PF members in Kasama call for re-trial of Father Bwalya

THE PF in Northern Province says the State must appeal the acquittal of outspoken Alliance for better Zambia ( ABZ ) leader Fr. Frank Bwalya.

PF provincial secretary Evarist Chellah says it the ruling party in the area strongly felt that the court did not take into account all the evidence presented by the complainants.

Mr. Chellah said the party in the province was unhappy with the court’s decision on the matter.

Alliance for Better Zambia (ABZ) president Frank Bwalya was recently acquitted Father Bwalya for defaming President Michael Sata by referring to him as ‘Cumbu-Munshololwa ( a potato ) ’’.

Bwalya said this in January this year during a live radio broadcast on Kasama’s Radio Mano.

Delivering judgment, Kasama Principal Resident Magistrate Vincent Siloka stated that he found nothing defamatory in the word ‘cumbu munshololwa’ as it merely referred to a person who does not listen to advice.

Magistrate Siloka said he understands that ‘cumbu munshololwa’ is just one of the many Zambian sayings and idioms used by Bembas.

He noted that convicting Bwalya would amount to inhibiting freedom of expression and censured the accusers of having fabricated the word Umuwelele in a bid to fix the Fr. Bwalya.

Magistrate Siloka emphasized that freedom of expression should be respected in a democratic state like Zambia.

Commenting on his acquittal, Bwalya said the victory was a triumph for democracy, good governance and the rule of law.

    • Emwe ba PF, who took you to court when you called former presidents cabbage, nyamasoya or baka nitundila, time is running out for you to full fill your promises, you are only remaining with 2015 next year ka.

  2. These guys from Kasama should even be in a better position to understand that those words are not defamatory. They invented them and should accept to be on the receiving end of such words. NEXT

    • This statement sums up what I also thought of them. Reminds me of a saying from one of Africa’s accomplished historian i.e. Ali Mazrui and I quote “Our friends are going to the moon but African’s are still struggling to get to the village”. People that are busy and doing productive things do not have time to fight personalities.

PF members that are attacking father Bwalya are not interested in peace and development, as much as we may disagree we must respect our right to disagree, I personally do not think father Bwalya should be prosecuted or attacked in any way, I admire father Bwalya and if anything PF owes alot to father Bwalya for what he did in the years before the 2011 elections.

    PF should accept the fail and concentrate on development. It is development of lip-service and not tangeable development in PF governance.

This nonsense of PF cadres running the country should come to an end fast; who do they think they are? they want to be above everybody including judges, the whole problem is because they lack education to understand contexts of phrases and anyone who speaks against the president is accused of insulting him;

  9. These thugs are working for Kabimba, Mmembe and Nchito who do not believe in the rule of Law but rather thrive in the sea of criminology. Their stars are the Masumbas and the Namulambes who join the PF to evade Justice.

    It is amazing that the PF thugs seem not to care about the health of their President who is squandering tax payers money in Israel, Korea, India, UK, and South Africa. All they care is to dehumanise the righteous men and women.

    Apparently, the PF have a mammoth task of finding a formular to reconcile with the Banshilubemba, if at all they dream to gain a single or half a vote in Kasama or Malole. Confusion and desperation is the prevailing state of affairs in the minds of PF headless fleet of chickens.

  10. So, Sikota in his ruling is implying that Sata does not listen to advice? I think the man of the veil has gone off mark. I ‘m a true Bemba and my ancestral seat is anchored on rich bemba idioms. Each bemba idiom points to a reality and used to teach, admonish, warn and describe situations and characters. The Kasama PF were in order and had a point to have taken Frank Bwalya to court for calling Sata cumbu munshololwa, (he who does not listen to advice). This allegation is not true because many people are on permanent pay roll employed to give advice to Sata. If Sata did not listen to advice all these people would have no jobs. Your judgement Sikota was not just. You were prejudiced. You should have rescued yourself from the case if you had interest in it.

  11. @imubemba Inkonko,let me ask you a question,if someone says you do not listen to advise as you put it,hw does it become an offence? Some of these things et te person who has been attacked be te complainant and not third parties,what s you interest?
