Final draft constitution ready by December 2013, Justice Silungwe

Chairman of the Technical Committee Drafting the Republican Constitution Justice Annel Silungwe has assured that the final draft constitution will be ready not later than December 2013.

Addressing a media briefing in Lusaka today, Justice Silungwe explained that the constitution making process is on course and will be completed within reasonable time but not later than December 2013.

“We really don’t want to commit ourselves to a timeframe but we commit to work as expeditiously as possible within a reasonable time, certainly not later than December,” Justice Silungwe said.

Justice Silungwe also revealed that the Committee has spent about K100 million from the K115 million allocated for the exercise.

“What this means is that we have a balance of about K15 million which will use for the remaining part of the constitution making exercise. We are well within the budget.”

Justice Silungwe further revealed that the final draft constitution will be accompanied by a report from the Committee explaining the rationale behind every article.

“We may also see some changes in the final report from the first draft document because the Committee has had to take on board fresh submissions from stakeholders,” he said.

He said the process of proofreading the final draft constitution will be concluded this week and that the document will simultaneously be submitted to Sata and the public.

“We have delayed in completing the final document because this is a complex exercise and we really want to do a good job,” he said.

  3. I hope the new constitution will limit the powers of the president, this is an important issue that I really hope has been addressed. The presidential qualifications should also be revisited, we cannot afford to have people like Sata again(ba grade 7) in state house, we have learnt a lesson. Only the law can bar bakaponya from running for political office, we need sanity from the people running the affairs of the country and not what we are seeing today in Zambia. I hope justice silungwe and his fellows are not drafting the constitution to please Sata and Kabimba! These uneducated people have no respect for the rule of law and we the people of Zambia through the constitution can curb this issue. We do not need for Sata to leave office for us to sue him.

    • Education alone is not key to successful governorship and leadership of a nation!there are many people who are educated but cannot deliver because thy lack leadership! We have a lot of Zambians who are in authoriy and have failed the nation but enriched their pockets e.g the body responsible for the privatizations of the mines and other parastal companies, all well educated people! Only to sell out the nation’s asserts for their own benefit! The same people are now running different companies and government ministries. These are failed managers and leaders who lack innovative ideas to generate growth whereever they are incharge. As long as these people are around, Zambia’s economy will never grow! These people have reached their level of incompetence other than being greedy!

  6. July-December 2013, proof reading, January – December 2014 scrutiny by Cabinet and budget for referendum, Jan-Dec 2015 debate by House of Chiefs and Parliament, January-December 2016 work suspended to allow for general elections. Prove me wrong.

    Hon. Justice Slungwe, what kind of proof reading can take 6 months? And which stakeholders have yet to made submissions? Do we have a chance to see those submissions as Zambians? Sad, really sad and disappointing. Ejoy your allowances, sir while we mourn the loss of another opportunity to have a better constitution.

    What can we do, after all, and who are we to even question your deliberately slow pace. We are only Zambian tax payers and voters-gullible? Proven so in the past elections including bye-elections.

    Still, I guess with the kind of spelling and grammar we see on LT, in the newspapers, and on stadium names even six months may not be enough.

  8. Parliamentary voting should be for the political party as opposed to an individual.

    A winning party should have powers to substitute or replace the Mp and it should have a full 5 year mandate

  10. Yes it is good to spend tax payer’s money on making a constitution that will be ignored by Ukwa anyway. What is the point of having a constitution that the head of state routinely flouts?

  11. So why was Ernest Mwansa, spokesperson for the Technical committee requesting extension till the end of July and that they would work for free. Now we are being told there is still a K15 million (K15billion old currency) remaining and that the work will be done over six months. Having requested for a months extension, why are we being told work will be completed in December. Secondly, if they were prepared to work for free, that implied they had exhausted the funds but now we are told there is still a balance. Is the mission to exhaust the funds just because funds are there or is the committee creating work so as to exhaust the funds? Someone is telling porkies.
