, Engine No. 2AZ-0874050, Chassis No. ACU25-0018077, property acquired from an illegal activity or proceeds of crime.

In Count 20, Valenta Miyoba Chizyuka Nkhata is charged with Money Laundering Contrary to Section 7 of the Prohibition and Prevention of Money Laundering Act No. 14 of 2001 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata, on dates unknown but between 1st January 2007 and 31st December 2008 at Lusaka, jointly and whilst acting together with other persons unknown, did engage directly or indirectly in business transactions that involve K4,495,044,500.00.

This money was acquired from an illegal activity whereby part of the said money was concealed or disguised by purchasing fifteen (15) computers, property acquired from an illegal activity or proceeds of crime, said Mr. Moono in the statement.

In Count 21, Valenta Miyoba Chizyuka Nkhata, is charged with Money Laundering Contrary to Section 7 of the Prohibition and Prevention of Money Laundering Act No. 14 of 2001 of the Laws of Zambia.

It is alleged that Valenta Miyoba Chizyuka Nkhata, on dates unknown but between 1st January 2007 and 31st December 2008 at Lusaka, jointly and whilst acting together with other persons unknown, did engage directly or indirectly in business transactions that involve K4, 495,044,500.00, money acquired from an illegal activity whereby part of the said money was concealed or disguised by acquiring Farm No. Sub Q of Farm 754, Lusaka West, property acquired from an illegal activity or proceeds of crime.

Exhausted Kenya embarrass Lesotho

Fatigued Kenya came from two goals down to force a 2-2 draw against Lesotho in Monday’s delayed COSAFA Cup Group B match in Kitwe hours after their arrival in Zambia.

Kenya shrugged off jetlag six hours after arriving in Kitwe to put up a spectacular second half performance scoring two lates goals to earn a point at Arthur Davies Stadium

It took Lesotho 41 minutes to take a lead when Mokhahlane Ralekoti scored from a penalty.

South African referee Victor Gomes pointed to the spot after Kenya defender Joackim Atudo had hacked Lesotho’s Litsepe Marabe in the box.

Eight minutes after the restart, striker Tale Thapelo increased Lesotho’s lead with a solo effort.

But seven minutes before time, Paul Muigai launched Kenya’s comeback with a headed goal before Wilson Obungu equalised five minutes later from the spot.

Lesotho defender Katleho Moleko had handled in the box.

Kenya appeared to have been motivated by massive support from local fans throughout the second half.

Namibia first to reach 2013 Cosafa Cup quarterfinals

Namibia are the first country in the preliminary group stages to reach the 2013 Cosafa Cup quarterfinals after a dramatic comeback to beat Seychelles 4-2 at Nkoloma Stadium in Lusaka.

The Brave Warriors will meet Bafana-Bafana at the same venue on Saturday for a place in the July 17 semifinals.

However, Namibia fought back twice to pick up the three points they needed to qualify for the last eight from there allotted two Group A games on maximum six points after earlier beating Mauritius 2-1 in the tournament opener on July 6.

Namibia were stunned after Yves Zialor put Seychelles ahead in the 10th minute.

Sadney Urikhob levelled scores in the 25th minute but Zialor put Seychelles back in the lead in the 37th minute after pouncing on a loose ball after some slapstick goalkeeping by Virgil Vries.

The two sides went 2-2 into the break through Ananias Gerbhart.

Gerbhart put Namibia ahead just after the restart in second half fraught with poor finishing by both sides.

Shangombo man found with suspected human skull, teeth and pubic hair

Police in Senanga are investigating a case in which a 21 year old man of Shangombo district was found in possession of suspected human remains comprising of a skull, teeth and pubic hair.

Police say Wamunyima Mwendabai of Nambowe village in Senanga whilst acting together with a 15 year old juvenile was found with a skull, teeth and public hair suspected to be that of a human being.

The duo was cornered on 2nd July 2013 around 20:00 hours as it was trying to sale the parts to an alert witchdoctor who later reported the case to the police.

The two are claiming to have found the suspected remains in the Kalongola/Liombo forest.

Police say they are yet to establish the source of the suspected human parts and have engaged experts to determine whether the remains are human or not.

Meanwhile, Police in Chipata are investigating a case in which one man died on the spot while two others sustained injuries when the Mitsubishi Canter they were travelling on was shot at by unknown people using an unknown type of firearm.

Norwel Phiri aged between 25 and 30 was shot at in the chest while the driver Fabian Soko and George Phiri, a passenger sustained multiple injuries.

The trio was ferrying 27 bales of tobacco from Mkanda’s Kambani area and when they reached Lundazi turn off, they heard a bang and later on discovered that Norwel had been shot at on the right breast.

The scene of the accident has been visited and initial investigations have revealed that the criminals were aiming at the driver but missed him and shot at the passenger as the windscreen on the driver’s side was completely shattered.

The incident occurred on yesterday at unknown time in Mkanda area in Lundazi.

The body of the deceased is lying in Chipata General Hospital Mortuary whilst the injured are admitted in the same hospital.

Kenya arrive in Zambia for COSAFA

The Kenyan national team has arrived in Zambia ahead of their Group B match against Lesotho on Monday evening.

Harambee Stars were earlier scheduled to play their opening match against Lesotho on Sunday 7th July but they requested to allow their players to compete in key Kenya Premier League fixtures.

As a result the match was pushed to Monday with a kick-off time of 17 Hours at Arthur Davies Stadium in Kitwe.

One fixture has already been played in Group B which saw Botswana and Swaziland play to a goalless draw on Sunday.

Meanwhile, Cosafa has adjusted the kick-off time for another Group B match between Lesotho and Botswana from 1500H to 1700H on Wednesday.

This was done to give Lesotho enough time before their next fixture.

This means the match between Kenya and Swaziland will kick-off at 15 hours instead of 17 Hours.

Acting Zambia Railways Managing Director Muyenga Atanga says the railway firm will not completely discard plans initiated by former Chief Executive Officer Professor Clive Chirwa.

Dr Atanga said the Directors at Zambia Railways have evaluated Prof Chirwa’s business and that they will adopt some of them in the ZRL new corporate business strategy for the year 2013-2015.

Dr Atanga has been acting as the head of the railway firm after the PF government retired Prof Chirwa was retired in national interest.

Prof Chirwa had presented an elaborate strategy to turn around the struggling firm by modernizing its fleet, rehabilitation its lines and building new dual lines between Lusaka and Livingstone including the construction of an underground railway station at Lusaka.

But Prof Chirwa’s grand vision for Zambia Railways was cut short after a rift emerged with the Board of Directors led by Mark Chona over the management of the railway firm and the utilization of the US$ 120 million grant from the Eurobond leading to his retirement.

But Dr Atanga says his team will not abandon Prof Chirwa’s plans but will infuse some of them into the new corporate business strategy.

He was speaking in Lusaka on Monday when he opened a strategic planning meeting for Zambia Railways at Ndozo Lodge in Chilanga.

“We will use some of his ideas, we can’t just throw everything but what is important is coming up with a new corporate business strategy that will be relevant to the present situation in which ZRL has found itself in,” Dr Atanga said.

“As a new team, we are looking at goals that are relevant to our business environment. The idea is to undertake a SWOT analysis of the present situation and then come up with new goals and targets.”

Dr Atanga said Zambia Railways is targeting to increase its market share of the bulk transport sector from the current 12 percent by encouraging businesses to move their goods from road to rail.

“We are ambitious and we want to grow this business so that we don’t depend wholly on government. At present we are moving 114, 000 metric tons of cargo per month but we have since raised that target this month to 120 metric tons. This year we are hoping to move 1.135 million metric tons by December,” Dr Atanga said.

He said Zambia Railways has a rated capacity of between 5 and 6 million metric tons of cargo adding that his management team is hopeful that ZRL will increase the tonnage to 3.5 million metric tons by end of 2015.

On rehabilitations, Dr Atanga said his set to award companies the rehabilitation contracts of its rolling stock by the end of July.

“This rehabilitation project is the major aspect of the company’s turnaround, it is major because it involves the major components of our business which is the rolling stock,” he said.

“We will be awarding successful bidders this month and they will take about two years to rehabilitate our rolling stock and we are hoping by end of 2015, we be able to move over 3.5 million metric tons per year.”

National Restoration Party (NAREP) president Elias Chipimo has predicted massive job cuts in the country’s mining sector.

Mr Chipimo told Qfm News in an interview that this is because of the current economic conditions prevailing in the global economy resulting in low copper prices.

He said the increased cost of production in the mining sector as a result of the PF government’s introduction of new laws and regulations without consulting is another factor that will lead to job cuts in the sector.

Mr Chipimo noted that the combined effect of the PF policies and global the economic conditions are impacting negatively on Zambia’s copper mines.

The NAREP leader said the looming state of affairs is sad noting that instead of more jobs being created, people are expected to lose jobs.

Residents in in Kasongo area on the Ndola-Kitwe dual carriageway have beaten and burnt to death an elderly couple suspected to have been practicing witchcraft.

The residents pounced on Jungo Chisola, 80 and his wife Mutengu Sankananu whom they beat until they passed out and later piled tyres on them before setting them ablaze.

Mr Chisola’s body was burnt to ashes while his wife had her right leg dislodged from the body and intestines were pulled out.

The residents accused the couple to have been behind the death of a man who in fact died in a road traffic accident.

The tread of murdering individuals on suspicion of practising witchcraft is becoming a disconcerting norm in Zambia. Government needs to step up address this issue.

In some cases elderly people suffering from mental disease and alzheimer’s which may set in due to old age are mistaken for witches. People also need to know that the brain shrinks in old age and as the brain shrinks thought processing wanes.The elderly begin to have memory lapses,forgetfulness.

In the village an elderly person forgets the route to his village and finds him or herself in another village,people anonymously agree that the Old person is a witch and that’s why was he or she is found in the wrong place wondering.

This commonly happens at night when the elderly go out of the house to relieve themselves they wonder off their hamlet into the other people’s homes and villages and are suspected of being witches;she was flying and dropped off in another village.

Chief Mpezeni urges government to transform Chipata into a city

Paramount Chief Mpezeni of the Ngoni People in Eastern province has appealed to government to consider transforming Chipata into a City.

Chief Mpezeni said if Chipata is transformed into a City, there will be speedy development in his area and more people will benefit from such developments.

Chief Mpezeni told the Republican Vice President, Dr. Guy Scott that his people have so many challenges which need to be addressed by government as soon as possible.

Chief Mpezeni added that his people are willing to work with the ruling Patriotic Front (PF) government to ensure that Chipata is put on the agenda to be developed.

The Paramount Chief has also appealed to government to ensure that they deploy more police officers to the area ahead of the forthcoming July 25th Chipata Central Parliamentary By-Elections in order to curb violence.

Meanwhile, Vice President, Dr. Guy Scott, has assured the Chief Mpezeni that government will ensure that Chipata is developed.

Dr. Scott says the PF is a caring government that does not segregate but works with a passion of developing the nation.

Obama Remarks on Gay Rights: Is Fr. Leonard Chiti Right?

President Obama made news recently when he called on Africans countries to respect human rights for all their citizens, including gays. Obama’s statement followed the long awaited U.S. Supreme Court ruling on the status of same-sex couples in America. After the court ruled that same-sex couples have equal rights like heterosexual couples, the President praised the move, claiming it was a “proud day for America.” But Obama did not end there – he pressed African countries to recognize gay rights as human rights.

“When it comes to how the state treats people, how the law treats people, I believe that everybody has to be treated equally.” Senegalese President Macky Sall responded by telling Obama that while his country is “very tolerant to gays,” it was “still not ready to decriminalize homosexuality.”

Both Western and African media jumped on this exchange. Many saw Sall’s statement as an open rebuke of Obama’s support of homosexuality. Others, however, viewed the encounter as a clash of cultures – Western liberal and African primitive. While African media empathized the former, Western media generally projected the latter.

As expected, the Zambian media carried story. The reported response of Fr. Leonard Chiti, the Director of the Catholic Jesuit Center for Theological Reflection forced me to respond. Fr. Chiti claimed that Obama’s call to decriminalize homosexuality is a non-starter in Zambia. The question is why? “When you look at the draft constitution, you will see that Zambians have been categorical about their rejection of clauses that seem to allow rights for people of such orientations and I don’t see any change in that regard.”

Fr. Chiti is entitled to his own judgment but the basis of his claim is highly flawed. To start, Fr. Chiti agrees that they are “people of such [same-sex] orientations who are Zambians, yet justifies their harassment based on popular opinion, which I find unjust. As a priest, he should have suggested how best we should approach the gay issue. Second, Obama’s remarks followed the ruling of the Supreme Court on the issue of human sexuality. That ruling rendered California’s Proposition 8, which outlawed same-sex marriages through the referendum (which won popular vote in 2008) invalid. In other words, human rights are not based on majority votes but on the conviction that every human being is endowed with inherent rights to be respected and protected. The court ruled in favor of equality – all citizens have equal rights in America. So what is wrong with treating all citizens equally?

Third, Obama’s statement should be understood within the context of the rule of law as opposed to votes. It is the court that interpreted the U.S. Constitution to mean that all Americans are entitled to equal treatment under the law. For me, Obama’s call for African nations to decriminalize homosexuality is not a non-starter but an opportunity for Zambians to discuss the issue with an open mind.

Finally, Obama called on African nations to treat all Africans regardless of their sexual orientation equally, which I believe is the duty of every State. Are gays citizens of our nations equally entitled to State protection as heterosexuals? That millions of Zambians are opposed to gay rights does not justify state sanction of their persecution. The holocaust in Nazi German and the Rwandan genocide were based on this kind of thinking. Dietrich Bonheoffer, who refused to side with the Nazis and was killed as a result once said:

“It is the nature, and the advantage, of strong people that they can bring out the crucial questions and form a clear opinion about them. The weak always have to decide between alternatives that are not their own.”

Fr. Chiti had an opportunity to direct the nation on the complex issue of homosexuality, but chose the popular route – thereby repeating a myth we all know – homosexuality is a Western import to Africa.

Before you insult me, let me help Fr. Chiti on this issue. The clash between Presidents Sall and Obama is due to what I term conflict of human rights. Who counts? – “the local people” or “the global community?” Is the claim that “our culture and religions do not accept homosexuality” enough to deny human rights to gays?

These questions are crucial to the issue at hand. Many Africans oppose gay rights on the basis that they are protecting cultural authenticity. Yet, our nations are part of the global community in which gay rights are now human rights. Since global rights are viewed as “universal and timeless,” the Western nations want Africa to respect them. On the other hand, African nations reject gay rights as a way of preserving Africa traditional and religious identity. But as Amy Guttmann argues,

“Cultural survival in and of itself is … not a human right, since the ultimate beneficiaries and claimants of human rights must be persons, and the price of enabling some cultures to survive may be violating human rights”

Gay rights defenders are convinced that gay rights are human rights, while African governments’ rebut such claims with ultimate impunity. The encounter between the two heads of States should be understood from this perspective.

Regardless of how we feel, the missing voice in that encounter is the African gay person. Rather than give gays a voice, politicians spoke for them. But as Bonheoffer once said,
“We must learn to regard people less in light of what they do or omit to do, and more in the light of what they suffer.”
When will Africa accept that gays have suffered enough and should be allowed to live peacefully in their nations? In 1868, Hogoza was executed in Natal, South Africa. His crime – he was gay. Across Africa, lesbians and gays have been sexually abused and in some cases killed. As I am writing some young boys are in jail – their crime, they are gays. Had Fr. Chiti reflected on the suffering of our fellow beings – the beatings, arrests, torture, and ridicule of, his response would have been different.

Obama or no Obama, gay communities across Africa are determined to fight for their Human rights. Our draft and national constitutions may criminalize homosexuality but gays are determined to win this fight for their freedoms. After all, we are not the first nations to resist gay rights – Europeans and American once did the same. But no system can continuously deny the oppressed their rights forever. Gays know their rights and no law will deny them what they believe are their fundamental Human rights.

The challenge is, to use Ian Douglas words,

“How can the global live with the local and the local live with the global, without either one or the other seeking to superimpose itself on the other with a destructive and life denying result?”

Our arrogance to gay rights is life denying, and only Christian love and humility will make us to see God’s image in all God’s people – even in our Gay, Bisexual, Lesbian and Transgendered brothers and sisters.

MMD gets backing on plans to protest against Acting Chief Justice

Opposition Alliance for a Better Zambia (ABZ) has backed plans by the Movement for Multiparty Democracy (MMD) to stage a peaceful demonstration against the alleged illegal continued acting of Justice Lombe Chibesakunda as the country’s Chief Justice.

ABZ president Frank Bwalya said even though his party does not share all reasons the MMD has put forth to call for the stepping down of Justice Chibesakunda from being Chief Justice, the ABZ will remain in support with the people calling for her to step down.

Speaking in an interview with Qfm, Father Bwalya observed that a government such as that of the Patriotic Front that is allegedly seeking to destroy all important institutions as the Judiciary to entrench itself, can not push the agenda to the develop the country.

And Father Bwalya has also disclosed that his party which was scheduled to be launched on July 1 this year will instead be unveiled on July 27 this year in Kitwe.

Father Bwalya says his party has already given notice to the Police about its official launch.

Father Bwalya noted that if the Police do not respond to the notice of the launch of the ABZ, his party still go ahead to launch its presence on the country’s political scene.

Father Bwalya has also disclosed there is also an alleged plot by the PF government to disrupt the launch of the ABZ in Kitwe.

The ABZ president has warned that such plots will not work as his party is determined to make its presence on the countrys political arena known through an official launch that will take place on a Saturday.

Tests on beef products on two impounded ZAMBEEF trucks negative

Tests on meat products on the two Zambeef trucks detained at the Katima Mulilo Border post have revealed NO sign of Aromatic Aldehydes.

Aromatic Aldehydes are believed to cause cancer.

But the Health Minister , Joseph Kasonde says the two trucks have since been released to proceed with delivery of the products to Zambeef.

Dr. Kasonde however says inspections on food products entering the country will be intesified to ensure they are fit for human consumption.

He said this in an interview with ZNBC in LUSAKA.

Dr Kasonde also said results on tests done in South Africa and Germany on the alleged unwholesome meat products seized from Zambeef are not yet out.

Last Week, Dr Kasonde told parliament that preliminary tests run on some Zambeef imported products tested positive of Aromatic Aldehydes.

Dora Siliya to be summoned soon for question-ACC Director General

Anti-Corruption Commission (ACC) has disclosed that it had started a probe into electoral graft allegations levelled on Dora Siliya by the Supreme Court,which nullified her election on June 27.

This is according to ACC Director General Roswin Wandi, who said the former legislator would soon be called for questioning as the ACC is “actively” on the case.

“Our legal team is already working on Ms Siliya’s case following the ruling,” Ms Wandi said. “We are already on the case and we will soon obtain the full judgement from the Supreme Court so that we can thoroughly study it and map a way forward.”

Ms Wandi’s disclosure comes days after Home Affairs Minister Edgar Lungu stated that the Supreme Court’s decision to nullify Ms Siliya’s election was to be taken “seriously” following the gravity of the corruption allegations.

“We want the public to know that we are taking this matter [Dora] seriously,” Ms Wandi said “ We cannot disclose the details but we are on the case.”

Ms Siliya was taken to court by PF candidate in the 2011 polls Leonard Banda, who contended that the former broadcaster engaged in a litany of electoral malpractices that influenced the election results in her favour.

Supreme Court judge Elizabeth Muyovwe in her ruling said Ms Siliya engaged in “illegal practices” and she also found a “massive” corruption case on Ms Siliya,who, while campaigning, also linked President Sata to homosexuality.

Botswana, Swaziland draw

Swaziland goalkeeper Nhlanhla Gwebu put up a fantastic performance as his side battled to a goalless draw with Botswana in the COSAFA Cup Group B opener at Kitwe’s Arthur Davies Stadium on Sunday.

Gwebu put up several brilliant saves in both halves to deny Botswana a win in the match characterised by poor finishing.

Both sides were cautious in the first half as they created few scoring opportunities in the match watched by a sizeable crowd at Arthur Davies.

Botswana could have taken an early lead had Moamedi Moatihaping not headed over the bar in the third minute.

Swaziland dictated play in the second half after their opponents dominated the first half.

Swaziland and Botswana enjoyed massive support from Kitwe fans despite failing to produce goals.
