VICE-PRESIDENT, Guy Scott, has said he is qualified to hold his position and challenged MMD national chairperson for legal affairs, George Kunda to take the matter to court.

Dr Scott said Article 34, Sub-Section Three of the Republican Constitution made it clear that he was eligible to hold his position, althought he could not contest the presidency in the event of a presidential election.

In an interview at his office yesterday, Dr Scott said Mr Kunda was failing to accept the loss of power and could not believe that he was in the opposition.

He said he was a Zambian by birth and had been in the country all along.

Dr Scott said many Zambians in some border areas were also affected by the clause which was the reason the current draft constitution contained a provision that proposes to replace it.

The vice-president said the clause was introduced to specifically bar first Republican president Kenneth Kaunda from contesting the 1996 presidential elections.

“In other words, if there is a presidential by-election, I can act as Republican president for three months, supervise the elections but I cannot be a candidate for presidency,” Dr Scott said.

He said even before he was appointed vice-president, the matter was discussed by lawyers who explained that he was eligible for appointment.

“He should also be very careful because people in Zambia do not like racism. Such sentiments in a way are racist, but let him go to court,” Dr Scott said.

Dr Scott said the Zambian people had welcomed his appointment because it had given them an extra mark as people who accommodated others from various backgrounds.

  1. Yes – I think Mr Kunda must desist from deepening the already worrying trend of bigotry based on a lack of alternative, substantial arguments. It is terrible to observe in this century how race, tribe, religion and other “classisms” are being invoked to further people’s ambitions or opinions. It is sickening!!!!

  2. We all know this already that he cannot run for president and this is not Kunda’s point of contention. What Kunda wants to know is why Sata saw it proper to pass the instruments of power to his unelected cousin Chikwanda to act as president when Guy Scott himself was in the country, why? We saw this happen to Mwanawasa during Chiluba’s tenure when even stinking scum of the world like Ben Katanga Mwila, Zimba and the evergreen coup plotting suspect Miyanda acted as president while Levy was yawning at Cabinet Office. If anything Kunda is on Guy’s side, it’s the tribally bigoted Sata whois manifesting a new vile dimention, racism.

  4. Honestly, one is given to wonder the intellectual capability of the average Zambian. Or could it be the case that most of the people pasting here are Bemba whence as bigotted as Sata and this tribal bigotry of their is blinding them to reality? Why should Chikwanda act as president in the absence of Sata when Guy Scott is in the country? I will ask Bembas a question and would like them to use their heads and not hearts, had it been Lubinda or Dr Banda made to act as president, not Chikwanda, would their support for Zondwe’s move still hold? Such acts just create unnecessary diviions in the country which Sata seems to thrive on but ladies and gentlemen, brothers and sisters, we do not need this as a nation, we have enough woes already as it were.

    • the point u missed is that, the presido is free to choose anyone. it is not automatic or obligatory to vest the power in the vice presido. the other thing is that, u cannot give what u don’t have, hence, racism or tribalism exists first in the mind of the one talking about it; like u and me. check it out.

    People have really missed the point that Honourable Kunda was trying to put across and it is unfortunate that the journalist could not ask Dr Scott or Mr Sata the real question raised by Hon Kunda. And the question is this?

    Why did Michael Sata not hand over the instruments of power to Guy Scott to act as President , when it is clear that Guy scott was the second in command , elected and was in the country when the president left for South Africa. That is the question you shallow journalist should ask both Mr Sata and his VEEP. We want to hear it from their mouths

      Yes that was the intent of the question asked and quoted in paper yesterday.

      The story answer is that the law allows the president to exercise that discretion. All previous presidents have done it.

      A funny thing about the law huh? The office and the instrument of authority. Two distinct items that we often think of as one. And all you are asking is why are they separate. Kunda as lawyer should know better. Sometimes just an LLB is not enough or it the illness?

I think Mr Sata is right by not appointing this man to act as the president as he does not qualify to be a president. fellow bloggers, what is means is that when one is acting as a president, he should be in conformity with the law, or he should be eligible for the position which Scott is not. Nothing racial about this. Just like RB if it is true his parents were not from Zambia then he ruled illegaly and that is not racial at all. The question is then, why have such a VP? Is the president not comfortable with other people?

  7. A veep is a potential presido, if the potentiality of the veep does not qualify him to be presido, its just a matter of logic that he is not worth the position, if he qualifies, why is it that he has never acted as presido, 2+2=4 no more no less

The way i look at this issue, it’s like Kunda was being sympathetic to Scott, because the instruments of power were left to Chikwanda despite the fact that Scott was in the country, and that by virtue of being Veep, as per protocol, it ultimately means Scott is supposed to act as president.The bone of contention is not that Scott is not qualified, he qualifies, but why can’t Scott act as president when HE MCS is out of the country? Meaning that Scott, as it was, was taking orders from his junior, Chikwanda in this case, right? Nay, something is amiss here. And I feel that government should put the record straight so that we don’t find ourselves dumbfounded
    in future.

  11. Will my mixed race children, be eligible to be Republican presidents?
    I am Zambian born and bred although I have left that country in disgust, and my fiance is Scottish. His grandfather was born in Cornwall and is thus English. His great grandmother is related to the wife of Edward the V1 called Alexandra of Denmark ( meaning my children are going to be really in Royal family here)
    His mother is all Scottish.

    Could someone confirm that my children will contest the presidency without question?
    I am so worried and uneasy, and have just lost appetite

You hold the second highest position in the country yet you cannot discharge those duties and on those grounds, you could be held incompetent. Why have a vice that cannot be a president, everything surrouding your appointment does not make sense.     Many times my CEO leave all keys, bank checks etc to me and NOT to his deputy. I am 4 th in command, and whenever he is out-of-country, the deputy CEO chairs all meetings. I can’t fire nobody, but deputy can. same as what happening in Zambia
    There is no way Chikwanda can fire messed Kambwili or command that Siliya get locked up, but Scot can do it when Sata is away.

  27. If Guy Scott has a busy productive Office, he need not respond to newspaper stories or on-line publications. His responce is just intended to sway the minds of the judges in his favour. Frankly, it is embarrasing for Zambia to appoint a Scottish white-man as Vice-President when the country has produced and nurtured numerous respectable indigenous Zambian intellectuals. As a Zambian I have been reduced to the level of a refugee within my own country. I travel to other countries with my head down – in shame. Hence, Guy Scott must not pretend thal all is well in the PF Camp. From its inception the PF was considered as a personal property of Sata & Guy Scott Co. Ltd. This is a reality.   29. Actually, some legal points that Hon. George Kunda is raising are meant to save Guy Scott from further subtle embarassments by his boss, Sata. It will be folly to think that Sata acted in good faith by side-lining Guy Scott when he assigned instruments of power to a Minister of Finance. Acting responsibilities go first to a Vice-President, or to a Minister of Defence in the event that a sitting Vice=Prresident is out of the country. The big question is: Why on Earth did President Sata travel with GBM on international business in Uganda that merely required the services of a Foreign Minister? Was it a ploy to keep a close eye on GBM and distance Guy Scott from the seat of power? Kunda is simply expressing on matters of govervance formalities.

    • I thought, in Uganda, they were discussing security issues concerning the Great Lakes Region, which Zambia plays a part, and you don’t think matters of cross-border security does not need a close ear of the Defense Minister? Are you kidding man!? Complain about something else, OK!

  31. Fools on this blog zoona, even MMD boot liker, none of you has taken a little bit of time to look at what our current constitution talks about in terms when the Prez is out of the country, it clearly says the prez in Writing can leave the power to anyone or the vice Prez if he wishes.
    During Chiluba’s regime certain times he, left instruments of power not on the vice prez but to some other people, again in WRITING.
    PLEASE, read the constitution first before you argue what you do not know. DR Scot is qualified to act, so does anyone who is MP of the house if the prez decides. I end here hope i have schooled some of you fellaz, check constitution now

If the vice-president is physically or mentally infirm or absent from Zambia (not just Lusaka) that’s when he can assign someone else to act. School yourself with article 39 before you think of schooling someone else.

    The fact that you hate a person does not mean that whatever they do or say is wrong. There is a legal conundrum here. I would like to ask Dr Scott:
    1.  How many passports does he hold?
    2. When he reached the age of 21, did he renounce his British nationality to take up ‘Zambian’ citizenship?
    3. Why did he not act as President in the absence of Sata?
    There is no racism here, it is just a clear matter of the law.

  41. Guy Scott should not worry about George Kunda. Kunda is only making an observation that is valid, and actually GK wants to save Guy Scott from future embarrassments. Guy Scott instead MUST worry about the behaviour of his boss Micheal Sata. Sata clearly sidelined Guy Scott to act as President. If Guy Scott for any technical reason does not qualify to act as President when Sata is not in Zambia, then Guy Scott cannot be Vice President. Because by definition the Vice President ‘automatically takes over when the President is not around or dies, as was the case with Mwanawasa and Rupiah Banda. Guy Scott should not justify things to save Sata’s face because this will come to haunt him in future and he will be alone! Fact is, as usual, SATA CANNOT BE TRUSTED. What a bunkum Sata is!!

SATA has only been out of the country twice..first he left for uganda VP was in austria.secondly SATA left for RSA and VP was in MUKUSHI…instruments of power are only given in LUSAKA at statehouse..remember when MWANAWASA left for egypt RB was in CHIPATA and MWANAWASA gave the instruments of power to MPOMBO then defence minister.As for GUY SCOT, he qualifies to be CABINET MINISTER,VICE PRESIDENT and he also qualifies to be ACTING PRESIDENT but does not qualify to be PRESIDENT simply because he is not Zambia by BOTH birth (born in zambia) and decent (parents born in zambia) he is only Zambian by BIRTH were as for yo to be PRESIDENT of ZAMBIA you need BOTH. This is what mwanawasa did by bringing Rupiya Banda from the farm and made him a vice president. Have you seen where Zambia is now all because of Mwanawas’s blunder? It is not right for Sata to do what he did and he should not do it again. If any of PF(Black Zambian) cadres have links in UK, they will be shoked to know that if an English/Scotish/Welsh man dared to marry a non-British woman, the system in Britain will NEVER appoint such a man to any top-ranking Govt position. This system, which Guy Scott knows too well, has been incorporated into unwritten regulations to ensure that no secret data is passed on to a foreign country through marriages. Sata lived in London, and is conversant with such British security provisions. He can only correct this anomallous scenario via a Cabinet re-shuffle to assign Guy Scott a safer position. The security of Zambia has been undressed to highest levels of nakedness.This time around, many SADC states will never risk share sensitive data with Zambia. Sata must grow up and be wiser.

The instruments of power are physical elements, they have to be handed over in person … if Guy Scott (VP) was out of town at the time of departure, the President had the right to hand these over to whomever is privy to the security protocols in Zambia and is qualified to act in his absence. I expected Honorable Kunda to be privy to that but I guess he was filled with bigotry and threw away constitutionality.
