Prof Chirwa pleads not guilty, released on Police Bond, trial date set for October 22 and 23

Former Zambia Railways Limited (ZRL) Executive Director Professor Clive Chirwa who was arrested by the Anti Corruption Commission (ACC), today pleaded not guilty to two counts of failure to disclose interest and abuse of office amounting to over K200,000 before Kabwe Principal resident Magistrate John Mbuzi.

Chirwa aged 59 who is jointly charged with ZRL Director of Finance Regina Mwale 50, pleaded not guilty to two counts when he took plea before Magistrate Mbuzi today.

In the first count, Prof Chirwa is charged with failure to Disclose Interest contrary to section 28 (1) of the Anti-Corruption Act No.3 of 2012.

Particulars of the offence are that Prof. Chirwa, between 1st November, 2012 and 31st December, 2012 as Chief Executive officer ZRL recommended at the Zambia Railways Board meeting that Clavel Incorporated Limited, a company in which he is a shareholder be given a contract to train Zambia Railways employees without disclosing interest contrary to section 28 (1) of the Anti-Corruption Act No.3 of 2012.

In the second count, Prof Chirwa who is jointly charged with Ms Mwale, 50 is charged for Abuse of Authority of Office contrary to section 99 (1) of the Penal Code Cap 87 of the Laws of Zambia.

Particulars of the offence are that between 1st November, 2012 and 30th April, 2013 Prof. Chirwa and Ms Mwale whilst acting together abused the authority of their office by authorizing a total payment of K289, 128.84 to Fallsway Apartments of Lusaka for accommodation for the benefit of Pro Chirwa without following laid down procedures an act which is prejudicial to the rights and interest of ZRL a public office.

Professor Chirwa is being represented by Yosa Yosa of Simenza and Sangwa associates while Ms Mwale is represented by Collins Chizao of Mulilo Kabesha and Company.

The court has since set October 22 and 23, 2013 as trial date while the accused are on police bond.

    • Anyway dont worry Prof.chirwa, those two charges are small charges
      Charge number one…failure to declare interest, you were fired for that!!
      Charge number two.. failure to follow procedure when paying for accomodation,, they will probably ask you to pay back the money… case over!!

      Next time, make sure you have your contract in black and white,,, and dont act desperate like you did.

    • Why are some bloggers looking at Clive as a “victim” If he is a victim, then he created that himself. The charges are clear and he has been give an opportunity to clear his name.

      Lets look at the merits of the case/charges and the penalties they carry if convicted not the individual

      With this kind of attitude by some bloggers, how do we even hope to at least scale down corruption?

    • This is what happens when a professional joins ranks with the Kabova’s in PF. How can such a clever man fool hisself like this. Did you really expect any different from Sata and his group? I mean Really??? Ba Chirwa why did you insult HH just to win the favour of PF?? Now your political career is over… Your only hope is to ask for forgiveness from UPND and to be re-instated. you can still be given a ministerail position, of which you are still deserving.
      Ba Zambia you should have listened to HH when he was asking for an economic plan with PF during the Pact days before they could talk of positions. Now u are crying!!!

    • At least those of us that saw Chirwa for the “connman” that he is are now vindicated. A CEO who proposes to a board to hire is defunct company to provide training when it has never delivered training to anyone in the world. If indeed he was such a distinguished Professor, his Company would have been a lot busier with fees paid for his list “contributions” that litre his CV. Chirwa thought his conned his way to the Bank and wanted to “Milk” ZRA for everything he could….

      Your brain functioning amazes me! How do you call these “false” allegations when Chirwa is on record agreeing to “have attempted” using his company? He is also on record “claiming that his stay at Fallsway was in line with what Ministers did. Although he says that’s where he was taken to begin with. The allegations are not false. The problem Chirwa has created is that his “conning” claims in his CV, his Mansion and over £2m earnings will now be under the spotlight and he may just loose the little credibilty he may have left (at least from the likes of you).
      He claimed that the board were the ones who where corrupt but we await arrests and charges.

      you chaps will never develop. can you for one second stop looking at money and look at how the man accomplished in 3 months and how good his dream was. that should be your basis for argument. i have faith in Atanga as well but reviving this company is a big job so in both cases stop looking at the money involved

  2. He is a victim of circumstances and being found in a right place(wrong place maybe ? ) at a wrong time.Crazy what patriotism can do.It is just a matter of time and he will be vindicated and have that last laugh.

  4. It is indeed sad that a learned gentleman should end up like this. Point is that Chirwa was being arrogant and short sighted by aligning himself to PF. He ditched his UPND colleagues and called them names. whereto now?????? lesson leant is that, in life, look at the bigger picture and be strategic i.e. long term in your vision, don’t be swayed by these quick fixes etc

  6. Ba prof, this is a lesson to all those innocent Zambians who may be lured by PF for positions. Ba PF niba “don’t ukubeba indeed”. PF is cursed. The first party in Zambia to rule for one term only. 2016, the PF “canoe” is sinking and no one will retrieve it. Especially that none of the two magotts fighting to succeed Sata is popular in Zambia.

      The problem with Zambians is that we are too easily swayed by material things and lack the “depth” to see beyond our noses. Zambians can vote for Kabimba for President because he yaps too much, (Ati bakali) and GBM because of his wealth. Simple as that. So educating the voters is key to “getting it right in Zambia”.

  8. The professor should have exhibited professionalism in his duties, he took things for granted and lightly. Accountability is paramount in all that we do and the professor should always remember that. ZRS was and is being watched closely because every Jim and Jack want a proper running rail system in Zambia. People had so much hope in this man and he failed to do the simple things required of him and he was only seeing an opportunity to make bucks.

    • The man may have pocket some. But lets think about his skills and plans he had for our transport indunstry just imagine this came to pass. This is what we are losing due to lack of a proper system. Lets realise that with money very very few people are able to stand. So let the Govt help the people like chirwa to apply the knowledge and skills with minimum temptations. Lets come up with a system were they are not allowed to handle money directly eg how can he be allowed to engange a contractor when this is suppose be done by a commitee through biding. Imagine kalusha bwalya as a young footballer was allowed to handle money for the national team maybe he would have pocketed some, kicked out of the team and there would have been no 1988 Africa footballer of the year in zambia

  13. I feel sorry for Prof. Chirwa. I think it is totally unfair. We call the man all the way from the UK and then this. We are going to scare people in the diaspora. No one will dare come back home!!

  14. Zambia is heading for a complete doom under the PF administration. Of course, I personally credit the late Anderson Mazoka who had put Zambia Railways to where it was in the 70s, 80s and late 90s. We had Zambezi and Kafue Passenger Express trains which used to operate between Kitwe and Livingstone on a day to day basis. It was a pride to the nation and the trains used to provide all the comfort one could deserve. Today, it’ s history and it’ s very apparent that, that situation shall never ever come back because we have got a bunch of jockers in government who lack the genuine developmental vision for the country. I yearn that picture of ZR in those years and I mourn about it. Vernon Johnson Mwaanga where are you to pass on a comment on this one ?

  17. I believe Zambia has lost an opportunity to have our ailing railway brought to modern standards. Chirwa was the man and this is shame. Not to be bad, but K289m is a lot of money for such a short stay in those apartments. in hindsight perhaps ZRL should have rented a house in Kabulonga for him or the board should have advised. But let’s not prosecute him. His interests no matter how people perceive things were ultimately still patriotic… As Zambians, we need to stop this stupid witchhunts

  18. Dr. Simon Kamwendo Miti is now Permanent Secretary for Parliamentary Business at Cabinet Office. Dr. Miti looted Ministry of Health with over K23billion lying that his money came from his family. The ACC know that Dr. Miti does not come from a rich family. I know the Miti family from Ndola. Dr. Miti has brothers and sisters who are very poor. Why has this corrupt man not been arrested? The reason why corrupt people are being protected is because of patronage. In 2016, real criminals like Dr. Miti must be rounded up. Many thousands of lives have been lost because of the looting by Dr. Miti and his thugs. Why harrass a professional like Prof. Clive Chirwa? How are we going to attract professionals from the diaspora? Let the ACC do there job by looking at and investigating real criminals.

  19. The ACC are not well trained to properly investigate real crime. Prof. Chirwa has not committed a crime in the real sense. He paid more rent than he was allowed. Big deal. He tried to co-opt his company to conduct training. Big deal. If he owes Zambia Railways which I doubt, let him be asked to pay back. End of story. Let this habit of victimisation end. VIVA Justice.

  20. I agree with Lazo. Why is this Dr. Miti still not in jail? How can a confessed criminal who wrote a ” pardon me ” letter to Pres. Rupiah Banda be appointed as P.S by a President who is allergic to corruption? Dr. Miti has aasets which are dirty and shady. He hide his assets by using friends and relatives. Unless the ACC are not aware of these things. Let the real criminals go to jail.

  21. So sad about Prof. Clive Chirwa. I agree with Lazo that the ACC are not well trained. The clear criminality which Dr. Miti engaged in is clear for all to see. I used to work at Engen Filling Station at Kafue Road where Dr. Miti used to bring his personal cars to be refuelled on the ministry of health account. Its very bad that innocent people are being victimised. Laws of the jungle. 2016.
