Give President Banda time to study Tribunal report, public told

Some civil society organizations have condemned members of the public who are mounting pressure on president Rupiah Banda to relieve Communication and Transport Minster Dora Siliya of her duties when the tribunal reports have just submitted their report to the president for study.

Committee of Citizens Executive Director Gregory Cifire said President Banda should now be given ample time to study and understand the findings of the tribunal before he could take action.

Mr. Cifire told ZANIS in an interview in Lusaka today that mounting pressure on the president is not the solution to such a problem.

He said currently there are pressing issues such as finding a lasting solution towards rebuilding of the national’s economy that require agent attention of the President .

He explained that with the global economic recession, president Banda should be concentrating on finding measures that government must put in place to cushion its effects than discussing the Dora Siliya saga.

He further added pressure from citizens is also likely to affect other developmental projects which are supposed to be implemented by the Minister.

Mr. Cifire pointed out that with the undue pressure that has continued to mount , the Minster would be intimated to make any decisions or sign other projects that are aimed at benefiting all Zambians.

He has however; advised members of the public to offer positive criticism that will not install fear in the Minster but rather build and contribute towards finding solutions to the problem the country is facing.

And speaking in a separate interview Evangelical Youth Alliance (EYA) president Moses Lungu has describe the pressure on president Banda as unfair.

Reverend Lungu said people who are calling for the president to act quickly on the tribunal findings are not doing it in good faith

He said it is not possible for the president to study and fully understand the findings within 24 hours .

He said the president should be given time to design mechanisms that will help him understand the matter before rushing into firing the minister.

The Dennis Chirwa tribunal that was tasked to probe Communications and Transport Minster Dora Siliya against corrupt charges concluded its settings and presented its report to president Banda on Thursday last week for study.

The tribunal that cleared the minister on two allegation however stated that the minister committed an offence by ignoring the legal advise of the attorney General Mumba Malila over the contract awarded to RP Capitals Partners Limited for the valuation of ZAMTEL assets.

The tribunal stated that the minister breached Article 54 sub Article 3 of the constitution when she selected the company to value the assets of ZAMTEL.

Some sections of society have stated to call on President Banda to make decision over the report .

  1. Some of these so called NGOs are really getting on my nerves, they are so unprogressive. Do they want him to be given a year just to study that brief report?

  2. Even I thought otherwise, if I were the president I would not fire dora under this aura of noise and characters trying to score points. It simply sets a bad precedent and encourages some characters to think that the president will act under their pressure. That’s the cost of noise making. With specific reference to the case, everybody including legal experts has their legal opinion. That is why even judges do overturn each other’s ruling in court, and that is why one can win what may seem to be a hopeless case upon appeal to another set of judges.

  4. Why do LT bring up this cheap news from these political prostitutes who have little morals to respect the rule of law . Some of these civil societies are ashame and black skulls of corruption.

In my layman’s understanding of the Tribunal’s findings, the Tribunal has implicitly recommended that Dora Siliya should be removed in their reference to Article 37 of the Constitution under which the President can be impeached for breaching the Constitution. If the President can be impeached, what makes a lesser mortal like Dora Siliya so important that she can breach the constitution and get away with it? What will shock me is if RB just gives her a slap on the wrist and merely reprimands her. This, in my humble view, will be the ultimate display of contempt for the Constitution by RB.

  6. If she broke the law why wait to study the report? She must be fired and prosecuted immediately. However, the President can`t act under pressure from lumpens.

  9. What…..why should he even study it. He has just to read the conclusion where it is mensioned that Dora is found wanting. Just 2 hours will do. Then the third hour is to anounce that Dora is fired.

  11. The longer it takes the Prez to read the findings, the safer will Dora be from being dropped i guess…i feel so coz if he was in a hurry to fire her he would have read the findings fast enough..i bet you all.

Untill you realise that Dora has no criminal charges facing her but constitutional breach, in strict law she is free to be redeployed, reengaged at national level and serve the same country or indeed be retained.RB within his constitutional powers has the prerogative to retain or relocate her.But at the end of this circus, it RB and MMD placing another MMD member in that position and indeed not any of us here or those wishing otherwise.The winner is MMD and RB because any decision does not reduce their statutory and power control.Painful but real life.From Many MMD loyalists will come a new Minister to serve but Dora could find herself relocated with little or nothing to lose because she has the constitutional privilege to serve the country as long as there is nothing criminalizing her.

  13. What are the implications of RB not firing somebody who breached the constutition in her course of duty while acting on his behalf? Since ministers are appointed to act on behalf of the president and that RB was fully supportive of DORAs deeds. Dont you think he is equally answerable to this constitutional breach? Unless he claims he was not aare of the deeds of DORA. May be the best way is to relieve her of duties. Any thoughts about ?????? .

  16. There is nothing to study. In fact to have some bit of honour if there is anything left Siliya should just resign. She does not need to be told that she has been dropped. She is just embarrasing her appointing authority who are finding it difficult to tell her that she acted inappropriately since both Number 1 and 2 supported her. There is no hope for her to remain even a member of parliament. She should realise by now that she was just a pone in the big game.
    Hard luck Dora. try in the next government. May be PF.

  17. A President just browses through these reports and gives them to aides to study them and give him advise. Right now the Legal and Political Special Assistants should be going through this with their staff, the President doesn’t need months to announce his decision at all. He has resources at his disposal to make this decisions in days. How long did Obama take to make major economic decisions, do think he sat down for days going through all the numbers?

  18. I wonder what sort of people this Rev Lungu preaches to. I am sure it is one of those churches were people congregate in homes. The congregants must be a desperate lot to seek deliverance from such a nicompoop. Rupiah needs to fire Dora to score points for himself. These people have zero PR knowledge.

  19. This may turn out to be fun… what is happening in Zambia is a joke when you look at it closely. I’m no lawyer but my understanding is that all legal issues to do with the government must be refered to the Attorney General. He is the one qualified to advise the government and the President for that matter on legal issues. So by default the one who should be studying this report is AG Malia – he is the one Banda must delegate the studying and receive an advice and/or recommendation of what to do with Dora. The irony is that the AG is the one Dora Siliya ‘Offended’ if you want to use that term. The AG is the one who gave evidence against the Siliya and he is the one who should be studying the reeport – what a remarkable coincidence! 🙂

My foot, how does LT get to know phone conversations between a nonexistent political party or NGO and Zanis? Do they have gprs-enabled microchips implanted on our phone lines? Some news items are not newsworthy. Fr. Bwalya was talking more sense to me.

  21. #9. Max, I agree with you, if Banda does not fire Dora, he is in direct contravention of Article 37 of the Constitution. If he think he can do monkey tricks here, we have Mvunga and Chongwe waiting in the wings to wage a giagantic legal battle against Nyama Soya.

    Please, Zambians let this be a CONSTITUTION matter and not relations.

  29. #38 Grace…. If MR RB is to make an honest decision he will definetly not be influenced by these cries but by what is TRUE. Simple. These courts may take time to dispose of cases but do you know that privately Magistrate are bribed to rule in favor of some one who is guilty? Ts a fact

  30. Let us be frank and stop beating about the bush. Cifire and Lungu are Easterners trying to come to the rescue of their fellow Easterner. They are also appealing to the emotions of a president who is an Easterner. These guys and their wako ni wako and their umdzi ku mawa strategies can be very very dirty at times. Remember how they ganged up to catapult RB to presidential candidacy!! Wake up and see through these machinations, People>
