ZNBC sues Chanda Chimba III over “Stand up for Zambia”

THE Zambia National Broadcasting Corporation (ZNBC) has sued freelance journalist Chanda Chimba III demanding that he pays the Corporation more than K500, 000 it has so far paid and is yet to pay in legal proceedings instituted against the national broadcaster for airing the “defamatory” Stand up for Zambia programme on his behalf.

Chimba is already in court facing other charges emanating from the production of the same “Stand up for Zambia” programme But ZNBC in this matter wants the Lusaka high court to order Chimba to make full payments and reimbursement to ZNBC for the paid damages and legal fees which it paid on his behalf to several third parties in the proceedings instituted against the Corporation and Chimba between 2010 and 2011.

The national broadcaster also wants another order for Chimba to make full payments of all outstanding third parties claims due to be paid to several third parties including the sum of K180, 000 still due and payable to Transparency International Zambia (TIZ).

TIZ has already sued Chimba in the Lusaka high court for defamation of character arising from the same programme.

ZNBC further wants the court to order Chimba to make full payments or settlement of all claims due to be paid to several third parties in damages for the breach of the contractual indemnity.

ZNBC said in its statement of claim filed before the Lusaka principal magistrate court that it was a duly licensed national broadcaster and that in 2010 and 2011 respectively, it was an external production of Chimba’s television programme entitled “ Stand up for Zambia which it aired on his behalf at his request.

It said that this was according to the agreement entered upon by it and Chimba under the ZNBC radio and television advertising contract.

ZNBC stated that it expressly agreed in the contract that Chimba would fully cover ZNBC in respect of any third party claims that may arise out of the contract.

It stated that the agreement further stated that in an event that third parties raised a claim against ZNBC out of the contract, Chimba would fully indemnify ZNBC in respect of all the sums that ZNBC was due to pay to several third parties as a result of the programme.

It said that Chimba was liable to make full payments and reimbursement to ZNBC for the paid damages and legal fees and the amount of K180, 000 which was still owed to TIZ and another K322, 500 in respect of damages and legal fees paid so far by the corporations in legal suits which it had been dragged to court because of Chimba’s programme.

  1. But ama politics, niya baaad! You are suing somebody who was being used by the former regime, by the same broadcaster that was televising the program. Zambia needs “healing”, really.

    • Whats the problem?? He signed a contract!!!

      Though saying that, one wouldn’t be amiss to suppose that he may not have understood the language of the contract, going by the poor levels of literacy in the country as evidenced on LT & other blogs!!

      We even encounter characters who are proud to maintain the status quo, arguing, English is not our native tongue!! Is it any surprise, that this country is left to pick up the pieces after our supposedly “Educated” technocrats organise loans, bonds etc etc – they read the title BUT NOT THE SMALL PRINT, actually they read the first paragraph, then COMPREHENSION BECOMES A ROCK-FACE!!!

    • in the first movie of the matrix trilogy, the character morpheus apologises to Neo that he freed him from the matrix at such a ripe old age. He said they dont usually free grown ups as the mind finds it difficult to adjust to the real world. The damage to most of us zambians is so intense that we cant even possibly imagine conversing with each other professionally,educationally in a native tongue. we always use english as a standard for our education. Maikalange whats the insistence,obsession with english. The japanese dont use english,the germans,the russians,the koreans, and they are not “picking up pieces”,infact in terms of research and innovation these countries lead the world unlike popular belief that its the americans. In what language do you think maikalange if i may ask?

    • so like in the matrix, i know its hard for you to let go of the imperialists way of life,language,system of education,social life etc, but try a little harder. Its not easy,bt atleast you will be free,you wont have try so hard to suit other set of peoples standards. You will be able to practice your true culture,all the time, anywhere and in all situations. the results are great. just like in the movie matrix once free,you can do things that everyone else locked into the system wouldnt even dare to dream of. i dont want to give up on you and focus only on our next generation. try my brother,free your mind.

Firstly, the Subordinate Courts (or is it ‘Magistrates’ Courts) have no jurisdiction to preside over matters where the claim exceeds K30,000 (unless the law was amended and for some reason I’m not aware)! Secondly, ZNBC were paid by Chanda Chimba for the programs to be aired, hence he discharged his contractual obligation. I’m sure ZNBC’s assessment dept at the time cleared the contents of the program as ‘safe to air’ and as such the corporation must pay for it’s love of money and lack of respect for ethical journalism!

    • Dude, what about the disclaimer they used to put as prologue? “The following Programe is apolitical programme. ZNBC bears no responsibility for the contents presented in this programe….”, something of the sort. This put Chanda Chimba the f00l as the only identifiable guy behind this mistimed, defamatory programme.

      And actualy the effect of Stand up for Zambia was to make the intended victim famous….grrrrrrhh.

  3. Where on earth will poor Chanda get all those figures of money ZNBC is dreaming about? ZNBC management should just learn from these marriages of convenience in future that is if they will ever learn.

If i had any powers to appoint and disappoint, i would fired the CEOs of ZNBC’chibamba kanyama, ZAMTEL’s mwanakatwe, LUSAKA WATER & SEWERAGE CO.’s ceo whatever his name is. These three gentlemen should be fired for gross incompetence and gross inetia. Their incompetence is unrivaled in the whole of Sub-Saharan Africa.

    If zambia has to develop, performance should be respected above cheap degrees and whatever nonsense.

    • @George Bush, please justify your allegation that the three are incompetent. In the absence of reasonable justification, your allegation could just be a sign of your envy and jealousy!

    • ZNBC has never reached the levels it has now reached under Chibamba Kanyama. If you care, make a random questionnaire with ZNBC staff and the public. Your assessment is typical of individuals without a pedigree of achievement.

    • I am wondering as well. It wasn’t defamatory. He was reporting the truth. So in PF government if you report bad things abt PF it’s defamatory. Yakosa kanshi

    • The only institution Chanda Chimba may have defamed is the Catholic Church and they are not suing. For the others, Chanda Chimba reported nothing that was not already public knowledge if not already reported in the Post. Chanda Chimba just defend yourself and if you have a good legal team some of those claiming to be defamed will be disgraced.

    • You need to talk to this Ka Chanda Chimba and realise how silly the Guy is…He is even not sorry for what he did……he is still stuck on the same silly story line of his.

    • Why should Chanda Chimba be sorry? He did nothing wrong. What about the Fred Mmembe propaganda you swallow every day, not to mention the US$3.5m owed by Mmembe which Sata is protecting him from paying. Why are they concentrating on Chanda Chimba? Because he is not singing their praises like the Post.

  7. I’m trying to understand what is happening here …. so did CCIII storm into ZNBC and ORDERED them to air his programs?

    Probably not, ZNBC has/had a managing director who could have blocked the airing of the program. The program, by the way was not defamatory to ZNBC. So who is really suing CCIII?

  8. Here we go again! Can we be serious and stop this witch hunting? These personal vandetas will not help the economy in any way, Chimba has the right to air and share his views of any political leader, party as he sees fit especially if it has to do with his country Zambia. People have to know what goes around if they need to put someone in office to serve them, which depends on them entirely if they go ahead to vote for or against. I dont think twisting issues in order to silence someone will help very much in this evolving world, So leave him alone we all know he is targeted!

    • Cindy, Chimba abused his rights. The lawsuit is leveled against him because of his ignorance. If the MMD had won those elections Chimba would by now be a Hero instead of being targeted for his love of money. Let him pay the charges. ZNBC found him with the case to answer.

  9. This is a sad story. Chanda Chimba III, broadcast issues that were true and factually correct. What we are witnessing now is a testmony to his broadcasts. Most of the time he had clips of “SATA”himself entangling himself in his usual incoherent thinking. If you want a glimpse of these the yutube videos are all on line for your own judgement. He doubted whether Masebo had any brains at all “meaning she is stupid”, he called Panji Kaunda as a Lice carrying being and so he could not enter his office neither would he share the same platform with him.

  10. Jail that chap he thought things would be on his side always. Where on earth can one have such courage to air that nonsense against an elderly person hopping to get a job if the party in power at that time bounces back into office!! That is rhetoric!!

    • Malupenga did just that about another elderly person and he got a job. He got that job because of propaganda on Barotseland Agreement 1964, propaganda on the detained Lozi activists etc… And it was all lies. Why are you not talking about him? Because Sata won? When Sata loses power, you people at ZNBC will not be able to look Chanda Chimba in the eye when he is your Director-General. Remember … things change.

  11. How can such a guy be inundated with such unrealistic payments? My guess is that the guy’s life at the moment is not even worth a pound, £, (K8) athough, to be fair in Zambia, this guy may be a President one day going by the dust he has been raising. And he has been to jail before, an important pre-requisite.

  12. Chanda Chimba is a prophet, it was out of love for PF and Sata that he spoke things he did because there is conherence as though Sata/PF conspired that he publishes what he did. For example, I remember very well Chimba emphasizing that the enemy of Sata was his foul mouth – currently the PF members starting with his vice president and others follow, they are victims of his foul mouth. For us who not followers of PF for luck of inspirational stature its worse he is abusing us as though we not Zambians the citizenship we both are.

    Yes, ZNBC should take responsibility. Had MMD won Chimba III would have been a hero. Cadreism/kaponyaism is a very big sore which needs to be flushed if Zambia is to redeem itself. So fed with situation where thieves are laundered into saints just because they are in the ruling party. MMD was doing much the same. And the tax payers are helpless because the system becomes so self serving that they do not stand a chance of even making a dent.
