I asked Chungu to come back, his Lawyer

Former intelligence Chief, Xavier Chungu’s lawyer, Nicholas Chanda said that he asked his client to return to Zambia because he had no case.

“I advised him to come back because the State had amended its charges unless it wants to start the cases afresh,” Mr Chanda said.

Mr Chanda said he asked Chungu to surrender himself to the police because he did not want him to appear as if he was running away from something although there was no case against him

And chairperson of the Task Force on Corruption, Max Nkole denied that the Task Force on Corruption had struck a deal with the former intelligence chief.

Mr Nkole said assertions that the Task Force had a deal with Chungu to make him a State witness were false because the latter voluntarily took a plane to come back home at his own cost.

He said Chungu’s return would be helpful to both the prosecution team and the defence.
“We are not trying to persecute him but to seek the truth out of him, everything boils down from him. He becomes relevant not only to the prosecution but also the defence,” he said.

Mr Nkole said the decision to have Chungu become a State witness depended on prosecutors who were handing his cases.

“However, the accused is at liberty to decide whether to become a State witness or for the defence,” he said.

He said in law, an accused person could opt to become a witness but in the present state Chungu still remained charged with various criminal cases.

Mr Nkole said Chungu landed in the country at midday and that the Task Force on Corruption was interested to know how he escaped and those who aided him would be prosecuted.

On whether certain cases Chungu was facing would be amended, Mr Nkole said this depended on procedure and the prosecution team who would decide if they would have to start the cases afresh.

When asked about where Chungu had come from, Mr Nkole refused to disclose on grounds that this could compromise the security of that country.

Prior to his escape, Chungu was facing a number of cases in court.

In one count for instance, Chungu was alleged to have abused authority of his office as ZSIS director general by making irregular payment of US$70,000 to church organisations abroad on February 16, 2000.
In the second count, Chungu on February 12, 1999, allegedly stole US$16,846 cash which came into his possession by virtue of his employment.

Then senior resident magistrate, Douglas Zulu, discharged Chungu following an application by the Anti-Corruption Commission to withdraw the case on grounds that he was facing a similar charge in another court.

The Abachas disclosed where the money was and how much and they were given some and the state took the rest and they did not go to jail. Obasanjo said taking them to court was just making lawyers rich. This is what the Nchito brothers have done. Why not just ask FTJ and company to confess, get all the money and give them amnesty?

No. The police must prosecute lawyer Nicolas CHANDA for standing in the way of Justice. Anyway, police will prosecute nobody over CHUNGU’s stay away because they, police, also knew where Chungu was, lest the tax payers ‘prosecute’ the police.

    Chungu was in MAPUTO. So, Chungu was in MOZAMBIQUE. There shall be no security threat on that Country.

    Here is what I think. It seems the task force is overwhelmed with cases. So what the government should do is place bounties.

    They should place bounties on individuals on the wanted list. They should then make this list available to private investigators and how much they will pay for the bounty.

    I tell you, you will see criminals being persecuted left right and centre.

    We already have a private police force anyway (ARMCO, SAFETEC, etc) and they seem to do a better job than ZP.

    BTW, is the TASK FORCE like a Zambian FBI or something???

    Rashid, Maestro’s views and mine differ. We are two different people with different interests and different points of view. The only thing I have in common with Maestro, Village concept and Sarah is the support of Hakainde Hichilema.

This slowness is probably calculated and I think that is why former President Chiluba’s cases have not yielded anything. The man handpicked late former President Mwanawasa and so what would the late have done to ‘bite the finger that’ feed him? All these things we have seen are a CIRCUS, but now the MMD has to reorganise itself in readiness for 2011 elections. Therefore, all key criminally charged Luapulans and Northerners have to be cleared so that the Undereducates votes will be neutralised by winning their support as retaining GRZ in the next tripatite elections becomes crucial.

    I dont know much about the Chungu guy but from what I can gather up, he seems to be a key figure in the persecution of Chiluba, Katele, etc and so there is not much I can say about the whole issue.

    What I have made here though is an observation and the observation is newspaper sales will sky-rocket, law firms will make loads of money through dragging court cases and who knows, the task force and Zambia Police will get a tap on the back.

    Not that it matters but as for the other posts, Biggie Jim and I are planning on how we will own a group of companies in Zambia. We will be like a powerful minority…lol.

    Am sorry my friend its not the cases that are amended but the laws that made Chungu amenable to court. On the other hand i agree with you that based on changes in the legislative framework he may have little to answer for. the defence team studied his case finely. It will be reduced to a mere academic exercise rather facts at law and corresponding evidence. Have fun man.

    However, it is way offside from what I think and believe.My understanding is that education enlightens an individual and it is cardinal for someone to mmake sound judgements.Thus, below Grade 12 school dropouts can NOT, not NEVER, make rational decisions no matter how much credible advice they recieve.

    Many pipo are calling , rightly so, for the plundner cases to be droped to save money. But these cases have value that money can not measure. Like the imppression investores and other goverments have of zambia fighting corruption. It also keeps the fight in the populance phycic alive.   168. This chungu issue raises more questions than answers. We keep hearing that he came back on his own and willingly handed himself to the police. But why then was he using a fake name in his passport? And why wasnt his lawyer and the police waiting for him if he was coming to hand himself in? Why did it take a tip from an immigration officer to recognised him for the police to organise themselves and arrest him at the airport? I have a feeling that the guy simply intended to sneak into the country and live a quiet life with the full knowledge of RB’s govt. Him being arrested was not part of the plan

    And Caritas Zambia executive director Samuel Mulafulafu has said Chungu’s return is a test case for President Rupiah Banda’s commitment to fighting corruption.

Chiluba must have been promised a lot of things including droping all the court cases and recognising his legacy which had been put in jeopardy by the Mwanawasa admn. Chiluba must have been promised a lot of things including dropping all pending court cases and recognising his 10 year legacy which had generated in to oblivion bcoz of levy’s fight against corruption. The prosecuttion of plunderers was a good cause but in it lay a monster invisible to many and the campaign has largely contributed to the continued slow development in other sectors of society.
