The Ndola high Court was yesterday morning kept guessing on the whereabouts of Patrick Mwanawasa to commence hearing in the Kafulafuta parliamentary election petition.

Patrick’s absence forced the court to adjourn the matter twice with the hope of securing his attendance. When the matter was recalled at exactly 12:30, Patrick’s lawyer, Benson Siame informed the court that his client had communicated to him via phone that he was tied up.

Mr. Siame added Patrick promised that he would be in Ndola before the end of business but never turned up due to his busy schedule. This forced Ndola court Judge Mary Mulanda to adjourn the matter to today in the interest of justice.

Patrick Mwanawasa is petitioning the election of MMD’s James Chiseba as Kafulafuta Member of Parliament. Patrick is the son of former late republican president Levy Mwanawasa.

First Quantum Pays For Zambia’s 2012 AFCON Rights

ZNBC’s excuse that they cannot broadcast the 2012 Africa Cup has been given a boost after mining concern FQM gave them US$ 250,000.

First Quantum minerals resident director Kwalela Lamaswala said the deal will see ZNBC carry live TV and radio broadcasts of Zambia’s Africa Cup Group A games.

FQM’s package means ZNBC now has a shortfall of US$160,000 of its total broadcast package rights of US$410,000 for the Africa Cup tournament.

“First Quantum has had a fruitful association with soccer, and shares the passion of Zambians for the beautiful game. Therefore, it became imperative for us to lead the way in ensuring that the millions of soccer fans are not deprived of the joy and thrill of seeing their idols in action at Africa’s prestigious football arena,” Lamaswala said in a statement.

UPND will oppose increase in retirement age – Mweetwa

The United Party for National Development (UPND) has vowed not to support the PF government’s proposal to increase the retirement age from 55 to 65 years.

UPND deputy spokesperson Cornelius Mweetwa says the proposal once implemented will deny the young people especially graduates an opportunity to be employed.

He observes that narrowing employment opportunities for the young people will result in brain drain as most of the graduates will resort to looking for employment in the diaspora.

Speaking to QFM News, Mr. Mweetwa says the statement by the immediate past labour Minister Fackson Shamenda that the issue is non-negotiable is unacceptable and has urged the labour movement not to dance to the tune of government.

He adds that the move to increase the retirement age is a political gimmick which PF is trying to use to avoid paying retirement packages and shift the burden to future governments.

LAZ attacks on Judiciary anger Union

15
File:Some female judges and other judiciary staff pose for a photograph after a workshop in Lusaka

The Judiciary and Allied Workers Union of Zambia (JAWUZ) has taken a swipe at the Law Association of Zambia (LAZ) for using the media to call for reforms in the Judiciary.

Speaking at a media briefing in Lusaka today, union President Peter Mwale called on LAZ to engage stakeholders to improve and expand service delivery to the public in the dispensation of justice as opposed to speaking through the media.

And in response to recent statements that LAZ has issued on the Judiciary, Mr. Mwale has demanded that LAZ desists from issuing such statements as they have the potential to destroy and ruin the integrity and independence of the Judiciary.

He says it is unfair for LAZ as a professional body to call for the dismissal of any perceived corrupt judges and Magistrates through the media on unsubstantiated facts knowing that such officers cannot defend themselves through the press.

Mr. Mwale says LAZ is fully aware of the challenges that the Judiciary is faced with and that it is important for the Law Association to help address the constraints and not use their positions to seek for jobs in government.

And Mr. Mwale has refuted assertions of a management crisis in the Judiciary stating that management is intact and capable of delivering better services with regards to the dispensation of justice in the country.

Meanwhile, the Law Association of Zambia (LAZ) has increased calls for an independent Chief Justice through judicial reforms charging that the current Chief Justice position held by Justice Ernest Sakala enjoys no ‘security of tenure’ as Zambia’s democracy continues to grow, according to correspondence to the Minister of Justice in possession of the Daily Mail.

“The current Chief Justice does not enjoy security of tenure as he is on a contract and serves at the President’s pleasure,” the LAZ letter to the Ministry of Justice reads, adding: “This is not a healthy state of affairs requiring immediate remedy.”

LAZ president James Banda confirmed that there is correspondence to that effect but “I really can’t say anything more at this stage. I have to call you back.”

But the Daily Mail can confirm that it is LAZ’s considered position that a Chief Justice that serves at the mercy of the President is open to “manipulation” by the executive, hence the need to have the position protected by law the way positions such as Director of Public Prosecutions, Attorney-General and Solicitor-General are.

LAZ also wants High Court judges to be more independent via a reform that shall ensure they do not serve on contract because that, too, makes them weak, “especially that the terms of the contracts are not known to the public.”

The law lobby group also wants the Ministry of Justice to shake up the bench by replacing the top brass at the judiciary as soon as possible as the judiciary reforms continue, suggesting that “we already have eminent persons of high integrity who we are confident will spearhead reforms and ensure that the integrity of the judiciary is restored and maintained.”

This is the first time LAZ has effectively passed a vote-of-no-confidence in the current judiciary heads, in a development that may culminate in major changes in the judiciary depending on the response from the Minister of Justice.

Mr Banda told the Minister of Justice in the letter that the need for change was urgent in order for progressive judicial reforms to commence.

Chief Justice Ernest Sakala, a reformist himself, could not be reached for a comment yesterday.

A private company collects garbage in Lusaka

The Lusaka City Council (LCC) has issued another stern warning to unauthorized garbage collectors against illegal garbage collection in the city.

LCC Public Relations Officer (PRO) Henry Kapata said it was illegal for unauthorized individuals to collect garbage in residential areas before signing a memorandum of understanding with the local authority.

Mr. Kapata said this in an interview with ZANIS today.

He noted that all legal garbage collectors have since signed memoranda of understanding with the council and have since been allocated a legal dumping site in Chunga.

He said the council was incensed with illegal garbage collectors who dump the collected refuse indiscriminately.

Mr. Kapata explained that those who would not comply with the law will face the wrath of the law.

He further explained that the authorized garbage collectors were also working with the community in collecting refuse.

Mr. Kapata added that residents should also play a role by not dumping garbage in undesignated places.

Cases of Gender Based Violence on the increase

2

The Young Women Christian Association (YWCA) is working with government to stop gender based violence in the country.

YWCA Executive Director Patricia Ndhlovu told ZANIS in Lusaka today that cases of gender based violence involving spouse battering and killing in Zambia have increased.

Mrs. Ndhlovu said cases of women being killed as a result of domestic differences with their husbands have increased.

She said her organisation was working hard to sensitise the public against gender based violence while empowering the victims of the same.

She further said spouses should learn to dialogue as opposed to resorting to violence.

Mrs. Ndhlovu emphasised the need for victims of gender violence to report to the police and other relevant authorities so that perpetrators are brought to book.

She said the total number of gender based violence cases in the first quarter of 2011 was 2,028.

Out of this number, 462 cases were of child defilement, 64 were rape cases, 645 were spouse abuse and 12 cases were of murder involving
female spouses.

Mrs. Ndhlovu has since urged members of the public to actively help fight gender base violence and ensure a zero tolerance to the vice.

Liato’s K2.1 billion case: State not ready, Magistrate refuse to have case delayed

Austin Liato
Austin Liato

Principal resident Magistrate Aridah Chulu has overruled an application by the state to have the case in which former Labour Minister Austin Liato is charged with receiving suspected stolen property adjourned to a later date in February, 2012.

The case relates to the K2.1 billion unearthed at Mr Liato’s farm buried in the ground in two steel trunks.

Mr. Liato was this morning supposed to appear for plea when the prosecution team submitted an application for adjournment of the matter to a later date next month in order to allow the Director of Public Prosecutions (DPP) Mutembo Nchito time to determine whether the prosecution was in public interest.

But Principle Resident Magistrate Chulu dismissed the application on the basis that justice must prevail in the interest of all parties involved in the matter.

She said adjourning the case to February is too long a time especially that the court in its last sitting had agreed to deal with the matter today.

Magistrate Chulu further said Justice delayed is Justice denied and therefore ordered that the matter comes up on Wednesday, January 18 2012 for plea and commencement of trial.

She has since urged the prosecution team to get the necessary instructions from the DPP and be adequately prepared for trial.

And Mr. Liato’s bail has been extended.

Zesco starts maintenance works on Sesheke-Mongu line

5

ZESCO has started carrying out maintenance work on the 66kv Sesheke-Mongu transmission line into Western Province to improve the quality of service.

The works, which started on January 4, 2012, follow customer and stakeholder consultations which took place on December 30, 2011 in Mongu where the best way of managing power outages was agreed.

This is according to a customer notice released in Sesheke yesterday and signed by Zesco director of corporate affairs and business development Bestty Phiri.

Mr Phiri said the planned outages would be effected for three days in a week on Mondays, Wednesdays and Saturdays for approximately 20 working days.

The duration of each outage will be eight hours from 08:00 to 16:00 hours in Mongu, Senanga, Kaoma, Kalabo and surrounding areas.

Mr Phiri said the planned maintenance activities were aimed at improving the transmission line’s earthing, insulation and communication systems.

Recent communication audits conducted on a number of power line towers have indicated the need to re-install the earthing system following losses attributed to vandalism of the earth wires.

He said once the corrective maintenance works were completed, the area would have reliable power supply at the right voltage.

“The supply of safe, quality and reliable power to the area will contribute to sustaining economic and social activities, hence support improved livelihood of the communities in the area,” Mr Phiri said.

He said Zesco would also install optic fibre network on the transmission line which would bring about speed and broadband communication.

Mr Phiri said the improvement of the communication system would ensure that fast and reliable communication for the real time monitoring, control and operation of the transmission line.

“The optic fibre network to Western Province will improve the efficiency of Zesco’s communication and online processes leading to the timely responses to queries and faults.

Further, optic fibre will facilitate for the provision of broadband communication services to banks, Government departments, schools, hospitals and the business community in the area, thereby contributing to reducing the cost of doing business,” he said.

Mr Phiri said Zesco was thankful to the provincial administration and its customers for the permission granted to carry out the corrective maintenance on the transmission line.

Zamtel report shows that RP Capital official issued instructions and drafted presidential speeches

139

THE report by the Commission of Inquiry into the sale of Zamtel has revealed more anomalies, including one in which an official from RP Capital Partners of Cayman Island, issued directives to high ranking senior Zambian Government officials and drafted ministerial and presidential speeches on matters surrounding the Zamtel deal.

The 112 paged report states that the committee tasked to probe the sale of Zamtel discovered numerous e-mail correspondence from a Peter Heilner, issuing directives to senior Government, Zambia Development Agency (ZDA) and Zamtel officials.

“The committee has uncovered numerous email correspondence from RP Capital’s Peter Heilner issuing directives to high ranking and senior GRZ, ZDA and Zamtel officials, set timetables and tasks, drafted ministerial and even Presidential speeches and letters and orchestrated the deployment of personnel to strategic positions and departments,” the report reads.

The report states that it was clear from the outset that RP Capital, the transaction advisors in the Zamtel deal through Mr Heilner,single-handedly planned, managed, drove, controlled and executed the entire process.

The report says the Government, ZDA, Zambia Information Communication Technology Authority (ZICTA), State House staff, Zamtel and many others were reduced to the role of mere spectators with little or no input and control over the process.

The report says that audited Zamtel accounts dated March 31, 2009 pegthe book value of the company’s fixed assets -that is only the property, plant and equipment at US$81 million (K412,072,000,000).

The report states that the $81 million is just a book value and not the market value of Zamtel’s fixed assets which would be expected to be considerably higher than that.

“The committee finds it difficult to understand how RP Capital advisors could arrive at a value of Zamtel’s fixed assets of $38million in the absence of conducting a thorough, detailed and professional valuation of Zamtel’s fixed assets,” the report reads.

The Government further decided to pay for the 25 per cent shareholding it already owned in Zamtel and paid a total $334,440,000 in what was termed as Tax shares and subscription amount while Lap Green only paid $257 million for the 75 per cent shareholding of which the Government was only entitled to $42.6 million translating to 16.6 per cent of the sale value.

The Government has to date only received a cash sum of $15 million and that RP Capital received more than $12.6 million based on 5 per cent of $257 million.

The report reveals that the Zesco optical fibre network assets valued at approximately $20 million was given free of charge to Zamtel.

Lap Green also took over Zamtel as a debt free company with $64million sitting in its bank account which was provided by the Zambian Government.

And giving examples of correspondence, Press releases and speeches prepared by RP Capital’s Mr Heilner for the Government, the report attached a letter drafted by him and signed by former president Rupiah Banda on November 9, 2009 to Chinese President, Hu Jintao, asking for a loan from the China Export and Import Bank.

In the draft letter, Mr Banda was asking his Chinese counterpart to assist the Zambian Government obtain $75,424,323 concessional loan from the $10 billion programme for infrastructure in developing countries to cover the amounts owed to Zamtel’s Chinese equipment suppliers, Huawei and ZTE for projects that the two companies were in the process of completing.

“I write to you to request your assistance in a matter that is of national importance to the Republic of Zambia. As you may be aware, the Government of the Republic of Zambia is currently in the process of privatising Zamtel which has severely under performed in recent history.

“This privatisation will revitalise the telecommunications sector in Zambia through increasing investment and will contribute substantially to the development of Zambia as whole,” read the letter drafted by Mr Heilner on behalf of former president Banda to President Hu.

The letter stated that the sale of Zamtel was of considerable urgency in order to ensure the success of the company and on-going development of Zambia.

“I would like to request your support in obtaining approval from the China Export and Import Bank in respect of Zambia’s application,” the ?letter read.

Another document drafted by Mr Heilner was a Press statement by the then minister of Communications and Transport, Geoffrey Lungwangwa, on the ICT sector in Zambia.

In the statement allegedly written for the minister by Mr Heilner,Professor Lungwangwa said that the government and the communications Authority of Zambia (CAZ), ZICTA, had set out two ways in which they intended to encourage the deployment and usage of ICT products and services in Zambia.

Prof Lungwangwa said the first was through careful management of the licensing regime and that CAZ intended to issue no additional fixed or mobile licenses for the foreseeable future.

He said the second was through pricing and that CAZ intended to use its powers as set out in the new ICT Act to intervene in the wholesale market that existed between telecommunications operators.

Mr Heilner is also alleged to have provided answers to parliamentary questions, Order number 760, where questions concerning how much money the Government ministries and departments owed Zamtel immediately prior to the acquisition by Lap GreeN and how Lap GreeN intended to recover the debt.

The other question was on the total value of Zamtel assets at the time of privatisation.

Mines Minister Wylbur Simuusa
Mines Minister Wylbur Simuusa (L)

Government has refuted claims by the opposition MMD that lack of clarity by the PF on its economic policy has raised uncertainty among potential investors.

Mines and mineral Development Minister Wilbur Simuusa has told QFM that under the PF government there has been overwhelming response from the potential foreign investors who have expressed interest in investing in Zambia especially in the mining industry.

Mr. Simuusa noted that the PF government would also ensure that it keeps on promoting foreign direct Investment in flow saying this greatly contributes to the growth of the economy.

And Mr. Simuusa has also told QFM that the ministry has intensified mine inspections to ensure that mining companies comply with the standard safety measures.

Mr. Simuusa noted that the ministry is committed to ensuring that the lives of the mine employees are safeguarded.

He has since warned mines that would be found breaking the safety regulations of stern penalty action.

Meanwhile, Chinese ambassador to Zambia Zhou Yuxiao says his office recently conducted a research on the Chinese owned mines to see whether they were complying with the safety measures.

Ambassador Zhou says the research reviewed that the Chinese owned mines with only account for about 5 percent of the mining activities in the country met the required standards of safety measures.

The envoy notes that what prompted him to carry a research was as a result of the negative reports that had spread concerning the Chinese investment in the country.

He however, added that he was aware of the few cases involving Chinese investors who could have abrogated the laws and added that the Chinese investors that will be found wanting should be prosecuted.

Ambassador Zhou was speaking to QFM news.
