Given Lubinda drags fellow MP to court for failure to pay rentals

PATRIOTIC Front (PF) Kabwata Member of Parliament (MP) Given Lubinda has sued fellow MP Vincent Mwale for alleged failure to pay rentals exceeding K167, 000.

The rental arrears are in connection with Mr Lubinda’s plot number 21/27/4586 also known as Namakau house situated in Chilenje Township.

It was operated by Mwale, who is Chipangali MP as a restaurant and discotheque under the name of East Point Discotheque.

Mr Lubinda wants the Lusaka high court to order Mwale to pay him K167, 600 being rental arrears and lost rental income under lease agreement between the two.

He also wants Mwale to be ordered to pay him damages for loss of income for non-use of the plot from June to November last year, due to refusal or neglect by Mwale to hand over the property to him in breach of clause 2 (1) of the lease agreement.

Mr Lubinda wants Mwale to be ordered to pay him damages for damage caused to the property and his business partners or agents contrary to the agreement.

He said Mwale should be ordered to pay for water and electricity arrears or refund to him for paying for the same.

He said that by the lease agreement monthly rent was agreed at K27, 000 net of withholding tax which Mwale agreed to pay to the Zambia Revenue Authority (ZRA).

Mr Lubinda said that in April last year, he reduced the monthly rentals to K20, 000 upon request from Mwale but by then, Mwale already owed K90, 000.

He said in June last year, Mwale through his business partners terminated the tenancy and at the time he owed K111, 000.

Mr Lubinda said that Mwale refused or neglected to surrender or hand over the property to him and only handed the property and keys to him in November last year.

He has lost out on rental income due to the delayed handover and that Mwale had ripped off the ceiling and doors from the property.

He said the money owed to him now stood at K167, 600 in rental arrears and lost income which Mwale had refused to pay.

  3. One thing I know about Lubinda is that when he was a tenant, he honored his rental obligations but the the black sport of the so called dubious Namakau plot will haunt him for life. ” Iwe” Lubinda you know what am talking about.

  6. PAC Chairman does not match words with deeds shuwa??? He is busy roasting permanent secretaries when he is negligent of his duties in his private dealings. If that is not hypocrisy I don’t know what the word means.

  7. THIS IS VERY LITTLE MONEY FOR A LEADER FAILING TO SETTLE , BECAUSE THEY ARE LOWLY PAID, ITS HIGHTIME WE ASK PARLIAMNET TO INCREASE SALARIES FOR OUR LEGISLATORS, MWALE IS AN HONEST MAN HE HAS NO CASH BECAUSE THE SALARY IS TOO LOW.

  8. Mwale his a briliant folk what a mess, every time, he makes old folks sweat during PAC, and that impresses me, he is one guy who needs to be supported, But he should pay!
