The Lusaka Magistrates Court has sentenced prominent musician Maiko Zulu, formerly known as St Michael, to six months imprisonment with hard labour, suspended for one year on one charge of trafficking in five balls of cannabis weighing 17 grammes.

Passing sentence on Zulu, 39, of house No. 15, Libala Stage 2 in a packed courtroom yesterday, Magistrate David Simusamba said Zulu, while serving his sentence, should not engage in any offence related to drug trafficking, failure to which he would be slapped with a custodian sentence.

“I have considered facts in mitigation and it is apparent that the offender is a house-hold name and a chief breadwinner of both his family and extended family.

“I will, therefore, impose a jail sentence on you, Maiko Zulu, of six months with hard labour and a suspended sentence of 12 months in which you will be required to visit 10 high schools in Lusaka, perform at Government functions and public holidays for free,” he said.

The magistrate said Zulu, in his community work, would be required to visit 10 high schools in Lusaka Province to speak about the dangers of drug abuse.

Mr Simusamba said Zulu deserved lenience because he was a first offender and an icon in championing child labour issues in communities.

Facts before the court were that on February 3, 2009, Zulu did traffic in psychotropic substances namely marijuana contrary to the laws of Zambia.

The sentence means Zulu would serve the 12-month sentence outside prison but should not commit a similar offence within the stipulated time.

In mitigation, Zulu through his lawyer, Sugzo Dzekedzeke, said he prayed that the court did not give him custodial sentence because he had not wasted the court’s time and taxpayers’ money by admitting the charge without delay.

Zulu said if the court meted out custodial sentence on him, his dependants would suffer because he was not just the chief breadwinner of his household but also of his extended family, which included his mother and eight children from his deceased siblings.

He said he had two school-going children who would suffer if he was sent to province.

Zulu said he was International Labour Organisation (ILO) ambassador against child labour and also an ambassador of the courts of law through his day-to-day activities.

He said he was also coordinating a programme on behalf of ILO meant for creation of employment for youths in the country.

Zulu said should a custodial sentence be slapped on him, the ILO programmes would be affected.

He said he was also the coordinator of a football team in his community that sought to identify talent and prevent youths from engaging in dangerous activities.

Local musicians that attended Zulu’s judgment included Angela Nyirenda, Saboi Imboela, Danny Peddle, Mozegeta, Mathew Tembo, James Chamanyazi and Moses Sakala.

Comedian Bob Nkoshya was also present.

  4. Maiko, don’t go round being a bad influence on our children. Rastafarianism is not about smoking ganja. Its about promoting equality amongst all human beings of whatever race, colour, creed, religion, culture etc. You are an icon who should lead by example. Its not too late man, you can still redeem yourself. Every man is bound to fall, but what is important is not to remain on the ground, but raise and contribute positively to society.

    6 months sentence with hard labour but suspended for 1 year means, he is free and will not go to jail at all…but, should he be found with dobo within 1 year..he goes in automatically, for a longer period, which cannot be suspended.

  21. The magistrate missed out one point. This man needed to be rehabilitated before going round schools & performing at public functions. Who is going to listen to a man who will probably be jayed.

    Dagga smoking is highly addictive. Maiko admitted the “dobo” was for his consumption. The process of stopping the intake is gradual & therefore, he needs serious counselling before doing the community work. The magistrate court should reconsider the decision they made.

  27. In Zimbabwe they have a region (near Zambian boarder)where dobo smoking is regarded as part of the tradition of the local people. They get hordes of tourists there (similar idea to Amsterdam with its ganja smoking pubs). The result in Zim has been plenty of development for the locals originally regarded as backward, proper control of the use/quality of the stuff & ofcourse government gets taxes. It is a win-win situation but unfortunately we just want to condemn.

Apparently, smoking the stuff in moderation does not do much harm to one’s body, but the problem is “moderation” is subjective. I think this is the reason why many govts the world-over have specific laws regarding this substance. The case you have highlighted is one way in which a positive outcome can be achieved in using this substance. I also note that you said a “50/50” situation is arrived at.

  47. I get the feeling that Maiko Zulu did not have adequate legal representation. The cannibis found in his possession was not adequate to incur a charge of drug trafficking as there would be no economic justification for him to do so. The reason he pleaded guilty was because he wanted to be treated as a first offender who did not waste the court’s time. However, I feel this has cost him dearly as he ended up to confessing to a more serious crime than that which he actually committed….Hold on a moment. I’ve just noticed that the caption under the photo mentions possession rather than trafficking. It would be helpful if the article was clear as possession and trafficking are not the same.

I burn it as well and I’m a medical doctor (a respected member of the community I like to think). And guess what- I have a few older colleagues who smoke it as well- I am talking heads of hospital depts here. Being a US born “Zambian” from Zambian parents I feel sad to read that “THE MAN” is in charge everywhere. I have visited Zambia twice in my life and love it and hope to settle there when older.   65. Maiko Zulu’s case remindes me of one Nasty D, also a musician. ba December DEC nabbed him and that was the turning point. he quite music and went to CBU to persue a course. Ha sometimes bad things when they happen can be a turning point in your life. Hope maiko pulls through. I’m just wondering how other poor people not looked at same way(suspended sentence) when found with one ball of cannabis, they end up in jail!!! Eaeish!

Most people currently serving in Government have been dealing in drugs since the KK era and to-date,they have not seen custodial sentences come there way. Yet, despite St. Micheals contribution to the community, he receives six months with hard labour…over 17g of sun dried marijuana (‘good quality by the way…’). The criminal justice is showing double standards here. I wonder whether this a status (social) issue or not.     Zulu,in your community work, would be required to visit 10 high schools in Lusaka Province to speak about the dangers of drug abuse.

  82. Miko Zulu performing for free as part of his jail sentence conditions. Correct me if iam wrong. Miko sings with a band. Are the band members going to assist in serving the sentence or are they also part of the sentence. Lawyers should educate us on this one

    I think this is kind of weired,i dont think Maiko performing att these schools going to change anything among the pupils.Take for instance the Munali boys or The Kabulonga Boys,they will start cheering immediatelly he is on stage and they wont pay any attention to his message.And 17 grams isnt such a big deal and DEC cant tell me they didnt know Maiko was doing this stuff all along.And the sentence is a lenient one,we have seen people who have spent years behind bars for only being found with seeds.Maiko kosafye kakabalika…….

  84. i don’t think the sentence is light or heavy. but looking from the other side, the guy will lose plenty of $$$ and even when he gets out, he will continue smoking weed. The best the court they would have done is just slap him in pockets not the six month sentence. I know is a well known guy and i don’t think his marijuana was for sell it was for his personal consumption. The judge just want to send the message to everyone caught with the same crime to be aware of the sentence if caught. BUT LET THE GUY GO OUT TO THE SCHOOLS AND REHAB CENTERS AND ADVOCATE ABOUT THE USAGE OF DRUGS AND ALCOHOL THAN SLAPPING HIM WITH THE 6 MONTH JAIL TIME. RASTA IS TO MARIJUANA AS PASTOR IS TO BIBLE!!!

  86. i realy dont believe that a grown man who smokes canabis in the confines of his own home is doin anything wrong. The laws need to be revised worldwide, except ofcourse the scandnavians, god bless them.
