the family and herself are happy with her appointment as MMD national trustee contrary to claims by the late president’s son Patrick that the family was not consulted.

Ms Mwanawasa said claims by Patrick that she was not aware of the appointment were not true and advised her nephew to avoid being used by people not happy that the Mwanawasa family was ready to work with President Rupiah Banda.

“The Mwanawasa family has always been ready to work with President Banda. We said this even at first prior to the October 2008 presidential by-election and I do not see the reason things can change now.

“This situation will not take us anywhere. I mean, Patrick has never been in touch with me to talk about this issue and if anything, Patrick is just a child and he is not the person we should be consulting over such issues,” she said.

Ms Mwanawasa said family members who included her uncles Green Chilabika and Philimon Mokola and her older sister Rona were all consulted and gave a ‘green light’ for her appointment to the NEC.

Reacting to claims published in yesterday’s Post edition that she and the family were not consulted, Ms Mwanawasa said she even had the opportunity of discussing the matter with her close friends who all advised her to accept the appointment.[quote]

She advised Patrick to go back to school and build his future than allowing himself to be used by the people that would not help him shape his destiny.

Ms Mwanawasa said her family was ready to work with President Banda’s administration and that was the reason she accepted the appointment.

“In fact, after my appointment, we even went to State House with my two uncles to meet and thank President Banda for recognising me as a person who can work with the party and this confirmed that we were actually consulted,” she said.

Rona Mwanawasa said separately in Chisamba that the family actually sat down and advised her sister to take up the position.

“We actually sat down as a family and advised Evelyn to accept the appointment. We are MMD and we see no reason we should abandon the party to join the opposition just because our brother has died,” she said.

She said that those trying to use Patrick should desist from doing so because they were just bent on destroying the young man.

“In fact, if Patrick says anything wrong in the whole thing, he should have contacted us than going to the newspaper. We have never been in touch with him and it is not true for him to say he had even contacted Evelyn over the appointment,” she said.

Patrick claimed in the Post Newspaper story that MMD wanted to use the Mwanawasa name only when it suited them and that the appointment of her aunt was not genuine and was just intended to benefit the MMD.

But Rona said Patrick was not a politician and had never been one and that those trying to use him were not helping him.

Operations at LCM to commence after development of concentrator

Operations at Luanshya Copper Mines, LCM, owned by new Chinese investors, NFCA, will begin once the mine is redeveloped.

NFCA General Manager, Luo Xingeng, says operations are expected to commence about Six months after the takeover of the mine.

Mr Luo, who spoke through an interpreter, disclosed this when he paid a courtesy call on Luanshya District Commissioner, George Kapu today.

Mr. Luo said the investor is focusing at developing the flotation system at the concentrator and the underground haulage system that are obsolete.

He said the new investor is reorganising the mine to ensure facilities are put in place for improved production and overall performance of the mine.

He said the mine owners will make effective use of facilities for reduced production costs to sustain operations even in the wake of the global economic crisis.

He also assured government that management at the mine will strictly adhere to labour laws and ensure that workers are well remunerated.

Mr. Luo said his company shares government concern over some investors, who are denting the image of genuine Chinese investors, by mistreating workers and failing to adhere to labour laws.

He said all the 1,700 former employees of LCM, who lost their jobs when the mine shutdown operations, will be recruited though the exercise will be conducted in phases beginning with critical areas.

District Commissioner Mr. Kapu said the coming of NFCA to Luanshya has brought relief to the residents, who were faced with high rate of unemployment.

He said government is happy that NFCA has come at a time when most of the companies closed operations due to negatives effects of the global economic recession.

Striking nurses and other health workers at the University Teaching  Hospital, UTH, have given government a two-week ultimatum in which to address their demands.

The workers have vowed to continue with the strike until government pays them improved risk, night duty, Uniform, and housing allowances among other demands.

They accused government of neglecting their plight of working up to 78 hours per week when ministers are getting huge salaries and allowances.

The workers issued the ultimatum when Labour Minister Austin Liato addressed them at UTH this afternoon.

The irate health workers, who displayed placards denouncing the effort by Labour Minister to address them, said they will not succumb to any form of intimidation by government.[quote]

Zambia Congress of Trade Union, ZCTU, President, Leonard Hikaumba, who sympathised with the nurses advised government to desist from evacuating ministers to South Africa for medical treatment because the measure was compounding the problem in the health sector.

“We demand equal treatment in the distribution of health care facilities with those in south Africa because nurses at UTH are working under difficulty situations. We see senior government officials being flown outside for medical treatment when that money can be used to purchase the needed equipment, where is the fairness?”, Mr. Hikaumba wondered.

Mr. Hikaumba advised the nurses to remain united as ZCTU is working with the Zambia Union of Nurses Organisation, ZUNO, to pressurize government to improve conditions of service for public health workers.

He said the 15 per cent salary increment awarded to the nurses was done in good faith and dismissed claims that government bribed the labour leaders to settle for a ‘meagre’ 15 per cent salary increment.

He urged the health workers to go back to work because if they continued with the strike action, government would take advantage and weaken the solidarity in speaking with one strong voice through their reputable union, ZUNO.

But in response, Labour and Social Services Minister, Mr Liato urged the nurses to go back to work as their plight has been heard.

Mr. Liato, a former labour movement leader of the Energy and Allied Workers’ Union said negotiations for bargaining cannot be done in a short period of time but government acts when communicated to through labour union leaders.

He added that President, Rupiah Banda, has been in office for only nine months and pleaded that government be given enough time to address the concerns of the workers.

“Go back to work then the negotiation will go smoothly because government cannot start bargaining when workers are away. Government has heard from your side and so hear our side also. Allow the bargaining process to start because no-one is interested in trivialising this matter be it government or union leaders. As government we are addressing the strike with the urgency it deserves,” assured Mr. Liato.

Continuous voter registration to commence this month

The Electoral Commission of Zambia (ECZ) has announced that it will soon kick-start the continuous voter registration exercise.

ECZ Public Relations Manager, Chris Akufuna told ZANIS in an interview in Lusaka today that the commission was currently putting in place the necessary logistical requirements.

Mr. Akufuna said ECZ would strive to stick to the earlier announcement by its Chairperson Justice Florence Mumba to commence the exercise this month.

“The Electoral Commission of Zambia will endeavor stick to the earlier statement by Justice Florence Mumba that the continuous voter registration will start by June this year and members of the public will be informed once the exercise begins,” he said.

Mr. Akufuna said the ECZ is working tirelessly to ensure that the exercise commences promptly.

The ECZ Public Relations Manager said the commission is alive to the fact that it needs to act with a sense of urgency over the matter.

He said the exercise would ensure that all eligible voters are capture so that they may exercise their right to vote.

Pressure is amounting on the ECZ to commence the continuous voter registration exercise.

Government this year allocated K5 billion in the national budget to the ECZ for the continuous voter registration.

President Rupiah Banda is this Wednesday expected to hold a press conference at State House to address various issues affecting the nation.

This is according to a statement released to ZANIS by his Special Assistant for Press and Public Relations, Dickson Jere in Lusaka today.

Mr. Jere said the media briefing is expected to begin at 10:30 hours, adding that members of the diplomatic corps and accredited journalists should be seated by 10:00 hours.

He also stated that journalists, who wish to cover the press conference, should contact the Zambia News and Information Services (ZANIS) for accreditation and clearance.

Since he came into office in November last year, President Banda has held only one press conference.

Confusion reigns in Shangombo over electricity generator

Confusion reigned in Shangombo district today when residents protested against Zesco’s attempt to move a power generator from there to Chavuma district in North-western province.

The residents foiled the move by Zesco management to transport one of the power generators to another province.
Sinjembela Member of Parliament (MP) Mubika Mubika confirmed the development to ZANIS in a telephone interview today.

Mr. Mubika said a Zesco vehicle which was carrying the equipment, has since been detained at Shangombo police station.

He expressed disappointment with Zesco management for attempting to take away one of the two generators from his district to another especially that the area has had no electricity for many decades now.

Mr. Mubika lamented that he was not informed about the move by Zesco to take away the generator from his area to Chavuma district.
He wondered how his area would develop without electricity, which he said was a driving force to attaining the Millennium Development Goals (MDGs).

Mr. Mubika said power was vital to Shangombo district because of the ongoing developmental projects in the health, education, agriculture, tourism and local government in the area.

He said it would be irrational for Zesco to take one generator away especially that the two pieces of electricity generating equipment were not yet operating well.

Mr. Mubika, who is also Communications and Transport Deputy Minister, castigated Zesco saying he would lose his political stability if electricity supply was interrupted.

“ZESCO should know that Shangombo district is growing at a faster rate because of the developmental projects embarked on by government in my area and it is for this reason that government is pumping in a lot of funds to Shangombo district to spearhead development,” he said.

Meanwhile, Zesco has since instructed its engineers to stop the decision to remove the generator from Shangombo.

Zesco Public Relations Manager Lucy Zimba told ZANIS in an interview that in the interim, the company would look for an alternative way to provide Chavuma district with a generator.

Ms. Zimba said even though one generator was removed from Shangombo to another district, it could have been on short term basis because the other generator in the district was capable of supplying the entire area with electricity.

“Shangombo has got two generators and getting one of the generators was done in the short term basis because we realise that Shangombo has got a few customers. We have rescinded the decision to remove one of the generators from there to Chavuma district,” she said.

Chavuma and Shangombo districts are among the districts in the country that are run by thermal power generator.

Government, realising the cost of fuel has embarked on the rural electrification programme to connect Chavuma and Shangombo districts to the national grid.

Government devises stringent measures to curb corruption

Government has put in place stringent mechanisms to curb corruption in the public service.

Secretary to Cabinet Joshua Kanganja said it has become necessary to put in such measures because government efforts to fight corruption were being frustrated by some unscrupulous public service workers who corruptly divert public resources for selfish personal gain.

Dr Kanganja was speaking in Lusaka today during a Zambia National Broadcasting Cooperation Television interview to mark the eve of the Africa Public Service Day, which falls tomorrow.

He said cabinet recently approved the Anti-Corruption Policy, which is aimed at enabling ministries and government departments to perform within the legal framework of government.

He said government was concerned with the way public resources were being mismanaged or misapplied, adding that it will soon put in place measures that scale up the formation of integrity committees in all parts of the country.

Dr. Kanganja disclosed that government was working out modalities that would establish a financial intelligence unit, with a view to addressing fraud and money laundering related activities.
He further disclosed that President Rupiah Banda would soon launch the Anti-Corruption Policy.

Meanwhile, Dr. Kanganja has urged civil servants in the country to be non-partisan in order for them to effectively implement government policies.

Dr. Kanganja said there is need for civil servants to be loyal to the government of the day as government can only propel development if it received maximum support from the workers.

He further called on the public service workers to exhibit the highest sense of discipline in order to ensure that the public service delivered to the people was enhanced.

Dr. Kanganja said there was need for public service workers to change their mindset and poor working attitudes if they are to deliver quality services to the public.

The Secretary to Cabinet has since urged public service employees to be selfless and remain focused in order for them to contribute meaningfully and effectively to the development of the country.

Court Registrar rejects Chiluba’s submissions

Ndola High Court Registrar Jones Chinyama has turned down Second Republican President Frederick Chiluba’s application for submissions, pending judgement of his case.

Dr. Chiluba had last month made an application to file his submission after failing to meet the deadline.

Mr. Chinyama told the court that he had never instructed the senior court’s clerk to admit Dr. Chiluba’s application to file submission after the deadline.

Dr. Chiluba applied to file his belated submissions on May 21.[quote]

He was earlier supposed to file the submission on April 30.

His spokesperson Emmanuel Mwamba said Dr. Chiluba will revert to his defence counsel to decide the next action.

Meanwhile Mr. Chinyama has extended Dr. Chiluba’s bail application.

This is in a case where he is accused of plunder of national resources.

Chinese power company show interest in Kafue power project

gridThe China National Electric Equipment Corporation (CNEEC) has shown interest in developing the Kafue Lower Gorge Hydro Power Station at a cost of $1.5 billion.

Corporation President, Zhao Ruolin, says the Chinese power company will source for the money if the Zambian government agrees to contribute fifteen per cent of the total cost.

Znbc’s Luckson Nthani reports that Mr. Zhao made the pledge in Beijing on Monday.

This was when a delegation of Zambian parliamentarians and government officials visited the Headquarters of CNEEC which is solely-owned by the Chinese government.

He also said CNEEC is willing to help Zambia to develop alternative sources of energy from bio-mass, thermal, solar and wind.[quote]

At the same meeting, Chief parliamentary Whip, Vernon Mwaanga thanked the government of China for supporting Zambia’s efforts to meet its energy needs.

And Commerce Minister Felix Mutati has invited the President of CNEEC, Mr. Zhao to Zambia in July to attend a SADC pledging conference for the Kafue Lower Gorge Power Station Project.

Mr. Mutati said Zambia’s power deficit needs urgent attention.

CNEEC has already signed a Memorandum of Understanding with private investors in Zambia who are planning to develop a hydro-power station on the Kalungwishi River in the Luapula Province.

The Kalungwishi River Power Station is expected to cost $600 million.

Teachers in Northern Province call off strike

Teachers in Northern Province have ended their two-week long strike action and have since resumed work.
Zambia National Union of Teachers (ZNUT) Provincial chairperson, Nondo Kasanda confirmed the development in an interview with the Zambia News and Information Services (ZANIS) in Nakonde yesterday.

Mr. Kasanda, who is also Zambia Congress of Trade Unions (ZCTU) Nakonde branch, said teachers in all the 12 districts in Northern Province have ended their strike action and gone back to work.

He said the union in the province was happy that the teachers have decided to resume work despite being unhappy with the 15 per cent salary increment which it signed with government recently.
He commended teachers for their resolve to resume work in the interest of the children and the nation at large.

Mr. Kasanda said the union was aware that its membership was disappointed and frustrated with the outcome of the protracted negotiations for increased salaries and improved conditions of service for the year 2009.
He has also supported calls for the formation of one teacher union so as to increase the bargaining power.

And Mr. Kasanda has said teachers in Northern Province have welcomed the appointment of Dora Siliya as Minister of Education, replacing Geoffrey Lungwangwa, who has gone to the ministry of Communications.

Mr. Kasanda appealed to Ms. Siliya to quickly settle down and ensure that a technical committee is appointed to look into the issues of housing allowances for the teachers and ensure that they are concluded soon.

The ZNUT provincial chairperson has also invited Ms. Siliya to visit Northern Province schools in Chiluba and Kaputa districts for her to appreciate the problems being faced by the teachers there.
He also appealed to the minister to ensure that teachers were paid their outstanding fixed housing allowances in good time.

Nakonde SDA church cleans up police cells

The Seventh-Day Adventist (SDA) church Dorcas mothers in Nakonde district in Northern Province yesterday cleaned up Nakonde police cells.

The Dorcas mothers also prepared food for the remandees and later donated food stuffs worth thousands of Kwacha.

Speaking to the Zambia News and Information Services (ZANIS) at Nakonde police station shortly after the cleaning exercise, Nakonde Main Church Dorcas Leader, Catherine Sinyangwe said the church had a duty of looking after the needy people in society.
Ms. Sinyangwe said the church will not relent in carrying out community services in the quest to improve the living standards of the vulnerable people in society.
She also appealed to those in prison to always remember to pray to God to intervene in their situations.

Earlier, SDA pioneer Elias Chileshe, in his special sermon to the remandees said God does not forsake his children no matter what they do.
Reading from Luke 15:11, Chileshe said God was always willing to receive his children as long as they confessed their sins.
He also appealed to the members of the public to stay away from going against the law saying God is not pleased seeing his children in prison.

State’s evidence against Former President FTJ Chiluba

THE State has submitted that the court should convict former Second Republican president, Frederick Chiluba and his two co-accused persons, former directors of Access Financial Services (AFS), Faustin Kabwe and Aaron Chungu on all the 12 counts they are each charged with.

The State submitted that the evidence before the court proved beyond any reasonable doubt that the accused persons committed the offences under each count in respect of which they stand charged.

This is in the case in which Chiluba, Chungu and Kabwe are charged with theft of public funds amounting to over US$500, 000.

The State submitted that the monies were paid out in favour of beneficiaries other than the Government, or deposited in private accounts a conversion, which coincided with an intention to permanently deprive the Government from use or enjoyment of the funds.

The State also submitted that according to the meaning of section 21 of the Penal Code all parties to a common unlawful purpose are liable as principal offenders irrespective of the role played in the joint enterprise.

The State proposed to deal with these counts together as the court would note that the evidence relating to these counts was largely identical.

“ This honourable court, may thus if the evidence before it warrants, convict the three accused persons either in counts one to three or counts four to six as principal offenders, even though they were not all perpetrators of the crime,” read the submissions.

Task Force prosecutor Mutembo Nchito submitted that in the above counts, Kabwe and Chungu were the principal offenders while Chiluba was an accessory before the fact as he procured the commissioned offences charged in the said counts according to section 21 (2) of the Penal Code.

He submitted that in counts seven, eight and nine actus reas in these counts occurred through the fraudulent conversion of Government funds to the Zamtrop account for the use of Chiluba’s children. [quote]

Mr Nchito submitted that Chiluba was liable to be convicted as a principal offender either on the basis of the principal of joint unlawful purpose with person here not indicated or for procuring the offence in counts seven to nine.

“The evidence before this court is that, that was a Government account and that all the monies in it ought to be treated as such, we wish to stress that the payments to Chiluba’s children were made out of the Zamtrop account, the defence ought to show that monies paid to his children were private sources,” read the submissions.

And in counts 10 through to 12, the State submitted that the transactions involved in these counts were similar to those involving counts one to six in that each transaction was a perfect replica of the others.

He submitted that at the time the conversion of the funds took place the accused persons intended indefinitely to exclude the Government from enjoying its rights to the monies alleged to have been stolen.

“The fact that Kabwe and Chungu did not want to keep a ledger at AFS to replicate the ledger at Meer Care and Desai, the State submit that the action of the two indicated that they did not want these transactions to ever come to light since stolen Government funds were laundered through this account,” he stated.

The State submitted that the circumstances in the case revealed a joint unlawful purpose between Chiluba and his co accused persons as there was clear intention to divert Government funds to procure properties for Vincent Malambo and Eric Silwamba by Chiluba as promises although he might not be directly involved in actus reas.

Earlier, Chiluba had submitted that the case be dismissed because it appeared to be novel and mere fiction.
Chiluba said this in his final defence submissions filed in court by his lawyers, Robert Simeza and John Sangwa. Judgment has been set for July 20.

Mpulungu man dies mysteriously

A Mpulungu man in Northern Province has mysteriously died after he allegedly “crash landed” on one of the houses in Muzabwera compound.

Local Police sources confirmed the death and named the deceased as Milanzi Sipanje, who is believed to be in his 40s.

ZANIS reports that Police said Sipanje was brought to the police station around 02:00hrs this morning (Sunday) naked, after he “crash landed” at one of the houses.

He was later charged with criminal trespass.

Sources said as police officers on duty were trying to interrogate him, Simpanje suddenly grew weak adding that the last words he uttered were only his names.[quote]

He died around 10:30 hrs as police were trying to take him to the hospital after noticing his weakness.

Police said they suspect witchcraft related activities as being the cause of his death. The victim sustained no bruises or any injuries on his body.

And police have dismissed as false, assertions from some Mpulungu residents that Sipanje died in police cells after being clobbered for failing to pay the ‘cell fee’ by one of the ‘landlords’ in the cells who are famed and notorious for making their own rules.

They said their investigations revealed that Simpanje could have died of natural causes and not as a result of beatings sustained whilst in police cells.

Hospital officials at Mpulungu district hospital also confirmed receiving Sipanje’s remains saying the body was Brought In Dead (BID) around 10:38hrs this morning.

The deceased’s body is lying in Mpulungu district Hospital awaiting postmortem.

Authorities at Saint Mark’s boarding high school in Choma, Southern Province have been given a two-week ultimatum to resolve the problem of poor sanitation which is threatening the lives of pupils at the learning institution.

ZANIS reports that according to a report submitted in Choma to a United Nations Children’s Fund (UNICEF)sponsored workshop on legal enforcement under the Community Led Total Sanitation programme, the action follows an inspection by a team of health experts conducted at the school Friday.

The report states that pupils at the institution answer the call of nature in the surrounding bush as the ablution block is in a pathetic state due to erratic supply of water.

The extent of open defaecation which is evident around the school premises has the potential to spread disease to both the institution and surrounding communities, the workshop heard.

The report has also revealed that raw effluent discharged from the school sewer system is flowing into the adjacent Munyeke stream thereby posing a serious danger to unsuspecting villagers consuming water from the stream.

The workshop heard that the school surroundings are in a pathetic state due to the accumulation of heaps of garbage and general neglect by the school administration.

“At the time of inspection, the school management was very uncooperative and could not take any advice to improve the school sanitation, “the report states. “The school has been given two weeks to resolve its sanitation challenges failure to which closure will be recommended in line with the provision of the law to protect human life.”

The report also raised concern at the poor state of the school dining hall which has no chairs but only old and dirty tables, forcing pupils to take their meals while standing.

And chief Macha who described the situation at Saint Marks boarding high school as unfortunate said he would next week personally visit the institution in his capacity as chairperson of the district Joint Monitoring Team on Sanitation to discuss the matter with the school administration.

He said the school may be recommended for closure if the administration fails to abide by recommendation of the health inspectors.

“I am extremely embarrassed by what is happening at the school which has a good record of academic excellence. Something has gone wrong at management level. I will go there next week to discuss with the headmaster so that we find a lasting solution,” he said.
